A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF PALM SPRINGS, CALIFORNIA
UPHOLDING THE DECISION OF THE DIRECTOR
OF PLANNING SERVICES AND DENYING AN
APPEAL BY EISENHOWER MEDICAL CENTER
FOR A MINOR ARCHITECTURAL APPLICATION TO
ALLOW PREVIOUSLY INSTALLED LANDSCAPE
LIGHTING AT THE PROPERTY LOCATED 155
SOUTH SUNRISE WAY, APN 508-100-056.
WHEREAS, on May 15, 2012, the Planning Director approved a Minor
Architectural Application (MAA) to allow the installation of ten LED compact
floodlight fixtures in the landscape area adjacent to the medical office building at
151 South Sunrise Way, and required that the wattage of each fixture be
reduced to 16 — 20 watt LEDs; and
WHEREAS, on May 22, 2012, Eisenhower Medical Center filed an appeal of the
Planning Director's decision; and
WHEREAS, Sections 94.04.00(E)(2)(b) of the Palm Springs Zoning Code allows
decisions by the Director of Planning Services to be appealed to the Planning
Commission; and
WHEREAS, on June 13, 2012, the Planning Commission conducted a public
review of the appeal request, including all of the evidence presented in
connection with the matter, including, but not limited to, the staff report prepared
on the matter, and all written and oral testimony presented.
THE PLANNING COMMISSION HEREBY FINDS AS FOLLOWS:
Section 1: That the decision by the Director of Planning Services to require a
reduced wattage was justified based on the following:
1. Section 93.21.00(A)(3): Exterior lighting shall be ... installed so that
lights do not blink, flash or be of unusually high intensity or
brightness,
2. Section 93.21.00(A)(4): Exterior lighting shall be... appropriate in
height, intensity and scale to the uses and the site they are serving.
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the
Planning Commission hereby rejects the appeal and upholds the decision of the
Director of Planning Services to require a reduced wattage for the ten LED
landscape light fixtures installed at the property located at 155 South Sunrise
Way.
