R-11015RESOLUTION NO.6258 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM SPRINGS, CALIFORNIA, DETERMINING THAT THE VACATION OF A "20' WIDE EASEMENT TO THE CITY OF PALM SPRINGS FOR GOLF COURSE PURPOSES" WITHIN LOTS 1-55 OF TRACT NO. 2808, M.B. 52, PAGES 42-45, IS CONSISTENT WITH THE PALM SPRINGS GENERAL PLAN; ENGINEERING FILE R 11-15. WHEREAS, the City of Palm Springs has filed an application to have the easement shown as "20' WIDE EASEMENT TO THE CITY OF PALM SPRINGS FOR GOLF COURSE PURPOSES", abandoned and vacated within Lots 1-55 of Tract No. 2808, Map Book 52, Pages 42-45, R.C.R.; and WHEREAS, Section 65402{a} of the California Government Code requires that no street or easement shall be vacated or abandoned if the adopted general plan applies thereto until the location, purpose and extent of such easement vacation or abandonment have been submitted to and reported upon by the planning agency as to conformity with said adopted general plan or part thereof; and WHEREAS, Section 607 of Article VI of the Charter of the City of Palm Springs established the Planning Commission, and assigned it all duties set out in the California Planning and Zoning Law for a planning agency; and WHERAS, the Applicant has requested vacation of excess public easement not necessary for future or intended use as shown on said Tract No. 2808, consistent with fhe Palm Springs General Plan. NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the Planning Commission hereby determines that the proposed easement vacation shown as a "20' WIDE EASEMENT TO THE CITY OF PALM SPRINGS FOR GOLF COURSE PURPOSES", within Lots 1-55 of Tract No. 2808, is consistent with the Palm Springs General Plan.
