A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM SPRINGS, CALIFORNIA, FINDING
THAT THE FINAL DEVELOPMENT PLANS ARE IN
SUBSTANTIAL CONFORMANCE WITH PRELIMINARY
PLANNED DEVELOPMENT DISTRICT 323 TO SUBDIVIDE
49 RESIDENTIAL DWELLING SITES AND A COMMON
AREA, AND APPROVE CONFORMING DWELLING
DESIGNS, LOCATED AT THE SMOKE TREE RANCH,
1850 SMOKE TREE LANE.
WHEREAS, On March 22, 2006, the Planning Commission recommended that the City
Council adopt the Mitigated Negative Declaration for the proposed project; and approve
the Planned Development District PD-323, and associated Tentative Tract Map 33878
and architectural designs; and
WHEREAS, on April 5, 2006, the City Council voted to approve Case No 5.1090,
Planned Development District (PD-323) and Tentative Tract Map (TTM 33878); and
WHEREAS, on March 28, 2007, the Planning Commission held a public meeting to
review the Final Development Plans for the project, including plans for a new single
family dwelling within the tract; and
WHEREAS, a Mitigated Negative Declaration for the project was previously adopted by
the City Council, in conjunction with the approval of Case No 5.1090, Planned
Development District (PD-323) and Tentative Tract Map (TTM 33878); and
WHEREAS, the Planning Commission has carefully reviewed and considered all of the
evidence presented in connection with the meeting on the project, including but not
limited to the staff reports, all written and oral testimony submitted by the applicant, and
all written and oral testimony presented.
THE PLANNING COMMISSION HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to CEQA, The Planning Commission finds that the Initial Study
and Mitigated Negative Declaration adequately address the general
setting of the project, its potentially significant impacts, and the mitigated
measures related to each significant effect for the proposed project. The
Planning Commission further finds with the adoption of the proposed
Mitigated Negative Declaration (MND), potentially significant
environmental impacts resulting from this project will be reduced to a level
of insignificance.
The Planning Commission further finds the modifications to the proposed
General Plan Amendments will have the same of less impact than the

project analyzed in the MND and that no new impacts were identified nor
were new mitigation measures identified. 0
Section 2: The Final Development Plans are in substantial conformance with the
Preliminary Planned Development District (Case No 5.1090 - PD-323),
including plans for a new single family dwelling.
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the Planning
Commission finds that the Final Development Plans are in substantial conformance with
the Preliminary Planned Development District 323 (Case 5.1090), subject to the
conditions in the attached Exhibit A.

Before final acceptance of the project, all conditions listed below shall be completed to the
satisfaction of the City Engineer, the Director of Planning Services, the Chief of Police, the Fire
Chief or their designee, depending on which department recommended the condition.
Any agreements, easements or covenants required to be entered into shall be in a form approved
by the City Attorney.
ADMINISTRATIVE
1. All conditions of the Preliminary Planned Development (PD-323) and Tentative Tract Map
33878 as approved by the City Council shall be in full force and effect.
2. All future dwellings proposed for Planned Development District PD-323 shall be subject to
review and approval as Minor Architectural Approvals in accordance with the provisions of
the Palm Springs Zoning Code.
