HomeMy WebLinkAboutPC Resolution _5031- Case PD 231RESOLUTION NO. 5031 OF THE PLANNING COMMISSION OF THE CITY OF PALM SPRINGS, CALIFORNIA, FINDING THAT THE FINAL DEVELOPMENT PLANS FOR THE GOLF MAINTENANCE COMPLEX ARE IN SUBSTANTIAL CONFORMANCE WITH PRELIMINARY PLANNED DEVELOPMENT DISTRICT 231 LOCATED AT ESCENA AT GENE AUTRY TRAIL AND VISTA CHINO, ZONE PD-231, SECTION 18. WHEREAS, Lennar Inland Communities ("the applicant") has development plans for the golf maintenance complex for Escen a WHEREAS, on September 28, 2005, a public meeting on the application for final development plans for the golf maintenance complex was held by the Planning Commission in accordance with applicable law; and WHEREAS, a mitigated negative declaration of environmental impact was previously adopted by the City Council on July 16, 2003, in conjunction with the approval of Case No. 5.0666 PD- 231; and WHEREAS, the Planning Commission has carefully reviewed evidence presented in connection with the meeting on the project, the staff report, and all written and oral testimony presented. THE PLANNING COMMISSION HEREBY FINDS AS FOLLOWS: Section 1: Section 2: and considered all of the including but not limited to Pursuant to CEQA, a mitigated negative declaration of environmental impact was previously approved by City Council on July 16, 2003, in conjunction with the approval of Case No. 5.0666 PD-231. Pursuant to Section 15162 of the California Environmental Quality Act (CEQA), the preparation of further documentation is not necessary because the circumstances of the project have not changed. The present project could not, therefore, result in any new environmental impacts beyond those already assessed in the adopted mitigated negative declaration. The golf maintenance complex has been designed in accordance with the design guidelines for the Escena (Palm Springs Classic) project in terms of height, mass and bulk of buildings, utilization of architectural features, lighting, and screening of service areas. The complex is also consistent with the preliminary approvals in terms of building location and land use. The preliminary approvals state that the golf maintenance complex shall comply with the development standards of the M-1 zone. Staff has reviewed the plans for the maintenance complex and determined that the plans comply with the development standards of the M-1 zone. Therefore, the proposed project is in substantial conformance with preliminary Planned Development District 231. K x K NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the Planning Commission finds that the final development plans for the golf maintenance complex are in substantial conformance with preliminary Planned Development District 231.
