OF THE PLANNING COMMISSION OF THE CITY OF PALM
SPRINGS, CALIFORNIA, APPROVING, CASE NO. CASE NO:
3,2678, A MAJOR ARCHITECTURAL APPLICATION BY A.
RASOUL MOTAHARI TO CONSTRUCT A 27.926 SQUARE
FOOT TWO STORY BUILDING, FOR SELLING AND
WAREHOUSING OF STONE PRODUCTS WITH 2,985
SQ.FT. OF OFFICES AT 63695 ORR WAY, ZONE M-2,
SUBJECT TO THE CONDITIONS OUTLINED IN THE
ATTACHED RESOLUTION AND CONDITIONS OF
APPROVAL. THE PROPERTY LOCATION IS THE
NORTHWEST CORNER OF 20TH AVENUE AND RUPPERT
STREET, PALM SPRINGS, CA. (APN 66-411-004),
PARCEL 1 OF PARCEL MAP 20820.
WHEREAS, the Planning Commission has received an application by A. Rasoul Motahari to
construct a 27,926 square foot building for selling and warehousing of stone products
with 2,985 sq.ft. of offices at 63695 Orr Way, Zone M-2; and
WHEREAS, Pursuant to Section 92.17.1.00 of the Zoning Ordinance, The M-2 is
intended to provide for the development of industrial uses which include fabrication,
manufacturing, assembly or processing which do not in their maintenance, assembly,
manufacture or plant operation create by-products to any degree which will adversely
affect the resort -open space environment of the city. (Ord. 1447 (part), 1993; and
WHEREAS, Pursuant to Section 92.17.1.01 A 1 of the Zoning Ordinance, wholesaling and ware
housing are permitted uses in the M-2 Zone; and
WHEREAS, a notice of public hearing of the Planning Commission of the City of Palm Springs
to consider the Major Architectural Application No. 3.2678 was circulated and published in
accordance with applicable law; and
WHEREAS, on September 28, 2005 on the Major Architectural Application for a buildings to be
constructed on 1.55 acres was held by the Planning Commission in accordance with applicable
law; and
WHEREAS, the planning Commission has carefully reviewed and considered all of the evidence
presented in connection with the hearing on the project, including but not limited to the staff
report, and all written and oral testimony presented.
THE PLANNING COMMISSION HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to the California Environmental Quality Act, the Planning
Commission finds that this project is could have a significant effect on the environment,

there will not be a significant effect in this case because revisions in the project have
been made by or agreed to the project proponent. The Planning Commission hereby
prepares and proposes to adopt a Mitigated Negative Declaration for this project.
Section 2: Pursuant to Zoning Ordinance Section 92.16.00, the Planning Commission finds
that:
The proposed project is architecturally compatible with the surrounding zones and
would not depreciate the character of the resort community. The uses are defined as
wholesaling and warehousing and would be carried on in an unobtrusive manner.
Pursuant to Zoning Ordinance Section 92,17.01(A)(4)(f) the Planning Commission
finds that:
Retail uses in conjunction with wholesaling and warehousing uses are allowed with
92.17,01.01 (A) (1).
Pursuant to Zoning Ordinance Section 92.17.01(C)(5), the Planning commission
finds that:
Pursuant to Zoning Ordinance Section 92.16.01 Section (A)(4) the Planning
Commission finds that:
Wholesaling and warehousing are permitted uses in the M-2 Zone.
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the Planning
Commission hereby approve Case No. 3.2678-MAJ subject to those conditions set forth in the
attached Conditions of Approval, which are to be satisfied prior to the issuance of building
permits unless otherwise specified.
