HomeMy WebLinkAboutPC Resolution _5029- Case 3.1030 MAJRESOLUTION NO. 5029 OF THE PLANNING COMMISSION OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING MAJOR ARCHITECTURAL APPLICATION CASE 3.1030 MAJ, SUBJECT TO THE CONDITIONS STATED, OF DON LIM FOR THE CONSTRUCTION OF A 6,128 SF TWO-STORY BUILDING TO INCLUDE A RESTAURANT ON THE GROUND FLOOR AND SIX HOTEL ROOMS ON THE SECOND FLOOR, A POOL AND SPA AREA WITH A 425 SF PATIO COVER; AND AN ADDITIONAL 25 PARKING SPACES AND LANDSCAPING, LOCATED AT 1984 NORTH PALM CANYON DRIVE, ZONE C-1/R-3, SECTION 3, APN: 504-320-006, AND MAKING FINDINGS IN SUPPORT THEREOF. WHEREAS, Howard Johnson Hotel/ Don Lim ("Applicant") has filed an application with the City pursuant to Section 94.04.00 of the Zoning Ordinance for the construction of a 6,128 SF two- story building to include a restaurant on the first floor and six hotel rooms on the second floor; a pool and spa area with a 425 SF patio cover; and an additional 25 parking spaces and landscaping, located at 1984 North Palm Canyon Drive, Zone C-1/R-3, Section 3, APN: 504-320-005; and WHEREAS, notice of public hearing of the Planning Commission of the City of Palm Springs to consider Applicant's application for Major Architectural Permit Case No.3.1030 MAJ was given in accordance with applicable law; and WHEREAS, on September 28, 2005, a public hearing on the application for Major Architectural Permit Case No. 3.1030 MAJ was held by the Planning Commission in accordance with applicable law; and WHEREAS, the proposed M ajor Arch itectu ral Permit (Case No. 3.1030 MAJ) is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15303(c) (New Construction); and WHEREAS, the Planning Commission has carefully reviewed and considered all of the evidence presented in connection with the hearing on the project, including, but not limited to, the staff report, and all written and oral testimony presented. THE PLANNING COMMISSION HEREBY FINDS AS FOLLOWS: Section 1: Pursuant to CEQA, the Planning Commission finds as follows: Pursuant to the California Environmental Quality Act, the Planning Commission finds that this project is categorically exempt from further environmental review pursuant to Section 15303(c) of the California Environmental Quality Act (CEQA), which states that new construction of small structures not exceeding 10,000 square feet within an urbanized area is exempt from CEQA. Section 2: Pursuant to Zoning Ordinance Section 92.16.00, the Planning Commission finds that: The proposed project is architecturally compatible with the surrounding zones and would not K K Ee depreciate the character of the resort community. The development of a hotel expansion with a restaurant, pool and hot tub, landscaping, and additional parking is compatible with the existing Howard Johnson hotel directly to the north. Similar materials, colors, and landscaping will be used so that the expansion and the exiting hotel appear as one contiguous development. Since other hotels and restaurants surround the proposal, this project will not depreciate the character of the resort community. Pursuant to Zoning Ordinance Section 92.04.01(A)(2), the Planning Commission finds that: A hotel is an allowed use in the R-3 Zone provided that no more than 10 percent of the guest rooms contain kitchen facilities, and the proposed six hotel rooms have no kitchen facilities. Pursuant to Zoning Ordinance Section 92.12.01(C)(45), the Planning Commission finds that: A restaurant, excluding drive-in or drive -though restaurants, is an allowed use within the C-1 Zoning District. Pursuant to Zoning Ordinance Section 92.12,01(D)(20), the Planning Commission finds that: A conditional use permit is not required for a restaurant within the C-1 Zoning District if the hotel contains less than 30 rooms or more than 99 rooms. The proposed six -room addition to the existing 94-room hotel will provide a hotel with 100 rooms. Therefore, a restaurant is a permitted use and no conditional use permit is required. NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the Planning Commission hereby approves Major Architectural Application Case No. 3.1030 MAJ, subject to those conditions set forth in the attached Exhibit A.
