OF THE PLANNING COMMISSION OF THE CITY OF PALM
SPRINGS, CALIFORNIA, EXTENDING THE PERIOD TO
COMMENCE SUBSTANTIAL CONSTRUCTION TO JANUARY
12, 2006 AND APPROVING MINOR SITE PLAN CHANGES FOR
CASE 5.0934 PD-281, AN APPLICATION BY MCCORMACK
BARON SALAZAR FOR 80-UNIT APARTMENTS LOCATED AT
THE SOUTHWEST CORNER OF SUNRISE WAY AND VISTA
CHINO ZONE R-2 AND P, SECTION 11.
WHEREAS, Desert Aids Project filed an application for Case No. 5.0934 - PD-281 for the
construction of 85 transitional housing units and a 31,422 square foot Family Care Center; and
WHEREAS, on July 16, 2003, the City Council voted to approve Case 5.0934 - PD-281 for a
general plan amendment to redesignate 2.17 acres of land from P to M15, the construction of
85 housing units and a 31,422 square foot Family Care Center located at the southwest corner
of Sunrise Way and Vista Chino; and
WHEREAS, McCormack Baron Salazar is no longer the master developer of the project and will
only be developing the 80 housing units and related improvements; and
WHEREAS, the housing units and related improvements represent Phase 1 of the overall
project; and
WHEREAS, the period to commence substantial construction on the housing units will expire on
July 12, 2005; and
WHEREAS, certain financing issues and construction costs have occurred beyond
applicant's control necessitating a time extension. to commence substantial construction;
the
WHEREAS, minor architectural and site plan changes not affecting the intent of the PD-281
have been proposed by the applicant; and
WHEREAS, a Mitigated Negative Declaration of environmental impact was previously approved
by City Council on July 16, 2003, in conjunction with the approval of the project; and
WHEREAS, the Planning Commission has carefully reviewed
evidence presented in connection with the meeting on the project,
the staff report, and all written and oral testimony presented.
THE PLANNING COMMISSION HEREBY FINDS AS FOLLOWS:

Pursuant to CEQA, a Mitigated Negative Declaration of environmental impact
was previously approved by City Council on July 16, 2003, in conjunction with the
approval of the project.
Pursuant to Section 15162 of the California Environmental Quality Act (CEQA),
the preparation of a Subsequent Negative Declaration, Addendum Negative
Declaration, or further documentation is not necessary because the changed
circumstances of the project will not result in any new significant environmental
impacts beyond those already assessed or a substantial increase in the severity
of previously identified significant effects.
Section 2: The financing issues and construction costs are factors that have occurred
beyond the applicant's control. These two factors have pushed the construction
schedule back necessitating additional time to commence substantial
construction. At this time, the building and grading permits are in the final review
stages and should be ready for issuance in the next 30 days. Therefore, the
Planning Commission finds good cause to extend the period to commence
substantial construction by six months to January 12, 2006.
Section 3: The Planning Commission finds that with the minor architectural and site plan
adjustments the project will still be compatible with and integrate well into the
surrounding community.
Section 4: Even with the minor architectural and site plan adjustments the proposed project
is still in substantial conformance with the Preliminary Planned Development
District (Case No 5.0934 - PD-281).
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the Planning
Commission extends the time period to commence substantial construction to January 12, 2006
and finds that even with the minor architectural and site plan changes, the final development
plans are still in substantial conformance with Preliminary Planned Development Distric
