RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF PALM
SPRINGS, CALIFORNIA, APPROVING
CASE NO. 5.0960, A CONDITIONAL USE
PERMIT FOR A 710 SQUARE FOOT
GUESTHOUSE LOCATED AT 855 NORTH
HERMOSA DRIVE, ZONE R-1-C, SECTION
11.
WHEREAS, the Irene James (the "applicant") has filed an application for a Conditional Use
permit to construct a 710 square foot guest house at 855 North Hermosa Drive, Zone R-1-
C, Section 11; and
WHEREAS, the Zoning Ordinance requires that a guesthouse larger than 1150 of the lot
size as well as those with kitchens may be permitted subject to the approval of a
Conditional Use Permit; and
WHEREAS, notice of public hearing of the Planning Commission of the City of Palm
Springs to consider Case No. 5.0960 was given in accordance with applicable law; and
WHEREAS, on May 28, 2003, a public hearing on the application for Case No. 5.0960 was
held by the Planning Commission in accordance with applicable law; and
WHEREAS, the Planning Commission has carefully reviewed and considered all of the
evidence presented in connection with the hearing on the project, including but not limited to the
staff report, and all written and oral testimony presented.
THE PLANNING COMMISSION HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to CEQA, the Planning Commission finds that this project is
categorically exempt from further environmental review per Section 15301
(Existing Facilities) and Section 15303 (New Construction or Conversion of
Small Structures), whereas the proposed guest house meets the conditions
outlined for new construction of small structures and for minor additions to
existing structures.
Section 2: Pursuant to Section 94.02.00 of the Zoning Ordinance, the Planning
Commission finds that:
a. The use applied for at the location set forth in the application is properly one for which
a Conditional Use Permit is authorized by the CiVs zoning ordinance.
Pursuant to the Zoning Ordinance, a guest house is a use which is conditionally
permitted in the R-1-C zone, for lots with a minimum size of 15,000 square feet in area
and occupy more than 1150 of the total lot area. At 17,000 square feet in area, the lot
exceeds the minimum size required for a guest house.
b. The said use is necessary or desirable for the development of the community, and is
in harmony with the various elements or objectives of the General Plan, and is not
detrimental to the existing or future uses specifically permitted in the zone in which the
proposed use is to be located.
The proposed use and improvements are desirable in that it will allow for the residents
of the single family residence, which is the primary structure on the property, to
accommodate occasional guests with a separate living area and also allow for additional
storage. Guest houses are for occasional visitors and therefore, the proposed structure
is consistent with the objectives of the General Plan, and will not be detrimental to the
existing or future permitted uses within the R-1-C zone in which the proposed use is to
be located.
C. The site for the intended use is adequate in size and shape to accommodate said use,
including yards, setbacks, walls or fences, landscaping and other features required in
order to adjust said use to those existing or permitted future uses of land in the
neighborhood.
The lot area exceeds the minimum lot area requirements forthe intended use. As such,
the project site is adequate in size and shape to accommodate the proposed guest
house, including yards, setbacks, and required parking.
d. The site for the proposed use relates to streets and highways properly designed and
improved to cant' the type and quantity of traffic to be generated by the proposed use.
The project site is accessed by public streets which are adequate to serve the
residential neighborhood within which the site is located. The guesthouse will serve only
occasional visitors to the single family residence, which is the primary use on the site
and will not intensify uses on the site or in the area.
e. The conditions to be imposed are deemed necessary to protect the public health, safety
and general welfare, of the existing neighborhood in which this project is situated.
All proposed conditions of approval are necessary to ensure compliance with Zoning
Ordinance requirements and to ensure the public health, safety and welfare.
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the Planning
Commission hereby approves Conditional Use Permit 5.0960 subject to those conditions set
forth in the attached Exhibit A, which are to be satisfied prior to the issuance of a Certificate of
Occupancy unless otherwise specified.
