THE PLANNING COMMISSION OF THE CITY OF PALM SPRINGS,
CALIFORNIA, APPROVING CASE NO 5.0931 - PD-279, AN
APPLICATION BY CENTURY VINTAGE HOMES FOR A FINAL
PLANNED DEVELOPMENT DISTRICT TO ALLOW THE
CONSTRUCTION OF 308 SINGLE FAMILY HOMES, 282 GATED
AND 26 UNGATED, IN A SINGLE-FAMILY RESIDENTIAL
COMMUNITY, INCLUDING ON AND OFF -SITE IMPROVEMENTS,
FOR THE PROPERTY LOCATED AT THE NORTHEASTCORNER
OF GATEWAY DRIVE AND HIGHWAY 111, ZONE R-1-C,
SECTION 34.
WHEREAS, Century Vintage Homes (the "Applicant") has filed an application with the City pursuant
to Section 94.03.00 of the Zoning Ordinance for approval of a Final Planned Development District
(project), for Case No. 5.0931 - PD-279; and
WHEREAS, on January 22, 2003, a public hearing of the Planning Commission of the City of Palm
Springs to consider Case 5.0931-PD-279, was given in accordance with applicable law; and
WHEREAS, on February 26, 2003, the City Council approved the proposed project; and
WHEREAS, on March 26, 2003, a public meeting for the project was held by the Planning
Commission in accordance with applicable law; and
WHEREAS, the Planning Commission has carefully reviewed and considered all of the evidence
presented in connection with the meeting on the project, including but not limited to the staff report,
and all written and oral testimony presented.
THE PLANNING COMMISSION HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to CEQA, the Planning Commission finds that the current environmental
assessment for Case No. 5.0931-PD-279 adequately addresses the general
environmental setting of the proposed Project, its significant environmental impacts,
and the mitigation measures related to each significant environmental effect for the
proposed project. The Planning Commission furtherfinds that with the incorporation
of proposed mitigation measures, potentially significant environmental impacts
resulting from this project will be reduced to a level of insignificance and therefore
` recommends adoption of a Mitigated Negative Declaration for the project.
The Planning Commission finds that with the site plan design, architecture,
landscaping and walls, the project will be compatible with and integrate well into the
surrounding community.
Section 3: The proposed project is in substantial conformance with the Preliminary Planned
MEW Development District (Case No 5.0931 - PD-279). �
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the Planning Commission
approves Case Number 5.0931 - PD-279, a Final Planned Development District, subject to all
conditions of approval dated March 26, 2003.
