HomeMy WebLinkAboutPC Resolution _4837RESOLUTION 4837 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM SPRINGS, CALIFORNIA, DETERMINING THAT NEIGHBORHOOD ELECTRIC VEHICLE (NEV) RENTAL IS A SIMILAR USE TO BICYCLE RENTAL, IN THE C-B-D (CENTRAL BUSINESS DISTRICT) ZONE. WHEREAS, the Planning Commission has received a zoning text determination request from GEM Rentals of Palm Springs, requesting that the Planning Commission make the determine that the rental of Neighborhood Electric Vehicles is an allowable use within the Central Business District (C-B-D) zone; and WHEREAS, GEM Rentals of Palm Springs Vehicles available for rental purposes; and Neighborhood WHEREAS, Neighborhood Electric Vehicles, as designated in the State of California Vehicle Code are also known as Low Speed Vehicles, as designated byfederal statute; and WHEREAS, Neighborhood Electric Vehicles are those licensed and registered electric vehicles which are limited to a maximum speed of 25 miles per hour by state law; and WHEREAS, the operation of Neighborhood Electric Vehicles are limited to those roadways where the posted road speed is 35 miles per hour and below; and WHEREAS, the City permits bicycle rentals in the R-3, R4 and C-B-D zones with a land use permit, and in the C-D-N, Cl-AA and C-2 zones as a permitted use; and WHEREAS, the Planning Commission determines that Neighborhood Electric Vehicles rentals are similar to other visitor serving uses allowed in the C-B-D, and that with conditions of approval, and through the land use permit process, such businesses would provide a service to the community; and WHEREAS, considered information. the Planning Commission held all evidence, including but not NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of Palm Springs, determines that Neighborhood Electric Vehicles rental is a use permitted in the C- B-D zone through the land use permit process.
