RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM SPRINGS, CALIFORNIA, APPROVING CASE NO.
5.0944, A CONDITIONAL USE PERMIT FOR A 508 SQUARE
FOOT GUESTHOUSE LOCATED AT 2190 CALLE FELICIA, ZONE
R-1-C, SECTION 13.
WHEREAS, the Rocco Gambino (the applicant") has filed an application for a Conditional Use
permit to construct a 508 square foot guest house at 2190 Calle Felicia, Zone R-1-C, Section 13;
and
WHEREAS, the Zoning Ordinance requires that a guesthouse larger than 1150 of the lot size as
well as those with kitchens may be permitted subject to the approval of a Conditional Use Permit;
and
WHEREAS, notice of public hearing of the Planning Commission of the City of Palm Springs to
consider Case No. 5.0944 was given in accordance with applicable law; and
WHEREAS, on March 26, 2003, a public hearing on the application for Case No. 5.0944 was held
by the Planning Commission in accordance with applicable law; and
WHEREAS, the Planning Commission has carefully reviewed and considered all of the evidence
presented in connection with the hearing on the project, including but not limited to the staff report, and
all written and oral testimony presented.
THE PLANNING COMMISSION HEREBY FINDS AS FOLLOWS:
,tion 1: Pursuant to CEQA, the Planning Commission finds that this project is categorically
exempt from further environmental review per Section 15301 (Existing Facilities) and
Section 15303 (New Construction or Conversion of Small Structures), whereas the
proposed guest house meets the conditions outlined for new construction of small
structures and for minor additions to existing structures.
tion 2: Pursuant to Section 94.02.00 of the Zoning Ordinance, the Planning Commission finds
that:
The use applied for at the location set forth in the application is properly one for which a
Conditional Use Permit is authorized by the City's zoning ordinance.
Pursuant to the Zoning Ordinance, a guest house is a use which is conditionally permitted in the
R-1-C zone, for lots with a minimum size of 15,000 square feet in area and occupy more than
1150 of the total lot area. At 17,000 square feet in area, the lot exceeds the minimum size
required for a guest house.
The said use is necessary or desirable for the development of the community, and is in
harmony with the various elements or objectives of the General Plan, and is not detrimental to
the existing or future uses specifically permitted in the zone in which the proposed use is to be
located.
The proposed use and improvements are desirable in that it will allow for the residents of the
single family residence, which is the primary structure on the property, to accommodate
occasional guests with a separate living area. Guest houses are for occasional visitors, the
proposed structure is consistent with the objectives of the General Plan, and will not be
detrimental to the existing orfuture permitted uses within the R-1-C zone in which the proposed
use is to be located.
C. The site for the intended use is adequate in size and shape to accommodate said use, including
yards, setbacks, walls orfences, landscaping and other features required in order to adjust said
use to those existing or permitted future uses of land in the neighborhood.
The lot area exceeds the minimum lot area requirements for the intended use. As such, the
project site is adequate in size and shape to accommodate the proposed guest house, including
yards, setbacks, and required parking.
d. The site for the proposed use relates to streets and highways properly designed and improved
to cant' the type and quantity of traffic to be generated by the proposed use.
The project site is accessed by public streets which are adequate to serve the residential
neighborhood within which the site is located. The guesthouse will serve only occasional visitors
to the single family residence, which is the primary use on the site and will not intensify uses on
the site or in the area.
e. The conditions to be imposed are deemed necessary to protect the public health, safety and
general welfare, of the existing neighborhood in which this project is situated.
All proposed conditions of approval are necessary to ensure compliance with Zoning Ordinance
requirements and to ensure the public health, safety and welfare.
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the Planning Commission
hereby approves Conditional Use Permit 5.0944 subject to those conditions set forth in the attached
Exhibit A, which are to be satisfied prior to the issuance of a Certificate of Occupancy unless otherwise
specked.
