HomeMy WebLinkAboutPC Resolution _4825- Case 5.0916 GPACZ1;M-101-11111LQ 14I1101u:1:R OF THE PLANNING COMMISSION OF THE CITY OF PALM SPRINGS, CALIFORNIA, RECOMMENDING APPROVAL OF A GENERAL PLAN AMENDMENT SO AS TO REDESIGNATE A 5.11 ACRE PARCEL FROM M15 (MEDIUM DENSITY RESIDENTIAL) TO GC (GENERAL COMMERCIAL) AND C (CONSERVATION) AND AN AMENDMENT TO THE ZONING MAP SOAS TO REZONE A 5.11 ACRE PARCEL FROM R-2 (LIMITED MULTIPLE FAMILY RESIDENTIAL) AND R-1-AH (SINGLE FAMILY RESIDENTIAL) TO C-M (COMMERCIAL MANUFACTURING) AND 0-20 (OPEN LAND) FOR THE PROPERTY LOCATED AT 4155 MATTHEW DRIVE, ZONE R-2 AND R-1-AH, SECTION 30. WHEREAS, Matthew Dragicevich Charitable Remainder Trust, (the "applicant") has filed an application with the City for a General Plan Map Amendment to redesignate 5.11 acres of land from M15 (Medium Density Residential) to GC (General Commercial) and C (Conservation) for the property located at 4155 E. Matthew Drive; and WHEREAS, the applicant has filed an application with the City pursuant to Section 94.07.00 of the Zoning Ordinance for a Change of Zone of 5.11 acres of land from R-2 (Limited Multiple Family Residential) and R-1-AH (Single Family Residential) to C-M (Commercial Manufacturing) and 0-20 (Open Land) for the property located at 4155 E. Matthew Drive; and WHEREAS, notice of a public hearing of the Planning Commission of the City of Palm Springs to consider Case No. 5.0916 GPA/CZ, a request to amend the General Plan Map and Zoning Map, was given in accordance with applicable law; and WHEREAS, on August 14, 2002 a public hearing to consider Case No. 5.0916 GPA/CZ, a request to amend the General Plan Map and Zoning Map, was held by the Planning Commission in accordance with applicable law; and WHEREAS, on September 11, 2002 a public hearing to consider Case No. 5.0916 GPAICZ, a request to amend the General Plan Map and Zoning Map, was held by the Planning Commission in accordance with applicable law; and WHEREAS, on November 13, 2002, a public hearing to consider Case No. 5.0916 GPA/CZ, a request to amend the General Plan Map and Zoning Map, was held by the Planning Commission in accordance with applicable law; and WHEREAS, on January 8, 2003, a public hearing to consider Case No. 5.0916 GPA/CZ, a request to amend the General Plan Map and Zoning Map, was held by the Planning Commission in accordance with applicable law; and WHEREAS, on January 22, 2003, a public hearing to consider Case No. 5.0916 GPA/CZ, a request to amend the General Plan Map and Zoning Map, was held by the Planning Commission in accordance with applicable law; and WHEREAS, notice of a public hearing of the Planning Commission of the City of Palm Springs to consider Case No. 5.0916 GPAICZ, a request to amend the General Plan Map and Zoning Map, 0 was given in accordance with applicable law; and WHEREAS, in accordancewith Section 15063 of the California Environmental Quality Act, an Initial Study was prepared and staff found that the proposed project could not have a significant effect on the environment; and WHEREAS, the Planning Commission has carefully reviewed and considered all of the evidence presented in connection with the hearing on the project, including but not limited to the staff report, all written and oral testimony presented. THE PLANNING COMMISSION HEREBY FINDS AS FOLLOWS: Section 1: Pursuant to CEQA, the Planning Commission finds that the proposed project could not have a significant effect on the environment. Section 2: Given the use and location of the site, the existing commercial uses of the site more closely associates with the commercial uses to the west and northwest than the apartments to the north and residential use and vacant land to the east. Section 3: The amendment to the General Plan will result in the proposed change of zone being in conformity with the General Plan Map and Report. Section 4: The subject property is suitable for the uses intended in the General Plan f� designation and the uses permitted in the proposed zone, in terms of access, size �f of parcel, relationship to similar or related uses, and other considerations deemed relevant by the Commission. Section 5: The proposed change of zone and change of General Plan designation is necessary and proper at this time, and is not likely to be detrimental to the adjacent property or residents. NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the Planning Commission hereby recommends approval of Case No. 5.0916 GPAICZ, as shown in Exhibit A.
