HomeMy WebLinkAboutPC Resolution _4811- Case 5.0905-PD-274RESOLUTION NO. 4811 THE PLANNING COMMISSION OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING CASE NO 5.0905-PD-274, AN APPLICATION BY CREATIVE COMMUNITIES, LLC., FORA FINAL PLANNED DEVELOPMENT DISTRICT FOR A GATED, 63 UNIT CLUSTER RESIDENTIAL DEVELOPMENT, LOCATED AT THE SOUTHEAST CORNER OF EAST PALM CANYON DRIVE AND ARABY DRIVE, R-3, SECTION 25. WHEREAS, Creative Communities, LLC. (the "Applicant") has filed an application with the City pursuant to Section 9403.00 for approval of a Final Planned Development District (project), for Case No. 5;0905-PD-274; and WHEREAS, on June 12, 2002, the Planning Commission voted to recommend that the City Council approved the proposed project; and WHEREAS, on July 3, 2002, the City Council found that it independently reviewed and considered the information contained in the Mitigated Negative Declaration and found that it adequately discusses the significant environmental effects of the proposed Project, and that on the basis of the initial study and comments received during the public review process, it found that with the incorporation of proposed mitigation measures, potentially significant environmental impacts resulting from this project will be reduced to a level of insignificance and therefore adopted a Mitigated Negative Declaration for the project. The City Council found that the Mitigated Negative Declaration reflected its independent judgment; and WHEREAS, the proposed project was approved by the City Council on July 3, 2002; and WHEREAS, on November 13, 2002, a public meeting for the project was held by the Planning Commission in accordance with applicable law; and WHEREAS, the Planning Commission has carefully reviewed and considered all of the evidence presented in connection with the meeting on the project, including but not limited to the staff report, and all written and oral testimony presented. THE PLANNING COMMISSION HEREBY FINDS AS FOLLOWS: Section 1: �J The City Council found that it independently reviewed and considered the information contained in the Mitigated Negative Declaration and found that it adequately discusses the significant environmental effects of the proposed Project, and that on the basis of the initial study and comments received during the public review process, it found that with the incorporation of proposed mitigation measures, potentially significant environmental impacts resulting from this project will be reduced to a level of insignificance and therefore adopted a Mitigated Negative Declaration for the project. Section 2: The proposed project is in substantial conformance with the Preliminary Planned Development District (Case No 5.0905-PD-274). NOW, THEREFORE, BE IT RESOLVEDthat, based upon the foregoing, the Planning Commission approves Case Number 5.0905-PD-273, a Final Planned Development District, subject to all conditions of approval dated July 3, 2002.
