HomeMy WebLinkAboutPC Resolution _4804- Case 5.0860 PD-266RESOLUTION NO. 4804 THE PLANNING COMMISSION OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING CASE NO 5.0860-PD-266, AN APPLICATION BY THE HEAVENSTONE COLLECTION, LLC FORA FINAL PLANNED DEVELOPMENT DISTRICT TO ALLOW THE DEVELOPMENT OF A 6-UNIT MULTI- FAMILY RESIDENTIAL COMPLEX ON 1.37 ACRES, LOCATED AT THE NORTHEAST CORNER OF INDIAN CANYON DRIVE AND ALEJO ROAD, R-3 ZONE, SECTION 11. WHEREAS, Architectural Properties (the "Applicant") has filed an application with the City pursuant to Section 9403.00 for approval of a Final Planned Development District (project), for Case No. 5.0860-PD-266; and WHEREAS, on November 28, 2001, the Planning Commission voted to recommend that the City Council approved the proposed project; and WHEREAS, on March 20, 2002, the City Council found that the project was categorically exempt from further environmental review under Section 15303, Multi -family residences of six units or less and Section 15323, In -fill Development, of the California Environmental Quality Act (CEQA); and WHEREAS, the proposed project was approved by the City Council on March 20, 2002; and WHEREAS, on August 28, 2002, a public meeting for the project was held by the Planning Commission in accordance with applicable law; and WHEREAS, the Planning Commission has carefully reviewed and considered all of the evidence presented in connection with the meeting on the project, including but not limited to the staff report, and all written and oral testimony presented. THE PLANNING COMMISSION HEREBY FINDS AS FOLLOWS: Section 1: The proposed project is categorically exempt from further environmental review under Sections 15332 (Multi -family developments of six units or less) and 15332 (In -fill Development) of the California Environmental Quality Act (CEQA); and Section 2: The proposed project is in substantial conformance with the Preliminary Planned Development District (Case No 5.0860-PD-266). NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the Planning Commission approves Case Number 5.0860-PD-266, a Final Planned Development District, subject to all conditions of approval dated March 20, 2002. ADOPTED this 91" day of October, 2002.
