HomeMy WebLinkAboutPC Resolution _4779- Case 10.433RESOLUTION NO. 4779 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM SPRINGS, CALIFORNIA, CASE NO. 10.433, DETERMINING THAT THE DEDICATION OF A 300 SQUARE FOOT AREA ON A PORTION OF PARCEL NO.1 ON THE WEST SIDE OF ORANGE AVENUE AND THE VACATION OF A 6,000 SQUARE FOOT PORTION OF ORANGE AVENUE BETWEEN MESQUITE AVENUE AND SUNNY DUNES ROAD IS CONSISTENT WITH THE GENERAL PLAN, R-1-D ZONE, SECTION 19. WHEREAS, the Planning Commission has received a request for the dedication of a 300 square foot area on a portion of Parcel No.1 on the west side of Orange Avenue and vacation of a 6,000 square foot portion of Orange Avenue, between Mesquite Avenue and Sunny Dunes Road; and WHEREAS, the vacation of the subject right-of-way will not negatively affect any developed or undeveloped properties; and WHEREAS, the subject rights -of -way exceeds the width required in the General Plan Circulation Element for a local road by 300 square feet; and WHEREAS, the resulting right-of-way width is consistent with the General Plan; and WHEREAS, the Planning Commission of the City of Palm Springs has considered the subject vacation at its regular meeting of March 27, 2002; and WHEREAS, the Planning Commission has carefully reviewed and considered all of the evidence presented in connection with the request, including but not limited to the staff report and all written and oral testimony presented. NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the Planning Commission hereby determines that the vacation of the said right-of-way is not in conflict with the City's General Plan. ADOPTED this 27th day of March, 2002.
