RESOLUTION OF THE PLANNING COMMISSION OF THE CITYOF
PALM SPRINGS, CALIFORNIA, DETERMINING THAT THE USE OF
A MASSAGE SCHOOL FALLS WITHIN THE CATEGORY OF
SPECIAL PURPOSE SCHOOLS AS PERMITTED BY LAND USE
PERMIT WITHIN THE C-1 (COMMERCIAL RETAIL BUSINESS)
ZONE.
WHEREAS, the Planning Commission has received a request fora determination to allow the use
of a massage school within the C-1 zone; and
WHEREAS, the Planning Commission has determined that a massage school use would fall within
the category of special purpose schools as permitted by a Land Use Permit (92.12.01 C.1.1.) within
the C-1 zone; and
WHEREAS, on April 10, 2002, the Planning Commission carefully reviewed and considered all of
the evidence presented in connection with the request, including but not limited to the staff report,
and all written and oral testimony presented.
THE PLANNING COMMISSION HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to CEQA, the Planning Commission finds that this project is categorically
exemptfrom California Environmental Quality Guidelines (CEQA), pursuantto Class
1, Section 15301, Existing Facilities.
Section 2: Pursuant to Zoning Ordinance Section 94.01.02, the Planning Commission finds:
a. That the use is in keeping with the stated intent and purpose of the zone.
Pursuant to the Zoning Ordinance, a massage school would meet the intent as a business
district, primarily retail business in character, with related hotels, service, office cultural and
institutional uses in the C-1 zone because the local hotel and spa workforce would benefit
from the training to meet the service needs of both visitors and residents alike within the City
Limits.
b. That field investigations have disclosed that the subject use and its operation are
compatible with the uses permitted in the zone wherein it is proposed to be located.
The proposed use would, through the Land Use Permit process, be reviewed forthe impact
of the use and imposed with such conditions deemed necessary to insure that this use is
compatible with adjacent properties and the community. The proposed use would be
required to meet all development standards and general conditions required by the zoning
code such as parking, noise, and lighting, and would not be detrimental to the existing or
future uses specifically permitted in the zone in which the proposed use is to be located and
is necessary or desirable for the development of the community. 0
C. That the subject use is similar to one (1) or more uses permitted in the zone within
which it is proposed to be located.
The massage school use is similar to the listed special purpose schools permitted by a
Land Use Permit.
d. That the subject use will not cause substantial injury to the values of property in the
zone within which it is proposed to be located.
The proposed use would, through the Land Use Permit process, be reviewed for the impact
of the use and imposed with such conditions deemed necessary to insure that this use is
compatible with adjacent properties and the community, and be required to meet all
development standards and general conditions required by the zoning code such as parking,
noise, and lighting, and would not be detrimental to the existing or future uses specifically
permitted in the zone in which the proposed use is to be located.
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the Planning Commission
hereby determines that a massage school use would fall within the category of special purpose
schools as permitted by a Land Use Permit (92.12.01 C.1.1.) within the C-1 (Commercial Retail
Business) zone.
