HomeMy WebLinkAboutPC Resolution _4724- Case 8.243RESOLUTION NO.4724 OF THE PLANNING COMMISSION OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING VARIANCE 8.243 TO ALLOW THE INSTALLATION OF TWO (2) MAIN IDENTIFICATION SIGNS ON RAMON ROAD, TO EXCEED THE ALLOWABLE SQUARE FOOTAGE FOR A MAIN IDENTIFICATION SIGN ON SAN LUIS REY, AND FOR A SIGN PROGRAM FOR LOWE'S HOME IMPROVEMENT WAREHOUSE LOCATED AT 5201 EAST RAMON ROAD, M-1 ZONE, SECTION 20. WHEREAS, Harlan Laws Corporation, (the "Applicants") have filed an application with the City pursuant to Section 9406.00.13 of the Zoning Ordinance for a Variance to allow the installation of two (2) main identification signs on Ramon Road, to exceed the allowable square footage for a main identification sign on San Luis Rey, and for a sign program for Lowe's Home Improvement Warehouse located at 5201 East Ramon Road, M-1 Zone, Section 20. WHEREAS, Notice of a Public Hearing of the Planning Commission of the City of Palm Springs to consider the application for the Variance was given in accordance with applicable law; and WHEREAS, on November 22, 2000, a Public Hearing for the Variance was held by the Planning Commission in accordance with applicable law; and WHEREAS, the proposed Variance is categorically exempt from the California Environmental Quality Act (CEQA); and WHEREAS, the Planning Commission has carefully reviewed and considered all of the evidence presented in connection with the hearing on the project, including but not limited to the staff report and all written and oral testimony presented. THE PLANNING COMMISSION HEREBY FINDS AS FOLLOWS: Section 1: Pursuant to CEQA, the Planning Commission finds as follows: a. The project is categorically exempt from the requirements of CEQA pursuant to Section 15303. Section 2: Pursuant to Zoning Ordinance Section 9406.00.13, the Planning Commission finds that: 1. Because of special circumstances applicable to the subject property, including shape topography, location or surroundings, the strict application of the Zoning Ordinance would deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. Due the size of the site, the scale of the building, the increased front setback of the building, and the speed of traffic along Ramon Road, it is necessary for this property to have 2 main signs for better visibility. 2. Any variance granted shall be subject to such conditions as will assure that the adjustment thereby authorized shall not constitute a grant of special privilege inconsistent with the limitations upon other properties in the vicinity and zone in which the subject property is situated. The granting of the Variance will be inconsistent with the limitations upon other properties within the City. 3. The granting of the Variance will not be detrimental to the public health, safety, or welfare, or materially injurious to property and improvements in the vicinity and zone in which the property is located. The granting of the Variance will be materially detrimental to the public health, safety, convenience, orwelfare, or injurious to property and improvements in the same zone in which the property is located. 4. The granting of such variance will not adversely affect the General Plan forthe City. The proposed Sign Variance does adversely affect the General Plan and the proposed Variance is allowed by the zoning ordinance, therefore adversely affecting the General Plan for the City. NOW, THEREFORE, BE IT RESOLVED, that, based upon the foregoing, the Planning Commission hereby approves Variance 8.243 subject to staffs recommendations and conditions outlined in the Resolution. Wall sign - 329 square feet located on the north elevation (Ramon Road) b. Monument sign - 47.5 square feet adjacent to Ramon Road C. Wall sign - 200 square feet located on the east elevation (San Luis Rey) d. Two (2) convenience signs located on the north elevation which include a 44.3 square foot sign forthe Garden Center and a 61.6 square foot sign for the Indoor Lumber Yard. 2. Denied signs are as follows: a. Off -site monument sign - adjacent to Gene Autry Trail 3. That the exposed neon sign shall conform to Section 9320.10.C6 of the Zoning Ordinance. 4_ No additional signs including temporary banners shall be permitted.
