OF THE PLANNING COMMISSION OF THE CITY OF PALM
SPRINGS, CALIFORNIA, APPROVING, SUBJECT TO THE
CONDITIONS STATED, A ONE (1) YEAR TIME
EXTENSION FOR CASE NOS. 5.0779 (CUP) AND 6.423
(VARIANCE) FOR AN APPROVED WIND ENERGY
CONVERSION SYSTEM (WECS) FACILITY CONSISTING
OF 10 600-700 KW, 233 FOOT TALL WIND TURBINE
GENERATORS AND ASSOCIATED APPURTENANCES
AND A FACILITY YARD ON 78.13 ACRES OF LAND
LOCATED SOUTH OF INTERSTATE 10 AND GARNET
AVENUE AND WEST OF INDIAN AVENUE IN PORTIONS
OF LAND IN SECTION 16AND 21, T3S, R4E, SBBM: APNS
668-412-001 AND 669-040-006 (WECS 16 WEST); E-1
ZONE,
WHEREAS, Mr. Michael Azeka of Seawest Windpower, Inc. (the "applicant") has filed an
application for the first time extension for Case No. 5.0779 for an approved Wind Energy
Coversion System (WECS) facility consisting of 10 600-700 kW, 233 foot tall wind turbine
generators and associated appurtenances and a facility yard on 78.13 acres of land located
south of Interstate 10 and Garnet Avenue and west of Indian Avenue in portions of land in
Section 16 and 21, T3S, R4E, SBBM: APNS 668-412-001 and 669-040-006 (WECS 16
West); E-1 Zone; and
WHEREAS, on July 22, 1998, the applications as described above were approved 6-0-1
by the Planning Commission pursuant to the conditions of approval contained in Resolution
No. 4596; and
WHEREAS, the applicant is requesting an additional year to complete final engineering
design, secure construction financing, and obtain building permits; and
WHEREAS, the request for time extension would keep the application active until July 22,
2001;and
WHEREAS, the Planning Commission considered the applicant's time extension request
for the project at its duly noticed meeting held on July 12, 2000; and
WHEREAS, the Planning Commission has independently reviewed all evidence provided
including the staff report dated July 12, 2000 and all other written and oral testimony, and
finds the project, subject to the original conditions of approval (Exhibit A), consistent with
the requirements of the ordinances of the City and with State law; and
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Palm
Springs, California, after considering the evidence provided at the meeting does hereby
recommend approval of the first 92-month time extension for Case Nos. 5.0779 -CUP and
6.423 (Variance) for property herein described, subject to the original conditions contained
in Exhibit A.
