HomeMy WebLinkAboutPC Resolution _4657RESOLUTION NO. 4657 OF THE PLANNING COMMISSION OF THE CITY OF PALM SPRINGS, CALIFORNIA, PROVIDING RECOMMENDATIONS TO THE STATE OF CALIFORNIA DEPARTMENT OF PARKS AND RECREATION FOR A MITIGATED NEGATIVE DECLARATION AND ENVIRONMENTAL ASSESSMENT FOR THE PALM SPRINGS AERIAL TRAMWAY MOUNTAIN STATION AND TOWER MODERNIZATION, LOCATED WITHIN THE MOUNT SAN JACINTO STATE PARK, RIVERSIDE COUNTY, SECTIONS 13, 14 AND 23, T4S, R3E, SBBM. WHEREAS, the Mount San Jacinto Winter Park Authoirty (the "applicant") has filed an application with the State Department of Parks and Recreation for a proposal to modernize the Palm Springs Aerial Tramway Mountain Station and towers within Mount San Jacinto State Park, Riverside County, Sections 13, 14 and 23, T4S, R3E, SBBM; and WHEREAS, the focus of the renovation program is to allow for larger, round tram cabins to be utilized along the tram route; and WHEREAS, three areas along the tram route will require rock removal to accommodate the wider tram cabins; and WHEREAS, the loading and unloading area at the Mountain Station will require upgrades to allow for the wider tram cabins; and WHEREAS, development of this site is subject to approval by the State Department of Parks and Recreation; and WHEREAS, the State Department of Parks and Recreation has submitted the Environmental Assessment, a Draft Mitigated Negative Declaration and proposed Mitigation Monitoring Program for this project to the City for review and comment in accordance with applicable California Environmental Quality Act (CEQA) guidelines, which requires the State to forward all Environmental Review materials to other applicable responsible agencies for a thirty (30) day review and comment period, pursuant to Section 15105 of CEQA; and WHEREAS, the Planning Commission approved the Environmental Assessment for the revitalization of the Valley Station of the Palm Springs Aerial Tramway (Case No. 5.0798) _ oil -,,February 24, 1999 and recommended approval to the City Council of Phase One of the �) Valley Station renovation program on April 28, 1999; and WHEREAS, the City Council approved Phase One of the Valley Station renovation program on May 5, 1999; and 0 WHEREAS, the Environmental Assessment has identified three areas (Biology, Sewer and Septic systems and Parks and Recreation) where a significant impact on the environment could occur unless mitigation measures are provided; and WHEREAS, a Mitigation Monitoring Program, which includes 13 mitigation measures, is proposed to address the environmental concerns associated with the project, as listed above; and WHEREAS, the rock removal is proposed to occur through controlled blasting techniques that would limit the amount of air blast shock waves, ground vibrations and fly rock, which will limit the possibilities for any environmental impacts associated with resultant landslides and alteration of drainage patterns in Chino Canyon; and WHEREAS, the Planning Commission reviewed the project and the Environmental Assessment and Mitigated Negative Declaration for the application at its meeting of August 25, 1999, and made a recommendation to the State Department of Parks and Recreation that the Environmental Assessment is adequate, the proposed Mitigation Measures and Mitigation Monitoring Program are sufficient to address any potential environmental issues and that the Planning Commission is in support of the Palm Springs Aerial Tramway Renovation project. NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the Planning Commission of the City of Palm Springs recommends that, based upon an evaluation of the Environmental Assessment and Draft Mitigated Negative Declaration and proposed Mitigation Monitoring Program for the renovation of the Mountain Station and Towers for the Palm Springs Aerial Tramway, these documents are sufficient and thoroughly address any potential environmental impacts through the proposed Mitigation Monitoring Program, and support the renovation of the Palm Springs Aerial Tramway as presented. AYES: Mills, Caffery, Raya, Jurasky, Klatchko NOES: ABSENT: Fontana, Matthews ABSTAIN: ATTEST: CITY OF PALM SPRINGS, CALIFORNIA B 1..LJ--� PI nning Commission Chairman Planning ommission Secretary K /0.41ao RESOLUTION NO, 4656 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM SPRINGS, CALIFORNIA, DETERMINING THAT THE VACATION OF A PORTION OF TAHQUITZ DRIVE NORTH OF ARENAS ROAD IS CONSISTENT WITH THE CITY OF PALM SPRINGS GENERAL PLAN. WHEREAS, David Johnston, a property owner of real property on both sides of the street in question, has filed a request with the City for the vacation of a portion of Tahquitz Drive, consisting of a 50-foot wide, 9,624 section of said street, for the purpose of incorporating said right-of-way into a planned 26-unit bed and breakfast inn, R-2 zone, Section 15; and WHEREAS, the vacated section of Tahquitz Drive is proposed to be incorporated into the internal circulation and open space areas for said bed and breakfast inn; and WHEREAS, the vacation of the subject right-of-way will not affect any other developed or undeveloped properties in the immediate vicinity; and WHEREAS, the subject right-of-way is not identified on the General Plan Circulation PIan Map; and WHEREAS, the proposed street vacation is not in conflict with any Goals, Policies and Objectives on the City General Circulation Plan; and WHEREAS, the City Council has previously approved street vacations for all sections of Tahquitz Drive easterly of the portion in question, pursuant to Resolution No. 13952 on September 2, 1981 and Resolution No. 14181, on March 17, 1982; and WHEREAS, the Planning Commission of the City of Palm Springs has considered the subject vacation at its regular meeting of August 25, 1999; and WHEREAS, the Planning Commission has carefully reviewed and considered all of the evidence presented in connection with the request, including but not limited to the staff report, and all written and oral testimony presented. NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the Planning Commission hereby determines that the vacation of the said right-of-way is not in conflict with the City's General Plan. ADOPTED this 25' day of August. 1999.
