HomeMy WebLinkAboutItem 3B - AR-2024-0054_ARC Packet_07022025ARCHITECTURAL REVIEW COMMITTEE STAFF REPORT DATE: JULY 7, 2025 NEW BUSINESS SUBJECT: A REQUEST BY THE ALTUM GROUP, ON BEHALF OF SUN COMMUNITY FEDERAL CREDIT UNION, FOR A MAJOR ARCHITECTURAL REVIEW APPLICATION TO CONSTRUCT A NEW 2,895-SF BANK AND AN AUXILIARY DRIVE-THRU FACILITY AT A 1.08- ACRE UNDEVELOPED SITE LOCATED AT THE SOUTHEAST CORNER OF EAST RAMON ROAD AND SOUTH CALLE SANTA CRUZ, ZONE M- 1, SECTION 19 (CASE AR-2024-0054). (NK) FROM: Department of Planning Services PROJECT DESCRIPTION: This is a request to construct a 2,895-SF bank (Sun Community Federal Credit Union) at a maximum building height of 21.08 feet and an ancillary drive-thru facility at a 1.08-acre undeveloped site located at the southeast corner of East Ramon Road and South Calle Santa Cruz in the M-1 (Service/Manufacturing) Zone. On April 22, 2025, the Planning Commission approved a Major Development Permit application for the proposed project. RECOMMENDATION: That the Architectural Review Committee (ARC) approve the proposed project subject to the Conditions of Approval recommended by staff (Attachment 2). ISSUE: 1. At its meeting on April 22, 2025, the Planning Commission imposed the following conditions for the approval of the Major Development Permit application, Case DP- 2024-0005): a) Reduce the amount of the drive-thru lanes near the entry and exit points from two lanes to one (two-lane bypass/stacking area near the kiosk to remain) and expand the middle landscape island to the west and south. b) The ARC to review the following: i. Solar control on the north building elevation; ii. South building elevation for possible enhancement; Architectural Review Committee Staff Report Page 2 of 8 Case AR-2024-0054 July 7, 2025 iii. Increase the amount and variety of plant materials to screen the drive- thru and parking area, particularly on the Calle Santa Cruz frontage; iv. Kiosk design to ensure that it will stay free of dust and debris; v. Placement of California Fan Palms on the East Ramon Road frontage to ensure that they do not block the view of the ATM area for visibility and safety purposes; vi. A treatment plan for the proposed African Sumac and Palo Verde or the replacement of such materials with alternative plant materials; and vii. Correct disparities between the plant material list and photos BUSINESS PRINCIPAL DISCLOSURE: Public Integrity Disclosure Form is included as an attachment to the report (Attachment 4). BACKGROUND INFORMATION: Related Relevant City Actions 03/12/2024 Pre-Application (PAR-2024-2000) review was completed by the Department of Planning Services. 05/17/2024 Parcel Merger application (PM 23-08-4301) to consolidate APNs 680- 072-013; -014; -019; -020; -021; and -022 was recorded (Lead Department: Engineering Services Department). 04/22/2025 Planning Commission: 1) Adopted the Mitigated Negative Declaration (MND) as an adequate environmental document for the proposed project and associated impacts; 2) Approved a Conditional Use permit (CUP) application (CUP-2024-0009) for the drive-thru facility; 3) Approved a Major Development Permit application (Case DP-2024- 0005) for site development; and 4) Recommended the adoption of the MND and approval of a Change of Zone application (Case COZ-2024- 0001) which proposed to change the site’s zoning designation from Professional (P) to M-1 (Service/Manufacturing) to the City Council. 05/28/2025 City Council voted unanimously to adopt the MND and approve the Change of Zone application, COZ-2024-0001. Site Information Zone: Service/Manufacturing (M-1) General Plan Land Use Designation: Office (O) Net Acres 1.08 Acres (Approx. 47,045 SF) Neighborhood Notice 07/03/2025 The surrounding neighborhood organizations within one (1) mile of the site were sent notice that the proposed project would be reviewed by the Architectural Review Committee on July 7, 2025. Architectural Review Committee Staff Report Page 3 of 8 Case AR-2024-0054 July 7, 2025 STAFF ANALYSIS: Project Details: The applicant is proposing to construct a new 2,895-SF bank and an ancillary drive-thru facility on a 1.08-acre undeveloped parcel in the M-1 (Service/Manufacturing) Zone. In addition to the proposed building, the proposed site design includes a new drive-thru facility designed with a canopy and an ATM, parking, landscape, and trash enclosure. Site Plan: The 1.08-acre project site is a through lot and located on the east side of South Calle Santa Cruz between East Ramon Road and East Calle de Ricardo. Two-way vehicular access to the site is provided on the South Calle Santa Cruz and Calle De Ricardo frontages. Access to the site on the East Ramon Road frontage is limited to pedestrian access. The proposed 21.08-foot-high, 2,895-SF building will be centrally positioned towards East Ramon Road. Two rows of parking spaces are provided on the west side of the building, and the drive-thru facility is located on the east side of the building. The site’s existing topography is relatively flat, and the abutting parcels to the east are City- owned parcels that are currently undeveloped. Mass, Scale, and Architectural Composition: The project proposes a single-story commercial building at a maximum height of 21.08 feet. The project site is a corner through lot, and the parcel to the east, which is the only abutting parcel, is currently undeveloped. The applicant is seeking a reduced yard setback along East Ramon Road via an AMM. Because there is no abutting parcel on the elevation for which the yard setback reduction is requested, the approval of the AMM application would not affect any property. City records state that the building heights of the properties across the streets to the west (4299 E. Ramon Road, APN: 680-071-003) and south (4375 E. Calle De Ricardo, APN: 680-073-012) of the project site are 21.5 feet and 19.75 feet, respectively. The size of the proposed bank (2,895 SF) is significantly smaller than the existing buildings on these parcels (West: 11,750 SF, South: 6,452 SF) and the proposed building height is relatively close to the height of such buildings. Grading and Topography: While the site’s existing topography slopes down from its northeast corner towards south. The elevation difference between the highest and lowest points is approximately 3 feet, and the slope is insignificant and unremarkable overall (1.9 % slope). The project plans to establish a 3-foot-deep retention basin along Calle De Ricardo between Calle Santa Cruz and south entrance/exit to capture on site runoff. Water collected at different points on site will be directed to this retention basin through grading. The architectural treatment is consistent on all four sides of the proposed building(s), unless otherwise approved by the ARC; Y The project proposes similar architectural treatment on all sides as exemplified by the repeated material and color application and incorporation of rectangular form and grid pattern. 2. The design of accessory structures, such as carports, cabanas, and similar accessory structures, shall be consistent with the form, materials and colors of the principal building(s), unless otherwise approved by the ARC; Y The proposed design includes freestanding structures such as the drive-thru canopy and trash enclosure. The proposed drive-thru canopy incorporates architectural elements that are found on the primary building as exemplified by the yellow painted accent fascia and “wooden” screen, and the exterior of the proposed trash enclosure will be painted to match the color of the building exterior. Overall, the design of such structures are architecturally compatible with the primary building. 3. The façade elements and fenestration are composed in a harmonious manner; Y The proposed building consists of multiple volumes. The north/primary elevation of the main component part of the building is designed with expansive floor-to-ceiling glazing with two recessed windows on both sides. Overall, the building incorporates rectangular form and shape, as well as grid pattern. The grid pattern adds a sense of scale and prevents a monotonous appearance. The individual architectural component is properly scaled for a cohesive appearance. Architectural Review Committee Staff Report Page 6 of 8 Case AR-2024-0054 July 7, 2025 Criteria and Findings [PSZC 94.04.00(E)] Compliance 4. The proposed materials are consistent with the context of the site, adjacent buildings, and the desert environment; Y The proposed construction materials include metal, EIFS, CMU, and wood, all of which are commonly used construction materials and are contextually appropriate. The proposed materials are durable and will withstand the local desert climate. 5. The proposed color scheme is appropriate to the desert environment and consistent with the site context; Y The project proposes a desert-neutral color palette which consists of taupe and brown/bronze, in addition to yellow and blue accent colors. The application of the accent colors is limited and contextually appropriate. 6. Shading devices and sun control elements, excluding landscape materials, are provided to address environmental conditions and solar orientation; Y The primary entrance to the building is located on the north elevation, which proposes generous glazing application and a canopy. Additionally, the east elevation of the building is designed with a screen and a canopy for solar control. While the proposed architectural design does not include shading devices on the south and west elevations, very limited glazing application is proposed for these elevations. Visibility is vital for the proposed land use for safety purposes, and the proposed design is adequate to meet this finding. 7. The proposed landscape plan is consistent with the requirements of PSMC Chapter 8.60; Yes, as conditioned The proposed plant palette consists of drought-tolerant plant materials that are included in the Lush and Efficient gardening book. The landscape plan generally incorporates the conditions of approval imposed by the Planning Commission for the approval of the Major Development Permit application (e.g. California Fan Plam placement along East Ramon Road, Alternative plant material selection to replace African Sumac and Palo Verde), except for an increase in the amount and variety of plant materials along the Calle Santa Cruz frontage. Staff is recommending a condition of approval which requires an increase in the amount and variety of plant material along Calle Santa Cruz. Additionally, the landscape and irrigation plans are subject to review and approval by the Riverside County Agricultural Commissioner’s Office and Desert Water Agency (DWA) as conditioned to ensure that the project aligns with the City’s Water Efficient Landscape Ordinance. As conditioned, the project meets this requirement. 8. The proposed landscape plan is consistent with all applicable zoning requirements, including any streetscape requirements, landscape buffer requirements, and screening requirements; Y Architectural Review Committee Staff Report Page 7 of 8 Case AR-2024-0054 July 7, 2025 Criteria and Findings [PSZC 94.04.00(E)] Compliance The project site is designed with landscape buffer on all sides, and the proposed parking lot shading of 65% far exceeds the minimum shading requirement of 30%. 9. The shading for pedestrian facilities on the subject site or abutting public right(s)-of-way is adequate; Y Shade trees are proposed along the pedestrian pathway leading from the parking lot to the main entrance of the building which is located on the north side. Similar treatment is proposed for the secondary pedestrian path on the south elevation. The north elevation has the least amount of sun exposure, and the proposed shading is adequate for the pedestrian facilities considering the nature of the proposed use which requires clear visibility for public safety purposes. 10. The proposed lighting plan is consistent with the requirements of PSZC Section 93.21.00, and the proposed lighting will not materially impact adjacent properties; Yes, as conditioned The proposed outdoor lighting does not fully meet the zoning code requirements (e.g. Minimum footcandle, Average-to-Minimum Uniformity Ratio). However, the nonconforming outdoor lighting can be modified to meet the zoning code requirements without altering the character of the project. Staff is recommending a condition of approval which requires the proposed outdoor lighting to fully conform to the City’s outdoor lighting standards. As conditioned, the project meets this requirement. 11. Appropriateness of signage locations and dimensions relative to the building façade(s), or appropriateness of the site location for any freestanding signage, as may be warranted for the development type; N/A Sign installation would require a separate Sign Permit application. A Sign Permit application has not been submitted as a part of this application. 12. Screening is provided for mechanical equipment and service yards, so as to screen such facilities from view from public rights-of-way and abutting properties; Y The project proposes rooftop mechanical equipment installation, which will be located behind the parapet. The equipment will not be visible from public rights-of-way. 13. The proposed application is consistent with any adopted design standards of an applicable specific plan, planned development district, or other applicable adopted design standards and regulations. Yes, as conditioned Architectural Review Committee Staff Report Page 8 of 8 Case AR-2024-0054 July 7, 2025 Criteria and Findings [PSZC 94.04.00(E)] Compliance The project site is not located in a Specific Plan or Planned Development District. As analyzed in this table, the proposed project generally conforms to the requirements of the Zoning Code except for the outdoor lighting. To address this issue, staff is recommending a condition of approval which requires the proposed outdoor lighting to fully meet the outdoor lighting standards. As conditioned, the proposed project meets this requirement. ENVIRONMENTAL ANALYSIS: The proposed development is considered a “project” pursuant to the terms of the California Environmental Quality Act (“CEQA”). The City has evaluated the project under CEQA Guidelines and a Mitigated Negative Declaration (MND) has been adopted as an adequate environmental document for the proposed project and associated impacts by the City Council. A Notice of Determination (NOD) was submitted to the State Clearinghouse (SCH#: 2025010345) and recorded with the County of Riverside on May 29, 2025. CONCLUSION: The proposed project generally conforms to the Palm Springs Zoning Code and architectural review requirements except for conformance with the City’s Outdoor Lighting Standards. Additionally, the condition of approval imposed by the Planning Commission for the approval of the Major Development Permit application, Case DP-2024-0005, has not been entirely met. Although minor adjustments to the development proposal are necessary for the project to fully conform to the zoning code regulation and conditions, such changes are relatively minor and would not alter the character of the proposed development. Therefore, staff recommends that the ARC approve the proposed project subject to the conditions of approval included in the attached draft resolution (Attachment 2). THE ARCHITECTURAL REVIEW COMMITTEE FINDS AND DETERMINES AS FOLLOWS: A. The Altum Group, on behalf of Sun Community Federal Credit Union (the “Applicant”), filed COZ-2024-0001 (Change of Zone), CUP-2024-0009 (Conditional Use Permit), DP-2024- 0005 (Major Development Permit), AR-2024-0054 (Architectural Review), and AMM-2024- 0056 (Administrative Minor Modifications) applications in accordance with Sections 94.07.00 (Change of Zone), 94.02.00 (Conditional Use Permit), 94.04.01 (Development Permit), 94.04.00 (Architectural Review), and 94.06.01 (Administrative Minor Modifications) and of the Palm Springs Zoning Code for the construction of a 2,895-SF bank and an auxiliary drive-thru facility at a 1.08-acre undeveloped site located at the southeast corner of East Ramon Road and South Calle Santa Cruz, Zone P. Applicant requested a Change of Zone to change the site’s ‘Professional’ (P) zoning designation to ‘Service/Manufacturing’ (M-1); and B. The proposed project is considered a “project” pursuant to the terms of the California Environmental Quality Act (“CEQA”), and an Initial Study/Mitigated Negative Declaration (IS/MND) was prepared for this project and distributed for public review and comment in accordance with CEQA; and C. On April 22, 2025, a public hearing to consider Cases COZ-2024-0001, CUP-2024- 0009, and DP-2024-0005 was held by the Planning Commission in accordance with applicable law; the Planning Commission voted unanimously to approve CUP-2024-0009 and DP-2024- 0005 subject to conditions of approval and recommended approval of COZ-2024-0001 to the City Council. The conditions of approval included the requirement that the Architectural Review Committee (ARC) review the following: 1) Solar control on the north building elevation; 2) South building elevation for possible enhancement; 3) Increase the amount and variety of plant materials to screen the drive-thru and parking area, particularly on the Calle Santa Cruz frontage; 4) Kiosk design to ensure that it will stay free of dust and debris; 5) Placement of California Fan Palms on the East Ramon Road frontage to ensure that they do not block the view of the ATM area for visibility and safety purposes; 6) A treatment plan for the proposed African Sumac and Palo Verde or the replacement of such materials with alternative plant materials; and 7) Correct disparities between the plant material list and photos; and D. On May 28, 2025, the City Council held a duly noticed public hearing on the Project in Architectural Review Committee Resolution No. July 7, 2025 Case AR-2025-0054 Page 2 of 3 accordance with applicable law. The City Council carefully reviewed and considered all of the evidence presented in connection with the hearing on the Project, including but not limited to the staff report, all environmental data including the IS/MND prepared for the project and all written and oral testimony presented, and found the IS/MND to be in compliance with CEQA and found that any potentially significant environmental impacts outlined in the report will be adequately mitigated to less than significant levels. At the conclusion of the public hearing, the City Council introduced and waived further reading of this Ordinance adopting the final MND and to change the current zoning designation of the subject property from ‘Professional’ (P) to ‘Service/Manufacturing’ (M-1); and E. On July 7, 2025, the City’s Architectural Review Committee held a public meeting in accordance with applicable public law to review Case AR-2024-0054. At said meeting, the Architectural Review Committee carefully reviewed and considered all of the evidence presented in connection with the Project, including, but not limited to, the staff report, and all written and oral testimony presented. THE ARCHITECTURAL REVIEW COMMITTEE RESOLVES: Section 1: The proposed development is considered a “project” pursuant to the terms of the California Environmental Quality Act (“CEQA”). The City has evaluated the project under CEQA Guidelines and a Mitigated Negative Declaration (MND) has been adopted as an adequate environmental document for the proposed project and associated impacts by the City Council. A Notice of Determination (NOD) was submitted to the State Clearinghouse (SCH#: 2025010345) and recorded with the County of Riverside on May 29, 2025. Section 2: As demonstrated in the staff report, the Project conforms to the Architectural Review criteria and findings stipulated in Section 94.04.00(E) of the Palm Springs Zoning Code as conditioned. Section 3: Based upon the foregoing, the Architectural Review Committee hereby approves Case AR-2024-0054 for the construction of a 2,895-SF bank (Sun Community Federal Credit Union) at a maximum building height of 21.08 feet and an ancillary drive-thru facility at a 1.08- acre undeveloped site located at the southeast corner of East Ramon Road and South Calle Santa Cruz in the M-1 (Service/Manufacturing) Zone (APNs: 680-072-013, -014, -019, -020, - 021, -022), subject to the conditions of approval attached herein as Exhibit A. EXHIBIT A Case AR-2024-0054 Sun Community Federal Credit Union SEC of East Ramon Road and South Calle Santa Cruz July 7, 2025 CONDITIONS OF APPROVAL Before final acceptance of the project, all conditions listed below shall be completed to the satisfaction of the City Engineer, Director of Planning Services, Building Official, the Chief of Police, the Fire Chief or their designee, depending on which department recommended the condition. Any agreements, easements or covenants required to be entered into shall be in a form approved by the City Attorney. ADMINISTRATIVE CONDITIONS ADM 1. Project Description. This approval is for the project described per Case AR- 2024-0054; except as modified below: ADM 2. Conform to all Codes and Regulations. The project shall conform to the conditions contained herein, all applicable regulations of the Palm Springs Zoning Ordinance, Municipal Code, and any other City County, State and Federal Codes, ordinances, resolutions and laws that may apply. ADM 3. Indemnification. The owner shall defend, indemnify, and hold harmless the City of Palm Springs, its agents, officers, and employees from any claim, action, or proceeding against the City of Palm Springs or its agents, officers or employees to attach, set aside, void or annul, an approval of the City of Palm Springs, its legislative body, advisory agencies, or administrative officers concerning Case AR-2024-0054. The City of Palm Springs will promptly notify the applicant of any such claim, action, or proceeding against the City of Palm Springs and the applicant will either undertake defense of the matter and pay the City's associated legal costs or will advance funds to pay for defense of the matter by the City Attorney. If the City of Palm Springs fails to promptly notify the applicant of any such claim, action or proceeding or fails to cooperate fully in the defense, the applicant shall not, thereafter, be responsible to defend, indemnify, or hold harmless the City of Palm Springs. Notwithstanding the foregoing, the City retains the right to settle or abandon the matter without the applicant's consent but should it do so, the City shall Architectural Review Committee Resolution No. July 7, 2025 Sun Community Federal Credit Union Page 2 waive the indemnification herein, except, the City's decision to settle or abandon a matter following an adverse judgment or failure to appeal, shall not cause a waiver of the indemnification rights herein. ADM 4. Maintenance and Repair. The property owner(s) and successors and assignees in interest shall maintain and repair the improvements including and without limitation all structures, sidewalks, parking areas, landscape, irrigation, lighting, signs, walls, and fences between the curb and property line, in a first class condition, free from waste and debris, and in accordance with all applicable law, rules, ordinances and regulations of all federal, state, and local bodies and agencies having jurisdiction at the property owner’s sole expense. This condition shall be included in the recorded covenant agreement for the property if required by the City. ADM 5. Right to Appeal. The decision of the ARC shall be final unless appealed to the Planning Commission within 15 days following the date that the director issues notification to the applicant of the decision. The director shall schedule the appeal for consideration by the planning commission within 30 days following receipt of the appeal request and payment of the appeal fee. The decision of the Planning Commission shall be final unless further appeal is made to the city council in the manner provided by Chapter 2.05 of the Palm Springs Municipal Code. ADM 6. Public Art Fees. This project shall be subject to Chapters 2.24 and 3.37 of the Municipal Code regarding public art. The project shall either provide public art or payment of an in-lieu fee. In the case of the in-lieu fee, the fee shall be based upon the total building permit valuation, the fee being 1/2% for commercial projects or 1/4% for residential projects with first $100,000 of total building permit valuation for individual single-family units exempt. Should the public art be located on the project site, said location shall be reviewed and approved by the Director of Planning and Zoning and the Public Arts Commission, and the property owner shall enter into a recorded agreement to maintain the art work and protect the public rights of access and viewing. ENVIRONMENTAL ASSESSMENT CONDITIONS BIOLOGICAL RESOURCES BIO-1. Prior to construction and issuance of any grading permit, the City of Palm Springs shall ensure compliance with the Coachella Valley Multiple Species Habitat Conservation Plan (CVMSHCP) and its associated Implementing Agreement and shall ensure the collection of payment of the CVMSHCP Local Development Mitigation Fee. CULTURAL RESOURCES Architectural Review Committee Resolution No. July 7, 2025 Sun Community Federal Credit Union Page 3 CUL-1. Tribal Monitoring. Earth-moving activities, including grading, grubbing, trenching, or excavations at the site shall be monitored by a qualified Native American monitor(s). If any cultural materials are discovered, they shall be recorded and evaluated in the field. The monitors shall be prepared to recover artifacts quickly to avoid construction delays but must have the power to temporarily halt or divert construction equipment to allow for controlled archaeological recovery if a substantial cultural deposit is encountered. The monitors shall determine when excavations have reached sufficient depth to preclude the occurrence of cultural resources, and when monitoring should conclude. If artifacts are discovered, these shall be processed, catalogued, analyzed, and prepared for permanent curation in a repository with permanent retrievable storage that would allow for additional research in the future. Monitoring: CUL.A. Prior to the issuance of a grading permit for the site, the applicant shall provide fully executed monitoring agreement(s) to the City. Responsible parties: Project applicant, Planning Division, City Engineer. CUL.B. Within 30 days of the completion of ground disturbing activities on the Project site, a report of findings shall be filed with the City. The report will summarize the methods and results of the monitoring program, including an itemized inventory and a detailed analysis of recovered artifacts, upon completion of the field and laboratory work. The report should include an interpretation of the cultural activities represented by the artifacts and a discussion of the significance of all archaeological finds. Responsible parties: Project applicant, Project archaeologist, Tribal monitor, Planning Division, City Engineer. TRIBAL CULTURAL RESOURCES TBL-1. Prior to issuance of a Grading Permit, the applicant shall obtain written approval to proceed with construction from the Los Coyotes Band of Cahuilla and Cupeno Indians and Agua Caliente Band of Cahuilla Indians, Tribal Historic Preservation Officer or Tribal Archaeologist. The applicant shall contact the Tribal Historic Preservation Officer or the Tribal Archaeologist at (760) 699-6800, to determine their requirements, if any, associated with grading or other construction. The applicant is advised to contact the Tribal Historic Preservation Officer or Tribal Archaeologist as early as possible. If required, it is the responsibility of the applicant to coordinate scheduling of Tribal monitors during grading or other construction, and to arrange payment of any required fees associated with Tribal monitoring. The applicant shall coordinate scheduling of Agua Caliente Tribal cultural monitors during grading Architectural Review Committee Resolution No. July 7, 2025 Sun Community Federal Credit Union Page 4 or other construction, and to arrange payment of any required fees associated with Tribal monitoring. TBL-2. Prior to the commencement of ground disturbing activities, the applicant shall contact the Tribal Historic Preservation Office at ACBCI- THPO@aguacaliente.net to arrange cultural monitoring. PLANNING SERVICES DEPARTMENT CONDITIONS PLN 1. The street address numbering/lettering shall not exceed eight inches in height. PLN 2. Prior to issuance of a grading permit, a Fugitive Dust and Erosion Control Plan shall be submitted and approved by the Building Official. Refer to Chapter 8.50 of the Municipal Code for specific requirements. PLN 3. Prior to the issuance of building permits, locations of all telephone and electrical boxes must be indicated on the building plans and must be completely screened and located in the interior of the building. Electrical transformers must be located toward the interior of the project maintaining a sufficient distance from the frontage(s) of the project. Said transformer(s) must be adequately and decoratively screened. PLN 4. Outdoor Lighting Conformance. Outdoor lighting shall fully conform to the requirements of the Outdoor Lighting Standards (PSZC Section 93.21.00 - https://ecode360.com/43605755) and shall not produce disability glare, discomfort glare, light trespass, and/or light pollution as defined in Palm Springs Zoning Cod Sections 93.21.00(A)(7), (8), (9), and (10). The outdoor lighting plan shall be revised to conform to the zoning code regulations. PLN 5. Water Efficient Landscaping Conformance. The project is subject to the Water Efficient Landscape Ordinance (Chapter 8.60.00) of the Palm Springs Municipal Code and all other water efficient landscape ordinances. The applicant shall submit a landscape and irrigation plan to the Director of Planning for review and approval prior to the issuance of a building permit. Landscape plans shall be wet stamped and approved by the Riverside County Agricultural Commissioner's Office prior to submittal. Prior to submittal to the City, landscape plans shall also be certified by the local water agency that they are in conformance with the water agency’s and the State’s Water Efficient Landscape Ordinances. PLN 6. Sign Application Required. No signs are approved by this action. Separate approval and permits shall be required for all signs in accordance with Zoning Ordinance Section 93.20.00. Architectural Review Committee Resolution No. July 7, 2025 Sun Community Federal Credit Union Page 5 PLN 7. Surface Mounted Downspouts Prohibited. No exterior downspouts shall be permitted on any facade on the proposed building(s) that are visible from adjacent streets or residential and commercial areas. PLN 8. Exterior Alarms & Audio Systems. No sirens, outside paging or any type of signalization will be permitted, except approved alarm systems. PLN 9. Outside Storage Prohibited. No outside storage of any kind shall be permitted except as approved as a part of the proposed plan. PLN 10. Riverside County Airport Land Use Commission (ALUC). The project is subject to review and approval by the ALUC. All conditions of approval imposed by the agency shall be implemented. PLN 11. Time Limit. The time limit for the commencement of construction under a Development Permit approval shall be two (2) years from the effective date of the approval, unless an extension of time is granted pursuant to PSZC Section 94.12.00. ENGINEERING DEPARTMENT CONDITIONS Before final acceptance of the project, all conditions listed below shall be completed to the satisfaction of the City Engineer. All Grading Plans, Improvement Plans, Required Studies and Documents listed below, must be submitted to Engineering Services Department for review and approval. STREETS ENG 1. Any improvements within the public right-of-way require a City of Palm Springs Encroachment Permit. All improvements are subject to inspection and a 48-hour inspection notification is required. ENG 2. Submit street improvement plans prepared by a registered California civil engineer to the Engineering Services Department. The plan(s) shall be approved by the City Engineer prior to issuance of any encroachment or building permits. ENG 3. Costs associated with off-site street improvements may be reimbursed, pursuant to a Reimbursement Agreement approved by the City Council, in accordance with the policies established by Resolution 13487, and amended by Resolution 16031. Following completion and acceptance of off-site street improvements by the City Engineer, if reimbursement is requested in writing by the applicant, the applicant shall submit a formal request for preparation of a Reimbursement Agreement and a $5,000 Architectural Review Committee Resolution No. July 7, 2025 Sun Community Federal Credit Union Page 6 deposit for City staff time associated with the preparation of the Off-site Street Reimbursement Agreement, including City Attorney fees. The applicant shall be responsible for payment of all associated staff time and expenses necessary in the preparation and processing of the Reimbursement Agreement with the City Council, and shall submit additional deposits as necessary when requested by the City, which are included in the amount that may be reimbursed to the applicant through the Reimbursement Agreement. The Reimbursement Agreement is subject to the City Council’s review and approval at a Public Hearing, and its approval is not guaranteed nor implied by this condition. RAMON ROAD ENG 4. Remove the existing curb return located at the southeast corner of Ramon Road and Calle Santa Cruz and replace with a 35 feet radius curb return in accordance with City of Palm Springs Standard Drawing No. 200 and 206. ENG 5. Construct a 14-feet wide raised, landscaped median island as specified by the City Engineer from Calle Santa Cruz to Vella road. Provide left turn pockets as required and allowed by the City Engineer. The median nose width shall be constructed 4 feet wide and shall have stamped concrete. The left turn pockets shall be designed in accordance with Section 405 of the current edition of the Caltrans Highway Design Manual, as approved by the City Engineer. a. Submit landscaping, lighting and irrigation system improvement plans for review and approval by the City Engineer. The irrigation system and lighting shall be separately metered from the parkway landscaping. Maintenance of the median island under an agreement between the City (city to provide agreement) and Applicant (HOA, entity and their successors or assignees) for perpetual maintenance by the applicant. The plans shall be approved in conjunction with the street improvement plans for the median and prior to issuance of encroachment or building permits, unless otherwise allowed by the City Engineer. ENG 6. All median landscaping shall be guaranteed for a period of one year from the date of acceptance by the City Engineer. Any landscaping that fails or is destroyed during the one year landscape maintenance period shall be replaced with similar plant material to the satisfaction of the City Engineer, and shall be subject to a subsequent one year landscape maintenance period. ENG 7. Construct pavement with a minimum pavement section of 5 inches asphalt concrete pavement over 4 inches crushed miscellaneous base with a Architectural Review Committee Resolution No. July 7, 2025 Sun Community Federal Credit Union Page 7 minimum subgrade of 24 inches at 95% relative compaction, or equal, from edge of proposed gutter to clean sawcut edge of pavement along the entire frontage of new improvements in accordance with City of Palm Springs Standard Drawing No. 110. (Additional pavement removal and replacement may be required upon review of existing pavement cross- sections, and to ensure grade breaks of the pavement cross-section do not occur within a travel lane.) If an alternative pavement section is proposed, the proposed pavement section shall be designed by a California registered Geotechnical Engineer using "R" values from the project site and submitted to the City Engineer for approval. ENG 8. Remove and replace existing asphalt concrete pavement where required, in accordance with applicable City standards. ENG 9. All broken or off grade street improvements along the project frontage shall be repaired or replaced. CALLE SANTA CRUZ ENG 10. Construct a 6 inch curb and gutter, 20 feet east of centerline along the entire frontage, with a 25 feet radius curb return and spandrel at the northeast corner of the intersection of Calle Santa Cruz and Calle De Ricardo in accordance with City of Palm Springs Standard Drawing No. 200 and 206. ENG 11. Construct the north half of a 6 feet wide cross gutter at the northeast corner of the intersection of Calle Santa Cruz and Calle De Ricardo to match existing in accordance with City of Palm Springs Standard Drawing No. 200 and 206. ENG 12. Construct a feet wide driveway approach in accordance with City of Palm Springs Standard Drawing No. 201 shall be constructed, in accordance with Zoning Code 93.06.00 C (15). ENG 13. Construct a 5 feet wide sidewalk behind the curb along the entire frontage in accordance with City of Palm Springs Standard Drawing No. 210. ENG 14. Construct a Type B curb ramp meeting current California State Accessibility standards at the northeast corner of the intersection of Calle Santa Cruz and Calle De Ricardo in accordance with City of Palm Springs Standard Drawing No. 213. ENG 15. Construct pavement with a minimum pavement section of 3 inches asphalt concrete pavement over 4 inches crushed miscellaneous base with a minimum subgrade of 24 inches at 95% relative compaction, or equal, from edge of proposed gutter to clean sawcut edge of pavement along the entire frontage in accordance with City of Palm Springs Standard Drawing Architectural Review Committee Resolution No. July 7, 2025 Sun Community Federal Credit Union Page 8 No. 110. Construct a 6 inch curb and gutter, 18 feet north of centerline along the entire frontage and match with existing at east property line in accordance with City of Palm Springs Standard Drawing No. 200. ENG 19. Construct a feet wide driveway approach in accordance with City of Palm Springs Standard Drawing No. 201 shall be constructed, in accordance with Zoning Code 93.06.00 C (15). ENG 20. Construct a 5 feet wide sidewalk behind the curb along the entire frontage in accordance with City of Palm Springs Standard Drawing No. 210. ENG 21. Construct pavement with a minimum pavement section of 3 inches asphalt concrete pavement over 4 inches crushed miscellaneous base with a minimum subgrade of 24 inches at 95% relative compaction, or equal, from edge of proposed gutter to clean sawcut edge of pavement along the entire frontage in accordance with City of Palm Springs Standard Drawing No. 110. (Additional pavement removal and replacement may be required upon review of existing pavement cross-sections, and to ensure grade breaks of the pavement cross-section do not occur within a travel lane.) If an alternative pavement section is proposed, the proposed pavement section shall be designed by a California registered Geotechnical Engineer using "R" values from the project site and submitted to the City Engineer for approval. ENG 22. Remove and replace existing asphalt concrete pavement where required, in accordance with applicable City standards. ENG 23. All broken or off grade street improvements along the project frontage shall be repaired or replaced. The minimum pavement section for all on-site pavement shall be 3 inches asphalt concrete pavement over 4 inches crushed miscellaneous base with a minimum subgrade of 24 inches at 95% relative compaction, or equal. If an alternative pavement section is proposed, the proposed pavement section shall be designed by a California registered Geotechnical Engineer using "R" values from the project site and submitted to the City Engineer for approval. ENG 25. On-site drive aisles or parking lot shall be constructed with curbs, gutters, and cross-gutters, as necessary to accept and convey street surface drainage of the on-site streets to the on-site drainage system, in accordance with applicable City standards. SANITARY SEWER ENG 26. All sanitary facilities shall be connected to the public sewer system (via the proposed on-site private sewer system). New laterals shall not be connected at manholes. GRADING ENG 27. Submit a Precise Grading Plan prepared by a California licensed civil engineer to the Engineering Services Department for review and approval. The plan shall be approved by the City Engineer prior to grading permit issuance. a. A Fugitive Dust Control Plan shall be prepared by the applicant and/or its grading contractor and submitted to the Engineering Services Department for review and approval. The applicant and/or its grading contractor shall be required to comply with Chapter 8.50 of the City of Palm Springs Municipal Code, and shall be required to utilize one or more “Coachella Valley Best Available Control Measures” as identified in the Coachella Valley Fugitive Dust Control Handbook for each fugitive dust source such that the applicable performance standards are met. The applicant’s or its contractor’s Fugitive Dust Control Plan shall be prepared by staff that has completed the South Coast Air Quality Management District (AQMD) Coachella Valley Fugitive Dust Control Class. The applicant and/or its grading contractor shall provide the Engineering Services Department with current and valid Certificate(s) of Completion from AQMD for staff that have completed the required training. For information on attending a Fugitive Dust Control Class and information on the Coachella Valley Fugitive Dust Control Handbook and related “PM10” Dust Control issues, please contact AQMD at (866) 861-3878, or at http://www.AQMD.gov. A Fugitive Dust Control Plan, in conformance with the Coachella Valley Fugitive Dust Control Handbook, shall be submitted Architectural Review Committee Resolution No. July 7, 2025 Sun Community Federal Credit Union Page 10 to and approved by the Engineering Services Department prior to approval of the Grading plan. b. The first submittal of the Grading Plan shall include the following information: a copy of final approved conformed copy of Conditions of Approval; a copy of a final approved conformed copy of the Site Plan; a copy of current Title Report; a copy of Soils Report; and a copy of the associated Hydrology Study/Report; a copy of the project-specific Final Water Quality Management Plan. ENG 28. Prior to approval of a Grading Plan (or issuance of a Grading Permit), the applicant shall obtain written approval to proceed with construction from the Agua Caliente Band of Cahuilla Indians, Tribal Historic Preservation Officer or Tribal Archaeologist ( a copy of the written approval must be provided to the City) . The applicant shall contact the Tribal Historic Preservation Officer or the Tribal Archaeologist at ACBCI- THPO@aguacaliente.net to determine their requirements, if any, associated with grading or other construction. The applicant is advised to contact the Tribal Historic Preservation Officer or Tribal Archaeologist as early as possible. If required, it is the responsibility of the applicant to coordinate scheduling of Tribal monitors during grading or other construction, and to arrange payment of any required fees associated with Tribal monitoring. ENG 29. In accordance with an approved PM-10 Dust Control Plan, temporary dust control perimeter fencing shall be installed. Fencing shall have screening that is tan in color; green screening will not be allowed. Temporary dust control perimeter fencing shall be installed after issuance of Grading Permit, and immediately prior to commencement of grading operations. ENG 30. Temporary dust control perimeter fence screening shall be appropriately maintained, as required by the City Engineer. Cuts (vents) made into the perimeter fence screening shall not be allowed. Perimeter fencing shall be adequately anchored into the ground to resist wind loading. ENG 31. Within 10 days of ceasing all construction activity and when construction activities are not scheduled to occur for at least 30 days, the disturbed areas on-site shall be permanently stabilized, in accordance with Palm Springs Municipal Code Section 8.50.022. Following stabilization of all disturbed areas, perimeter fencing shall be removed, as required by the City Engineer. ENG 32. A Notice of Intent (NOI) to comply with the California General Construction Stormwater Permit (Water Quality Order 2022-0057-DWQ as adopted September 8, 2022) is required for the proposed development via the California Regional Water Quality Control Board online SMARTS system. A copy of the executed letter issuing a Waste Discharge Identification Architectural Review Committee Resolution No. July 7, 2025 Sun Community Federal Credit Union Page 11 (WDID) number shall be provided to the City Engineer prior to issuance of a grading or building permit. ENG 33. This project requires preparation and implementation of a stormwater pollution prevention plan (SWPPP). As of September 4, 2012, all SWPPPs shall include a post-construction management plan (including Best Management Practices) in accordance with the current Construction General Permit. Where applicable, the approved final project-specific Water Quality Management Plan shall be incorporated by reference or attached to the SWPPP as the Post-Construction Management Plan. A copy of the up-to-date SWPPP shall be kept at the project site and be available for review upon request. ENG 34. In accordance with City of Palm Springs Municipal Code, Section 8.50.022 (h), the applicant shall post with the City a cash bond of two thousand dollars ($2,000.00) per disturbed acre. (if there is disturbance of 5,000 square feet or more) at the time of issuance of grading permit for mitigation measures for erosion/blowsand relating to this property and development. ENG 35. A Geotechnical/Soils Report prepared by a California registered Geotechnical Engineer shall be required for and incorporated as an integral part of the grading plan for the proposed development. A copy of the Geotechnical/Soils Report shall be submitted to the Engineering Services Department with the first submittal of a grading plan. ENG 36. The applicant shall provide Grading Certification for all building (or structure) pads in conformance with the approved grading plan to the Engineering Services Department for review and approval prior to issuance of Building Permits. ENG 37. In cooperation with the California Agricultural Commissioner and the California Department of Food and Agriculture Red Imported Fire Ant Project, applicants for grading permits involving a grading plan and involving the export of soil will be required to present a clearance document from a Department of Food and Agriculture representative in the form of an approved “Notification of Intent To Move Soil From or Within Quarantined Areas of Orange, Riverside, and Los Angeles Counties” (Revised - RIFA Form CA-1) prior to approval of the Grading Plan (if required). WATER QUALITY MANAGEMENT PLAN ENG 38. This project shall be required to install measures in accordance with applicable National Pollution Discharge Elimination System (NPDES) Best Architectural Review Committee Resolution No. July 7, 2025 Sun Community Federal Credit Union Page 12 Management Practices (BMP’s) included as part of the NPDES Permit issued for the Whitewater River Region from the Colorado River Basin Regional Water Quality Control Board (RWQCB). The applicant is advised that installation of BMP’s, including mechanical or other means for pre-treating contaminated stormwater and non-stormwater runoff, shall be required. ENG 39. A Final Project-Specific Water Quality Management Plan (WQMP) shall be submitted to and approved by the City Engineer prior to issuance of approval of any grading plan. The WQMP shall address the implementation of operational Best Management Practices (BMP’s) necessary to accommodate nuisance water and storm water runoff from the site. Direct release of nuisance water to the adjacent property (or public streets) is prohibited. Construction of operational BMP’s shall be incorporated into the Precise Grading and Paving Plan. ENG 40. Prior to issuance of any grading or building permits, the property owner shall record a “Covenant and Agreement” with the County-Clerk Recorder or other instrument on a standardized form to inform future property owners of the requirement to implement and maintain the approved Final Project-Specific Water Quality Management Plan (WQMP). Other alternative instruments for requiring implementation of the approved Final Project-Specific WQMP include: requiring the implementation of the Final Project-Specific WQMP in Home Owners Association or Property Owner Association Covenants, Conditions, and Restrictions (CC&Rs); formation of Landscape, Lighting and Maintenance Districts, Assessment Districts or Community Service Areas responsible for implementing the Final Project- Specific WQMP; or equivalent. Alternative instruments must be approved by the City Engineer prior to issuance of any grading or building permits. DRAINAGE ENG 41. All stormwater runoff across the property shall be accepted and conveyed in a manner acceptable to the City Engineer and released to an approved drainage system. Stormwater runoff may not be released directly to the adjacent streets without first intercepting and treating with approved Best Management Practices (BMPs). ENG 42. All stormwater runoff passing through and falling onto the site shall be accepted and conveyed to a new drainage system to be constructed as part of the development. An on-site retention basin and other storm drainage facilities approved by the City Engineer shall be required. ENG 43. All stormwater runoff passing through the site shall be accepted and conveyed across the property in a manner acceptable to the City Engineer. For all stormwater runoff falling on the site, on-site retention or other facilities approved by the City Engineer shall be required to contain Architectural Review Committee Resolution No. July 7, 2025 Sun Community Federal Credit Union Page 13 the increased stormwater runoff generated by the development of the property. Provide a hydrology study to determine the volume of increased stormwater runoff due to development of the site, and to determine required stormwater runoff mitigation measures for the proposed development. Final retention basin sizing and other stormwater runoff mitigation measures shall be determined upon review and approval of the hydrology study by the City Engineer and may require redesign or changes to site configuration or layout consistent with the findings of the final hydrology study. No more than 40-50% of the street frontage parkway/setback areas should be designed as retention basins. On-site open space, in conjunction with dry wells and other subsurface solutions should be considered as alternatives to using landscaped parkways for on-site retention. ENG 44. The project is subject to flood control and drainage implementation fees. The acreage drainage fee at the present time is $10,961.65 per acre in accordance with Resolution No. 15189. Fees shall be paid prior to issuance of a building permit. GENERAL ENG 45. Any utility trenches or other excavations within existing asphalt concrete pavement of off-site streets required by the proposed development shall be backfilled and repaired in accordance with City of Palm Springs Standard Drawing No. 115. ENG 46. All proposed utility lines shall be installed underground. ENG 47. All existing utilities shall be shown on the improvement plans if required for the project. The existing and proposed service laterals shall be shown from the main line to the property line. ENG 48. Upon approval of any improvement plan (if required) by the City Engineer, the improvement plan shall be provided to the City in digital format, consisting of a DWG (AutoCAD drawing filetype) and PDF (Adobe Acrobat document filetype) formats. Variation of the type and format of the digital data to be submitted to the City may be authorized, upon prior approval by the City Engineer. ENG 49. The original improvement plans prepared for the proposed development and approved by the City Engineer (if required) shall be documented with record drawing “as-built” information and returned to the Engineering Services Department prior to issuance of a final certificate of occupancy. Any modifications or changes to approved improvement plans shall be submitted to the City Engineer for approval prior to construction. Architectural Review Committee Resolution No. July 7, 2025 Sun Community Federal Credit Union Page 14 ENG 50. Nothing shall be constructed or planted in the corner cut-off area of any intersection or driveway which does or will exceed the height required to maintain an appropriate sight distance per City of Palm Springs Zoning Code Section 93.02.00, D. ENG 51. All proposed trees within the public right-of-way and within 10 feet of the public sidewalk and/or curb shall have City approved deep root barriers installed in accordance with City of Palm Springs Standard Drawing No. 904. MAP ENG 52. The existing parcels identified by Assessor’s Parcel Number (APN) 680- 072-013, 014, 019, 020, 021 and 022 shall be merged, or otherwise, a Lot Line Adjustment shall be perfected to relocate the property line common to the two parcels to comply with applicable planning and building codes related to the setback of any structures to the property line. An application for a Parcel Merger (or Lot Line Adjustment) shall be submitted to the Engineering Services Department for review and approval. A copy of a current title report and copies of record documents shall be submitted with the application. The application shall be submitted to and approved by the City Engineer prior to issuance of a building permit. TRAFFIC ENG 53. A minimum of 48 inches of clearance for accessibility shall be provided on public sidewalks. Minimum clearance on public sidewalks shall be provided by either an additional dedication of a sidewalk easement if necessary and widening of the sidewalk, or by the relocation of any obstructions within the public sidewalk along the frontage of the subject property. The site will take access from Calle Santa Cruz and Calle De Ricardo which will lead to 20 parking stalls. The site will contain landscaping around the perimeter of the property and around the building that will include on-site storm water retention. In addition, there will be a drive-up ATM machine located on the east side of the site that can accommodate vehicle queuing for up to seven vehicles. The proposed drive through ATM circulation and vehicle stacking is sufficient and will prevent congestion. The ATM will be housed in a shade structure with a 7.5 ft overhang to prevent heat and improve visibility of the screen. The Credit Union building will be positioned to face Ramon Road for adequate visibility to motorists and the police for safety. The proposed architecture will include glass, stucco, and longboard siding in soft earth tone colors. The architectural style will be contemporary/modern, utilizing varying roof heights, architectural projections, and a central architectural tower with exterior glazing fronting Ramon Road. The proposed building will use black window frames throughout the structure and will include a matching architectural trellis structure on the north façade fronting Ramon Road which will provide shade. The buildings’ modern style will facilitate a sense of openness and foster a comfortable setting for the Credit Union’s Members.
