Dear City Council,
I wanted to follow up on my earlier message regarding the request to allow construction at the
College of the Desert site to begin at 5:00 a.m.
In addition to the concerns I previously raised, I’d like to flag two important considerations:
First, approving this request could set a precedent that future projects across Palm Springs
may reference to justify similarly early start times. That opens the door to broader disruption
in other neighborhoods throughout the city, potentially impacting many more residents and
voters.
Second, I understand the proposal includes disabling the safety backup alarms on cement
trucks and using flag personnel instead. While this may reduce noise, it also raises real safety
concerns. If an accident were to occur—particularly one involving a worker—it could expose
the City to legal liability for approving a deviation from established safety protocols.
I strongly urge the City to weigh these broader implications when evaluating the request.

I just want to make one additional comment. Please add this to the email message I had sent
earlier.
While a 5 a.m. start is not reasonable, for ME personally (and I am not speaking for all
neighbors) the bigger issue is that the construction can go on for 14 hours a day! I would like
the City to set a reasonable end time (Like what I was told by Joshua Wolf the site supervisor)
for the work and noise to stop (he told me 1:30 p.m. with a 5 a.m. start) instead of going on
for 14 hours a day. This would be better for both the nearby residents and the C.W. Driver
workers toiling in the heat on this project. For me, a reasonable compromise would be a
summer workday limit of 6 a.m. to 3 p.m. or something comparable.

We have just recently received the letter from the City regarding the request for earlier work
hours for the C.W. Driver crew working on the Palm Springs COD campus. We are long -time
residents of Palm Springs (19 years) and live in the Sunrise Park neighborhood (in the Mayor's
District 3) in the area just to the west of the construction site. We have talked to several of our

neighbors in our immediate area and they are also concerned about this proposed change.
Several of them are also writing letters in opposition.
We strongly oppose this special request and ask that the City Council reject this proposal.
We believe that a 5:00 a.m. start time is unreasonable for those of us living right by the
construction site. The morning time is the only time in the summer when we can be outside
and enjoy some cooler weather in peace. The construction company can already work from 7
a.m. to 7 p.m. for half of our days. Letting them begin work at 5 a.m. would allow them to
disrupt our days for 14 hours a day. Allowing us only 10 hours a day to enjoy our homes free
of construction noise is too much to ask. We already have had a taste of the noise and
vibrations from the early stages of construction, which has had a negate impact on our quality
of life here.
This requested time change is in direct conflict of Palm Springs City Ordinance 8.04.220
"Limitation of hours of construction." (See attached file.) It states that an earlier start can be
allowed in the event of unusual circumstances. We have lived in the desert for 19 years and
know that summer heat is not an unusual circumstance here. This construction company
should have been aware of the heat here in the summer when they accepted the contract to
work in the desert.
Note: Noise from the construction site started at 6:40 this morning (July 2nd) when I was out
walking my dog before the heat. There has already been a violation of the time restrictions! I
walked to the COD site before 7 a.m. to find out why the noise was starting before 7 a.m. I
talked to Joshua Wolf who told me he was the supervisor at the site. He said the noise was
because of an early delivery. However, there was a large piece of equipment moving large
rocks or pieces of concrete around right behind a neighbor's home. A clear violation of even
the current agreed to start time! Is the City policing what is going on there and will they in the
future? Note also that Joshua did tell me that with a 5 a.m. start time, they would only work
for 8 hours, so construction would stop at 1:30 p.m. every day because of the heat. Is this
accurate? This is not indicated in the letter from the City.
I also have questions about who was notified of this request for their and was it done with
enough advance notice. Our part of the Sunrise Park neighborhood most impacted by this
requested change is directly to the west of the building site, and at least some of us received
the City's letter. However, were residents of the VIBE community, who are also directly
impacted as they are right across Farrell from the site, also notified? Also, there are three
large apartment buildings (Desert Crest, Airport Gardens, and Sage Courtyard) directly across
Tahquitz that will be impacted as well. Did all those residents receive letters? Given that your
letter on this matter is dated June 23 and the hearing about this at the July meeting of the City
Council is scheduled for Wednesday, July 9, this does not seem to allow sufficient time for

comments or concerns to be raised by all. And given that this change is to take place on July
10, the day after the City Council meeting, there appears to be a rush to push this forward
without taking into account the input and the impact that this will have on many residents in
this area of Palm Springs.
Again, we respectfully and urgently ask that this request for expanded and unreasonable work
hours by C.W. Driver be rejected by the City Council.

Hello - we are in receipt of your notice regarding the request from College of the Desert for
early construction hours. We live at 183 Blue Moon Dr, Palm Springs, CA 92262 which is
directly across Farrell Dr from the construction site.
Although we understand the request for early hours, we are not comfortable with just having a
C.W. Driver contact for noise issues.
Do you trust that C.W. Driver would really resolve these issues?
Who and how are they being monitored?
Are they required to send any reported issues to someone with the city?
The notice goes on to state that "Failure by CW Driver to adequately address noise complaints
during the extended hours may result in modification to these conditions or other actions
necessary to protect public welfare." Great.... but who is overseeing CW Driver and who will
make these modifications or other actions?

RE: College of the Desert Early Construction Work Hours Request
Dear Resident:
The City of Palm Springs City Council will consider a request by the C.W. Driver construction company to
perform early construction work at the College of the Desert campus site located at the southwest corner
of Tahquitz Canyon Way and Farrell Drive. The request will be heard by the City Council on July 9, 2025; the
meeting begins at 5:30 p.m. in the Council Chamber at City Hall, 3200 E. Tahquitz Canyon Way, Palm
Springs.
C.W. Driver has requested construction outside of normal construction hours as follows:
Weekdays Saturday Sundays & Holidays*
Standard Hours: 7:00 am to 7:00 pm 8:00 am to 5:00 pm Not permitted
Applicant Request: S.:OO am to 7:00 pm 8:00 am to 5:00 pm Not permitted
*New Years Day, Memorial Day, July 4th, Labor Day, Thanksgiving Day, Christmas Day
The primary purpose of the early start time request is to allow for the pouring of concrete during periods of
extreme heat between 07/10/25 and 09/20/25, and again between 05/01/26 and 09/30/26. Due to the fact
that early construction work may pose noise impacts to surrounding residents, the City would impose the
following conditions should the City Council approve the request:
• Concrete truck backup alarms will be disabled between the hours of 5:00 a.m. and 7:00 a.m.
Pursuant to California OSHA §1592, C.W. Driver must employ a live flagger/spotter in clear view of
the operator to direct backing operations during those hours, and may also use white noise backup
alarms.
• The following activities will be prohibited during the hours of 5:00 a.m. and 7:00 a.m.: Operating
power tools and generators, demolition activities, heavy equipment operation (other than activities
directly related to concrete pouring), hammering, loudspeaker usage, running of air compressors,
and similar activities that produce excessive noise.
• C.W. Driver shall be required to have a staff member on call between the hours of 5:00 am and 7:00
am to respond to and resolve noise complaints. Any complaints regarding excessive noise between
the hours of 5:00 am and 7:00 am may be directed to the following staff member of C.W. Driver:
Richard Thurman, (626) 946-9068.
Failure by C.W. Driver to adequately address noise complaints during the extended hours may result in
modification to these conditions or other actions necessary to protect public welfare.

I have lived at 2580 E Tahquitz Canyon, Apt 312, for eight years but all this noise, dirt and dust
is making me sick. I am being forced to move for my health and peace of mind. I work
afternoon and nights and cannot hear my client’s a lot of the time. Please don’t allow them to
ruin my sleep and peace of mind anymore then I must deal with now. Please do not allow them
to work any earlier.
