AN ORDINANCE OF THE CITY OF PALM SPRINGS,
CALIFORNIA, APPROVING CASE COZ-2024-0001,
CHANGE OF ZONE, TO AMEND THE CURRENT ZONE
DESIGNATION OF 'PROFESSIONAL' (P) TO
'SERVICE/MANUFACTURING' (M-1) FOR A PROPOSED
NEW 2,895-SF BANK AND AN AUXILIARY DRIVE-THRU
FACILITY AT A 1.08-ACRE UNDEVELOPED SITE LOCATED
AT THE SOUTHEAST CORNER OF EAST RAMON ROAD
AND SOUTH CALLE SANTA CRUZ, ZONE P, SECTION 19.
City_Attorney's Summary
This Ordinance amends the zoning designation of property
located at the southeast corner of E. Ramon Road and S. Calle
Santa Cruz from "Professional" (P) to "Service/Manufacturing"
(M-1) for the construction of a bank and auxiliary drive-thru
facility.
WHEREAS, Sun Community Federal Credit Union, (the "Applicant") has filed COZ-
2024-0001 (Change of Zone), CUP-2024-0009 (Conditional Use Permit), DP-2024-0005
(Major Development Permit), AR-2024-0054 (Architectural Review), and AMM-2024-0056
(Administrative Minor Modifications) applications in accordance with Sections 94.07.00
(Change of Zone), 94.02.00 (Conditional Use Permit), 94.04.01 (Development Permit),
94.04.00 (Architectural Review), and 94.06.01 (Administrative Minor Modifications) and of
the Palm Springs Zoning Code for the construction of a 2,895-SF bank and auxiliary drive-
thru facility at a 1.08-acre undeveloped site located at the southeast corner of East Ramon
Road and South Calle Santa Cruz, Zone P; and
WHEREAS, the Applicant has requested a Change of Zone to change the site's
current 'Professional' (P) zoning designation to 'Service/Manufacturing' (M-1); and
WHEREAS, the Applicant has requested Major Development Permit, Conditional
Use Permit, and Administrative Minor Modifications approval for the construction of a new
2,895-SF bank with a reduced yard setback of 22.6 feet instead of the code -required 25
feet along the East Ramon Road frontage, in addition to an auxiliary drive-thru facility; and
WHEREAS, the approval authority of the Administrative Minor Modifications
application is the Director of Planning Services, and the application is excluded from the
purview of the Planning Commission's review; and
WHEREAS, on April 22, 2025, a public hearing to consider Cases COZ-2024-0001,
CUP-2024-0009, and DP-2024-0005 was held by the Planning Commission in accordance

with applicable law; the Planning Commission voted unanimously to approve CUP-2024-
0009 and DP-2024-0005 subject to conditions of approval and recommended approval of
COZ-2024-0001 to the City Council; and 0
WHEREAS, the proposed project is considered a "project" pursuant to the terms of
the California Environmental Quality Act ("CEQA"), and an Initial Study/Mitigated Negative
Declaration (IS/MND) has been prepared for this project and has been distributed for
public review and comment in accordance with CEQA; and
WHEREAS, on May 28, 2025, the City Council held a duly noticed public hearing
on the Project in accordance with applicable law. The City Council carefully reviewed and
considered all of the evidence presented in connection with the hearing on the Project,
including but not limited to the staff report, all environmental data including the IS/MND
prepared for the project and all written and oral testimony presented, and found the
IS/MND to be in compliance with CEQA and found that any potentially significant
environmental impacts outlined in the report will be adequately mitigated to less than
significant levels; and
WHEREAS, at the conclusion of the May 28, 2025 public hearing, the City Council
introduced and waived further reading of this Ordinance adopting the final MND and to
change the current zoning designation of the subject property from 'Professional' (P) to
'Service/Manufacturing' (M-1).
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY ORDAIN
AS FOLLOWS:
SECTION 1. That the recitals reflected above are true and correct, and are
incorporated by this reference herein as the cause and foundation for the action taken by
and through this Ordinance.
SECTION 2. That the conditions required to approve a change of zone, as
established by Zoning Code Section 94.07.00(A) have been met, as follows:
The proposed change of zone is in conformity with the general plan map and report.
The site's General Plan land use designation is O (Office), which is intended for the
development of professional offices, office operation -related retail uses, and hotels
as a part of a business or corporate park (Palm Springs 2024 General Plan, page
2-16). The Service/Manufacturing (M-1) Zone is "...intended to provide for the
development of service industries for commercial and hotel uses..." (PSZC Section
92.17.00.A). Since the M-1 Zone is intended to provide services that support
commercial activities and the operation of professional offices is generally
associated with commercial services, the proposed Change of Zone is in conformity
with the General Plan.
2. The subject property is suitable for the uses permitted in the proposed zone, in

terms of access, size of parcel, relationship to similar or related uses, and other
considerations deemed relevant by the commission and council.
In the M-1 Zone, a variety of service and manufacturing -related activities are
permitted. The site meets the minimum lot size requirement of the M-1 Zone, and
the site is easily accessible from two major thoroughfares, a collector street, and a
local street. Due to its proximity to the streets, the site has logistical advantage to
support the service and manufacturing uses that are permitted in the zone. The
abutting parcels to the east are City -owned parcels that are currently vacant, and
the north side of East Ramon Road are City -owned parcels that are a part of the
airport. The site is closely located to other parcels that are zoned M-1, and a mix
of uses that are permitted in the M-1 Zone and the General Plan O (Office) land
use designation area is observed in the site's vicinity. Therefore, it is suitable for
the uses that are permitted in the zone.
3. The proposed change of zone is necessary and proper at this time and is not likely
to be detrimental to the adjacent property or residents.
The M-1 Zone allows more diversified land uses compared to the P Zone.
Therefore, the proposed M-1 Zone designation is desirable for the site which is
located in the P and M-1 Zone transitional area and has been undeveloped for
years. The Change of Zone will expand the viability of the site in terms of its
development potential by providing new and additional opportunities. The site is
adjacent to professional office uses on its west and south sides. While a variety of
land uses are allowed in the M-1 Zone, the site's O (Office) General Plan land use
designation will encourage service -oriented uses, rather than manufacturing or
lighting industrial uses, which would be more compatible with the existing land uses
within the immediate surroundings.
SECTION 3. That the zoning amendment is hereby approved subject to conditions
of approval attached as Exhibit "A"
SECTION 4. That following independent review and analysis, the Mitigated
Negative Declaration (MND) has been completed in compliance with CEQA, the State
CEQA Guidelines, and the City's CEQA Guidelines and that, with the incorporation of
mitigation measures, the implementation of the project will have a less than significant
impact on the environment.
SECTION 5. Pursuant to California Law, this Ordinance was introduced at first
reading on May 28, 2025 and adopted following second reading on June 11, 2025 for the
approval of Case COZ-2024-0001 Change of Zone and the Mitigated Negative
Declaration.
SECTION 6. The Mayor shall sign and the City Clerk shall certify to the passage
and adoption of this Ordinance and shall cause the same, or the summary thereof, to be

published and posted pursuant to the provisions of law and this Ordinance shall take effect
thirty (30) days after passage. 0
