HomeMy WebLinkAbout2110ORDINANCE NO. 2110 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, AMENDING SECTION 2.29.010 OF THE PALM SPRINGS MUNICIPAL CODE TO EXPAND THE PLANNING COMMISSION TO EIGHT MEMBERS, SEVEN VOTING MEMBERS AND ONE NON -VOTING MEMBER. City Attorney's Summary This ordinance expands the City's Planning Commission from seven to eight members. WHEREAS, the City of Palm Springs ("City") is a charter city organized pursuant to Article XI, Section 5 of the California Constitution and pursuant to the authority so granted, the City has the power to make and enforce within its limits all ordinances and regulations with respect to municipal affairs not in conflict with its own charter. WHEREAS, Chapter 2.29 of the Palm Springs Municipal Code establishes the Planning Commission and the number of members the commission shall consist of. WHEREAS, expanding the membership of the Planning Commission from seven to eight members, seven voting members and one non -voting member, will provide the necessary support and resources to effectively manage and implement the growing number of planning projects and developments within the City; and WHEREAS, the non -voting member of the commission shall be limited to one three-year term, which shall not count towards City term limits. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Findings. That the findings and determinations reflected above are true and correct, and are incorporated by this reference herein as the cause and foundation for the action taken by the and through this Ordinance. SECTION 2. Amendment of Palm Springs Municipal Code Section 2.29.010. Section 2.29.010 of the Palm Springs Municipal Code is hereby amended to read as follows: "2.29.010 Created. Pursuant to Section 65100 et seq. of the California Planning and Zoning Law, there has been and hereby is established for the city a planning agency, consisting of a planning department, a planning commission, and the city council acting in combination. The planning commission consists and shall consist of sin eight Ordinance No. 2110 Page 2 members, seven voting members and one non-votinq member, serving without compensation, and appointed in the manner and for the terms prescribed in Sections 2.04.060 and 2.06.010 respectively, of this code. The eighth non -voting member shall not be counted toward quorum requirements nor toward required vote counts, and is limited to one, three-year term which does not_ count towards City term limits prescribed in Title 2 of this code. The eighth non -voting member shall not have the opportunity for reappointment as a non -voting member, nor will appointment as a non- voting member guarantee appointment as a full member of the planning commission. I -The Planning Commission shall have the powers, functions and duties prescribed in the Planning and Zoning Law and in the Palm Springs zoning ordinance and in this code and other local ordinances, provided that it shall not exercise any direct contracting authority as specified in Section 65007 of the planning and zoning law. SECTION 3. Compliance with California Environmental Quality Act. The City Council finds that this Ordinance is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the State CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Further, if the activity is deemed a project this City Council finds that this Ordinance is exempt pursuant to Section 15061(b)(3) of the State CEQA Guidelines, as it can be seen with certainty that there is no possibility that this Ordinance may have a significant effect on the environment. SECTION 4. Severability. If any section, sentence, clause or phrase of this Ordinance or the application thereof to any entity, person or circumstance is held for any reason to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect other provisions or applications of this Ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are severable. The City Council of the City of Palm Springs hereby declares that it would have adopted this Ordinance and each section, sentence, clause or phrase thereof, irrespective of the fact that any one or more section, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. SECTION 5. Effective Date.
