HomeMy WebLinkAboutItem 3A - Attach B_ARC Draft Reso PDD-2024-0007 WPG 25 dus 6-16-25RESOLUTION NO. ____ A RESOLUTION OF THE ARCHITECTURAL REVIEW COMMITTEE OF THE CITY OF PALM SPRINGS, CALIFORNIA, FINDING THE PROPOSED FINAL DEVELOPMENT PLANS FOR 25 SINGLE-FAMILY RESIDENTIAL UNITS TO BE BUILT ON 60-FOOT WIDE LOTS BY WOODBRIDGE PACIFIC GROUP, LLC, WITHIN PHASE 2 OF THE MIRALON DEVELOPMENT, TO BE IN SUBSTANTIAL CONFORMANCE WITH THE PREVIOUSLY APPROVED PRELIMINARY PLANNED DEVELOPMENT AS AMENDED ON NOVEMBER 2, 2016, THE MIRALON DESIGN GUIDELINES AND THE MIRALON VISION BOOK (CASE PDD-2024-0007 / 5.0982 – PDD 290 / TM 31848). WHEREAS, Woodbridge Pacific Group, LLC, (“Applicant”) filed a Final Planned Development District application with the City pursuant to Section 94.03.00(C)(7) of the City of Palm Springs Zoning Code to construct twenty-five (25) single-family residential homes on 60-foot-wide lots within Phase 2 of the Miralon development; and WHEREAS, on May 5, 2004, the City Council certified a Mitigated Negative Declaration (“MND”); and approved Case 5.0982 – Preliminary PD 290 / Tentative Tract Map 31848 for the development of 1,150 residential units on roughly 309-acres on the north side of Palm Springs (known as “Palm Springs Village”, aka “Avalon”, aka “Miralon”); and WHEREAS, on February 16, 2008, the final Tract Map (31848) for the project was recorded; and WHEREAS, on November 2, 2016, the City Council recertified the MND, a CEQA Addendum and approved an amendment to Case 5.0982 PD-290; and WHEREAS, On April 8, 2025, the Planning Commission held a public meeting to consider whether the Final Development Plans for Case PDD-2024-0007 / 5.0982 – PDD 290 / TM 31848 were in substantial conformance with the preliminary PD 290, (Case 5.0982), the Miralon Design Guidelines and the Miralin Vision Book; and WHEREAS, Palm Springs Zoning Code Section 94.03.00(F) – Criteria and Findings, requires that the Planning Commission shall not approve a final development plan unless certain findings are affirmatively made; and WHEREAS, at said meeting the Planning Commission carefully reviewed and considered all the evidence presented in connection with the meeting on the project, including but not limited to the staff report, and all written and oral testimony presented and voted to approve the project subject to conditions and referred the matter to a subcommittee comprised of one Planning Commissioner and two members of the Architectural Review Committee to work with the applicant to bring the architecture of the proposed homes into conformance with Conditions ARC 1 through ARC 14, prior to consideration of the project by the Architectural Review Committee; and Architectural Review Committee Resolution No. ____ June 16, 2025 PDD-2024-0007 / 5.0982-PDD 290 Final PDD Plans for 25 homes in Miralon by Woodbridge Pacific Group, LLC Page 2 of 3 WHEREAS, on April 27, 2025 Planning Commissioner Morrill, ARC members O’Donnell and Walsh met with staff and the applicant to bring the architecture into conformance with the Conditions; and WHEREAS, on June 16, 2025 the Architectural Review Committee held a public meeting in accordance with applicable law to consider the application; and WHEREAS, at said meeting the ARC carefully reviewed and considered all the evidence presented related to the project, including but not limited to the staff report and all written and oral testimony presented. THE ARCHITECTURAL REVIEW COMMITTEE FINDS AND DETERMINES AS FOLLOWS: SECTION 1: ENVIRONMENTAL DETERMINATION At its meeting of April 8, 2025 the Planning Commission recertified the Mitigated Negative Declaration (“MND”) for the Miralon Project, finding that the current Final Development Plan for a portion of the Miralon project encompassing 25-lots and associated private streets, landscape and other improvements (Case PDD-2025-0007 / 5.0982 / PDD 290 / TM 31848) is in substantial conformance as conditioned with the Preliminary Planned Development District (Case 5.0982 / PDD 290 / TM31848) as amended on November 2, 2016 and will not result in any new or additional significant environmental impacts beyond those identified in the MND and Addendum. As such, no further environmental analysis is required for this Final Development Plan. SECTION 2: FINDINGS The Architectural Review Committee makes the following findings pursuant to PSZC Section 94.03.00(F) regarding consistency between the preliminary and final PD: 1. The final development plan is in substantial conformance with the preliminary development plan. The proposed final development plans are in substantial conformance with the originally approved preliminary development plans and the Miralon architectural and landscape design guidelines, with respect to use, density, design, style, materials, colors, and other development standards, as conditioned. The proposed 25 new homes will be constructed on 60-foot-wide lots that were previously created when the City Council approved Tract Map 31848 for the project in 2004. The site plan and the tract map layout will remain the same. The project conforms to this finding. 2. The final development plan is in substantial conformance with all other associated entitlements for the development; and Architectural Review Committee Resolution No. ____ June 16, 2025 PDD-2024-0007 / 5.0982-PDD 290 Final PDD Plans for 25 homes in Miralon by Woodbridge Pacific Group, LLC Page 3 of 3 The final development plans as conditioned are in substantial conformance in terms of the proposed residential use, density, design, style, materials, colors, and development standards of the Miralon architectural and landscape design guidelines as approved in the preliminary planned development district plans, as conditioned. The project conforms to this finding. 3. The final development plan incorporates all modifications and conditions to the preliminary development plan as approved by the City Council The proposed final development plan as conditioned, is in substantial conformance with the Preliminary Planned Development including conditions and development standards previously approved by the City Council, the Miralon Design Guidelines and the Miralon Vision Book. Therefore, the project conforms to this finding. NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the Architectural Review Committee approves Case PDD-2024-0007 / 5.0982 / PD 290; the final development plans for the proposed twenty-five single-family residential units to be built on 60-foot-wide lots within Phase 2 of the Miralon project by Woodbridge Pacific Group, LLC as being in substantial conformance with the preliminary planned development district as amended and approved by City Council on November 2, 2016, the Miralon Design Guideline and the Miralon Vision Book subject to conditions of approval in Exhibit “A”.
