HomeMy WebLinkAbout25312RESOLUTION NO. 25312 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ESTABLISHING A DISASTER OVERLAY ZONE, ADOPTING A FEE SCHEDULE FOR THE DISASTER OVERLAY ZONE AREA, AND ADOPTING AN EXPEDITED REVIEW PROCESS FOR CITY PERMITS AND APPLICATIONS RELATED TO RECOVERY AND RECONSTRUCTION EFFORTS. WHEREAS, on May 17, 2025, a bomb exploded outside the American Reproductive Centers fertility clinic at 1199 North Indian Canyon Drive in Palm Springs, California, resulting in the death of the suspected bomber and causing injuries to at least four other individuals; and WHEREAS, this terrorist attack caused significant damage to the clinic and nearby properties, shattering windows and causing damage to buildings within a several blocks of the bombing site; and WHEREAS, property owners and business owners have suffered substantially from the property damage as a result of the bombing, impacting business operations and use of property; and WHEREAS, in an effort to assist in the reconstruction of the fertility clinic and rebuilding of all other businesses and properties damaged in the terrorist attack, the City Council wishes to expedite all required City permits and approvals necessary for the reestablishment of the affected businesses and properties; and WHEREAS, the City Council, in adopting this resolution is not levying any new fee or service charge or approving any increase in any existing fee or service charge, but instead is establishing an alternative amount for existing fees/service charges. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the foregoing recitals are true and correct and are incorporated herein by this reference. SECTION 2. Disaster Overlay Zone Boundaries. The Disaster Overlay Zone is hereby established encompassing all areas damaged in the terrorist attack, the boundaries of which are further depicted in Exhibit A. The Disaster Overlay Zone shall automatically sunset on November 30, 2025, unless otherwise extended by a resolution or motion of the City Council. SECTION 3. Disaster Overlay Zone Fee Schedule. A separate permit fee schedule is hereby established for the Disaster Overlay Zone, included as Exhibit B to this Resolution, which shall supersede the fees listed in the Comprehensive Fee Schedule as currently in place as to those properties/businesses within the Disaster Resolution No. 25312 Page 2 Overlay Zone for those permit applications are deemed completed while this Resolution is in effect. Where a conflict may arise between the Disaster Overlay Zone Fee Schedule and the Comprehensive Fee Schedule, the City Manager shall determine the applicable fee. The Disaster Overlay Zone Fee Schedule shall automatically sunset on November 30, 2025, unless otherwise extended by a resolution or motion of the City Council. SECTION 4. Building Permits. Any building permit application submitted for the repair or reconstruction of building damaged in the terrorist attack shall be expedited, with the first review completed within 3 to 5 City business days from the complete application submittal date. This initial review period may be extended by the Building Official where documentation or plans are needed to complete the review. The subsequent review period for any resubmitted documentation shall be similarly expedited. SECTION 5. Planning Entitlements. That any ministerial planning application such as a Land Use Permit, Certificate of Appropriateness, or similar application for the reestablishment or repair of any property or business impacted by the terrorist attack shall be expedited, with a decision on the application returned within 3 to 5 City business days from the complete application submittal date. This initial review period may be extended by the Planning Director where additional documentation or plans are needed to complete the review. The subsequent review period for any resubmitted documentation shall be similarly expedited. SECTION 6. Inspections. That any required Building Inspection or Fire Inspection shall be conducted within 24 hours of any submitted request for inspection for work conducted in the Disaster Overlay Zone under an approved permit. SECTION 7. Business Licenses. Any application for a new business license within the Disaster Overlay Zone or the relocation of business from the Disaster Overlay Zone shall be reviewed and issued within 2 City business days from the complete application submittal date. This review period may be extended by the Finance Director where additional documentation may be needed. SECTION 8. Severability. The provisions of this Resolution are severable. If any portion, section, subsection, paragraph, clause, sentence, phrase, work, or application of this Resolution is for any reason held to be invalid by a decision of any court of competent jurisdiction, that decision shall not affect the validity of the remaining portions of this Resolution. The City Council declares that it would have adopted this Resolution and each and every portion, section, subsection, paragraph, clause, sentence, phrase, word and application not declared invalid or unconstitutional without regard to whether any portion of this ordinance or application thereof would be subsequently declared invalid. SECTION 9. CEQA. This Resolution is statutorily and categorically exempt from the requirements of the California Environmental Quality Act (Public Resources Code, §§ 21000 et seq.)("CEQA") because it involves a adoption of a governmental funding mechanism, which is not subject to CEQA. (Kaufman & Broad -South Bay, Inc. v. Morgan Hill Unified School District, (1993) 9 Cal.App.4th 464). 0 Resolution No. 25312 Page 3 SECTION 10. Effective Date.
