A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, DETERMINING THAT
PUBLIC CONVENIENCE WOULD BE SERVED BY THE
ISSUANCE OF A TYPE 48 ALCOHOL LICENSE FOR A
COCKTAIL LOUNGE USE LOCATED AT 180 EAST PALM
CANYON WAY, ZONE C-1, GENERAL PLAN "TRC",
CENSUS TRACT #448.05, APN: 508-346-012) CASE PCN-
2-2025-0001.
WHEREAS, CRA Management, LLC submitted a request for a Resolution of Public
Convenience or Necessity ("PCN") to allow an additional Type 48 alcohol license to be
issued for a cocktail lounge use located at 180 East Palm Canyon Drive; and
WHEREAS, The State of California Business & Professions Code Section 23958.4
provides the regulatory framework for allowing a local governing body to approve the
issuance of an additional alcohol license in census tracts where there is an existing
"undue concentration" of alcohol licenses if it determines the public convenience or
necessity would be served by the issuance of the requested license; and
WHEREAS, based on the ABC's distribution method for alcohol licenses, the
maximum number of alcohol license in Census Tract 448.05, where the subject property
is located is one (1), however currently there are eighteen (18) active alcohol licenses in
this census tract and thus, an "undue concentration" of alcohol licenses exists in this
census tract; and;
WHEREAS, on September 14, 2022, at a noticed public meeting, the Planning
Commission approved Case 5.1561 CUP (Planning Commission Resolution #6923),
approving the cocktail lounge use at the subject location; and
WHEREAS, on May 28, 2025, the City Council held a public meeting that was
noticed in accordance with applicable law. At said meeting the City Council considered
Case PCN-2025-0001 including the staff report and all oral and written testimony; and
WHEREAS, based upon the findings established by the Planning Commission in
Resolution 6923 which is attached to this resolution as Exhibit "A", the City Council has
determined that a cocktail lounge at this location is desirable and that the public
convenience would be served by the issuance of a Type 48 alcohol license at that
establishment.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS
FOLLOWS:
SECTION 1. That the foregoing Recitals are true and correct and are incorporated
herein by this reference.

SECTION 2. That the public convenience would be served by the issuance of a
Type 48 alcohol license for the cocktail lounge located at 180 East Palm Canyon Drive,
(Census Tract 448.05) subject to the conditions of approval outlined in Exhibit "A" of
Planning Commission Resolution #6923.
