Sunrise Way, Unit 203, Palm Springs STAFF ANALYSIS: The owner for the property located at 400 N. Sunrise Way, Unit 203, Palm Springs did not hold a Vacation Rental Registration Certificate by the City of Palm Springs as of the date of violation on May 2, 2025. Staff has determined that the owner has, without a Registration Certificate, advertised and operated the property at 400 N. Sunrise Way, Unit 203, as a Vacation Rental from elements as follows in violation of Palm Springs Municipal Code 5.25.040 (a): 1. Advertisement Airbnb.com/rooms/1397243952822632423 listed as “Downtown Palm Springs 1/1 Condo” ATTACHMENT 5 2. Advertisement Airbnb.com/rooms/1397243952822632423 did not state a minimum night stay. ATTACHMENT 5 3. Advertisement Airbnb.com/rooms/1397243952822632423 calendar lists 3 reviews. ATTACHMENT 5 4. A Code Compliance Officer submitted an online booking inquiry to stay during the dates May 16, 2025, through May 18, 2025, (2-nights); ATTACHMENT 6 5. A response was received by the Code Compliance Officer confirming availability for the dates May 16, 2025, through May 18, 2025, (2-nights); ATTACHMENT 6 Staff finds that the advertisement found on Airbnb.com/rooms/1397243952822632423 and inquiry affirmation for the dates May 16, 2025 through May 18, 2025, (2-nights) for stay at property 400 N. Sunrise Way, Unit 203, is in violation of §5.25.040(a) and proceeded to issue Administrative Citation AB0767, in the amount of $5,000, to Christopher Allen White, the owner on title, for operating a Vacation Rental without a Vacation Rental Registration Certificate. The Administrative Citation was mailed by the Department of Special Program Compliance staff to the mailing address on title. The following Palm Springs Municipal Codes sections and Regulations are applicable to this matter. The Palm Springs Municipal Code §5.25.030 Definitions, reads as follows: "Vacation Rental" means a single-family dwelling, or any portion thereof, utilized for occupancy for dwelling, lodging, or sleeping purposes without the Owner being present for a period of twenty-eight (28) consecutive days or less,…” "Vacation rental registration certificate" or "registration certificate" means the annual permit and/or a registration for a vacation rental or a homeshare interest issued by the city pursuant to this chapter. Sunrise Way, Unit 203, Palm Springs Palm Springs Municipal Code §5.25.040(a) reads as follows: The operation of a Vacation Rental or a Homeshare Interest without a Vacation Rental Registration Certificate is prohibited. Palm Springs Municipal Code §5.25.090(c) reads as follows regarding the administrative fine: (c) Any person who operates a Vacation Rental without a Vacation Registration Certificate, shall be liable to the City for the payment of transient occupancy tax pursuant to the provisions of the Palm Springs Municipal Code Chapter 3.24, including without limitation penalties and interest, payment of an administrative fine in the amount of Five Thousand Dollars ($5,000.00), and permanent ineligibility to operate a Vacation Rental in the City…” Administrative Regulation “Operation of a Vacation Rental” dated 07/2017 defining “Operation” of a Vacation Rental to include the following: 1. “Advertisement” of the property means on any web-based advertising, hosting platform, print media, bulletin, signage, radio, and television or on any other medium for the purposes of promoting interest in, testing the market for, or soliciting the occupancy of a property for a period of twenty-eight (28) consecutive days or less. 2. An owner, agent or other representative of the owner has an interest in rental, exchange, trade, gift, or grant of a guest stay at a property of less than twenty-eight (28) consecutive days or less. 3. Grounds of the Appeal Response I am appealing Administrative Citation #A80767 based on the grounds that I did not give my approval to have my residence, that I live in part-time, to be listed on Airbnb and was unaware that this had happened. The Airbnb account and listing was created by a friend; not me. I did not have any access to this account until after May 5th. From February 15, 2025 -April 30, 2025, I was residing in Bangkok, Thailand. I did not return to Palm Springs until May 5th, 2025. My condo was listed on Airbnb in April 2025. Prior to leaving for my trip, I had moved all my personal belongings to storage, in preparation of putting my condo on the market to sell when I returned. Many family members and friends tried talking me out of selling my condo and convinced me that I should find a long term renter instead. After much hesitation, I asked a friend if they could help me find a renter to rent it for 6 months to a year, while I was in Thailand. I only wanted one renter. I was not doing this to make a profit but to retain ownership of my property that my family said was a good investment due to its location and condition. I also was hoping for a long term renter as it would also allow me to stay in Thailand much longer, as I am not currently working. While in Thailand, I followed up with my friend in February, March and early April to see if he had found a renter. He did not. I said I was disappointed in that but all was good. I was only disappointed because it meant I would have to return to Palm Springs in May, and I couldn't stay in Thailand longer (but I didn't tell him that). Since I was returning in less than 4 weeks, I did not follow up again as I assumed there would be no point of finding a long term renter if I was coming back soon. Upon my return is when I found out my friend had listed my condo on Airbnb. · The explanation I was given is when he heard I was disappointed that it was not rented, he decided to go an alternate route and listed it on Airbnb without my knowledge or approval. He was only trying to help under good intentions. This is something he's never done before, and was unaware of the process of what the City requirements were. to be able to rent it out. Item 7 - Page 15 • When I found out that he had put my condo on Airbnb, I said that we needed to take the listing down as that is not what I agreed on doing. But there were reservations booked up to May 26th, so he didn't know if taking the listing down would affect those reservations and cause us to be fined by Airbnb for cancelling. He already received a fine for cancelling a reservation prior and I didn't want to receive more cancellation fines. So I said we will just delete the account after that May 26th reservation so no one can book anymore. My friend and I had no idea what the process was in listing my condo for a short term rental. If I wanted to list my condo on Airbnb, I ABSOLUTELY would have went through the proper process of obtaining a certificate, and following all of the City's guidelines. I bought this condo in Oct 2022 and I use it as a part time residence, where I only live in it 6 months out of the year. For those 6 months I wasn't living in it, I could have easily used it as a short term rental to have an additional source of income, but I didn't because I don't like strangers in my personal space (which is also why I was hesitant to even rent it out for long term renter). So I never had any intention of doing this. I'm very sorry this happened, and me and my friend have learned a valuable lesson, and will never do this again. At my hearing, I will present to the board the following evidence: -My travel/lodging receipts showing I was in Thailand during the time my condo was listed on Airbnb -Communication between my friend and the person that was inquiring about the condo for the May 16-18 reservation, that is cited and referenced on my Citation, showing that I was not the one who listed and managed my condo on Airbnb Item 7 - Page 16 ; 3. Relief that I am seeking: I am asking the Board for leniency and to PLEASE revoke the $5,000 fine. I never had any intention of having a short term rental. But having to pay $5,000 for something I was unaware of happening, nor approved of, would cripple me as I am currently not working. I'm also ok if I am still ineligible of not having a short term in the future as I have no desire to do it. After what has transpired, I have made the decision to sell my condo, so if the ineligibility of a short term rental is based on the residence and not the individual, I ask the Board to PLEASE remove the ineligibility so the future owner has the option of using it as short term rental, if they wish. When the citation was received, someone helped me figure out how to remove the listing on Airbnb and cancel all the reservations. So the violation has been corrected.
