SUMMARY
An appeal of administrative citation AB0766 issued in the amount of $2,500 and the two-
year suspension of the Vacation Rental Registration Certificate #053484 for the property
located at 1569 E. Racquet Club Rd., Palm Springs, California.
RECOMMENDATION:
1) Open the Appeal Hearing and accept public testimony.
2) Adopt Resolution No. ______, A RESOLUTION OF THE ADMINISTRATIVE
APPEALS BOARD OF THE CITY OF PALM SPRINGS, CALIFORNIA, ON THE
APPEAL OF THE ADMINISTATIVE CITATION AB0766 AND ADMINISTRATIVE
DECISION OF A TWO-YEAR SUSPENSION OF THE VACATION RENTAL
REGISTRATION CERTIFICATE FOR THE PROPERTY LOCATED AT 1569 E.
RACQUET CLUB RD., PALM SPRINGS, CALIFORNIA.
Background
The property located at 1569 E. Racquet Club Rd., Palm Springs, California is a
registered Vacation Rental with Vacation Rental Registration Certificate #053484. The
start date was October 1, 2022. Vacation Rental Ordinance 1918 became in effect April
2017 and later amended and restated in November 2022 with Ordinance 2075. The
previous and current Vacation Rental Ordinance details rules that guests renting a
Vacation Rental for a period of 28 consecutive days or less must follow; Regulations that
owners must follow relating to each stay that is 28 consecutive days or less and that upon
the third violation in any twelve-month period, the City Manager shall suspend the
Vacation Registration Certificate for two (2) years.

Vacation Rental Appeal – 3187 Ventura Rd., Palm Springs
Palm Springs Municipal Code (PSMC) chapter 5.25 section 070(g) states that
notwithstanding the provisions of Section 11.74.043, any radio receiver, musical
instrument, phonograph, loudspeaker, sound amplifier, or any machine or device for the
producing or reproducing of any sound shall be conducted within a fully enclosed vacation
rental unit and shall not be audible at the property line of the vacation rental.
PSMC chapter 5.25 section 070(h) states that a summary or abstract of the written
contract, in a form approved by the enforcement official, shall be filed with the
enforcement official prior to each applicable occupancy, in a manner approved by the
enforcement official, and shall be posted in a conspicuous location on the vacation rental
property and shall be made available on site at the request of an enforcement official.
PSMC chapter 5.25 section 090(b) states that upon the third violation in any twelve-month
period, the city manager shall suspend the vacation registration certificate for two years.
Administrative Regulation dated August 2017, states under procedure A(3) that appeals
of the third administrative citation and the suspension of the Vacation Rental Registration
Certificate will be heard by the Administrative Appeals Board according to PSMC Chapter
2.50.
STAFF ANALYSIS
First Citation – A7861 – June 28, 2024
On June 28, 2024, the City of Palm Springs Code Compliance Division responded to a
complaint received from the city’s Vacation Rental Hotline regarding music at the
Vacation Rental property located at 1569 E. Racquet Club Rd. Code Officer Ingram
arrived at the property at 10:06 PM and observed music audible at the property line.
Citation A7861 was issued for violation of PSMC 5.25.070(g). The officer report is
included as ATTACHMENT 4. The citation was paid in full on July 2, 2024. There was an
appeal heard by an independent hearing officer on August 21, 2024, and the violation
was upheld:
Reviewer - SO. Violation Upheld. Violator must respond by
9/6/2024. Phone hearing held. Present from the City was CE Ofc
Ingram. The Appellant was also present. Ofc Ingram testified that
he received a noise complaint at the Appellant property. Upon
arriving he contacted the complaining party. Ofc Ingram was invited
into the r/p`s back yard. Once there he could clearly hear music
coming from the neighboring property. Ofc Ingram then made
contact with the Appellant at the front door of that property. He
explained the reason for his visit and discussed the noise
complaint. The Appellant was issued the citation and Ofc Ingram
left the property. Appellant testified that she and her family were at
the property. There is an outside patio area near the pool which
also has a TV mounted outside. Appellant said they were just at
the patio listening to videos on the TV. They were not using any

speakers to amplify the sound, just listening to the TV. If the
ordinance is that strict the owner of the property should not have a
TV outside. Based on the testimony it if clear Ofc Ingram could hear
noise coming from the TV past the property line while in the r/p`s
rear yard. The citation is UPHELD.
Findings:
Music audible at the property line of the Vacation Rental.
Second Citation – A8977 – April 19, 2025
On April 19, 2025, the City of Palm Springs Code Compliance Division responded to a
complaint received from the city’s Vacation Rental Hotline regarding music at the
Vacation Rental property located at 1569 E. Racquet Club Rd. Code Officers Guerrero
and Gonzalez arrived at the property at 10:28 PM and observed music audible at the
property line. Citation A8977 was issued for violation of PSMC 5.25.070(g). The officer
report is included as ATTACHMENT 5. The citation was paid in full May 2, 2025. An
appeal has been received and is scheduled for June 19, 2025. This appeal will be heard
by an independent hearing officer.
Findings:
Music audible at the property line of the Vacation Rental.
Third Citation – AB0766 – February 22, 2025
On April 19, 2025, the City of Palm Springs Code Compliance Division responded to a
complaint received from the city’s Vacation Rental Hotline, regarding music at the
Vacation Rental property located at 1569 E. Racquet Club Rd. Code Officers Guerrero
and Gonzalez confirmed a violation occurred and that short-term rental activity occurred
but a contract summary was not submitted to the Enforcement Official prior to occupancy.
The officer report is included as ATTACHMENT 6.
During the investigation, Code Compliance found that a guest stay occurred at the
property for the dates April 18, 2025, through April 21, 2025. A review of the contract
summary tool at the time did not show a contract summary submitted for the above stay:

Citation AB0766 was issued for violation of PSMC 5.25.070(h)
Findings:
No contract summary was submitted for a short-term guest stay for the dates April
18, 2025, through April 21, 2025
Pursuant to PSMC 5.25.090(b), “Upon the third violation in any twelve-month period, the
City Manager shall suspend the Vacation Registration Certificate for two (2) years”.
Pursuant to Administrative Regulation dated 8/2017, appeals of the third administrative
citation and the suspension of the Vacation Rental Registration Certificate will be
heard by the Administrative Appeals Board according to PSMC Chapter 2.50.
Based on the three (3) administrative citations issued in a twelve-month period, a
suspension of the Vacation Rental Registration Certificate pending the decision of the
Administrative Appeals Board hearing.

Furthermore, the appeal received was related to citation AB0766 with respect to the
$2,500 fine and the six-month suspension. This appeal was received before a notice of
suspension was issued. After staff review, AB0766 was the third citation issued thus a
two-year suspension being heard. A notice of suspension has not been issued as of the
date of this hearing due to two appeals in process. The following out comes can apply:
Citation A8977 is upheld by the independent hearing officer and AB0766 is upheld
by the Administrative Appeals Board, resulting in the two-year suspension
Citation A8977 is overturned by the independent hearing officer and AB0766 is
upheld by the Administrative Appeals Board resulting in a six-month suspension.
Citation A8977 is upheld by the independent hearing officer and AB0766 is
overturned by the Administrative Appeals Board, resulting in no suspension.
Citation A8977 is overturned by the independent hearing officer and AB0766 is
overturned by the Administrative Appeals Board, resulting in no suspension.
The following Palm Springs Municipal Code sections and Regulations are applicable to
this matter.
The Palm Springs Municipal Code, Vacation Rentals §5.25.070 – Operational
Requirements and Standard Conditions:
(g) Notwithstanding the provisions of Section 11.74.043, any radio receiver,
musical instrument, phonograph, loudspeaker, sound amplifier, or any
machine or device for the producing or reproducing of any sound shall be
conducted within a fully enclosed vacation rental unit and shall not be
audible at the property line of the vacation rental.

enforcement official, shall be filed with the enforcement official prior to each

A. Section 5.25.090(b) specifies, “Upon the third violation in any twelve
(12) month period, the City Manager shall suspend the Vacation Rental
Certificate for two (2) years.” Following is a clarification how violations are
counted.
1. Administrative citations for violations of Chapter 5.25 issued to the Vacation
Rental guest, Owner, or Owner’s agent prior to April 16, 2017, will count
towards the calculation of the three (3) violations in any twelve (12) month
period for suspending the Vacation Rental Certificate for such property in
accordance with Section 5.25.090(b).
2. There will be no suspension unless at least one (1) violation occurs under
new Ordinance No. 1918.
3. Appeals of the third administrative citation and the suspension of the
Vacation Rental Registration Certificate will be heard by the
Administrative Appeals Board according to PSMC Chapter 2.50.
Administrative Regulation “Authority for the Issuance of Administrative Citations”
dated 08/2017 reads as follows:
“Vacation Rental Enforcement Officials are hereby authorized to issue, an
Administrative Citation for the violation of the provision of Chapter 5.25 of the Palm
Springs Municipal Code without first complying with the pre-citation or courtesy notice
requirements contained in PSMC Section 1.06.030.”

Jurisdiction: This administrative hearing is conducted in accordance with Palm Springs
Municipal Code 2.50 which confers jurisdiction upon the Administrative Appeals Board.
WHEREAS the City investigated a complaint and found the property 1569 E.
Racquet Club Rd., Palm Springs, California to be in violation pursuant to Section
5.25.070(g) on June 28, 2024, and issued administrative citation A7861; and
WHEREAS the City investigated a complaint and found the property 1569 E.
Racquet Club Rd., Palm Springs, California to be in violation pursuant to Section
5.25.070(g) on April 19, 2025, and issued administrative citation A8977; and
WHEREAS the City investigated a complaint and found the property 1569 E.
Racquet Club Rd., Palm Springs, California to be in violation pursuant to Section
5.25.070(h) on April 19, 2025, and issued administrative citation AB0766; and
WHEREAS, upon the third violation in any twelve-month period, the City Manager
shall suspend the Vacation Registration Certificate for two (2) years; and
WHEREAS, Gal Simha, for the property located at 1569 E. Racquet Club Rd..,
Palm Springs, California filed an administrative appeal of administrative citation AB0766
and the administrative decision of a six-month suspension of the Vacation Rental
Registration Certificate with the City Clerk and paid the appeal fee; and
WHEREAS, pursuant to Administrative Regulation dated 8/2017, appeals of the
third administrative citation and the suspension of the Vacation Rental Registration
Certificate will be heard by the Administrative Appeals Board according to PSMC Chapter
2.50
WHEREAS the Administrative Appeals Board opened and conducted a duly
noticed Administrative Appeal Hearing on June 16, 2025; and
WHEREAS, the Administrative Appeals Board was presented evidence that Gal
Simha, owner of the property located at 1569 E. Racquet Club Rd., Palm Springs, is in
violation pursuant to Section 5.25.090 (b) of the Palm Springs Municipal Code; and

RE: 2. Specify the grounds of the appeal
I'm appealing on the grounds that this is my first offense to this city ordinance and I was experiencing
extreme family difficulties at the time. My youngest daughter was hospitalized on 03/25/205-
03/30/2025. I was physically with my daughter day in and day out in the hospital, I gave the
responsibility for the first time to my wife to complete on my behalf. As you may verify, I always file my
TOT Tax in a punctual manner every month. My wife had expressed to me that she had completed the
Contract summary on March 28,2025. Upon being questioned by the officer Gonzalez about the
Contract summary, I then questioned my wife who then proceeded to tell me that she had filed it to the
best of her knowledge. Upon further Investigation, I believe my wife may have incorrectly processed the
Contract Summary in the system as this was her first time using the website. I'm truly sorry for the
inconvenience this caused the city and I have implemented changes both on the property and my
procedures to prevent this from ever happening again.

At approximately 10:06 PM, I arrived at the property
located at 1569 E. Racquet Club Rd in response to a
vacation rental hotline music complaint. Upon arrival, I
immediately contacted the re porting party {RP), who
advised me to come to their house i;o I could witness the
music from their backyard. I made contact with the RP,
who directed me to their backyard . There, I was able to
hear music being played. Using the Shazam app, I
documented the song and artist to ve rify the music
violation. After confirming the violation, I called the local
contact on file, who was the property owner. I asked the
property owner to have the respons ible rente r come out
so I could address the music violation. The property
owner contacted the responsible renter, and I made
contact with the occupants at the front door. I informed
the responsible renter of the music complaint and
exp lai ned that I was able to hear music from the
reporting party's property. I asked the responsible renter
for their ID and notified him I would be issuing a c ItatIon
for music amplified beyond the property line. The
responsible renter presented their ID, and I issued citation
A7861. No further action was taken

Received report of a party from the VR hotline at 10:04
PM. No contract summary was on file for this stay. The
RP requested that we observe the violation from their
property. I arrived to the RP property which was directly
adjacent to 1569 E Racquet Club Rd at 10:28 PM with
Officer Grijalva and Officer Gonzalez and met with the RP.
They verified that they would provide us access to thei r
back yard to observe the violation and we followed him
into his back yard. I observed music being played on a
speaker from the back patio of 1569 E Racquet Club Rd
and was able to capture a Shazam of the song t itled; " La
Mejor Solucion by La Adictiva." I took three decibel
readings each two minutes apart from the adjacent
property and took photos. I arrived to the front of 1569 E
Racquet Club Rd to investigate if th i s property was owner
occupied. I called PSPD dispatch and ran plates for the
three vehicles in the driveway and took photos. None of
the vehicles owners matched the names of the owners of
the property. I then contacted the local contact, Ruth
Diaz, and asked if the property was owner occupied this
weekend. She stated that guests were on site for the
weekend and not the owners. I explained that no contract
summary was submitted for the stay and the guests were
observed playing music and being noisy beyond 10 PM . I
asked her to have the responsible guest who booked the
stay meet me in front of the property. A short while later
we did not see a guest come out so Officer Gonzalez and
I approached the door and knocked. A guest came out
and spoke with us and we introduced ourselves and the
reason for our presence. I asked for him to provide his
booking itinerary for his stay this weekend and he
showed me his Airbnb Booking itinerary on his cell phone
which I took a photo of. The stay was set at this property
for the dates of 4/18/25 until 4/21 /25. I asked if he
signed any city of Palm Springs rules and regulations
documents during his booking process with the owner of
the property/operator of the short term rental. He stated
that he just booked with Airbnb and didn't sign any other
paperwork except what was on Airbnb. I asked for his ID
and took a photo of this as well. We provided a good
neighbor brochure and explained that we were
conducting an investigation on the property and we were
able to hear music coming from the back yard. I showed
him a screenshot of the Shazam I captured playing from
the back yard. He stated that they were playing that song
very quietly on a phone and weren't being loud. I
explained that this is a citable offense and that we were
conducting an further investigation on the property for
this event. They seemed to be understanding of the
regulations we educated them on regarding quiet hours
and amplified sound. He stated that they would
immediately bring it inside for the night. We left the
property shortly after this conversation. I left the property
and wa-owner of the property, Gal
Simha, egarding the investigation. I
asked w y a contract summary was not submitted for
this guest stay. He stated that they completely forgot to

Music Beyond the Property Line. Local contact was
contacted at 11 :54 PM with our findings and action
taken. Further investigation will be conducted and a
citation will be issued for failure to submit a contract

You are hereby notified that a violation of Palm Springs Municipal Code Section 5.25.070(h) has been
determined to exist with respect to your ownership and use of the property referenced above. Accordingly,
you are receiving this Administrative Citation# AB0766. Pursuant to Section 5.25.090{d), you are ordered
to pay an administrative fine in the amount of two thousand five hundred dollars ($2,500.00). Further,
the Vacation Registration Certificate shall be suspended for a period of six (6) months for a first
offense.
Also, according to Section 5.25.090(d), a second violation arising from a failure to submit a contract
summary will result in an administrative fine in the amount of not less than five thousand dollars
($5,000.00) and a revocation of the owner's Vacation Registration Certificate.
Additional information concerning this violation is reflected below:
On Saturday, April 19, 2025, at approximately 10:28 PM, I, along with Code Officer Gonzalez and Code Officer
Grijalva, responded to an active nuisance complaint for this property in which a citation was ultimately issued to
the responsible renter who also confirmed that he had booked the property on Airbnb.com for a short-term stay.
Before responding to the property, a search via the city's recordkeeping database was performed to determine if a
contract summary submission was on file for this particular guest stay, and I was unable to locate any
submissions. During our response to the property, I received a phone call from the property owner, Gal Simha. at
11: 1 O PM in regards to our response to the property and the observed violations, in which Gal confirmed an active
short term stay at the property. During this conversation, I asked Gal why a contract summary was not submitted
for this short term stay, which he replied, stating that him and his wife, Erika Simha, must have forgot to submit the
contract summary and admitted full responsibility for the failure to submit their contract summary for the short term
stay. Upon return to my work desk, a thorough secondary investigation of the city's database was conducted, but
again I was unable to locate a contract summary submission for the active short term stay. Upon review of my
investigation on, a violation of Palm Springs Municipal Code Section 5.25.070 (H); Failure to Submit a Contract
Summary, was determined to exist.

The amount of fine is indicated on the front of the Administrative Citation.
The fine must be paid within fifteen (15} calendar days from the date the
citation is mailed. Payment can be made by credit/debit card on-line at
www.CitationProcessingCenter.com or by calling 1-800-969-6158.
Payments are also accepted in the form of a cashier's check, personal
check, or money order payable to the City of Palm Springs. Payment of the
fine does not excuse or discharge any responsibility and legal consequences
for continuation or reported occurrences of the violation(s). Write the citation

HOW TO APPEAL THIS CITATION
A responsible party receiving an administrative citation may appeal such
citation within fifteen (15} calendar days from the date the citation is mailed.
The provisions of Palm Springs Municipal Code Chapter 2.50 will apply to
appeals. An appeal must be filed in writing by using the applicable.
request for appeal form available from the City's website at
www.palmspringsca.gov OR www.psvacationrentalcompliance.com._lf you
choose to appeal this citation, payment of the administrative fine is
suspended pending a final decision by the Administrative Appeals Board.
However, you must pay the current appeal fee and submit the request for
appeal form to the Palm Springs Office of the City Clerk no later than fifteen
(15) calendar days from the date the citation is mailed. PAYMENT OF THE
ADMINISTRATIVE FINE MUST BE SENT TO THE CITY'S CITATION
PROCESSING CENTER IN NEWPORT BEACH SPECIFIED ABOVE. THE
APPEAL FEE AND REQUEST FOR APPEAL FORM MUST BE SENT TO
THE PALM SPRINGS OFFICE OF THE CITY CLERK. For questions,

FAILURE TO ANSWER OR PAY PENALTY FOR VIOLATION(S)
Failure to pay the penalty or contest the citation within fifteen (15)
calendar days may result in additional administrative fines and the
recordation of a special lien against your property. In addition,
notification may be made to the State of California Franchise Tax
Board.
Palm Springs Municipal Code provides for the issuance of
administrative citations for Municipal Code Violations. Fines are
cumulative and citations may be issued each day the violation exists.
Each and every day a violation is unadd ressed constitutes a separate
and distinct offense and shall be subject to citation.

Erika 's place was perfect for a much needed girls trip! Everyone commented on the comfy beds and the pool/hot tub
was amazing! Our NC stopped working out of nowhere, but Erika was quick to find a solution along with her cohost. We
appreciated the quick response and would definitely stay here again!

The home was well stocked and very comfortable with a great outdoor space. Erika responded quickly to all of my
questions. It is close to the airport, so lots of planes flying over. We paid to have the poo l heated -so g lad we did as the
air temperatures were unseasonably cool. Th e only compla ints we had were that the jacuzzi would not heat past 101
degrees and we were not told about when workers (pool guy, gardeners, and someone moving trash bin s to and from
the stre et) wou ld be showing up.

There is some road noise if this is a concern. It didn't bother us and we wou ld definitely book again.

We enjoyed our girls trip to Erika's house -it was exactly what we needed.
The house was clean and comfortable. The kitchen was stocked with any items we needed. We also loved that pool
floaties were available.
The destination is great, within 10 minutes from anything we needed in Palm Springs.
Would recommend!

Overall , my family and I had a lovely experience. There home was beautiful and clean. Communication was great.
Location was great. House had everything we needed. The only negative is that the pool heater was broken when we
arrived so we were unable to go in the pool/spa the first two/three days because it was too co ld. They had a technician
come to fix it and reimbursed us the daily heating cost for those days. However even once fi xed, the pool heater was
strong enough to heat the spa well or heat the pool well but it could not do both well simultaneously. We were really
looking forward to our baby enjoying the pool but it was often too cold for him.
