I would like to start of this communication by acknowledging the staff at The Juice in Palm Springs.
Unfortunately a 69 year old elderly local customer Linda Paulding became sick last week at your outflt.
Although Linda was able to drive to the Juice which is only a few miles from her home with no issues. For
whatever reason she started to become ill immediately at The Juice. According to Linda the staff was very
nice and another customer gave her a ride home. For now the reason why Linda became sick at The Juice is
unknown. Linda was hospitalized at The Nearby Eisenhower Health Facility last Friday morning. The timeline
for her 911 call and medical emergency was less than 12 hours after departing Juice Bar. Sadly Linda’s vehicle
was towed by Dave’s Tow Service last Friday the same day she was admitted to Eisenhower.
Over the past 6 days Linda’s health has continued to be substandard. She has no projected day for release
from Premiere Care Center where Eisenhower transferred her last week. The manager of Dave’s Tow Service
informed me that he has been an employee for over 30 years. Nevertheless he also shared even with Linda’s
drastic chain of events that started at The Juice. He was unable to release Ms. Paulding’s 2017 Hyundai
Accent for less than the $880 currently owed. The Dave’s Towing Manager also indicated there would be a $90
per day charge for every day going forward.
In spite of my overwhelming effort to explain Linda having no family in California, being elderly and
hospitalized. The gentlemen with Dave’s Towing informed me that he has several vehicles in his possession
owned by local elderly people with health issues. He also acknowledged like Linda these Seniors could not
afford to regain there cars because of expensive fees added daily. Let me be clear Linda takes full
responsibility for having to leave her vehicle which may have saved her life! Her decision to not drive may
have also saved The Juice some liability due to the location of her decline. Dave’s Towing alerted me that The
Juice recommended Linda’s vehicle for towing knowing her situation.
Hearing this very questionable course of action was taken so quickly could be perceived as elderly abuse.
These actions could also represent possible flnancial fraud and exploitation of the elderly from Dave’s Towing
and The Juice Ownership. Linda can pay only $250 to Dave’s Towing in effort to regain her fiawed 2017
Hyundai. The projected value of this vehicle is only $1,700! This vehicle may not be worth auction
administrative cost or inquiry. I may also add if Dave’s Towing is unwilling to release the vehicle for the $250
settlement.
Linda will be seeking additional assistance to challenge any lien attempted by Dave’s Towing or there legal
team. I will be forwarding this letter to the Local News, Department of Revenue, Attorney General Office and
Better Business. Hopefully The Juice Bar, Daves Towing and myself can resolve this complex predicament for
Linda soon. I live in Alabama and would likely have to locate someone to help Linda locally retrieve the

we recently received a letter in the mail offering a detailed explanation for why a Flood
Access Bridge should be built at the intersection of South Palm Canyon and Bogert Trail.
However, it failed to mention a key point: the proposed structure was originally designed to
support the development of 200 homes in Oswit Canyon - a project that is no longer moving
forward. A smaller, simpler solution would be more appropriate for today’s needs.
The authors of the letter express concern for the safety of the Andreas Hills neighborhood - a
concern we share. But we hope any solution to potential flooding would avoid unnecessary
disruption to daily traffic or limit access for hikers heading to Indian Canyons Park, the Lyken
Trail, or Oswit Canyon trails. We urge the Palm Springs City Council to give serious
consideration to an alternative, less intrucive flood management plan proposed by Jane
Garrison and the Oswit Canyon Trust.

My name is Michael Shaw, Artistic Director of Dezart Performs. On behalf of Dezart Performs, I am grateful for the
Council’s consideration of our request for a $250,000 Measure J grant from the City of Palm Springs to support
our $2 million adaptive reuse of a historically significant church into the Dezart Playhouse—a state-of-the-art
theater and cultural hub. This project will preserve an architectural treasure while establishing a vibrant new
destination for arts, tourism, and community engagement in Palm Springs.
We are proud to have secured a generous matching grant from philanthropist David C. Lee, along with support
from individual donors and foundations towards this project. The City’s investment of $250,000 would serve as a
critical public match to unlock additional private funding and underscore a powerful public-private partnership. The
multi-phase project budget of $2 million includes the down payment for the building purchase and the
renovations for a successful opening in November 2025.
To meet that timeline, we must complete essential Phase One upgrades—many of which Measure J funds would
directly support—including:
Installation of professional theatre lighting and a state-of-the-art sound system
Development of a high-performance stage
Upgrades to the interior of the theater, lobby and common areas
Essential upgrades to the electrical system to accommodate the conversion
Equipping dressing rooms with proper lighting, makeup stations, and costume prep areas
These elements are vital to delivering a professional-caliber experience for both audiences and performers.
Dezart Performs has been a respected presence in the Palm Springs arts community for 17 years. We currently
employ an 8-person staff and, in the 2024–25 season alone, hired over 35 local actors, directors, designers, and
technicians—providing meaningful employment to local creatives. As a professional Equity theater company,

Dear Members of City Council,
I live on Bogert Trail just east of the Palm Canyon Wash bridge. I am in full support of the low water
bridge project.
On Valentine’s Day 2019. I had a routine doctor wellness visit that should have kept me away from
home for about one hour. Instead, as I left my home around 9:30 AM, I noticed that water was over
the intersection at Bogert and South Plam Canyon but didn’t really give it much thought. Because of
the heavy rains and silt that had collected over the roadway, the intersection was impassable and
law enforcement prevented any entry to exit at the intersection. Eleven hours later at around 8:30
PM, I was able to return home.
This project has Caltrans and federal funding that will be lost if it is not commenced soon. Please
support this safety and life issue for the residents of Andreas Hills.

I am writing due to my extreme concern for the deadlines on the Low Water Crossing Project 06-18.
The April 2025 Hearing raised many questions that I would like clarification on to fully understand
this project and the timelines involved.
COUNCIL MEETING AGENDA
When is this issue coming before the council again? The 60-day delay puts this at June 11th as the
Wednesday anticipated for a hearing.
My understanding is the EIR will need to be updated and submitted, but it has not been so far. And
the Council has not directed the City Attorney to do this.
Can updating the EIR be done immediately or does the City Council have to vote on this at a full
Council Hearing?
Can the bidding process be approved and start before the EIR update is approved?
FUNDING
In the hearing J. Montalvo stated if we did not submit for reimbursements from CalTrans prior to
12/2026, we could not submit. He went on to state that if we did not use our funds by 2028, we
would lose them. I am confused as to the distinction since if you cannot submit after 12/2026 how to
have two more years before you lose them in 12/2028?
I would like the exact terms that define the deadlines for funding for this project. I have heard a
variety of answers from numerous persons over numerous meetings. I request in writing the
final, full answer as to the terms of the deadline for this funding. And what, if any, extension
options exist and the full terms surrounding an extension request.
TIMELINE ON FULLY-APPROVED DOKKEN PLAN
What is the expected timeline for the approved plan to progress to completion?
What is the timeline for each step (please indicate what can run concurrently)--
·Council to schedule meeting and to approve EIS update
·Update paperwork and submit EIS
·Wait for approval on updated EIS
·Council to schedule meeting and to approve bidding process
·Engineering to get bids out and then get them back
·Council to schedule meeting and to approve funds for the bids
·Contractors to begin once bids are approved

Reviewing and vetting other designs will take time and additional money.
Would another design (say the fifth offered concept) require a brand new EIR?
Is the plan able to be changed so completely without needing to go back to get approval from the
Feds for funds?
What is the timeline for each step (please indicate what can run concurrently)--
· To prepare paperwork and submit for new EIR approval
· Wait for approval on new EIR
· How long will it take at a minimum to fully develop a new design all the way to the
stamped-by-engineer at all needed agencies stage?
· How long will it take at a minimum to get CalTrans approval?
· Then we would have to add almost all of the time line from the DOKKEN-approved
plan above.
Please put in writing that we will definitely NOT lose our funding for the current design from
CalTrans by entertaining yet another alternate concept.
If you cannot, then I beg you to reconsider meeting to review further concept(s) as it seems the time
has slipped past for this. Instead hold a Council meeting immediately, even a special hearing, to
approve the updating the EIR to be submitted immediately, along with any tasks that can be
accomplished concurrently.
Thank you in advance for this valuable information in understanding the timeline on this project.
May I suggest that the sooner this information is compiled, the sooner we can all rest knowing our
deadline for this project is secure? I am certain I missed several steps in the process that will also
add time to the project.
Also, thank you for your dedication in addressing the life-safety issue in our Andreas Hills
Community. This flood control highway improvement project is long-overdue and will bring peace of
mind to our neighbors, especially as our weather events grow in severity. I am part of a community
group and our website, KeepAndreasHillsSafe.org, is dedicating to communicating with the
neighbors and the City, particularly on this project.

To Whom It May Concern:
I am a resident at 3133 Barona Rd. in Palm Springs, CA and I am in favor of a low water
crossing at Arenas Canyon.
One of the primary reasons I moved to Palm Springs was to enjoy the many hiking trails
the area provides. I frequently bring out-of-town visitors on the Oswitt Canyon Loop for
my family and friends to experience the trail’s native beauty on display. And, I am
grateful for the Oswitt Land Trust’s successful effort to prevent development in the
Canyon. However, as the owner of one of over 700 homes in the Andreas Hills
neighborhood I am concerned about the potential loss of access for emergency vehicles
during a flood and I believe building the bridge should be prioritized above the concerns
some have raised about the proposed plan interfering with the desert habitat.
As has been noted in some public communications, the road has flooded in 2019, 2010,
2005 and 1982. The demographics of the area are such that it is a group who requires
emergency help at a higher percentage than the average population. My husband and I
experienced loss of use of a condo for two years as a direct result of the 2022 Hurricane
Ian in Florida. Hundred-year storms do happen. In 2023 Hurricane Hilary hit Palm
Springs, the first in the area in 85 years. Extreme weather events are taking place. I
believe we need to be prepared for such occurrences.
The funds for the low water crossing improvement have been secured from Caltrans and
the Federal government but there is an upcoming deadline. If the City opts out of
building the bridge and misses the deadline it is my understanding there will not be
another opportunity to receive funding from these agencies for such a project. Based on
what was reported at the zoom meeting on June 2, both the Fire Department and the
Police Department approve of the plan. Engineers are recommending the plan as a
means of controlling the flow of water during a storm. Why would we ignore the advice
of these professionals? I urge the City of Palm Springs to approve the project and ensure
our community gets this important safety upgrade.

As h omeowners of 3193 E. Bogert Trai l si nce 2002, we strong ly support the Low-Water Crossing
Project referenced above. The f loods in 2005, 2010 and 2019 trapped us in our home.
We are supporters of Oswit Canyon and contribut ed to purchase of the property by the Oswit Trust in
order t o save the alluvial fan. Howeve r we believe safety is the first priority. As a person with
Parki nson's Disease and cardiac issues, it is imperative that emergency services are able to access
my home. Over the years I have had 4 events that have necessitated emergency services .
We urge t he City Council to approve this project ASAP before the funding is lost.

Hi All -
It has been almost a week, and I've received no response from anyone regarding the email I sent on May
28, 2025. CodePink Coachella Valley attended Villagefest (as usual) last Thursday, and last Sunday we
attended the celebration of Marilyn Monroe's birthday at the Downtown Park. I made eye contact with
the Mayor, but he never came over to speak to us, many of whom are Palm Springs residents or work in
Palm Springs. Many are of Palestinian, Syrian, or Lebanese descent and have lost members of their
family, and/or have family members who have been displaced and have nothing. It would be nice if you
showed as much concern for their families as for people who don't live in our city or area, just because
they share the same faith. I have shared multiple times on city platforms that I know personally, many
people who have lost family members or have family displaced and/or missing, that live in the Coachella
Valley. They don't get a voice or are afraid to use their voice because of personal and financial
retribution, and fear of being labeled a "terrorist" supporter. They don't have their local politicians giving
heartfelt speeches over their needless loss.
Without naming names, here is a photo with the Mayor of one of those people who has told me
personally that he has lost 90% of his family members who live in Gaza. Has he ever told you or any city
official that? Do you understand why he hasn't?
I have also been told that the doctor of the fertility clinic that was bombed is Palestinian. Has any city

I am writing to all of you because I am deeply disturbed by the mayor's recent appearance (and later
reactions) at a meeting organized by a very Islamophobic person, Bob Weinstein, titled "Standing Against
Hate in the Face of Heartbreak". An email was sent to Mayor DeHarte by a Codepink member, including
some screenshots of posts by Bob Weinstein on Facebook. They might be disappearing soon if he's smart
enough. At the end of the email, this member invited the Mayor to visit us on a Thursday at our weekly
vigil to see what we are about and to talk. We've been having vigils for Palestine on Thursdays since
September 2024, and are usually located right next to the Jehovah's Witnesses at the Marilyn Statue.
Screenshots of the emails and messages are attached. The Mayor's reaction was to have the police
contact us. Really??
I have seen the mayor park right by us on a Villagefest night and ignore us as we shouted, "Mayor,
Mayor, come talk to us!". Recently, a member of the Human Rights Commission stopped by and talked to
us. We will be attending their next meeting, FYI. I thought it was interesting that the HR Commission
member's first question/comment was that he thought we were not locals (like some out-of-town
instigators!). FYI, we're all Coachella Valley residents. I've been a Palm Springs resident, business owner,
or both since 1987.
The Mayor's speech at Bob Weinstein's event was primarily about the heartbreak of the two Israeli
Embassy employees being murdered. I empathize with that. I also empathize with the 107 Palestinians
murdered on the same day (May 17th).
I'm sure the Mayor will use the excuse of heightened tensions since the bombing in Palm Springs as the
reason for the police to be contacted. On the same day (May 21st) in Gaza, 107 Palestinians were
murdered. For those living in Gaza, just one bomb and one death would be a day of celebration.
Gaza (had) a population of roughly 2.3 million people, with over a million children. Gaza is roughly the
size of Palm Springs, Rancho Mirage, and Cathedral City, with 22 times the population and about 60%
children, 75% women, and children. Palm Springs has given roughly $4,000,000 in federal tax dollars to
Israel to commit genocide. Palm Springs' emergency resolution in support of Israel gives tacit consent for
the extermination of Palestinians. Their most recent plan is to starve Palestinians, which means the
children die first, a slow, painful death, with their heart giving out last as their parents watch.
Sorry if you think this is antisemitic, but I think it's wrong to burn children alive and/or starve them to

Honorable Mayor and City Council,
During last nights public Zoom meeting, it was brought to everyone’s attention that OLT had
submitted yet another Alternative (#5) to the CalTrans and Dokken drainage concept for the
South Palm Canyon box culvert. I’m writing to encourage you to immediately dismiss this
alternative, for many reasons.
In the City Staff Report, it was agreed that the City would welcome input from OLT - but that
after this period, the project was controlled and directed by the City. Four infeasible concepts
were presented by Haimann Engineering and roundly dismissed by an independant consultant,
costing the City over $100,000. OLT’s input was duly noted and dismissed.
Now several years later, and at the last public comment meeting, there is suddenly yet another
concept being put forth. Again, OLT’s had their duly agreed time and window, and they were
given ample time to voice their opinion. Play time is over.
When any Professionally Registered Engineer (P.E.) submits any plan for consideration for a
$9 million flood control project, there are certain thresholds they would be expected to meet
for their ideas to be taken seriously. These would include:
Scaled Engineering Drawings for comparison to the approved design, at the same scale.
Complete and accurate dimensions on Plans and Sections.
Nominal earthwork calculations for comparison to approved design.
Name of the Company on the Drawings.
Having the responsible Engineer explain their concept to the public, and being able to
stand behind and defend their proposal.
None of the above expected items were presented or evident last night. I believe the ambiguity
of these drawings is a deliberate tactic to stall the project even further - more detailed
drawings and calculations would need to be done, then a review period, and then more public
input.
I recommend that the Mayor & City Council not take the bait, nor even entertain a review.
While I recommend not even looking at this 5th concept, I’ve made my own observations.
The Caltrans approved design has a tight limit of work footprint. The work is being done
where it is needed, and it fits the adage of Keep It Simple Simon (KISS). It’s elegant in its
simplicity - a box culvert and a direct ditch. The rest of the project frontage is left intact - open
views of the canyon, and the ability to walk in anywhere to enjoy nature.
Option #5 has many issues that are concerning, aside from being ambiguous and not being

The Great Wall of Oswit
As drawn, this retaining wall stretches along the entire frontage of the project. This expanded
limit of work exposes the most vulnerable edge to the project. Based on the 2.5’ height, this
wall would require excavating approximately 8’ below the sidewalk grade to construct the
footing, likely out to the curb line. Once the stem wall was poured and constructed, it would
likely have to cure 28 days before being backfilled. I also question the constructability and
phasing of this wall. The cost of this wall, 2/3 of which would be buried, would likely be a
budget buster. Last night Jane Garrison stated concept #5 could “save $1 million in rip rap”.
But it’s an indefensible declaration, since there’s no way to know. And she neglected to
mention the cost of the Great Wall. If concept #5 were value engineered, the first thing to be
axed would be that wall.
From a public image standpoint, nothing says “we protect endangered species and habitats”
more than a few hundred linear feet of retaining wall. (Sarcasm intended). The wall also
physically limits public access to Oswit Canyon itself. And once you build a wall, now
someone has to maintain it during its life cycle. And replacement of the wall would again
require full excavation and removal.
From a LEED perspective - this wall, the excavation required, the energy expended to form,
pour, strip forms and then backfill would earn concept #5 a solid “F”. It’s too complicated and
too stretched out. It entirely violates the KISS adage.
The Big Ditch
With lack of any dimensions, no one has any clue how much excavation is required for the big
ditch. The Great Wall effectively serves as a dam spillway.
Another concern is the verbiage stated on the drawing. First it says no road overflow at high
flow, then maybe a little road overflow, then maybe a little more road overflow. Ambiguous
declarations with no backup documentation are not encouraging on a FEMA flood control
project. I’m also concerned about the sediment that would likely build up in this collection
ditch - it would require routine clean outs, another ongoing maintenance issue.
Haimann Engineering / Sustura Inc.
I have no experience with Mr Haimann, nor have any criticisms of him nor of his work - I
have only observations. He’s got a lot of acronyms behind his name. I read the reviews of his
first 4 concepts presented, which were not kind. And seeing this ambiguous 5th concept, my
faith in his firms work has not improved. I visited Sustura’s website which had beautiful
nature photographs of the ocean, meadows, forests, flowers and ski slopes. What I would have
expected is an extensive Client list, Municipalities served, Developments, Feasibility Studies,
Awards and perhaps a list and photographs of built public projects. There was nothing. The
ambiguous nature of the website matches the ambiguous nature of their recommendations on
this project.
Summary
OLT and Haimann have had their chance. This 5th concept is suspect, incomplete, wasn’t
requested, and simply a couple years too late. You have many other projects currently under
construction, and others for consideration to spend your time and energy on.
You’ve followed every step to the letter of the law, everyone has been heard, and it’s simply

I attended the live community input meeting re this project last week. I went in thinking this would be a good project
to alleviate flooding and access to my neighborhood, which is accessed via Bogert Trail. A question I had on my
mind was what would be done about Bogert Trail as part of this project. Photos of prior flooding to be addressed by
the project show South Palm Canyon and Bogert both flooded at the same time. Indeed, Bogert Trail just east of the
South Palm Canyon intersection is at a lower level than South Palm Canyon is.
Neighbor groups supported the project from a life safety point of view, as did the fire chief at the meeting. It was
also something that I was very interested in. I really thought that there must be a plan for Bogert since the majority
of residents in this area access their homes via Bogert. I just wanted to learn what the plan was.
I was surprised and disappointed to learn that Bogert is not part of the plan. And from what was stated at the
meeting, it does not appear to be a part of any future plan. Not only is it not to be addressed, it may flood even more
with the current plan since the high volume of water pouring into the golf course will likely make Bogert flood even
more.
The FEMA maps presented at the meeting did not show the entire area impacted by this project, and by being
limited in presentation, they did not fully inform us. Residents from further south stated that the flood water also
comes from south to north from the Indian Canyon area. A larger view of the FEMA map shows that the southeast
corner of the Bogert and South Palm Canyon intersection, which is undeveloped, and Bogert Trail itself, where it is
lower than South Palm Canyon, are part of this south to north flood drainage into the golf course. It seems
disingenuous to argue that this project will promote life safety to homeowners along Bogert Trail, when it is so
clear that it will not.
As it stands now, the project is not well conceived to benefit most of the residents in the South Palm Canyon area.
While much of the money for the project comes from outside the city, there will still be a very significant amount of
city money spent on this, in the millions. It is not money well spent when the plan is so inadequate to address life
safety and other issues that the city is already aware of.
Please do not proceed with this plan until it is amended to effectively address Bogert Trail and South Palm Canyon
flooding from Indian Canyon, and drainage from the golf course to ensure the great amount of additional water can
be directed into the Palm Canyon Wash.

I am writing about the proposed bridge and flooding abatement project on South Palm
Canyon near Bogert Trail.
As currently conceived, I am not in favor of the plan.
I live on Ridgemore Drive. To be sure, I recognize the need to reduce or eliminate
flooding events in the area. The proposed project does not meet the needs of the
community and may make the situation worse for many of us.
A bridge over South Palm Canyon at Bogert Trail would provide access to the
communities south of the beginning of Bogert Trail but would not improve the situation
for the residents of the various developments in and around Bogert Trail. As I
understand it, there are more than twice as many inhabitants in the Bogert Trail
neighborhoods as there are in the neighborhoods to the south. This project fails to meet
the basic test of utilitarian justice, doing the greatest good for the greatest number.
I have not seen any studies that proport to analyze the effect of the huge amounts of
water that will move from west to east under South Palm Canyon into the Bogert Trail
area. Homeowners along the initial stretch of Bogert Trail confirm that the golf course
lagoons fill up and overflow during large rain events, flooding their properties. In the
absence of some hydrological magic, pouring thousands of additional acre feet of water
into the same area would only make the situation worse: more flooding, a larger flooded
area, a longer period for recovery.
Not only does this project fail to address the needs of the vast majority of residents
affected by flood events in the South Palm Canyon – Bogert Trail area, it will likely make
the situation much, much worse for individuals who use Bogert Trail.

Then there is the liability issue.
How can the City of Palm Springs justify a project that does not include a study of the
effect of the revised water flows on the flood plain near the origin of Bogert Trail; a
project that any reasonable person would say is likely to worsen flooding for a majority of
households in the currently affected area?
More pronounced flooding, the likely outcome of creating waterflows eastward under
South Palm Canyon, will worsen public safety, not improve it. If first responders cannot
access the area for longer periods of time because this project has worsened flooding,
would the city not be responsible for negligently authorizing such a project?
The city has not provided any hydrological studies that proport to demonstrate that the
project will not worsen the current flooding along Bogert Trail. Would that not be a
minimum expectation before undertaking such a project?
I am in favor of a comprehensive project that addresses flooding for all the residents of
the area, prioritizing the needs of the greatest number of residents as possible in the
early phases of the project. In addition to not prioritizing the needs of the majority of
affected residents, this project is likely to worsen the situation for two-thirds of the
residents of the area. The city has not addressed this likely outcome and the related
public safety and liability issues.

dollars putting in water diversion to make the water go into the river that runs
under the bogart bridge instead of coming down South Palm Canyon so hopefully
that will help. There was no water or damage from the Hurricane that severely
damaged Cathedral City.
I'm all for public safety but if you don't make Bogat Trail higher no bridge on
Palm Canyon is going to fix the safety issue. There was no erosion on the oswit
side of the road. All of the damage was on the east side of South Palm Canyon
and the Bogart side because its LOWER and water goes down hill. The bridge
that you are proposing will most likely cost way more than 10 million and take
much longer than 1 year to build and not help with keeping bogart from flooding.
The tiny lake at Indian Canyon will flood and so will Bogart.
Please show this to your hydrologist. I also included a video of the road infront of
Spencers Resturant in downtown and as you can clearly see the amount of water
in downtown Palm Springs is much highter than the water at oswit canyon and
there is nothing that can be done there. Thank you for taking the time to read and

My husband and I are residents of the Andreas Hills neighborhood and attended the
neighborhood meeting last night at the Indian Canyons Country Club.
Seeing photos of flooding on South Palm Canyon and Bogert Trail and appreciating that our
neighborhood only has one way in and out, it seems to make sense to engage in construction
that will alleviate our isolation in significant weather events. As neighbors point out, and we
personally know, having access cut off can become a life safety issue. At the meeting we
heard
from the Fire Department Chief who emphasized the need for the bridge from a life safety and
first responder point of view. It’s a compelling argument and a primary reason to support a
flood control project.
However, the project is incomplete and should not be undertaken until flooding on Bogert
Trail is addressed. I asked several questions at the meeting for which I received no adequate
response from the City Engineer.
1.If no changes are made to the very low spot on Bogert Trail just east of Palm Canyon,
there is no solution to the Bogert Trail flooding issue that comes from the flooding and
spillover from golf cart underpass and from Palm Canyon itself.
2.At the published rate of 3000 cubic feet of water per second, how can the lagoons at the
golf course handle the additional water? In heavy rains the lagoons have filled up on
their own and saturated the course. Also, can the overflow from the lagoons into the
wash handle the excessive amount of extra water?
We were not provided any hydraulic information on the situation as it pertains to water flow.
We and our neighbors need to know that you are considering all aspects of this $10 million
dollar project and not just addressing a component that in the end will not improve access for
Andreas Hills.
I would love to hear from you with answers to these questions. The conversation thus far has
revolved around Palm Canyon flooding NOT impacts of high water to Bogert Trail. If
emergency vehicles can make it to the corner of South Palm Canyon and Bogert but not be
able to enter the Andreas Hills neighborhood, how can this project be beneficial? There would
still be 500+ homes without access. Also not addressed is the likelihood that the homes along
Bogert will be flooded if the area is inundated with 3000 CF [er second of water.

I reside in the Monte Sereno development on Bogert Trail. I bought in the area not knowing this was an issue and
worry that climate change is becoming more severe. It is time to prepare for the future. We need to move forward
with this project while the funds are available. Knowing the current political climate & the state of our national

Hi. I would like to amend my previous comment to the city (below) regarding the Arenas
Canyon Bridge Project on S. Palm Canyon Drive. I attended the listening session at Indian
Canyons Clubhouse on 5/29 and was persuaded that it is a project that should be completed. I
appreciated the Fire Chief's comments. I appreciated hearing the impact on owners past the
proposed bridge site, and the potential impacts to health and safety. I also was persuaded that
we are likely to see an increase in severe weather events in the coming 100 years than we have
seen in the last 100 years. Given that the city has been very thoughtful in their approach, they
have already revised the design to accommodate citizen concerns, and will engage in an
update of the environmental impact studies, I am on the side of trusting our elected officials to
make the right decision in the best interests of the community. I was not persuaded by the
opposition of Oswit Land Trust (I have been a supporter). They are not in the business of civic
engineering and water management. I trust that the city has engaged in a professional process,
using experts who have the experience and technical expertise to manage these issues and
solutions.
Thank you to the city employees who took their time to attend, and put the presentation
together for us. I very much appreciate the thoughtfulness and balancing of competing
viewpoints.

I live at Canyon Heights, immediately adjacent to Oswit Canyon. Our home abuts the
canyon and our neighborhood is accessed off S. Palm Canyon Drive between Murray
Canyon Rd and Bogert Trail.
I oppose the city's plan to build a bridge/water diversion project as currently proposed at this
site. We were here when it flooded in February 2019. It was not a complete wash out.
People were able to get through with caution. My understanding is that there was one other
flood event in the last 20 years. It doesn't appear to be a good use of funds and is more
intrusive to the area and wildlife than necessary.
