Dear Mayor and City Council Members,
I am a retired Registered Landscape Architect who wholeheartedly supports the bidding and
construction of the above named project.
The attempts by Oswit Land Trust (OLT) to block this project have been entirely misleading,
disingenuous and not based in truth. They have posted inflammatory and factually untrue
claims that this project is not needed, this project is based upon the needs of an unbuilt
housing development, and in their estimation since it hasn’t fully flooded in recent memory,
that it won’t flood again. As expected, OLT’s followers have lapped up these false statements
as “truth”.
I read the City’s project summary when it was published 9(?) months ago. I don’t need to refer
to the Summary, as I remember the most salient points.
Project Facts
This public safety project was designed approximately 18 years ago by CalTrans.
The project is funded.
The City bought the 3 acres in full view of the community and OLT.
The project area is a FEMA site.
The project is one of the last segments of a larger flood control strategy for Palm
Springs, and all watersheds downstream.
OLT stated the project wasn’t necessary, yet hired a Stanford professor to create
drainage options.
OLT’s consultant offered alternative drainage options that were immediately determined
not feasible by an independent Civil Engineering firm hired by the City of Palm
Springs.
OLT has failed to publicly acknowledge their participation in offering alternative
drainage solutions, while also stating that no drainage improvements are needed.
Just because the project area hasn’t flooded in recent memory, a 100 year storm event
can happen anytime. Also, 100 year storm events don’t happen “every 100 years” - they
can happen back to back, or in 5 years or 20.
Observations
CalTrans is a public entity that is charged with protecting the “health safety and welfare” of its
citizens and the infrastructure it designs and builds. Their licensed Civil, Structural,
Hydrological and Environmental engineers use proven engineering methods, rainfall data, core
samples, known infiltration rates and other means and methods. In short, the decisions
CalTrans makes are based in truth and facts.

The flippant and untrue public statements made by OLT about the project insinuating “it’s not
needed”, directly implicates some malfeasance and misuse of public funds by CalTrans.
Additionally, OLT’s objections fly in the face of a documented FEMA site, selfishly ignoring
the potential damage, injury or even death of everyone located downstream.
Summary
My hope is that you collectively vote to move this longstanding project forward, and not stall
it once again. Your vote isn’t about having “political courage”, it’s about common sense. Trust
CalTrans, trust engineers, their logic and science. Trust FEMA declarations, trust Flood
Control Districts, and choose to support the public safety of your constituents. The City would
be legally exposed beyond belief by denying a vetted, funded CalTrans, Flood Control District
and FEMA project. Do the right thing.

Hello my name is Chanel Holguin. I am writing this on behalf of Nell Smith. Nell Smith was
my case worker at the Transgender Health & Wellness Center. This woman, changed my life.
She saved me from a domestic violence situation and got me housed within a week. Because
of her I got my first studio, got hired at DAP Health, got my license back, a new car, and now
work at St. John’s. She is my angel and I appreciate all she has done for myself, the
transgender community, and humans in general. I pray you support her in which ever endeavor
she chooses to go because I know people will be helped. I love you Nell and God bless you

Dear Palm Springs City Council, As Co-Chair of Vista Las Palmas Neighbors Foundation, I oppose the current shared
ownership legislation. Three concerns: Quality of Life: Replacing neighbors with 8 rotating vacation families
degrades residential neighborhoods and drives residents to other valley cities. Zoning Rights: Residents bought in
single-family zones. Any city wide upzoning should require neighborhood votes, not council mandates.
Enforcement: With LLC ownership by 8 people, violations create legal nightmares. Are all owners penalized? Will
non-violating owners sue the city? This increases time share ownership in Palm Springs and degrades our

Hello my name is Nicole and I’m a survivor of domestic violence, sexual assault, and
trafficking. I’m also a mother, a student, and a woman rebuilding her life from the ground up.
I’m here today because of a housing program that didn’t just give me shelter — it gave me the
chance to start over safely, with dignity. And I’m especially here because of Nell.
Nell didn’t treat me like a case. She treated me like a person. She saw my whole story — the
trauma, the strength, the fear, and the fire — and she made sure I had a safe place to land
when I had nowhere else to go.
For survivors like me, especially those of us who identify as LGBTQ+ or trans, programs like
this are more than helpful — they are life-saving. We already fight to be seen. We shouldn’t
have to fight for housing too.
Nell understands that. Not from a distance, not from a textbook — from doing the work. And
that’s exactly why she belongs on the Human Rights Commission. Because she doesn’t just
talk about equity and justice — she lives it.

Good afternoon Ron,
I'm writing this email with so much heaviness and disappointment in my heart. I was recently
sent a social media post you posted of your visit to Temple Isiah regarding the tragic shooting
of 2 Israeli embassy staffers. I think it’s truly great that you are showing up for the Jewish
community during these hard times. The person who sent me this is a community member and
a friend. They pointed out that the man tagged in your post Bob Weinstein is a xenophobic and
Islamophobic extremist. I decided to take a look at his public Facebook page and was in
shock. Not that someone could be so hateful, wrong and misleading, but that my Mayor
endorses this person. The same Mayor who just said “Standing Against Hate in the Face of
Heartbreak.”
I want to give you the benefit of the doubt and believe you were not aware of the blatant and
unacceptable rhetoric this person is spreading. However, I have not seen one post from you
regarding the 9 year old Palestinian boy who was stabbed in Illinois. Or the Palestinian college
students who were targeted and shot in Vermont. Also nothing about the attempted drowning
of the 3 year old Palestinian girl in Texas. Those are all domestic tragedies you continue to be
silent about. The selective empathy from our leaders is beyond obvious at this point. This in
turn is causing more division and hurt within our beautiful city. Many members of the
community do not feel safe, including myself. You and other council members have
emboldened these extremists and their endless hate and discrimination.
Please review the screenshots attached from Bob’s public Facebook page. Ron, you need to
speak up about this. To say I’m disgusted would be an understatement. This man is not alone
in his rhetoric. He is comfortable spreading easily debunked and dehumanizing propaganda
like a Britain appointed leader for the Palestinians (who they did not know or want) that met
with Hitler and co-conspired to create the holocaust. The same garbage Netanyahu once tried
to pass off as truth and was quickly debunked by journalists and scholars. The purpose of this
is to get you to dehumanize the Palestinians and it has historically worked. But not anymore.
It’s bad enough that we’ve had to accept that our own community leaders have not spoken up
about the constant starvation, slaughter and bombardment the Palestinians are going through
by the unhinged psyhotic Israeli regime, but to publicly prop up someone like Bob is abhorrent
and unacceptable.
This is a big deal and not something that will go away quietly. We do not feel safe with this
person in the community and especially when they're being endorsed by our Mayor. I know
you are a busy man but you need to say and do something about this as soon as possible.
PS: I've also attached a clip of just some of the harassment we face when protesting against the
genocide in Gaza or doing our silent vigils. Though we mostly get support and praise from the
community there's always one or two completely unhinged zionist that verbally attacks us. In

I am writing as a concerned resident of the Old Las Palmas neighborhood to express my
strong opposition to the expansion of co-owned housing permits within our community.
Old Las Palmas is known for its historic significance, architectural preservation, and the
peaceful residential character that defines daily life here. The potential increase of co-
owned properties—often marketed as luxury vacation homes under shared ownership—
poses a serious threat to the integrity and long-term livability of our neighborhood.
While the city has enacted an ordinance limiting co-owned homes to 30 across Palm
Springs, our neighborhood’s unique heritage and residential density make it especially
vulnerable to the disruptions that can accompany these arrangements. We have already
seen the impact of short-term vacation rentals in the form of increased traffic, noise
disturbances, and transient occupancy patterns that erode the community spirit we have
worked hard to preserve.
Moreover, the influx of co-owned properties risks accelerating property inflation,
making it increasingly difficult for full-time residents and future generations to afford to
live here. If left unchecked, this trend will transform Old Las Palmas from a historically
grounded, diverse neighborhood into a revolving door for high-income absentee owners.
In light of these concerns, I respectfully request that any City Council members who
have received campaign contributions from individuals or entities affiliated with Pacaso
or other co-ownership platforms recuse themselves from any votes or deliberations on
this issue. It is critical that these decisions be made with transparency, free of conflicts of
interest, and with full accountability to the residents of Palm Springs.

We live in the Vista Las Palmas area of Palm Springs
in a home we purchased in 1972.
We already have approximately 50% of our street,
Rose Avenue, filled with Vacation Rentals, so you can
imagine the constant turnover of "Weekend Warriors"
that party and brutally change the nature and culture
of the City for us and the non-rental owners that remain.
Now, you propose to worsen the bleak situation by
allowing multiple separate owners to share in the
ownership and use of a single family home turning
our neighborhood into a zoo.
The City of Palm Springs is rightfully a destination
for vacation travelers, that's what hotels are for,
not to destroy the backbone of the City,
any City, by forcing permanent residents to flee.
The City Counsel should consider the kind of City
Pacaso Housing will create, no real neighbors that
care for their homes, parking and noise problems,
trash on the streets and gutters, an unlivable mess.

I am writing to register my VERY STRONG OPPOSITION to Palm Springs allowing the existence of time share /
multi-share housing in ANY predominately residential neighbor hood in Palm Springs.
I fully understand the importance of our tourism-based economy here in Palm Springs.
FYI-I was one of the Palm Springs residents who served on the citizens advisory committee to guide our city
government in their review and revision on the short term rental regulations several years ago. That committee was
composed of private citizens, short term rental property owners and short term rental property management
companies. So all “sides” were represented. There were months of difficult discussions, negotiations and eventually
good compromising, amongst the committee members. One of the main areas of opposition arose from the very
excessive negative impact on life quality when commercial housing is integrated into residential neighborhoods.
Forcing the loss of community support due to the constant influx of strangers who are in no way invested in the
quality of life where they are invading.
We eventually presented our recommendations, with compromises which passed by majority vote amongst all
committee members, to our city officials for consideration in revising the existing (at that time) short term vacation
rental regulations. Setting % limits per neighborhood.
Sadly, after that project ended, the very powerful and very well funded short term vacation rental property
management groups were able to effectively lobby our elected officials to completely ignore the full committee’s
recommendations. Resulting in an actual INCREASE in STR properties via creating a whole new category that
bypassed most of the actual regulations meant to modulate the impact in residential communities composed of the
very residents who support Palm Springs business YEAR ROUND by living here permanently.
So it was not surprising to see several years later that the regulations adopted failed. And we are now revising them
to better control the STR management companies because owners are so negligent in their own profit making on the
backs of destroying life quality.
It is with this same insight that I oppose the proliferation of what is simply yet another form of commercial housing
destroying the life quality of residential neighborhoods in Palm Springs. Time shares such as PACSO.
The fact cannot be disputed that whether short term, Airbnb / VRBO type housing or time share / multi-shared
interest properties, they are all BUSINESSES which provide temporarily accommodations to travelers / tourists. At
the expense of losing permanent housing. Driving up the COST of remaining permanent housing. And causing pubic
nuisance (mostly noise and parking) problems so significant that our city actually needs a department to mitigate
those issues. Regardless of WHO pays for the investigation / mitigation process.
These types of housing situations are in fact no different than hotels / motels. And should be regulated as such.
Meaning they should only be in commercial zoned districts. They should be REQUIRED to follow the same fire,
safety, evacuation, emergency lighting regulations.
AND be required to offer some sort of ADA accommodations. As are hotels which struggle to compete on the un-
level playing field which city governments such as Palms Springs have enabled.
Currently, there is not a single ADA compliant / wheelchair accessible short term rental property to be found
anywhere in Palm Springs. I brought this fact to the attention of our city leaders years ago, during our STR

committee meetings. And even suggested that the city offer a reduction the the permit fee to any STR which meets
certain ADA standards. Our mayor at the time shut me down with a curt “not going to happen”! As a physical
therapist with 47 years experience, who is now a disabled terminal cancer patient myself, I still find THAT
appalling.
I say a definite “NO” to allowing any proliferation of time share / multi-share housing in our fine city. And
ESPECIALLY in any residential neighborhoods.

We are residents of Monte Sereno in the Andreas Hills community. We have lived here 15 years.
On February 14, 2019 we received a distress call from our 90 year-old friends who at that time lived in a
condominium on Laverne Way. Due to the extreme heavy rain storm that day their front porch was flooded and
water was beginning to come in under the front door. Since both were using walkers, it was impossible for them to
take any action and they were extremely scared. They asked us to come over and help.
We immediately left and headed down Bogert Trail, but we were unable to proceed because the water was at a
dangerous height over both Bogert Trail and S. Palm Canyon Drive. Although we had an SUV, we were concerned
that we would flood the vehicle if we attempted to cross the water. We had to call our friends and tell them we were
unable to help them. It was a scary time. Fortunately, they just had damage to their entry hall flooring and some of
the living room carpet.
Now, when I think about the inability for emergency vehicles to reach our community when we have another similar
rainstorm (and we’re bound to given the rapidly changing climate) we are greatly concerned about the safety of
ourselves and our neighbors.
There really should be no debate about this. The safety of over 700 families is at stake.
Please put people first and approve the low water crossing project. Thank you.

As homeowners of 3193 E. Bogert Trail since 2002, we strongly support the Low-Water
Crossing Project referenced above. The floods in 2005, 2010 and 2019 trapped us in our
home.
We are supporters of Oswit Canyon and contributed to purchase of the property by the Oswit
Trust in order to save the alluvial fan. However we believe safety is the first priority. As a
person with Parkinson’s Disease and cardiac issues, it is imperative that emergency services
are able to access my home. Over the years I have had 4 events that have necessitated
emergency services.
We urge the City Council to approve this project ASAP before the funding is lost.

I know you always have so much on your plate but it’s past time that you hold SCE feet to the
fire. If we complain to PUC they literally side with SCE EVERYTIME so we have zero state
government oversight of this out of control power company. Rates keep rising and their
dependability keeps dropping. I live in Andreas Hills, last year we experienced 4
UNPLANNED outages, one for 20hours. This is inexcusable. SCE has a horrible record out
here and it’s time the City Council deal with them for the residents of PS. Today the power
went off, then later on, then off, then on again. This should not be the norm and the CITY
COUNCIL should put pressure on Edison as they do not listen to residents at all, for gods sake
there isn’t even a phone number to call them anymore for us.
SCE DOES NOT MAINTAIN THEIR EQUIPMENT, THEY WAIT UNTIL IT FAILS. BUT
THEY ALWAYS GET THE RATE RAISES THEY REQUEST. SOMETHING IS
WRONG HERE.
So please, for the safety, health and security of your residents do something. And please do
not tell me you are powerless, you know you are not.

To all city council members,
I live at 785 Bogert Trail. This special neighborhood is a gem in the city and my wife and I love living
here. I’m writing to express my support for the low flow water crossing project. With only one way
in/out of this area, this project is a critical, potentially life saving infrastructure that needs to be
approved. In 2024, there were 590 emergency calls to the 710 homes in the affected area. Then add
our aging population and climate change to the mix. How can this project not be approved as it is
essential for the safety of all residents in this area? The analogy I’d use for the project is that I
believe most people who own their home have homeowner’s insurance. Many years could go by
with no need for a claim but when issues arise, it’s essential that the insurance policy was in place.
This project is our insurance policy to ensure emergency vehicles can enter our neighborhood every
day, no matter the weather conditions.
Thank you for your on-going work to make Palm Springs a very unique and special city.

the Parade as We represent Our Patriot Ancestors who fought the Very First War in Establishing our Great Nation.

Dear Mayor, Mayor Pro Tem, and City Council Members,
These comment are submitted on behalf of the Center for Biological Diversity, the
Tahquitz Group of the Sierra Club, and the Bighorn Institute. Our organizations are committed to
the preservation of the Peninsular bighorn sheep and its habitats in Palm Springs and throughout
its range.
As explained in our April 7, 2025 letter to the City Council (incorporated herein by
reference), we are concerned that the City is relying on environmental review that is outdated—
the 2012 Mitigated Negative Declaration (“MND”).1 As a result, the City Council has not
considered the changed circumstances in the Oswit Canyon area and new information about
wildlife use and habitat restoration in the project area since the 2012 MND was adopted, which
is necessary before any new discretionary decisions are made regarding the project . As a result of
the new information and changed circumstances , the impacts of the Project construction and
operation to species and habitats, including to the endangered Peninsular Bighorn Sheep, may be
significantly greater than anticipated in the 2012 MND. Therefore, the City should undertake
subsequent environmental review to address these issues. Because these reasonably foreseeable
consequences were not addressed in the 2012 MND, the City cannot properly rely on the 2012
MND to support its decisions going forward and must undertake further environmental review.

Here, substantial changes have occurred in the “circumstances under which the project is
undertaken ” requiring “major revisions of the previous . . . negative declaration due to the
involvement of new significant environmental effects or a substantial increase in the severity of
previously identified significant effects . . .” (CEQA Guidelines, § 15162, subd. (a)(2).) In
addition, “[n]ew information of substantial importance, which was not known and could not have
been known with the exercise of reasonable diligence at the time the previous . . . negative
declaration was adopted, shows . . . [t]he project will have one or more significant effects not
discussed in the previous . . . negative declaration . . .” (CEQA Guidelines, § 15162, subd.
(a)(3).)
Below we provide additional details regarding the new information and changed
circumstances which show that the changes in impacts to the Peninsular bighorn sheep are
substantial and were not considered in the 2021 MND. Because the new information and
changed circumstances will lead to substantial impacts that have not been previously addressed ,
and may be able to be avoided through alternatives, or minimized and mitigated, subsequent or
supplemental CEQA review is required.

The 2012 MND’s information about the affected environment in the Biological Study
Area (“BSA”) (see map, MND at 22 (Figure 5)) and likely impacts addressed in the Natural
Environmental Study (2011) (“NES”) are now inaccurate with regard to the Peninsular bighorn
sheep.
The 2012 MND states that the Peninsular bighorn sheep, which are a listed species under
both the California Endangered Species Act and the Federal Endangered Species Act, “could
potentially, but are not expected to, occur within the BSA.” 2012 MND at 30. And the NES
relied on in the MND specifically assumes that the bighorn will remain at higher elevations in
the project area: “Peninsular bighorn sheep often occurs at higher elevations on steeper terrain
than is present within the BSA. The USFWS also does not expect it to occur in the BSA.” 2012
MND at 31 (citing NES). Similarly, Appendix B states, with reference to the bighorn, that
“[t]here are two known occurrences within 10 miles of the Project site. The species often occurs
at higher elevations on steeper terrain than is present within the BSA.” 2012 MND, Appendix B,
“Listed and Proposed Species Potentially Occurring or Known to Occur in the Project Area” at
B-14.
However, since the Oswit Canyon area has been placed in conservation and habitat
restoration efforts have been undertaken, Peninsular bighorn sheep are now frequently utilizing
the lower elevation areas in and adjacent to the BSA. Evidence of this use has been provided to
the City by several commenters including photographs and personal accounts of bighorn sighting

Additionally, evidence attached hereto as Exhibits A through D further documents
Peninsular bighorn sheep utilizing the canyon bottom and alluvial fan habitat at the base of the
canyon between 2020 and 2025, underscoring the species’ expanded presence in low-elevation
areas near the project site.3
The lack of identification and analysis of impacts to bighorn in and near the project site
affects the conclusions in several of the sections of the MND, including regarding impacts to
wildlife, special status species, and noise. The alternatives considered and the minimization and
mitigation measures adopted in the MND are insufficient to address these impacts as well.
Changed Circumstances
Because of the conservation and restoration activities undertaken by the land trust and
volunteers, the habitat in the Oswit Canyon area has been improved and restored. As a result, the
area is now more actively used by wildlife, including bighorn sheep, as noted above. Recent
evidence submitted to the City Counsel includes observations of a variety of native shrubs and
flowering plants and shows that the habitat is thriving. (2025_04_09 Item 3B PDF pp. 95 (list of
plant species observed on April 8, 2025)). Undeveloped low-elevation desert habitat within the
City is increasingly rare and provides important habitat for many species. The loss of such
habitat under the current Project design represents a significant impact. In light of the changed
circumstances, the City Council should consider whether alternative designs, or minimization
and mitigation measures are needed to address the loss of this low elevation habitat and the
previously unexamined impacts to bighorn sheep.
Construction-related impacts, including noise, dust, and disturbance, will have outsized
impacts on the bighorn sheep that now regularly utilize the project site. The City Council must
take another look at the Project and consider whether some or all of the Project impacts can be
avoided by design alternatives, or minimized and mitigated through design modifications or
other measures. At a minimum, the City Council must address the requirements of the Coachella
Valley Multiple Species Habitat Conservation Plant (MSHCP) regarding construction that will
impact bighorn sheep. Additional mitigation measures, such as seasonal construction restrictions,
wildlife exclusion fencing, and other protective provisions, must be incorporated as part of the
updated CEQA review.
The South Palm Canyon Drive Bridge Project was originally designed to capture
increased flows during high rain events associated with a large development project that would
have introduced roads and other impermeable surfaces. However, because the Oswit Canyon
property and alluvial fan area are now permanently conserved, that development project will no
longer occur. As a result, the projected flows may be significantly less than assumed in the
original design, raising questions about whether the size and scale of the Project are “right sized”
for current conditions.

Conclusion
The City cannot continue to rely on the 2012 MND to fulfill its environmental review
obligations under CEQA. Circumstances in the Project area have changed substantially: the vast
majority of the Oswit Canyon lands west of Palm Canyon Drive are now permanently preserved
in their natural condition, and new information has emerged regarding habitat restoration and
increased wildlife use, including by the endangered Peninsular bighorn sheep. As a result, the
impacts of the Project construction and operation to environmental resources will be significantly
greater than anticipated in the 2012 MND. Because these and other reasonably foreseeable
consequences of the Project were not addressed by the City in the 2012 MND, and mitigation
measures or alternatives could substantially reduce the significant impacts of the Project, the City
must undertake further environmental review pursuant to the CEQA Guidelines, 14 Cal. Code.
Reg. § 15162 (a), before any additional discretionary approvals are made for this Project by the
City Council.
As part of the updated environmental review, the public must be provided with a
meaningful opportunity to comment and submit additional information regarding the current
status of species and habitats in the area, as well as other changed circumstances and new
information relevant to the Project’s impacts to resources in the Project area, which will be
affected in ways that were not addressed in earlier CEQA review. The public must also be
provided an opportunity to comment on alternatives and mitigation measures that could
substantially reduce significant impacts of the Project in light of the changed circumstances and
new information.

The recently completed CV Link in the Lawrence Crossley neighborhood along
34th Ave to Lawrence Crossley Drive might be a good location to install shade trees
along the path which is part of the Tahquitz Golf Course. The City owns the golf
course and the reclaimed water irrigation is in place all along this pathway.
Approximated 15 trees could be planted adjacent to the pathway which would
provide shade and visual enhancement.

Has the City identified EV chargers as a priority? The existing infrastructure is grossly inadequate: (1) my condo
development does not have chargers and our Board seems resistant to acting, despite state laws on chargers; (2)
many chargers are broken, eg., 4 of 8 chargers at the public garage downtown were inoperable last week; (3) many
chargers appearing on apps are available for guests of restaurants & hotels only; (4) the public library’s charger is a
great City amenity, but it is dominated by Uber/Lyft drivers, leaving residents with little access; and (5) very few high
traffic areas — grocery stores, medical facilities, shopping destinations — have working chargers, eg., the two
chargers at the Camelot theater/cultural center have been broken for ages. Residents of PS need more chargers.
Encouraging better private sector maintenance of existing chargers would be a great start. I would like to see the
City adopt a plan to make PS an EV leader among California cities.
