E. REMARKS FROM THE CHAIR:
Chair Armstrong’s remarks emphasized the "value in art," sharing how the Asphalt Art
project evolved from a trial project to a valuable city initiative that’s been shown to improve
street safety, encourage engagement with the art, and add unforeseen value.
F. PRESENTATION
Visual Artist Rights Act (VARA), California Art Preservation Act (CAPA), and Code of
Ethics by Jill Tremblay, Best Best & Krieger.
Ms. Tremblay presented an overview of the Visual Artists Rights Act (VARA), the federal
law protecting the moral rights of visual artists, and The California Art Preservation Act
(CAPA), which provides additional protections specifically within the state . She also
shared Do’s and Don’ts for commissioners’ social media use.

1. Discuss request for the PS Pride Monument by artist Jim Isermann in the
amount of $400,000.
PS Pride Monument Board member Al Jones clarified that the requested funding is
actually $70,000 to cover the cost of installation.
NO DECISION WILL BE MADE UNTIL FURTHER NOTICE.
2. Ratify selection of Commissioner Gonsalves as member of Art Inventory RFP
Ad Hoc committee.

3. Approve creation of ad hoc committee to review maintenance needs and repair
of collection.

4. Discuss Artscape in Parks Proposal Review Process.
Tjhe process discussed is that commissioners will vote anonymously online to
select their top proposals, then at a Special Meeting, meet to review and
evaluate the finalists. Special meeting date of Tuesday, September 17th was
agreed on.
5. Discuss process for Public Art Inventory contractor solicitation.
Director Virata said this was already discussed at a meeting of the Ordinance Ad
Hoc Committee and no further discussion is needed.
H. PROJECT UPDATES:
1. Asphalt Art – Commissioner Silveira is working with the artist Marconi Calindas-
Cafege on this project. The artist is looking for four community volunteers,
possibly high school art students, to work with him on the day of the project. The

community would also like to coordinate a Saturday event hosted by the
Community Center to happen simultaneously with the project.
2. Beautiful Shade Call for Artists – Chair Armstrong shared that with another
month to go, we have already received approximately 12 submissions. It was
decided that Commission will review the entire process again at a later date.
3. Thompson Hotel Public Art Project – Director Virata provided an update that the
hotel mural is nearly complete, and the hotel is requesting reimbursement for
mural art fees. However, their request precedes the reimbursement process, as
the mural has not yet been approved.

E. REMARKS FROM CHAIR:
Chair Armstrong gave an overview of the project’s history and previous selection process
and explained how the Commission arrived at the current format, requiring this meeting
to review and narrow 40 qualified submissions to 1 0 finalists.
F. ITEMS FOR DISCUSSION/APPROVAL:
1. Artscape in Parks Proposal Review
A total of 40 submissions were reviewed and narrowed to 10 finalists after majority voting.

A regular meeting of the Palm Springs Public Arts Commission was called to order by
Chair Gary Armstrong on Tuesday, October 01, 2024, at 5:30 p.m.

MOTION BY COMMISSIONER LANDE TO ACCEPT THE AGENDA, SECONDED BY

D. PUBLIC COMMENTS
1. Michael Conway of the Baristo Neighborhood Organization read a letter from the
organization requesting that the Commission fund the first two stages of a Baristo
Channel project in the amount of $537,210.
2. Doug Fridsma of El Rancho Vista Estates, which is adjacent to Gateway Park,
expressed his support of the “Dancer” sculpture chosen for the park and for the
Commission’s overall initiative to bring art to neighborhood parks.
3. Raymond LaFleur, manager of a large gay men’s social media group, praised the
AIDS Memorial Task Force, artist Phillip K. Smith, and Mayor Jeffrey Bernstein for
creating a new memorial design that deeply resonates with the community after
extensive outreach and listening sessions. He recommended that the City Council
and Commission approve the design without change or stipulations.
4. Donald Copson supported Mr. LaFleur's comments about the AIDS Memorial and
requested the Committee create language to distinguish between public art and
memorials. He also proposed a more rigorous evaluation process that includes
public input on the designs of memorials to, at the outset, address the emotional
significance of the events being memorialized. Chair Armstrong mentioned that
such efforts were “on the agenda” of things the Committee are committed to doing

in the future.
E. REMARKS FROM THE CHAIR:
Chair Armstrong provided remarks on the successes of Public Art Commission projects
moving forward.
F. APPROVAL OF MINUTES: August 8, 2024
MOTION BY VICE CHAIR BURNS TO ACCEPT THE MINUTES, SECONDED BY
COMMISSIONER KIBBY, CARRIED 7-0 TO ACCEPT THE MINUTES.
G. ITEMS FOR DISCUSSION/APPROVAL:
1. Review and approve the proposed Palm Springs AIDS Memorial design; consider
request for $65,000 of Public Art Funds for the sitework and installation of the Palm
Springs AIDS Memorial:
Dan Spencer (Founder) and Phillip K. Smith III (Artist) presented the updated
design for the AIDS Memorial with a total budget now revised to be closer to $1.2M,
of which $540,000 has been secured to date, which includes the $65,000
previously approved by the city for installation. Concerns were raised about
maintenance and repair costs, graffiti prevention, and sustainability of the digital
content linked via QR codes.
MOTION BY CHAIR ARMSTRONG THAT THE COMMISSION APPROVE THE
PROPOSED DESIGN AND ITS INSTALLATION AT THE DOWNTOWN PARK
CONTINGENT UPON THE TASK FORCE MEETING THESE THREE
CONDITIONS: 1) ADDRESS ANTI-LOITERING CONCERNS; 2) PROVIDE A
FULL MAINTENANCE PLAN WITH COST ESTIMATES; AND 3) PREPARE AN
AGREEMENT ABOUT THE TERMS OF SERVICE FOR THE QR CODE
WEBSITE INDICATING IT WILL NOT BECOME THE CITY’S RESPONSIBILITY,
SECONDED BY VICE-CHAIR BURNS. MOTION PASSED 6-1.
THE COMMISSION AGREED TO WAIT TO VOTE ON THE FUNDING PORTION.
2. Consider and approve an allocation of $50,000 for Gateway Park and $50,000 for
Baristo Park as part of the ArtScape in the Parks Program .
MOTION BY COMMISSIONER LANDE TO APPROVE AN ALLOCATION OF
$50,000 FOR GATEWAY PARK AND AN ALLOCATION OF $50,000 FOR
BARISTO PARK AS PART OF THE ARTSCAPE IN THE PARK PROGRAM ,

Commissioner Kibby agreed to shadow the Victoria Park project and Vice Chair
Burns agreed to shadow the Baristo project.
3. Discuss Asphalt Art project schedule.
Commissioner Silveira shared that Saturday, November 9th, was chosen for the
Asphalt Art project. It will begin at 9:00 AM, with street closures scheduled for the
preceding Friday.
4. Discuss Beautiful Shade Call for Artists project status and possible deadline
extension.
MOTION BY COMM ISSIONER KIBBY TO EXTEND THE DEADLINE TO
NOVEMBER 15, 2024, FOR THE ACCEPTANCE OF PROPOSALS FOR THE
BEAUTIFUL SHADE PROJECT AND TO ASK DIRECTOR VIRATA TO EXPAND
THE CALL FOR PROJECTS IN THE $5,000 TO $25,000 RANGE, SECONDED
BY COMMISSIONER SILVEIRA AND CARRIED 7-0.
H. PROJECT UPDATES:
1. Airport Mural – Director Virata and Chair Armstrong shared that the artist Adair
Logan continues to paint in the evenings and the project is expected to be
complete very soon.
2. Richard Wyatt Mural – Director Virata agreed to contact the City’s lawyers to
ask them to track down the Wyatt estate for their involvement in determining
next steps for restoration and future maintenance.

Narrative Statement/ Mission
Thompson Palm Springs is committed to growing the
identity of Palm Springs as an innovative and creative
community. Thoughtfully placed in publicly accessible
areas throughout the hotel including the lobby and Lola
Rose restaurant; the Thompson Palm Springs
Collection celebrates diversity. With an emphasis on
amplifying the voices of indigenous artists, female
artists, artists of color, and artists identifying as
LGBTQIA; the mission of the Thompson Palm Springs
Collection is to collectively illustrate the diversity,
sophistication and boldness of the Palm Springs
community. The Thompson Palm Springs lobby and
Lola Rose restaurant are open and accessible to the
general public seven days per week.
The pages that follow include images, artist
information, and values of the art. Additional images,
information, or receipts can be provided upon request.

Gerald Clarke
A member of the Cahuilla Band of Mission Indians, Gerald Clarke
creates sculptures, paintings, and installation inspired by his
cultural heritage. He was schooled in the craft, art and traditions of
his ancestors and trained academically as a painter and sculptor,
which has enabled him to forge a creative practice characterized
by an innovative take on traditional techniques. He expresses his
contemporary indigenous experience in his art, and gives voice to
his Native community by dispelling myths, bringing truths to the
forefront, and finding a middle ground between perception and
reality. “In my work,” Clarke states, “I look for the unconventional
beauty one finds only in truths. It celebrates, it mourns, and
outshines all else.”
In 2020, the Palm Springs Art Museum presented solo exhibition of
Clarke’s work. He is currently showing a large site-specific
installation as part of DesertX.
Clarke received his BA /from the University of Arkansas (1991) and
an MA (1992) and MFA (1994) from Stephen F. Austin State
University, TX.
He was born in Hemet, CA; he currently lives on the Cahuilla
reservation in Anza, 40 miles southwest of Palm Springs.

Forrest Kirk
Forrest Kirk creates bold, colorful paintings using a variety of
media ranging from oils and acrylic to bubble wrap, fabric, and
gorilla glue. His images often reference psychological uncertainty
and anxiety arising from underlying power structures, specifically
those experienced in contemporary urban settings. For his recent
bodies of work, Kirk has focused on dramatizations he envisioned
referencing Ralph Ellison’s 1952 classic novel Invisible Man. In
these works, Kirk absorbs the experiences and visions as dictated
by the story’s besieged narrator.
In 2019, Kirk was a resident at the Bed Stuy Artist Residency,
Brooklyn, NY. His work resides in numerous private collections
and foundations, as well as in the permanent collection of the
Hammer Museum, Los Angeles and Museum of Contemporary
Art, San Diego.
Forrest Kirk studied at California State University, Los Angeles
and spent time studying classical painting techniques in an atelier
in Paris, France. Kirk was born in Los Angeles in 1975; he
currently lives and works in Los Angeles

As a member of the Ponca Tribe of Oklahoma,
Buffalohead uses storytelling and narrative
imagery to describe the American Indian cultural
experience. She uses an eclectic and often
saturated palette to depict whimsical animal
subjects and trickster tropes. The
commercialization of Native American culture is
expressed through these anthropomorphic
characters and intentional use of line and color.
Buffalohead received her Bachelor of Fine Arts
degree from the Minneapolis College of Art and
Design in 1995 and her Master of Fine Arts from
Cornell University in 2001. Buffalohead is a
recipient of the Joan Mitchell Foundation Painters
and Sculptors Grant, the McKnight Foundation
Fellowship for Visual Arts, a Jerome Foundation
Travel and Study Grant, and the Fellowship for
Visual Artists from the Minnesota State Arts Board.

Nanibah Chacon
Nanibah “Nani” Chacon, is a Dine (Navajo) and Chicana artist.
Nani is most noted for her female figurative works which utilize
bold colors and an illustrative format to create commentary
Native , Chicana and American culture. Her work brings forth a
dialogue between culture and contemporary social perspectives;
many times acting as a narrative to traditional ideas admidst the
current cultural climate.
Nani was born in Gallup, New Mexico and grew up both in Chinli,
Arizona and in Corrales, New Mexico. Her clan is To dich iini
(bitter water) and born for Chicano people. At 16 she was
introduced to graffiti and began a prolific career as a graffiti writer
and later developed strong aptitude in oil painting. Nani chose
figurative work as a basis of subject matter, she uses an
archetype of female characters to explore ideas of feminism,
culture, traditionalism and modernism.
Nani currently exhibits across the United States. She has
maintained a career as a Painter, Muralist and Educator and
Activist. In 2004 she received her Bachelor’s in Art Education
from the University of New Mexico. In 2013 she joined the art
and activist collective Honor the Treaties.

Eric-Paul Riege
Eric-Paul Riege (Diné) is a weaver and fiber artist working in
collage, durational performance, installation, woven sculpture, and
wearable art. Using weaving as both means and metaphor to tell
hybrid tales that interlace stories from Diné spirituality with his own
interpretations and cosmology, he understands his artworks as
animate and mobile. His practice pays homage and links him to
generations of weavers in his family that aids him in generating
spaces of sanctuary.
Reige’s recent solo exhibitions include Hammer Projects: Eric Paul
Reige at the Hammer Museum in Los Angeles (2022–2023), Larger
than Memory at the Heard Museum in Phoenix (2020), and Hólǫ́—it
xistz at the Institute of Contemporary Art Miami (2019). His recent
group exhibitions include the Prospect.5 Triennial in New Orleans
(2022), the Toronto Biennial of Art (2022), and SITElines Biennial,
presented by Site Santa Fe (2018). He holds a BFA, Art Studio and
Ecology from the University of New Mexico in Albuquerque. His
work is collected by Forge Project and ICA Miami, among others.
Reige is a member of the Charcoal Streaked Division of the Red
Running Into the Water clan. He was born and is based in Gallup,
New Mexico.

Art Conservation and Maintenance Standards
Thompson Palm Springs takes pride in its collection of publicly displayed works of art and recognizes the
importance of this artwork to the cultural and economic well being of the community. We are committed to the
documentation, preservation and maintenance of this collection. Treatments will be carried out in collaboration
with Curator, Collection Manager, hotel staff, artists, and restoration experts.
Condition Assessments: Inspections of artwork include information on the present location, the current condition
and the treatment or maintenance needed. While the general artwork condition will be monitored by hotel staff
daily, biannual inspections will be carried out by the Collection Manager, and thorough assessments shall be
conducted by a professional third-party conservator every three years.
Maintenance: Regular routine care of artwork, such as gentle cleaning and dusting, can be carried out by hotel
staff with the guidance of the Collection Manager and/or Curator, Virginia Shore. Thompson Palm Springs will
engage the artist or a professional third-party conservator to carry out maintenance beyond this routine care.
Art Conservation and Restoration: This level of art treatment refers to museum quality professional cleaning,
repair or refurbishing of an artwork due to aging, damage or vandalism. Work taking place at this level must be
approved by Virginia Shore, Curator and completed by an approved professional conservator.
