ARCHITECTURAL REVIEW COMMITTEE MEMORANDUM DATE: MAY 19, 2025 NEW BUSINESS SUBJECT: A REQUEST BY LILAC 19, LLC, FOR A MAJOR ARCHITECURAL PERMIT APPLICATION FOR THE CONSTRUCTION OF A QUICK SERVICE RESTAURANT NAMED CHICK-FIL-A WITH A DRIVE- THROUGH LOCATED AT 5200 EAST RAMON ROAD, ZONE M-1-P (PDD 291) (CASE # AR 2024-0003)(GM). FROM: DEPARTMENT OF PLANNING SERVICES PROJECT DESCRIPTION: This is a request for the Architectural Review Committee (ARC) to review a proposed Major Architectural Application from the owners of The Springs Shopping Center, for the redevelopment of Building “I” by demolishing an existing “in-line” retail building for the construction of one (1) quick service restaurant named Chick-Fil-A at 5,707-square feet in size with seventy-eight (78) indoor and twenty-four (24) outdoor seats with two (2) drive- through lanes. The Planning Commission approved the site plan and a Conditional Use Permit with conditions at the March 25, 2025, public hearing meeting. RECOMMENDATION: That the Architectural Review Committee approve the application subject to conditions. SCOPE OF REVIEW: 1. The Architectural Review Committee will evaluate the Major Architectural Application (Case AR 2024-0003 MAJ) for conformance to criteria listed in PSZC Section 94.04.00 for the proposed landscape and design of the new addition. 2. The Planning Commission approved a Conditional Use Permit (Case CUP 2024- 0001) for conformance to the criteria listed in PSZC Section 94.02.00 and determined that the project is consistent with the previously certified final EIR by the City Council on 10/19/2005 and no further analysis is required. Architectural Review Committee Memo Case # AR 2024-0003 MAJ May 19, 2025 – Page 2 of 8 PROJECT DESCRIPTION: The project consists of the demolition of the existing “in-line” retail structure known as Building “I” within The Springs Shopping Center; and the construction of one (1) quick service restaurant with drive-through facilities. The detail of the proposal is as follows: • Chick-Fil-A will be a standalone 5,707-square foot single-story structure placed in the same location as the razed Building “I” on a leased parcel from the overall shopping center ownership. The quick service restaurant will have seventy-eight (78) indoor and twenty-four (24) outdoor seats with a double drive-through allowing for fifty (50) vehicles to queue. The hours of operation to be from 5:30 AM to 11:00 PM Monday to Saturday and closed on Sunday. The new restaurant will be located in the south center of The Springs Shopping Center which is a big box retail center containing a home improvement center as the anchor store, with multiple in-line retail buildings, two (2) existing drive-through businesses, and a cluster of quick service restaurants. The Springs Shopping Center – red box is Building “I” site location Architectural Review Committee Memo Case # AR 2024-0003 MAJ May 19, 2025 – Page 3 of 8 PLANNING COMMISSION REVIEW: The Planning Commission reviewed the project at the March 25, 2025 meeting and approved a Conditional Use Permit (Resolution #6976) along with a set of conditions. Several which require the Shopping Center ownership to properly maintain the landscaping within the overall shopping center parking lot; provide internal wayfinding and signage program; identify measures to ensure the safety of pedestrians, and cyclists; and the quick service restaurant to reduce the proposed number of drive-throughs from three (3) to two (2) which is reflected in the revised site plan before the ARC. The Planning Commission specifically requested that the ARC review the landscape plan as stated in a condition: • Revise the landscape plan to provide a mix of Mexican and California palm trees, with shade trees along East Ramon Road, to be reviewed by the ARC. The applicant has changed the site plan to reflect the required double drive-through which resulted in an increase in landscaped area. In addition, the landscape plan has been revised to reflect the request of the Planning Commission with additional trees along East Ramon Road. BACKGROUND INFORMATION: Most Recent Ownership 04/26/2019 Lilac 19, LP Notification 09/24/2024 Property posted with “Project Under Consideration” sign listing the case number and contact information to review the proposal. 3/25/25 The Planning Commission at a public hearing approved (Resolution # 6976) for a Conditional Use Permit to construct a quick service restaurant with drive-through facilities with conditions. Field Check April 2025 Staff visited site to observe existing conditions. Details of Application Request Site Area Overall Center Total Existing Bldgs Chick-Fil-A Parcel 37-acres 393,000-square feet 86,957-square feet leased area I I Architectural Review Committee Memo Case # AR 2024-0003 MAJ May 19, 2025 – Page 4 of 8 ANALYSIS: Building Elevation: The proposed Chick-Fil-A structure will have an average height of twenty-one (21) feet with a center parapet of twenty-three (23) feet. The building is a mix of box elements consisting of EIFS stucco with the top portion in “White Cloud” cream color, and lower element in “Hardware” which is a contrasting darker brown color. A stone veneer will be added as accents at the building base and entry points which is similar to other buildings in the center. In addition, an aluminum storefront glazing system in dark bronze with canopy elements to be dark colored steel structures to match other buildings. Staff and the Urban Design Planner worked with the applicant on adding appropriately dimensioned overhangs above all windows for solar control. Site lighting on the building will be sconce fixtures that wash the walls with illumination. The large canopies over the drive-throughs will have recessed lighting that will be focused downward and not spill off the site. Landscape Plan: The proposed landscape plan shows the use of desert plantings along East Ramon Road and the access driveway to include Acacia, Multi-trunk Palo Verde, Rosewood, Mexican Ebony and Mesquite trees in 36” boxes. Large trees will be planted in the parking lot to provide the required shading. The new landscaping will require the removal of eighteen (18) existing tall palm trees throughout the site. Landscaping between Ramon Road and the outer screen wall will include multiple Agave, Bougainvillea, Bird of Paradise, Desert Spoon, Ocotillo, Red Yucca, and other ground covers. The area on the south side of the building will contain the outdoor seating area for twenty-four (24) seats under a covered canopy which will be surrounded by a large planter area containing two (2) larger trees and ground cover. Signage: Signage for the site is not part of the review at this time, however the building elevations show possible areas for signs. The Springs Shopping Center currently has a sign program and any proposed signs would need to adhere to those guidelines or an amendment could be sought. Architectural Review Criteria and Findings: PSZC Section 94.04.00(E) requires the approval authority to evaluate the application and make findings for conformance to the following criteria: Criteria and Findings [PSZC 94.04.00(E)] Compliance 1. A stone veneer will be added as accents at the building base and entry points which is like other buildings in the center. In addition, an aluminum storefront glazing system in dark bronze with canopy elements to be dark colored steel structures to match other buildings. All sides of the existing and new addition will be consistent and appear to be one structure. 2. The design of accessory structures, such as carports, cabanas, and similar accessory structures, shall be consistent with the form, materials and colors of the principal building(s), unless otherwise approved by the ARC; Y A fully enclosed trash structure constructed in the same materials as the building will be located to the south of the main building and will contain internal long-term bike parking for staff members. 3. The façade elements and fenestration are composed in a harmonious manner; Y The proposed Chick-Fil-A structure will have an average height of twenty-one (21) feet with a center parapet of twenty-three (23) feet. The building is a mix of box elements consisting of EIFS stucco with the top portion in “White Cloud” cream color, and lower element in “Hardware” which is a contrasting darker brown color. A stone veneer will be added as accents at the building base and entry points which is like other buildings in the center. In addition, an aluminum storefront glazing system in dark bronze with canopy elements to be dark colored steel structures to match other buildings. 4. The proposed materials are consistent with the context of the site, adjacent buildings, and the desert environment; Y The proposal will demolish the existing Building “I” to be replaced with the new 5,707-square foot restaurant building in a similar location at the center of the leased parcel. The use of construction methods with similar materials as existing structures will result in the building being similar in design and appearance to other buildings in The Springs Shopping Center. 5. The proposed color scheme is appropriate to the desert environment and consistent with the site context; Y Architectural Review Committee Memo Case # AR 2024-0003 MAJ May 19, 2025 – Page 6 of 8 Criteria and Findings [PSZC 94.04.00(E)] Compliance The building is a mix of box elements consisting of EIFS stucco with the top portion in “White Cloud” cream color, and lower element in “Hardware” which is a contrasting darker brown color. A stone veneer will be added as accents at the building base and entry points which is like other buildings in the center. In addition, an aluminum storefront glazing system in dark bronze with canopy elements to be dark colored steel structures to match other buildings. 6. Shading devices and sun control elements, excluding landscape materials, are provided to address environmental conditions and solar orientation; N/A The building orientation is north to south with the front entry facing west. Metal overhangs are placed over the front door and windows providing solar control. In addition, a 1,994-square foot freestanding canopy is proposed on the east side to provide shelter as patrons order and pay. A second 1,440-square foot canopy is placed over the food pick-up window. The outdoor seating area located on the south end of the building will be covered by a metal canopy with horizontal slat elements on the south and west facing elevations to provide shading. 7. The proposed landscape plan is consistent with the requirements of PSMC Chapter 8.60; Y The proposed landscape plan shows the use of desert plantings along East Ramon Road and the access driveway to include Acacia, Multi-trunk Palo Verde, Rosewood, Mexican Ebony and Mesquite trees in 36” boxes. Large trees will be planted in the parking lot to provide the required shading. The new landscaping will require the removal of eighteen (18) existing tall palm trees throughout the site. Overall, the landscape plan meets the requirements. 8. The proposed landscape plan is consistent with all applicable zoning requirements, including any streetscape requirements, landscape buffer requirements, and screening requirements Y Architectural Review Committee Memo Case # AR 2024-0003 MAJ May 19, 2025 – Page 7 of 8 Criteria and Findings [PSZC 94.04.00(E)] Compliance The existing parking lot configuration will remain unchanged with proposed landscaping within tree wells, along the site perimeter and adjacent to the outdoor seating area will enhance the overall site. The proposed plant palette consists of the plant materials that are included in the Lush and Efficient landscape gardening book. There is no turf proposed for this project. A low wall is required adjacent to the drive through lanes to screen from view. 9. The shading for pedestrian facilities on the subject site or abutting public right(s)-of-way is adequate; Y The existing parking lot with new trees placed in wells with new plantings along the perimeter sidewalk areas will provide increased shading. A connection from East Ramon Road onto the site will provide access as shown on the site plan and will be safe for pedestrians. 10. The proposed lighting plan is consistent with the requirements of PSZC Section 93.21.00, and the proposed lighting will not materially impact adjacent properties; Y A lighting plan has been provided that shows the continued use of existing light poles in the parking lot. New lighting will include illumination under the front entry overhangs, sconces affixed to the lower portion of the building, and lights mounted flush to the underside of the ordering and pick-up canopies. The photometric plan shows adequate light levels will be present and meets the PSZC outdoor lighting code. Y 11. Appropriateness of signage locations and dimensions relative to the building façade(s), or appropriateness of the site location for any freestanding signage, as may be warranted for the development type; N/A Signage for the business is shown on the submitted plans, however it is not part of this application. A separate sign package will be submitted and evaluated per the approved sign program for the shopping center. Should a deviation from the permitted size and number of signs be requested, a sign program amendment may return to the ARC. 12. Screening is provided for mechanical equipment and service yards, to screen such facilities from view from public rights-of-way and abutting properties; Y The mechanical equipment for the building will be placed on the roof and will be screened by the parapets and will not be visible from the street or parking lot. Architectural Review Committee Memo Case # AR 2024-0003 MAJ May 19, 2025 – Page 8 of 8 ENVIRONMENTAL ANALYSIS: The proposed development is a project as defined by the California Environmental Quality Act (CEQA). The project was analyzed when the development was first approved. As the proposal is less square footage than the razed building and there is no increase in height resulting, it is determined that the project is consistent with the previously certified final EIR by the City Council on 10/19/2005 and no further environmental analysis is required. CONCLUSION: The proposal to demolish an under performing in-line retail building for the construction of a new quick service restaurant with drive-throughs within The Springs Shopping Center at the intersection of a two Major Thoroughfares near other auto oriented businesses is an appropriate location. The proposal meets all the development standards of the PSZC and is in conformance with the General Plan Land Use designation. The use is consistent with the City of Palm Springs Zoning Code; therefore, staff recommends approval of the Major Architectural Application as all of the conditions of the Planning Commission review have been incorporated into the plans presented to the ARC. B. On April 8, 2021, the City Council adopted Ordinance No. 2042, amending Section 94.04.00 of the PSZC to reassign review of Major Architectural Review (MAJ) applications from the City’s Planning Commission to the City’s Architectural Review Committee. C. On March 25, 2025, the Planning Commission reviewed the project and unanimously voted to approve a Conditional Use Permit (CUP 2024-0001, Resolution #6976) and recommended approval to the Architectural Review Committee with conditions. D. On May 19, 2025, the City’s Architectural Review Committee held a public meeting in accordance with applicable public law. At said meeting, the Architectural Review Committee carefully reviewed and considered all of the evidence presented in connection with the Project, including, but not limited to, the staff report, and all written and oral testimony presented. THE ARCHITECTURAL REVIEW COMMITTEE RESOLVES: Section 1: The proposed 5,707-square foot quick service restaurant is considered a project pursuant to the California Environmental Quality Act (CEQA). The project was analyzed when the development was first approved. As the proposal is less square footage than the razed building and there is no increase in height resulting, it is determined that the project is consistent with the previously certified final EIR by the City Council on 10/19/2005 and no further environmental analysis is required. Section 2: As demonstrated in the staff report, the Project conforms to the Architectural Guidelines of PSZC Section 94.04.00 (“architectural review”); Section 3: Based upon the foregoing, the Architectural Review Committee hereby approves Case AR 2024-0003 MAJ for the construction of a 5,707-square-foot quick service restaurant with two (2) drive throughs located at 5200 East Ramon Road subject to the conditions of approval attached herein as Exhibit A.
