Tahquitz Canyon Way Palm Springs, CA 92263 Dear Members of the Palm Springs City Council, I hope this letter finds you well. I am writing to formally appeal the suspension of my short-term rental permit (Permit Number: 051456) for the property located at 3187 E Ventura Road, Palm Springs CA 92262. I understand that the suspension was issued due to a third violation in any twelve month period, and I wish to provide additional context and information that I hope will be considered in the review of my case. First and foremost, I want to express my commitment to complying with all local regulations and ensuring that my property remains in good standing within the community. I have always strived to adhere to the rules governing short-term rentals and maintain a respectful environment for both my guests and neighbors. Under Ordinance No. 2075; 5.25.070 Operational Requirements and Standard Conditions, section (f), as the owner of the property I have reasonably done prudent property ownership practices to ensure that the occupants and/or guests of the vacation rental unit do not create unreasonable noise disturbance, engage in disorderly conduct, or violate provisions of the Municipal Code or any state law. Below is a list of detailed examples of all the practices that have kept my property respectful to both guests and neighbors. For example: ● [Photo 1] The online Airbnb advertisement of the property states in detail the Palm Springs noise ordinance for guests to read prior to booking. The terms are specifically requiring the guest to abide by the restrictions. Guests are evicted immediately once there is a disturbance or guest does not follow the rules provided on the property website. ● [Photo 2] An immediate automated message is directly sent to the booking tenant that goes over the detailed Palm Springs noise ordinance rules. I also require the guest to reply that they understand and have any questions. ● Before the guest arrives at the property I have a face to face conversation or on the phone conversation around Palm Springs noise ordinance rules and if they have any questions I can answer them. ● I have two Ring Cameras posted on the front of the house facing the public street. If there is any noise, the Ring cameras pick it up and I notify guests if there is too much noise coming from the property. ● [Photo, 3, 4, 5] Once guests arrive at the property there are multiple signs posted with the Palm Springs Vacation Rental Registration Certificate with the noise ordinance and rules of the property at the entrance of the front door, as well as next to the sliding door where guests enter the backyard. There are two other signs with details around the Palm Springs noise ordinance on the kitchen island as well as outside posted around the pool area. ● [Photo 6] There is a copy of the “Good Neighbor brochure for Vacation Rentals” created by the city of Palm Springs for the guest to review at the property which details information about the noise ordinance. I kindly request that the City Council consider the following in reviewing my case: 1. Joining Vacation Rental Owners & Neighbors (VRON). VRON is dedicated to preserving Palm Springs' rich history of vacation rentals and home-sharing through education, awareness and the promotion of responsible vacation rental ownership and management. Their mission focuses on promoting responsible vacation rental ownership and fostering positive relationships between owners, neighbors, and the broader community. 2. The actions and procedures as a property owner providing the guest with detailed information on Palm Springs rules with short term rental. 3. We are restricting our property from the allowed 8 guests to only 4 guests at any given time. I value being a part of the Palm Springs community and have always aimed to be a responsible host. I am hopeful that, with the information provided, you will reconsider the suspension and allow me to continue operating my short-term rental in full compliance with all regulations.
