SUMMARY
Alvin Deleon has requested an appeal of administrative citation A8868 issued in the
amount of $500 and the two (2) year suspension of the Vacation Rental Registration
Certificate #051456 for the property located at 3187 Ventura Rd., Palm Springs,
California.
RECOMMENDATION:
1) Open the Appeal Hearing and accept public testimony.

Background
The property located at 3187 Ventura Rd., Palm Springs, California is a registered
Vacation Rental with Vacation Rental Registration Certificate #051456. The start date
was December 1, 2022. Vacation Rental Ordinance 1918 became in effect April 2017 and
later amended and restated in November 2022 with Ordinance 2075. The previous and
current Vacation Rental Ordinance details rules that guests renting a Vacation Rental for
a period of 28 consecutive days or less must follow; Regulations that owners must follow
relating to each stay that is 28 consecutive days or less and that upon the third violation
in any twelve-month period, the City Manager shall suspend the Vacation Registration
Certificate for two (2) years.

Vacation Rental Appeal – 3187 Ventura Rd., Palm Springs
Palm Springs Municipal Code (PSMC) chapter 5.25 section 070(g) states that
notwithstanding the provisions of Section 11.74.043, any radio receiver, musical
instrument, phonograph, loudspeaker, sound amplifier, or any machine or device for the
producing or reproducing of any sound shall be conducted within a fully enclosed vacation
rental unit and shall not be audible at the property line of the vacation rental.
PSMC chapter 5.25 section 070(c) states that no more than one automobile per bedroom
shall be allowed for each vacation rental.
PSMC chapter 5.25 section 090(b) states that upon the third violation in any twelve-month
period, the city manager shall suspend the vacation registration certificate for two years.
Administrative Regulation dated August 2017, states under procedure A(3) that appeals
of the third administrative citation and the suspension of the Vacation Rental Registration
Certificate will be heard by the Administrative Appeals Board according to PSMC Chapter
2.50.
STAFF ANALYSIS
First Citation – A8270 – May 26, 2024
On May 26, 2024, the City of Palm Springs Code Compliance Division responded to a
complaint received from the city’s Vacation Rental Hotline regarding the number of
vehicles at the Vacation Rental property located at 3187 Ventura Rd. Code Officers
Whittaker and Pisciuneri arrived at the property at 1:15 pm and found five vehicles at the
property. The permitted limit of vehicles for this property is four. Citation A8270 was
issued for violation of PSMC 5.25.070(c). The officer report is included as ATTACHMENT
4. The citation was paid in full on August 24, 2024, and there was no appeal received.
Findings:
The number of vehicles was over the permitted limit at the Vacation Rental.
Second Citation – A7862 – June 29, 2024
On June 29, 2024, the City of Palm Springs Code Compliance Division responded to a
complaint received from the city’s “My Palm Springs APP”, regarding music at the
Vacation Rental property located at 3187 Ventura Rd. Code Officers Ingram and
Whittaker arrived at the property at 6:15 pm and observed music audible at the property
line. Citation A7862 was issued for violation of PSMC 5.25.070(g). The officer report is
included as ATTACHMENT 5. The citation was paid in full July 5, 2024, and there was
no appeal received.

Vacation Rental Appeal – 3187 Ventura Rd., Palm Springs
Third Citation – A8868 – February 22, 2025
On February 22, 2025, the City of Palm Springs Code Compliance Division responded to
a complaint received from the city’s Vacation Rental Hotline, regarding music at the
Vacation Rental property located at 3187 Ventura Rd. Code Officers Grijalva and Keough
arrived at the property at 6:47 pm and observed music audible at the property line. Citation
A8868 was issued for violation of PSMC 5.25.070(g). The officer report is included as
ATTACHMENT 6. The citation was paid in full March 4, 2025, and appealed by the
Responsible Person and Owner on March 27, 2025. The matter was heard by an
independent hearing officer through the city’s citation processing vendor, Data Ticket, and
the violation was upheld.
Findings:
Music audible at the property line of the Vacation Rental.
Pursuant to PSMC 5.25.090(b), “Upon the third violation in any twelve-month period, the
City Manager shall suspend the Vacation Registration Certificate for two (2) years”.
Pursuant to Administrative Regulation dated 8/2017, appeals of the third administrative
citation and the suspension of the Vacation Rental Registration Certificate will be
heard by the Administrative Appeals Board according to PSMC Chapter 2.50.
Based on the three (3) administrative citations issued in a twelve-month period, a
suspension of the Vacation Rental Registration Certificate was issued March 6, 2025,
with effective suspension date starting on March 31, 2025, and ending on March 31, 2027.

The following Palm Springs Municipal Code sections and Regulations are applicable to
this matter.
The Palm Springs Municipal Code, Vacation Rentals §5.25.070 – Operational
Requirements and Standard Conditions:
(c) The owner shall limit overnight occupancy of the vacation rental unit to a
specific number of occupants, with the maximum number of occupants as
no more than two persons per bedroom within each vacation rental unit and
a maximum of no more than eight persons total within the vacation rental

unit, except that owner may allow up to two minor children, age 12 or under,
to occupy the vacation rental in addition to the maximum number of
occupants otherwise provided in this subsection. The number of bedrooms
in a vacation rental shall be verified by the enforcement official using county
assessor and/or city building records and/or a physical inspection of the
premises, prior to the issuance of a registration certificate. The owner may
also allow up to four daytime occupants in addition to the total number of
guests allowed for overnight occupancy pursuant to this subsection. No
more than one automobile per bedroom shall be allowed for each
vacation rental. Advertising and/or renting one or more vacation rentals as
part of a cluster or compound is prohibited.
(g) Notwithstanding the provisions of Section 11.74.043, any radio receiver,
musical instrument, phonograph, loudspeaker, sound amplifier, or any
machine or device for the producing or reproducing of any sound shall be
conducted within a fully enclosed vacation rental unit and shall not be
audible at the property line of the vacation rental.
The Palm Springs Municipal Code §5.25.090 – Violations
(b) “Upon the third violation in any twelve-month period, the City Manager shall
suspend the Vacation Registration Certificate for two (2) years”.
ADMINISTRATIVE REGULATION “Violation Count for Purposes of Suspending a
Vacation Rental Certificate”- Effective 8/2017
Procedure:
A. Section 5.25.090(b) specifies, “Upon the third violation in any twelve
(12) month period, the City Manager shall suspend the Vacation Rental
Certificate for two (2) years.” Following is a clarification how violations are
counted.
1. Administrative citations for violations of Chapter 5.25 issued to the Vacation
Rental guest, Owner, or Owner’s agent prior to April 16, 2017, will count
towards the calculation of the three (3) violations in any twelve (12) month
period for suspending the Vacation Rental Certificate for such property in
accordance with Section 5.25.090(b).
2. There will be no suspension unless at least one (1) violation occurs under
new Ordinance No. 1918.
3. Appeals of the third administrative citation and the suspension of the
Vacation Rental Registration Certificate will be heard by the
Administrative Appeals Board according to PSMC Chapter 2.50.

Jurisdiction: This administrative hearing is conducted in accordance with Palm Springs
Municipal Code 2.50 which confers jurisdiction upon the Administrative Appeals Board.
WHEREAS, the City investigated a complaint and found the property 3187 Ventura
Rd., Palm Springs, California to be in violation pursuant to Section 5.25.070(c) on May
26, 2024, and issued administrative citation A8270; and
WHEREAS, the City investigated a complaint and found the property 3187 Ventura
Rd., Palm Springs, California to be in violation pursuant to Section 5.25.070(g) on June
29, 2024, and issued administrative citation A7862; and
WHEREAS, the City investigated a complaint and found the property 3187 Ventura
Rd., Palm Springs, California to be in violation pursuant to Section 5.25.070(g) on
February 22, 2025, and issued administrative citation A8868; and
WHEREAS, upon the third violation in any twelve-month period, the City Manager
shall suspend the Vacation Registration Certificate for two (2) years; and
WHEREAS, Alvin Deleon, for the property located at 3187 Ventura Rd., Palm
Springs, California filed an administrative appeal of administrative citation A8868 and the
administrative decision of a two-year suspension of the Vacation Rental Registration
Certificate with the City Clerk and paid the appeal fee; and
WHEREAS, pursuant to Administrative Regulation dated 8/2017, appeals of the
third administrative citation and the suspension of the Vacation Rental Registration
Certificate will be heard by the Administrative Appeals Board according to PSMC Chapter
2.50
WHEREAS, the Administrative Appeals Board opened and conducted a duly
noticed Administrative Appeal Hearing on May 7, 2025; and
WHEREAS, the Administrative Appeals Board was presented evidence that Alvin
Deleon, owner of the property located at 3187 Ventura Rd., Palm Springs, is in violation
pursuant to Section 5.25.090 (b) of the Palm Springs Municipal Code; and

Dear Members of the Palm Springs City Council,
I hope this letter finds you well. I am writing to formally appeal the suspension of my short-term
rental permit (Permit Number: 051456) for the property located at 3187 E Ventura Road, Palm
Springs CA 92262. I understand that the suspension was issued due to a third violation in any
twelve month period, and I wish to provide additional context and information that I hope will be
considered in the review of my case.
First and foremost, I want to express my commitment to complying with all local regulations and
ensuring that my property remains in good standing within the community. I have always strived
to adhere to the rules governing short-term rentals and maintain a respectful environment for
both my guests and neighbors.
Under Ordinance No. 2075; 5.25.070 Operational Requirements and Standard Conditions,
section (f), as the owner of the property I have reasonably done prudent property ownership
practices to ensure that the occupants and/or guests of the vacation rental unit do not create
unreasonable noise disturbance, engage in disorderly conduct, or violate provisions of the
Municipal Code or andy state law. Below is a list of detailed examples of all the practices that
has kept my property respectful to both guests and neighbors.
For example:
• [Photo 1] The online Airbnb advertisement of the property states in detail the Palm
Springs noise ordinance for guests to read prior to booking. The terms are specifically
requiring the guest to abide by the restrictions. Guests are evicted immediately once
there is a disturbance or guest does not follow the rules provided on the property
website.
• [Photo 2) An immediate automated message is directly sent to the booking tenant that
goes over the detailed Palm Springs noise ordinance rules. I also require the guest to
reply that they understand and have any questions.

• Before the guest arrives at the property 1 have a face to face conversation or on the
phone conversation around Palm Springs noise ordinance rules and if they have any
questions I can answer them.
• I have two Ring Cameras posted on the front of the house facing the public street. If
there is any noise, the Ring cameras pick it up and I notify guests if there is too much
noise coming from the property.
• [Photo, 3, 4, 5] Once guests arrive at the property there are multiple signs posted with
the Palm Springs Vacation Rental Registration Certificate with the noise ordinance and
rules of the property at the entrance of the front door, as well as next to the sliding door
where guests enter the backyard. There are two other signs with details around the Palm
Springs noise ordinance on the kitchen island as well as outside posted around the pool
area.

by the city of Palm Springs for the guest to review at the property which details
information about the noise ordinance.
I kindly request that the City Council consider the following in reviewing my case:
1. Joining Vacation Rental Owners & Neighbors (VRON). VRON is dedicated to preserving
Palm Springs' rich history of vacation rentals and home-sharing through education,
awareness and the promotion of responsible vacation rental ownership and
management.
2. The actions and procedures as a property owner providing the guest with detailed
information on Palm Springs rules with short term rental.
I value being a part of the Palm Springs community and have always aimed to be a responsible
host. I am hopeful that, with the information provided, you will reconsider the suspension and
allow me to continue operating my short-term rental in full compliance with all regulations.

Other things to note
City of Palm Springs has a strict noise
ordinance for vacation rentals and a zero-
tolerance policy for any type of amplified
music played outdoors or indoors that can
be heard outdoors AT ALL TIMES. This
regulation applies to every short-term
rental property within the city of Palm
Springs. Guest can only have a maximum of
4 cars total parked at any given time during
stay. If there is a complaint to the city by a
neighbor and a compliance officer is
dispatched to the home, the contracted
renter will receive a $500 citation from the
City of Palm Springs. This would also result
, in the renters being evicted with no refund.

Upon receipt of this call, I confi rmed that this property is
a 4-bedrnom and departed the office. Upon my arrival to
the location at approximately 1 :15 pm, I observed 3
veh icles pa1 ked in the driveway, and 2 additiona l vehicles
parked in the street directly in front of the res idence. I
contacted the occupants at the front door, advised them
of the witnessed violation, and issued a citation to the
respons ible renter. After departing the location, I called
and left a voicemail for the listed lo ca l contact on file. I
received a return ca ll from the listed local contact at 2:55
pm, in which they stated that they were the pool service

I received a complaint regarding loud music at the
property located at 3187 East Ventura Rd. Upon arrival,
myself and Officer Whittaker approached the property
and could hear ampl1f1ed music from the street In front of
the location I used my Shazam app to document the
song and artist of the music being played. Officer
Whittaker contacted the property representative on file
and advised them of the music complaint and the
witnessed violation.
I made contact with the occupants at the front door,
notified them of the complaint, and informed the
occupants they were in violation of the vacation rental
music ordinance. I issued citation A 7862 to the
responsible renter Mayra Martinez Torres . The reporting
party did not request a callback, and no further action
was taken.

Received notification from the VR-Hotline at 4:41 pm
regarding "Loud party and 4 vehicles"
Officer Keough and I arrived to 3187 Ventura Rd at
4:53pm. From the street in front of the property, a
violation for music heard beyond the property line was
observed .
I took digital captures via my department-issued mobile
cellular device of the decibe l readings as we ll as a
shazam son capture of the son playing at the time -
I made contact with the occupants at the front door. I
ad vised them that I w itnessed a violation of music heard
beyo nd the property line. The occupants admitted to
playing music from the television. I requested from the
occupants to notify the responsible renter to meet me
outside. Brandon met me at the door, I edu c ated him of
the music ord inance, and he stated that the airbnb ad
stated music was okay as long as it was not playing past
7pm and that it was not loud due to it being sourced from
the television . I exp lained that although he c laims the
music was not loud and even though it was from the TV, a
violation sti ll exists due to the music be ing amplified and
heard from beyond the property line. I handed him a
'Good Neighbor brochure' to further explain the music
ordinance.
Brandon refused to provid e me his identification and did
not cooperate . I attempted to contact the designated
local contact but did not re c ei ve a respo nse .
Subsequently, I reached out to the property o w ner to
inform them of the situation and requested their
assistance in obtaining the occupant's identification.
After approximately 1 O minutes, the property owner
returned my call, stating that they had spoken with the
occupant and advised them to provide their identification.
The responsib le renter, Brandon, ultimately complied and
presented his ID, after which I proceeded t o issue the
citation A8867
I followed up with the property owner, Joseph, to notify
them of the conclusion of the event and the enforcement
action taken. The reporting party did not request follow
up.

Upon review of the recent activity at your Vacation Rental property at 3187 E. Ventura Rd., Palm Springs, the City
of Palm Springs is suspending your Vacation Rental Registration Certificate for a period of two (2) years. In order
to minimize the negative impact to the near-term guests visiting our city who may be currently booked at your
property, the suspension period will begin on March 31, 2025, and will end on March 31, 2027. All advertising
of your property for short-term renting must cease immediately.
During the suspension period, your property may not be rented for short-term stays (28 days or less) but you
may rent your property as a long term rental.
This suspension is being made in accordance with the City of Palm Springs Municipal Code Section 5 .25 .090(b) as
follows:
"Upon the third violation in any twelve month period, the City Manager shall suspend the Vacation
Registration Certificate for two (2) years."
During the last 12 months, the following citations have been issued to the property.

During your suspension, Transient Occupancy Tax returns and annual renewal fees will still be due unless you
choose to complete and submit the enclosed Owner's Request to Close TOT Permit and Vacation Rental
Certificate form.

You have the right to appeal this suspension pursuant to Palm Springs Municipal Code, Section 5.25.090(fJ,
and pursuant to Administrative Regulation dated 8/2017 (copy attached), your appeal will be heard by the
Administrative Appeals Board in accordance with Palm Springs Municipal Code, Chapter 2.50. Any appeal of
the third Administrative Citation A8868 must be addressed at this Administrative Appeals Board hearing pursuant
to the Administrative Regulation . Please also see the attached Written Notice of Appeal Form and Filing Process
information; or feel free to contact the Department of Special Program Compliance at #760-322-8382 with
questions.
Should you choose to appeal this suspension, your suspension does go into effect on March 31, 2025 in
accordance with this letter, and it remains in effect pending the outcome of the Administrative Appeals Board
hearing . Advertising or operating as a vacation rental prior to the determination of the Administrative Appeals
Board is a violation of PSMC Section 5.25.090(c).
To exercise your option to appeal, your completed Written Notice of Appeal Form with the non-refundable
appeal fee of $911.00 must be received by the City Clerk's office no later than March 27, 2025. and should be
