PLANNING SERVICES DEPARTMENT PC Director ARC PC & CC Current Proposed CHANGE OF ZONE M-1 P •Freestanding banks are neither allowed nor prohibited •Freestanding banks are permitted by right •Allows more diversified land uses •Increases the viability of the site P P SITE PLAN CONDITIONAL USE PERMIT (CUP) DESIGN REQUIREMENTS: •Safe on and off-site pedestrian and traffic circulation •7-vehicle queuing at a minimum •Screening of associated elements •Shade structure at the automated teller •Design compatibility with the rest of the site design ISSUES 1.Approval of the CUP, DP, and AMM applications are contingent upon approval of the COZ by the City Council. 2.AMM application review is excluded from the Planning Commission’s review. 3.Outdoor lighting plan does not fully meet the zoning code requirement – The issue can be addressed through a condition of approval without altering the character of the project. PLANNING SERVICES DEPARTMENT FINDINGS 1.The project meets the required findings for COZ, CUP, and DP approval, as conditioned. 2.IS/MND has been prepared – The potential environmental impacts can be reduced to less than significant with the implementation of mitigation measures. PLANNING SERVICES DEPARTMENT ADDENDUM 1.Staff recommends the Planning Commission to add the following condition of approval: “The time limit for the commencement of construction under a Development Permit approval shall be two (2) years from the effective date of the approval, unless an extension of time is granted pursuant to PSZC Section 94.12.00.” PLANNING SERVICES DEPARTMENT RECOMMENDATION 1.Adopt the Mitigated Negative Declaration as an adequate environmental document for the proposed project and associated impacts; 2.Approve the Conditional Use Permit (CUP-2024-0009) and Major Development Permit (DP-2024-0005) applications subject to the conditions of approval attached to the resolution (Attachment 3); 3.Add a new condition which reads, “The time limit for the commencement of construction under a Development Permit approval shall be two (2) years from the effective date of the approval, unless an extension of time is granted pursuant to PSZC Section 94.12.00.” 4.Recommend the following actions to the City Council, subject to conditions: i.Adopt the Mitigated Negative Declaration as an adequate environment document for the proposed project and associated impacts; and ii.Approve the Change of Zone application (COZ-2024-0001) to change the zoning designation of the project site from P (Professional) to M-1 (Service/Manufacturing).
