SITE PHOTOGRAPHS THOMPSON PALM SPRINGS1ST Floor 2nd Floor 3rd Floor 4th Floor PROPOSED SUBDIVISION ISSUES •The project proposes to subdivide the existing development into seven (7) parcels/airspaces, which would separate the parking from the rest of the uses (hotel, restaurants, retail spaces). •All uses are dependent on the on-site parking – Parking can potentially become inaccessible to these uses under the new ownership following the subdivision. •The City cannot approve a subdivision which would create nonconforming parking for any of the uses being involved. •Implementation of a measure to secure parking access for all on-site uses is necessary. PLANNING SERVICES DEPARTMENT FINDINGS RECOMMENDED CONDITION (Staff Memorandum Packet): PLN 1: Parking shall remain in common ownership and operation with the rest of the parcels/airspaces created by this map, to ensure that Code required on-site parking is provided for all such uses. RECOMMENDED REVISED CONDITION: PLN 1. Parking shall remain in common use with the rest of the parcels/airspaces created by this map, to ensure that Code required on-site parking is provided for all such parcels/airspaces. Prior to approval of the final map, Subdivider shall execute a recordable easement, in form and substance approved by the City Attorney, granting the owners of all other parcels/airspaces created by this map rights of vehicular access and parking on the parking lot identified in this map, and as shown on the plans approved per PD 324 (Case No. 5.1091). Said right of common use of the parking lot shall also be reflected in any Covenants, Conditions and Restrictions (CC&R’s) entered into between the owners of the parcels/airspaces created by this map. Both the easement and CC&R’s shall grant the City the right, but not the obligation, to enforce said right of common use. PLANNING SERVICES DEPARTMENT FINDINGS (Continued) •MND was adopted for the original development of Thompson Palm Springs – No new or additional environmental studies are required because no physical changes are proposed to the site as a part of this application. •The proposed project meets the required findings for Tentative Parcel Map approval with the adoption of the recommended Condition of Approval PLN 1. PLANNING SERVICES DEPARTMENT RECOMMENDATION •Planning Commission adopt the resolution and approve the proposed project subject to the conditions recommended by staff.
