SUBJECT: A REQUEST BY LILAC 19, LLC, FOR A CONDITIONAL USE PERMIT
FOR THE REDEVELOPMENT OF BUILDING “I” AT THE SPRINGS
SHOPPING CENTER FOR THE CONSTRUCTION OF A QUICK
SERVICE RESTAURANT WITH A DRIVE-THROUGH LOCATED AT
5200 EAST RAMON ROAD, ZONE M-1-P (PDD 291) (CASE NO CUP
2024-0001)(GM).

SUMMARY
This is a request for the Planning Commission to review an application by Lilac 19, LP,
the owners of The Springs Shopping Center, for the redevelopment of Building “I” by
demolishing an existing “in-line” retail building for the construction of one (1) quick
service restaurant at 5,707-square feet in size with seventy-eight (78) indoor and
twenty-four (24) outdoor seats with three (3) drive-through lanes. The project requires
the approval of a Conditional Use Permit (CUP) for the drive-through.
The Planning Commission previously reviewed this application at the December 11,
2024 meeting and voted to continue the project providing the following revisions to the
plan and conducting further study of the potential traffic impacts:
1. Evaluate the pedestrian connection from Ramon Road onto the site without
crossing the drive-through lanes.
2. Provide greater shading of the outdoor patio. Design the structure that will shield
the west and south facing sides plus add increased landscaping to help shade
the area.
3. Provide separation from the outdoor patio from the drive-through lanes.
4. The Springs Shopping Center ownership to bring the existing landscaping into
conformance with approved plans or provide a written phasing plan.
5. Revise the site plan to pull back the landscaped area on the east side of the
building to better align with the exit driveway.
6. Re-study the location of the ADA parking spaces.
7. Add palm trees to the perimeter of the site matching others in the center.
8. The building’s exterior to better relates to the rest of the shopping center by
examining the colors, or other elements beyond the stacked stone.
9. Revise landscaped plan including shade trees in the parking lot.

10. Study an alternate to the 3rd drive-through lane. Explain the process from
queuing, ordering, payment, meal fulfillment, exiting. Provide numbers served,
timing, and vehicles idling.
RECOMMENDATION: That the Planning Commission take the following action:
1. Approve the Conditional Use Permit subject to attached conditions of approval.
2. Determine that the project is consistent with the previously certified final EIR by
the City Council on 10/19/2005 and find that the Traffic Impact Assessment (TIA)
provided is a sufficient analysis of potential impacts to the internal circulation of
the shopping center.
3. Major Architectural Application to be reviewed by the Architectural Review
Committee (ARC) for final architectural approval.
TRAFFIC IMPACT ASSESSMENT:
The applicant hired Linscott, Law & Greenspan, Engineers (LLG) to conduct a Traffic
Impact Assessment (TIA) which was reviewed by the City Engineering Department.
LLG was tasked to prepare a report analyzing the new difference in trips anticipated
between current and future development to ensure that the proposed project would not
exceed the previously entitled development square-footage for The Springs Shopping
Center and to ensure that the trips will not exceed the previously entitled trip budget as
analyzed in the original 2005 EIR. In addition, an on-site circulation analysis was
performed for the proposed triple drive-through to ensure it will provide adequate
storage and that on-site circulation for the shopping center will be maintained. The TIA
is provided as an attachment to this Staff Memo.
Trip Generation:
The TIA provides detailed analysis of common traffic engineering standards that were
used to determine the total number of anticipated trips with the construction of the
Chick-Fil-A (CFA) and the demolition of Building I. Based upon the reduction of square
footage with the proposed project and the results of the trip generation comparison, LLG
concluded that the trips associated with the proposed project will not have an adverse
impact on the existing roadway network.
The original EIR determined that the total number of vehicles visiting the shopping
center daily would be 16,531 trips. The TIA used common traffic engineering practices
with a trip generation adjustment for pass-by vehicles to account for trips that are
already in the everyday traffic stream on the adjoining streets (E. Ramon Road, S. Gene
Autry Trail, and San Luis Rey Drive) and will stop as they pass by the CFA as a matter
of convenience on their path to another destination. This will account for 24% of the
anticipated visits to the restaurant during the PM peak time and 10% at the AM peak
time.

In Table 1 below, the total number of trips forecast to visit the shopping center with the
removal of Building I and the construction of the CFA will be 15,690 daily vehicles
equating to 640 less trips and within the originally analyzed EIR.

As shown at the bottom of Table 1 in the TIA, comparison of the trips generated by the
existing entitled land use to the trips generated by the proposed project shows that the
CFA will generate 640 fewer net daily trips than the approved EIR. According to the
report, based upon the reduction of square footage with the demolition of Building I and
the addition of CFA the results of the trip generation comparison shows that the project
will not have an adverse impact on the existing surrounding roadway network. From the
assessment, the anticipated trips with the proposed project are fewer than were
previously analyzed in the approved EIR for the site and therefore no further analysis is
required.
On-Site Circulation Evaluation:
The TIA analyzed the potential inbound and outbound vehicular paths that patrons of
the proposed CFA will utilize to access the site. Patrons will primarily utilize the two
existing driveways located along E. Ramon Road and the driveways located on S. Gene
Autry Trail, and San Luis Rey Drive. Based on the forecast trip generation the existing
shopping center driveways will adequately accommodate proposed traffic without
impacting traffic flow on surrounding roadways. The TIA provides Figure 4 and 5 in the
report and based upon the analysis the conclusion is made that on-site circulation is
adequate to serve the shopping center with the addition of the CFA.
Drive-Through Queuing Analysis:
The TIA analyzed queuing observations at four existing CFA sites in Irvine, San Juan
Capistrano, Yucaipa, and Santa Clarita to anticipate the number of vehicles that will
stack at the Palm Springs site (see Tables 2, 3 and 4 in the TIA). The TIA determined
that the average number of vehicles anticipated will be 19 or less 85% of the time. The

proposed project will provide storage for up to 49 vehicles within the proposed drive-
through lane without encroaching into the parking lot. Therefore, the 85th percentile
expected queues can be accommodated without interfering with internal circulation or
causing congestion in the parking lot. The TIA notes that the proposed 49 vehicle
storage drive-through lane can also accommodate the observed 95th percentile queues
occurring at the Yucaipa site which was a maximum of 31. The removal of the third
drive-through lane will reduce the number of vehicles able to stack by 13 which could
cause queuing into the parking lot during maximum peak times.
The TIA states that even though the drive-through queuing analysis demonstrates that
the proposed drive-through lanes will accommodate all potential vehicles, CFA will
implement the following program on an as-needed basis during peak operating times to
further ensure that vehicles will not queue back into the drive-aisle of the shopping
center or onto the public streets. The program consists of the following:
• Staff use iPad ordering system as team members greet vehicles in the drive-
through lanes during peak times. The iPad system allows team members to take
orders, receive payment, and assist in traffic movement within the parking lot.
• Face-to-face interaction with customers. Based on data from other comparable
stores, the iPad ordering system increases CFA drive-through speed of service
by 30% than the typical speaker box.
• Multiple lane drive-though concept implementation allows the second and third
drive-though lanes to be used for full order take and meal delivery, mobile order
pick-up lane, or for a pick-up point for smaller orders. The CFA operator has the
flexibility to use the second and third lanes as they see fit during peak demand.
• Traffic control will be maintained by CFA team members to regulate the drive-
through area after the pick-up window ensuring that only one vehicle will exit the
drive-through lane at one time.
SITE SPECIFIC COMMENTS FROM PLANNING COMMISSION:
The Planning Commission at the December 11, 2024 meeting gave directions to the
applicant regarding adjustments to the site plan and building architecture. Below is a
list of revisions followed by a description of actions or comments from CFA shown in
italics:
1. Evaluate the pedestrian connection from Ramon Road onto the site without
crossing the drive-through lanes.
The applicant studied moving the pedestrian crossing further to the west
along Ramon Road but settled on the original proposal as CFA staff will be
present for face-to-face ordering at this contact point.
2. Provide greater shading of the outdoor patio. Design the structure that will shield
the west and south facing sides plus add increased landscaping to help shade the
area.

The outdoor patio has been redesigned to add a low stone wall on the south
and west sides with metal horizontal louvers providing additional shading. In
addition, two large trees have been added to the adjacent landscaped area.
3. Provide separation from the outdoor patio from the drive-through lanes.
A low stone wall has been added to provide separation from the drive-through
lanes to the patio.
4. The Shopping Center ownership to bring the existing landscaping into
conformance with approved plans or provide a written phasing plan.
The Shopping Center owner provided a letter describing actions being taken
to restore the landscaping to the original plan. A new firm has been hired and
is currently implementing the attached phasing replanting plan. (see
attachments)
5. Revise the site plan to pull back the landscaped area on the east side of the
building to better align with the exit driveway.
The site plan has been revised to align the driveway.
6. Re-study the location of the ADA parking spaces.
The applicant has said that the stacking for the drive-through will not impede
vehicles from backing out of the ADA parking spaces and CFA staff will be on
site to help direct traffic. No change has been made.
7. Add palm trees to the perimeter of the site matching others in the Center.
The landscape plan shows the addition of palm trees at the perimeter of the
project site.
8. The building’s exterior to better relates to the rest of the shopping center by
examining the colors, or other elements beyond the stacked stone.
The applicant has said that the proposed colors will compliment and be not
contrast with the existing shopping center. Project architect will be available
for questions.
9. Revise landscaped plan including shade trees in the parking lot.
The landscape plan has been revised adding 36” box Mesquite shade trees in
the parking lot.
10. Study an alternate to the 3rd drive-through lane. Explain the process from
queuing, ordering, payment, meal fulfillment, exiting. Provide numbers served,
timing, and vehicles idling.
The Traffic Impact Assessment provides information related to the proposed
drive-through lanes.
REQUIRED FINDINGS:
This project’s conformance to the Conditional Use Permit findings of the Zoning
Ordinance is analyzed below.

CONDITIONAL USE PERMIT:
Section 94.02.00 of the Palm Springs Zoning Code (PSZC) requires that the following
conditions be met in order to approve a Conditional Use Permit:
1. That the use applied for at the location set forth in the application is properly one
for which a conditional use permit is authorized by this Zoning Code.
The proposed construction of one (1) quick service restaurant with three (3)
drive-through lanes within the M-1-P zone is a permitted use with the approval of
a Conditional Use Permit. Based on the finding the conditions has been met.
2. That the use is necessary or desirable for the development of the community, is
in harmony with the various elements or objectives of the general plan and is not
detrimental to existing uses or to future uses specifically permitted in the zone in
which the proposed use is to be located.
The General Plan designation of the subject property is Regional Business
Center (RBC) with an underlying zoning of M-1-P (Light Industrial) within a
Planned Development District. According to the General Plan, the RBC land use
designation is intended to accommodate a wide variety of business activities in a
multi-use environment and the RBC will provide job opportunities for the
residents of Palm Springs, and the whole Coachella Valley. Commercial, office,
and industrial uses that can be supported by their proximity to the freeway are
encouraged in this area. Uses are intended to provide large-scale development
opportunities that serve a region larger than the city proper. The proposed quick
service restaurant will be consistent with the retail services present within The
Springs Shopping Center. The redevelopment of the site will meet the following
General Plan Goals and Actions:
Goal LU1.4 – “encourage the introduction of new uses that are considered
to be of significant importance and contribute benefits to the City” the new
restaurant will provide economic benefits to the City and provide a source
of income for residents.
Goal LU8.3 – “encourage the development of specialty uses such as
restaurants that cater to the residents in close proximity to mixed/multi-use
areas” the location of the proposed project at the intersection of two major
throughfares within The Springs Shopping Center provides vehicular and
pedestrian access to the site for local residents and regional visitors.
Action LU8.3 – “continually monitor the preferred mix of uses withing
mixed/multi-use areas and encourage new uses that will provide new
services that complement existing uses” the elimination of an underutilized
in-line retail building with a new restaurant use is a response to changing
economic conditions and strengthens the mixed-use center.

Based upon the above enumerated findings relating to the General Plan Goals
and Actions the findings have been met.
3. That the site for the intended use is adequate in size and shape to accommodate
such use, including yards, setbacks, walls or fences, landscaping and other
features required in order to adjust such use to those existing or permitted future
uses of land in the neighborhood.
The project site is located within The Springs Shopping Center which is a big box
retail development consisting of a Home Depot as the major anchor store and
several other large buildings containing national retailers. The redevelopment of
Building “I” for the construction of Chick-Fil-A is appropriate for a site at the
intersection of Gene Autry Trail (State Highway 111) and East Ramon Road.
These are Major Thoroughfares with vehicle traffic counts at this intersection
among the most traveled within the Coachella Valley. The Springs Shopping
Center contains adequate parking and area to accommodate the use and
associated activity. Supporting studies have been provided stating that the
proposed site plan can adequately accommodate the traffic and circulation. The
auto-oriented nature of the mixed-use shopping center with the proposed
restaurant and drive-through lanes will provide convenience and accessibility to
patrons of the large retail center and the findings have been met.
4. That the site for the proposed use relates to the streets and highways properly
designed and improved to carry the type and quantity of traffic to be generated
by the proposed use.
The site is part of The Springs Shopping Center in an area comprised of multiple
large national retail stores near the corner of two main streets of South Gene
Autry Trail and East Ramon Road. Access to the restaurant will be from traffic-
controlled intersections and will primarily use the two existing driveways located
along E. Ramon Road and the driveways located on S. Gene Autry Trail, and
San Luis Rey Drive. Based on the forecast trip generation in the Traffic Impact
Assessment, traffic volume will be reduced as a result of this development and
the existing shopping center driveways will adequately accommodate proposed
traffic without impacting traffic flow on surrounding roadways. The proposed
building will meet all development standards for the zone per setbacks, heights,
lighting, and landscaping. The location of the quick service restaurant with three
(3) drive-throughs within the shopping center is an appropriate location for an
auto-reliant business. Access onto the site will be from existing driveways from
an internal street system which direct vehicles to signalized intersections. All
surrounding intersections are fully signalized with the appropriate number of
through and turning lanes. The introduction of a quick service restaurant would
not require additional traffic mitigation measures as the road network is fully built-
out and does not require modification to accommodate the anticipated traffic
volumes. Pedestrian access will be provided via existing sidewalks from East
Ramon Road. Based upon this determination the finding has been met.

5. That the conditions to be imposed and shown on the approved site plan are
deemed necessary to protect the public health, safety and general welfare and
may include minor modification of the zone’s property development standards.
The conditions imposed as part of this Conditional Use Permit are intended to
minimize impacts on the surrounding community. The CUP approval will work in
conjunction with the Major Architectural approval by the City. The site plan as
proposed will allow for the orderly development of the site as a quick service
restaurant with drive-through facilities.
ENVIRONMENTAL DETERMINATION:
The proposed development is a project as defined by the California Environmental
Quality Act (CEQA). The project was analyzed when the development was first
approved. As the proposal is less square footage than the razed building and there is no
increase in height resulting, it is determined that the project is consistent with the
previously certified final EIR by the City Council on 10/19/2005 and no further
environmental analysis is required.
CONCLUSION:
The proposal to demolish an under performing in-line retail building for the construction
of a new quick service restaurant with drive-throughs within The Springs Shopping
Center at the intersection of a two Major Thoroughfares near other auto oriented
businesses is an appropriate location. The proposal meets all the development
standards of the PSZC and conforms with the General Plan Land Use designation. A
Traffic Impact Assessment report was prepared determining that the traffic volume will
be less than originally anticipated in the original EIR, and on-site circulation will not be
impacted. The request for a triple lane drive-through with a large stacking capacity will
result in the maximum development potential of the site, however the auto-oriented
nature of the big box retail center at this specific location would not further contribute to
impervious surfaces from the existing conditions. The three (3) drive-throughs for an
anticipated high-volume restaurant are intended to quickly move vehicles through the
ordering and food pick-up process, reducing vehicle idling. Based upon the above
analysis, Staff recommends that the Planning Commission make the required findings
and approve the proposed project with conditions.

RESOLUTION NO.
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM SPRINGS, CALIFORNIA, APPROVING A CONDITIONAL USE
PERMIT APPLICATION CASE NO. CUP 2024-0001 FOR THE
REDEVELOPMENT OF BUILDING “I” TO INCLUDE THE DEMOLITION
OF AN EXISTING BUILDING FOR THE CONSTRUCTION OF A QUICK
SERVICE RESTAURANT NAMED CHICK-FIL-A WITH DRIVE-
THROUGH LOCATED AT 5200 EAST RAMON ROAD, ZONE M-1-P
(PDD 291).
THE PLANNING COMMISSION FINDS AND DETERMINES AS FOLLOWS:
A. Lilac 19, LLC, (“Applicant”) has filed a Conditional Use Permit (Case CUP 2024-
0001) with the City pursuant to Sections 94.02.00 (Conditional Use Permit); of the Palm
Springs Zoning Code for the construction of a one (1) quick service restaurant named
Chick-Fil-A at 5,707-square feet in size with seventy-eight (78) indoor seats and twenty-
four (24) outdoor seats with three drive-through lanes located at The Springs Shopping
Center, 5200 East Ramon Road. (This application, Case CUP 2024-0001 is referred to
herein as the “Project”.)
B. The property was posted with a “Project Under Consideration” sign on September
24, 2024 and a notice of a public hearing of the Planning Commission of the City of Palm
Springs to consider the Project was given in accordance with applicable law.
C. On December 11, 2024, the Planning Commission held a public hearing to
consider the Project in accordance with applicable law and voted to continue the hearing
to a date uncertain.
D. On March 25, 2025, the Planning Commission held a public hearing to consider
the Project in accordance with applicable law.
E. The proposed development is a project as defined by the California Environmental
Quality Act (CEQA). The project has been determined to be consistent with the certified
final EIR as approved by the City Council on October 19, 2005 as the proposal is less
square footage than the razed building and there is no increase in height resulting in no
further analysis required.
F. The Planning Commission has carefully reviewed and considered all of the
evidence presented in connection with the hearing on the Project, including, but not
limited to, the staff report, and all written and oral testimony presented.
G. Pursuant to Section 92.16.01(D)(7) of the M-1-P Zone in conformance with Section
94.02.00 of the Palm Springs Zoning Code for a Conditional Use Permit the Planning
Commission finds:

1. That the use applied for at the location set forth in the application is properly one

throughs within the shopping center is an appropriate location for an auto-reliant
business. Access onto the site will be from existing driveways from an internal
street system which direct vehicles to signalized intersections. All surrounding
intersections are fully signalized with the appropriate number of through and
turning lanes. The introduction of a quick service restaurant would not require
additional traffic mitigation measures as the road network is fully built-out and does
not require modification to accommodate the anticipated traffic volumes.
Pedestrian access will be provided via existing sidewalks from East Ramon Road.
Based upon this determination the finding has been met.

5. That the conditions to be imposed and shown on the approved site plan are
deemed necessary to protect the public health, safety and general welfare and
may include minor modification of the zone’s property development standards.
The conditions imposed as part of this Conditional Use Permit are intended to
minimize impacts on the surrounding community. The CUP approval will work in
conjunction with the Major Architectural approval by the City. The site plan as
proposed will allow for the orderly development of the site as a quick service
restaurant with drive-through facilities.
THE PLANNING COMMISSION RESOLVES:
That the findings and determinations reflected above are true and correct and are
incorporated by this reference herein as the cause and foundation for the action taken by
and through this Resolution. Based upon the foregoing, the Planning Commission hereby
approves Case CUP 2024-0001 for the construction of one (1) quick service drive-through
restaurant in The Springs Shopping Center located at 5200 East Ramon Road, subject
to the conditions of approval attached herein as Exhibit A.

CONDITIONS OF APPROVAL
Before final acceptance of the project, all conditions listed below shall be completed to the
satisfaction of the City Engineer, the Director of Planning Services, the Director of
Building and Safety, the Chief of Police, the Fire Chief or their designee, depending on
which department recommended the condition.
Any agreements, easements or covenants required to be entered into shall be in a form
approved by the City Attorney.
ADMINISTRATIVE CONDITIONS
ADM 1. Project Description. This approval is for the project described per Case CUP
2024-0001 except as modified by the conditions below.
ADM 2. Reference Documents. The site shall be developed and maintained in
accordance with the approved plans, date stamped March 12, 2025, including
site plans, architectural elevations and colors on file in the Planning Division
except as modified by the approved by conditions below.
ADM 3. Conform to all Codes and Regulations. The project shall conform to the
conditions contained herein, all applicable regulations of the Palm Springs
Zoning Ordinance, Municipal Code, and any other City, County, State and
Federal Codes, ordinances, resolutions and laws that may apply.
ADM 4. Minor Deviations. The Director of Planning or designee may approve minor
deviations to the project description and approved plans in accordance with
the provisions of the Palm Springs Zoning Code.
ADM 5. Indemnification. The owner shall defend, indemnify, and hold harmless the
City of Palm Springs, its agents, officers, and employees from any claim,
action, or proceeding against the City of Palm Springs or its agents, officers
or employees to attach, set aside, void or annul, an approval of the City of
Palm Springs, its legislative body, advisory agencies, or administrative
officers concerning Case CUP 2024-0001. The City of Palm Springs will

promptly notify the applicant of any such claim, action, or proceeding against
the City of Palm Springs and the applicant will either undertake defense of the
matter and pay the City's associated legal costs or will advance funds to pay
for defense of the matter by the City Attorney. If the City of Palm Springs fails
to promptly notify the applicant of any such claim, action or proceeding or fails
to cooperate fully in the defense, the applicant shall not, thereafter, be
responsible to defend, indemnify, or hold harmless the City of Palm Springs.
Notwithstanding the foregoing, the City retains the right to settle or abandon
the matter without the applicant's consent but should it do so, the City shall
waive the indemnification herein, except, the City's decision to settle or
abandon a matter following an adverse judgment or failure to appeal, shall not
cause a waiver of the indemnification rights herein.
ADM 6. Maintenance and Repair. The property owner(s) and successors and
assignees in interest shall maintain and repair the improvements including
and without limitation all structures, sidewalks, bikeways, parking areas,
landscape, irrigation, lighting, signs, walls, and fences between the curb and
property line, including sidewalk or bikeway easement areas that extend onto
private property, in a first class condition, free from waste and debris, and in
accordance with all applicable law, rules, ordinances and regulations of all
federal, state, and local bodies and agencies having jurisdiction at the
property owner’s sole expense. This condition shall be included in the
recorded covenant agreement for the property if required by the City.
ADM 7. Time Limit on Approval. Approval of this Conditional Use Permit shall be
valid for a period of two (2) years from the effective date of the approval.
Extensions of time may be granted by the Planning Commission upon
demonstration of good cause. Once constructed, the Conditional Use Permit,
provided the project has remained in compliance with all conditions of
approval, does not have a time limit.
ADM 8. Right to Appeal. Decisions of an administrative officer or agency of the City
of Palm Springs may be appealed in accordance with Municipal Code
Chapter 2.05.00. Permits will not be issued until the appeal period has
concluded.
ADM 9. Comply with City Noise Ordinance. This use shall comply with the provisions
of Section 11.74 Noise Ordinance of the Palm Springs Municipal Code.
Violations may result in revocation of this Conditional Use Permit.
ADM 10. Conditional Use Permit Availability. The applicant shall provide a copy of this
Conditional Use Permit to all buyers and potential buyers.

ENVIRONMENTAL ASSESSMENT CONDITIONS
ENV 1. Coachella Valley Multiple-Species Habitat Conservation Plan (CVMSHCP)
Local Development Mitigation Fee (LDMF) required. All projects within the
City of Palm Springs, not within the Agua Caliente Band of Cahuilla Indians
reservation are subject to payment of the CVMSHCP LDMF prior to the
issuance of certificate of occupancy.
ENV 2. California Fish & Game Fees Required. The project is required to pay a fish
and game impact fee as defined in Section 711.4 of the California Fish and
Game Code. This CFG impact fee plus an administrative fee for filing the
action with the County Recorder shall be submitted by the applicant to the
City in the form of a money order or a cashier's check payable to the
Riverside County Clerk prior to the final City action on the project (either
Planning Commission or City Council determination). This fee shall be
submitted by the City to the County Clerk with the Notice of Determination.
Action on this application shall not be final until such fee is paid. The project
may be eligible for exemption or refund of this fee by the California
Department of Fish & Game. Applicants may apply for a refund by the CFG
at www.dfg.ca.gov for more information.
PLANNING DEPARTMENT CONDITIONS
PLN 1. Sign Permits Required. No signs are approved by this action. All signs,
including temporary signs, shall be consistent with approved sign program for
The Springs Shopping Center. Amendment to the sign program will be
reviewed and approved in accordance with Section 93.20.00 (Signs) of the
Palm Springs Zoning Code (PSZC). No signs shall be installed without sign
permits.
PLN 2. Off-Street Parking. Parking for new building shall be accommodated by the
existing and newly constructed fifty-two (52) spaces on the leased area with
additional spaces as part of the overall Springs Shopping Center.
PLN 3. Water Efficient Landscaping Conformance. The project is subject to the
Water Efficient Landscape Ordinance (Chapter 8.60.00) of the Palm Springs
Municipal Code and all other water efficient landscape ordinances. The
applicant shall submit a landscape and irrigation plan to the Director of
Planning for review and approval prior to the issuance of a building permit.
Landscape plans shall be wet stamped and approved by the Riverside
County Agricultural Commissioner's Office prior to submittal. Prior to
submittal to the City, landscape plans shall also be certified by the local water
agency that they are in conformance with the water agency’s and the State’s
Water Efficient Landscape Ordinances.

PLN 4. Outdoor Lighting Conformance. Exterior lighting shall conform to Section
93.21.00, Outdoor Lighting Standards, of the Palm Springs Zoning Code.
Manufacturer's cut sheets of all exterior lighting shall be submitted to the
Planning Department for approval prior to the issuance of building permits.
No lighting of hillsides is permitted.
PLN 5. Outside Storage Prohibited. No outside storage of any kind shall be
permitted except as approved as a part of the proposed plan.
PLN 6. Property Use and CUP. If the use of the subject property is ever changed,
the City reserves the right to modify or revoke this Conditional Use Permit
application pursuant to Section 94.02.00(I) of the Zoning Code.

POLICE DEPARTMENT CONDITIONS
POL 1. Developer shall comply with Section II of Chapter 8.04 “Building Security
Codes” of the Palm Springs Municipal Code.
FIRE DEPARTMENT CONDITIONS
FD 1 These Fire Department conditions may not provide all requirements.
Owner/developer is responsible for all applicable state and locally adopted fire
codes. Detailed plans are still required for review. Conditions are subject to
final plan check and review.
FD 2 Fire Department Conditions were based on the 2022 California Fire Code as
adopted by City of Palm Springs, Palm Springs Municipal Code, PSFD
Appendix “T” Development Requirements and latest adopted NFPA
Standards.
FD 3 Conditions of Approval – “Conditions of Approval” received from the Palm
Springs Planning Department must be submitted with each plan set. Failure
to submit will result in a delay of plan approval.
FD 4 Plans and Permits (CFC 105.1):
Permits and scaled drawings are required for this project. Plan reviews can
take up to 20 working days. Submit a minimum of three (3) sets of drawings
for review. Upon approval, the Fire Prevention Bureau will retain one set.
A deposit for Plan Check and Inspection Fees is required at the time of Plan
Submittal. These fees are established by Resolution of the Palm Springs City
Council.

Complete listings and manufacturer’s technical data sheets for all system
materials shall be included with plan submittals. All system materials shall be
UL listed or FM approved for fire protection service and approved by the Fire
Prevention Bureau prior to installation.
Plans shall include all necessary engineering features, including all hydraulic
reference nodes, pipe lengths and pipe diameters as required by the
appropriate codes and standards. Plans and supporting data, (calculations
and manufacturers technical data sheets) including fire flow data, shall be
submitted with each plan submittal. Complete and accurate legends for all
symbols and abbreviations shall be provided on the plans.
FD 5 Access During Construction (CFC 503): Access for firefighting equipment
shall be provided to the immediate job site at the start of construction and
maintained until all construction is complete. Fire apparatus access roads
shall have an unobstructed width of not less than 24 feet and an unobstructed
vertical clearance of not less than 13'-6". Fire Department access roads shall
have an all-weather driving surface and support a minimum weight of 73,000
lbs.
FD 6 Required access (CFC 504.1): Exterior doors and openings required by
this code or the California Building Code shall be maintained readily
accessible for emergency access by the fire department. An approved access
walkway leading from fire apparatus access roads to exterior openings shall
be provided when required by the fire code official.
FD 7 Key Box Required to be Installed (CFC 506.1): Where access to or within a
structure or an area is restricted because of secured openings or where
immediate access is necessary for life-saving or fire-fighting purposes, the fire
code official is authorized to require a key box to be installed in an approved
location. The key box shall be flush mount type and shall contain keys to gain
necessary access as required by the fire code official.
• Key Box Contents (CFC 506.1): The Knox key box shall contain keys to all
areas of ingress/egress, alarm rooms, fire sprinkler riser/equipment
rooms, mechanical rooms, elevator rooms, elevator controls, plus a card
containing the emergency contact people and phone numbers for the
building/complex.
FD 8 Turning Radius: Fire access road turns and corners shall be designed with a
minimum inner radius of 25 feet and an outer radius of 43 feet.
FD 9 NFPA 13 Fire Sprinklers Required: An automatic fire sprinkler system is
required. Only a C-16 licensed fire sprinkler contractor shall perform system
design and installation. System to be designed and installed in accordance

with NFPA standard 13, 2016 Editions, as modified by local ordinance. Fire
pumps may also be required due to the size of the building.
FD 10 Fire Alarm System Required: An automatic or manual fire alarm system is
required. Only a C-10 licensed fire alarm contractor shall perform system
design and installation. System to be designed and installed in accordance
with NFPA standard 72, 2016 editions, as modified by local ordinance.
FD 11 Dead Ends: Dead-end fire apparatus roads in excess of 150 feet in length
shall be provided with an approved area for turning around a fire apparatus.
FD 12 Designated Fire Lanes: In private developments fire lanes shall not be less
than 24 feet in width (curb to curb) with no parking on either side and shall
be identified as fire lanes with red surb, stating in white lettering “NO
PARKING FIRE LANE”, or by approved signage, or by red curb with lettering
and signage.
FD 13 Private Fire Hydrants: This development may require private fire hydrants
and double check detector assemblies.
FD 14 Fire Department Access Roads/Driveways: Shall be provided so that no
portion of the exterior wall of the first floor of any building shall be more than
150 feet from such roads.
ENGINEERING DEPARTMENT CONDITIONS
STREETS
ENG 1. Any improvements within the public right-of-way require a City of Palm
Springs Encroachment Permit. All improvements are subject to inspection
and a 48-hour inspection notification is required.
RAMON ROAD
ENG 2. Remove and replace existing asphalt concrete pavement where required,
in accordance with applicable City standards.
ENG 3. All broken or off grade street improvements along the project frontage
shall be repaired or replaced.

ENG 4. The minimum pavement section for all on-site pavement to the drive
aisles and parking spaces shall be 3 inches asphalt concrete pavement
over 4 inches crushed miscellaneous base with a minimum subgrade of
24 inches at 95% relative compaction, or equal. If an alternative
pavement section is proposed, the proposed pavement section shall be
designed by a California registered Geotechnical Engineer using "R"
values from the project site and submitted to the City Engineer for
approval.
ENG 5. All on-site drive aisles shall be two-way with a minimum 24 feet wide
travelway (as measured from face of curb) where no parking is proposed.
ENG 6. On-site drive aisles and parking lot shall be constructed with curbs,
gutters, and cross-gutters, as necessary to accept and convey street
surface drainage of the on-site streets to the on-site drainage system, in
accordance with applicable City standards.
ENG 7. A clearly designated pedestrian walkway of adequate width shall be
provided to centralize a location for pedestrians entering or leaving the
retail areas and accessing the retail parking. Traffic signage, lighting,
pavement markings, and/or other visual cues shall be incorporated in the
design of the ground floor parking level to support the use of the walkway
by pedestrians and alert vehicles of the potential for crossing pedestrians.
SANITARY SEWER
ENG 8. All sanitary facilities shall be connected to the public sewer system via the
existing on-site private sewer system. The existing sewer service to the
property shall be used for new sanitary facilities. New laterals shall not be
connected at manholes.
GRADING
ENG 9. Submit a Precise Grading Plan prepared by a California licensed civil
engineer to the Engineering Services Department for review and approval.
The plan shall be approved by the City Engineer prior to grading permit
issuance.
a. A Fugitive Dust Control Plan shall be prepared by the applicant and/or its
grading contractor and submitted to the Engineering Services Department
for review and approval. The applicant and/or its grading contractor shall
be required to comply with Chapter 8.50 of the City of Palm Springs
Municipal Code, and shall be required to utilize one or more “Coachella
Valley Best Available Control Measures” as identified in the Coachella
Valley Fugitive Dust Control Handbook for each fugitive dust source such

that the applicable performance standards are met. The applicant’s or its
contractor’s Fugitive Dust Control Plan shall be prepared by staff that has
completed the South Coast Air Quality Management District (AQMD)
Coachella Valley Fugitive Dust Control Class. The applicant and/or its
grading contractor shall provide the Engineering Services Department with
current and valid Certificate(s) of Completion from AQMD for staff that
have completed the required training. For information on attending a
Fugitive Dust Control Class and information on the Coachella Valley
Fugitive Dust Control Handbook and related “PM10” Dust Control issues,
please contact AQMD at (866) 861-3878, or at http://www.AQMD.gov. A
Fugitive Dust Control Plan, in conformance with the Coachella Valley
Fugitive Dust Control Handbook, shall be submitted to and approved by
the Engineering Services Department prior to approval of the Grading
plan.
b. The first submittal of the Grading Plan shall include the following
information: a copy of final approved conformed copy of Conditions of
Approval; a copy of a final approved conformed copy of the Site Plan; a
copy of current Title Report; a copy of Soils Report; and a copy of the
project-specific Final Water Quality Management Plan.
ENG 10. Prior to approval of a Grading Plan (or issuance of a Grading Permit), the
applicant shall obtain written approval to proceed with construction from
the Agua Caliente Band of Cahuilla Indians, Tribal Historic Preservation
Officer or Tribal Archaeologist ( a copy of the written approval must be
provided to the City) . The applicant shall contact the Tribal Historic
Preservation Officer or the Tribal Archaeologist at ACBCI-
THPO@aguacaliente.net to determine their requirements, if any,
associated with grading or other construction. The applicant is advised to
contact the Tribal Historic Preservation Officer or Tribal Archaeologist as
early as possible. If required, it is the responsibility of the applicant to
coordinate scheduling of Tribal monitors during grading or other
construction, and to arrange payment of any required fees associated with
Tribal monitoring.
ENG 11. In accordance with an approved PM-10 Dust Control Plan, temporary dust
control perimeter fencing shall be installed. Fencing shall have screening
that is tan in color; green screening will not be allowed. Temporary dust
control perimeter fencing shall be installed after issuance of Grading
Permit, and immediately prior to commencement of grading operations.
ENG 12. Temporary dust control perimeter fence screening shall be appropriately
maintained, as required by the City Engineer. Cuts (vents) made into the
perimeter fence screening shall not be allowed. Perimeter fencing shall
be adequately anchored into the ground to resist wind loading.

ENG 13. Within 10 days of ceasing all construction activity and when construction
activities are not scheduled to occur for at least 30 days, the disturbed
areas on-site shall be permanently stabilized, in accordance with Palm
Springs Municipal Code Section 8.50.022. Following stabilization of all
disturbed areas, perimeter fencing shall be removed, as required by the
City Engineer.
ENG 14. The applicant shall obtain approvals to perform any off-site grading from
the record owner(s) of those adjacent properties to be impacted.
Approvals shall include, but not be limited to, a right-of-entry and
permanent slope easement, a maintenance and joint use agreement, or
other legally recognized approvals, subject to the review and approval by
the City Engineer and/or the City Attorney. Off-site approvals by the
adjacent property owner shall be required prior to approval of a grading
plan.
ENG 15. A Notice of Intent (NOI) to comply with the California General Construction
Stormwater Permit (Water Quality Order 2009-0009-DWQ as modified
September 2, 2009) is required for the proposed development via the
California Regional Water Quality Control Board online SMARTS system.
A copy of the executed letter issuing a Waste Discharge Identification
(WDID) number shall be provided to the City Engineer prior to issuance of
a grading or building permit.
ENG 16. This project requires preparation and implementation of a stormwater
pollution prevention plan (SWPPP). As of September 4, 2012, all
SWPPPs shall include a post-construction management plan (including
Best Management Practices) in accordance with the current Construction
General Permit. Where applicable, the approved final project-specific
Water Quality Management Plan shall be incorporated by reference or
attached to the SWPPP as the Post-Construction Management Plan. A
copy of the up-to-date SWPPP shall be kept at the project site and be
available for review upon request.
ENG 17. In accordance with City of Palm Springs Municipal Code, Section 8.50.022
(h), the applicant shall post with the City a cash bond of two thousand
dollars ($2,000.00) per disturbed acre at the time of issuance of grading
permit for mitigation measures for erosion/blowsand relating to this
property and development.
ENG 18. A Geotechnical/Soils Report prepared by a California registered
Geotechnical Engineer shall be required for and incorporated as an
integral part of the grading plan for the proposed development. A copy of

the Geotechnical/Soils Report shall be submitted to the Engineering
Services Department with the first submittal of a grading plan.
ENG 19. The applicant shall provide all necessary geotechnical/soils inspections
and testing in accordance with the Geotechnical/Soils Report prepared for
the project. All backfill, compaction, and other earthwork shown on the
approved grading plan shall be certified by a California registered
geotechnical or civil engineer, certifying that all grading was performed in
accordance with the Geotechnical/Soils Report prepared for the
project. Documentation of all compaction and other soils testing are to be
provided even though there may not be a grading plan for the
project. Prior to issuance of Building Permits.
ENG 20. The applicant shall provide Grading Certification for all building (or
structure) pads in conformance with the approved grading plan to the
Engineering Services Department for review and approval prior to
issuance of Building Permits.
ENG 21. In cooperation with the California Agricultural Commissioner and the
California Department of Food and Agriculture Red Imported Fire Ant
Project, applicants for grading permits involving a grading plan and
involving the export of soil will be required to present a clearance
document from a Department of Food and Agriculture representative in
the form of an approved “Notification of Intent To Move Soil From or
Within Quarantined Areas of Orange, Riverside, and Los Angeles
Counties” (Revised - RIFA Form CA-1) prior to approval of the Grading
Plan (if required). The California Department of Food and Agriculture

WATER QUALITY MANAGEMENT PLAN
ENG 22. This project shall be required to install measures in accordance with
applicable National Pollution Discharge Elimination System (NPDES) Best
Management Practices (BMP’s) included as part of the NPDES Permit
issued for the Whitewater River Region from the Colorado River Basin
Regional Water Quality Control Board (RWQCB). The applicant is
advised that installation of BMP’s, including mechanical or other means for
pre-treating contaminated stormwater and non-stormwater runoff, shall be
required.
ENG 23. A Final Project-Specific Water Quality Management Plan (WQMP) shall be
submitted to and approved by the City Engineer prior to issuance of a
grading or building permit. The WQMP shall address the implementation
of operational Best Management Practices (BMP’s) necessary to

accommodate nuisance water and storm water runoff from the site. Direct
release of nuisance water to the adjacent property (or public streets) is
prohibited. Construction of operational BMP’s shall be incorporated into
the Precise Grading and Paving Plan.
ENG 24. Prior to issuance of any grading or building permits, the property owner
shall record a “Covenant and Agreement” with the County-Clerk Recorder
or other instrument on a standardized form to inform future property
owners of the requirement to implement and maintain the approved Final
Project-Specific Water Quality Management Plan (WQMP). Other
alternative instruments for requiring implementation of the approved Final
Project-Specific WQMP include: requiring the implementation of the Final
Project-Specific WQMP in Home Owners Association or Property Owner
Association Covenants, Conditions, and Restrictions (CC&Rs); formation
of Landscape, Lighting and Maintenance Districts, Assessment Districts or
Community Service Areas responsible for implementing the Final Project-
Specific WQMP; or equivalent. Alternative instruments must be approved
by the City Engineer prior to issuance of any grading or building permits.
DRAINAGE
ENG 25. The applicant shall accept and convey all stormwater runoff across the
property and conduct the runoff to an approved drainage structure. On-site
retention may be allowed on that portion of the property where historically,
stormwater runoff is conveyed. All on-site grade slopes shall not be less
than 0.5%. If onsite retention is utilized, retention basin calculations shall
be provided to the City Engineer. This information required prior to site
plan approval.
ENG 26. This project shall be required to install measures in accordance with
applicable National Pollution Discharge Elimination System (NPDES) Best
Management Practices (BMP’s) included as part of the NPDES Permit
issued for the Whitewater River Region from the Colorado River Basin
Regional Water Quality Control Board (RWQCB). The applicant is
advised that installation of BMP’s, including mechanical or other means for
pre-treating contaminated stormwater and non-stormwater runoff, shall be
required by regulations imposed by the RWQCB. It shall be the
applicant’s responsibility to design and install appropriate BMP’s, in
accordance with the NPDES Permit, that effectively intercept and pre-treat
contaminated stormwater and non-stormwater runoff from the project site,
prior to release to the City’s municipal separate storm sewer system
(“MS4”), to the satisfaction of the City Engineer and the RWQCB. Such
measures shall be designed and installed on-site; and provisions for
perpetual maintenance of the measures shall be provided to the

satisfaction of the City Engineer, including provisions in Covenants,
Conditions, and Restrictions (CC&R’s) required for the development.
ENG 27. The project is subject to flood control and drainage implementation fees.
The acreage drainage fee at the present time is $4,898.47 per acre in
accordance with Resolution No. 15189. Fees shall be paid prior to
issuance of a building permit.
GENERAL
ENG 28. Any utility trenches or other excavations within existing asphalt concrete
pavement of off-site streets required by the proposed development shall
be backfilled and repaired in accordance with City of Palm Springs
Standard Drawing No. 115.
ENG 29. All proposed utility lines shall be installed underground.
ENG 30. All existing utilities shall be shown on the improvement plans if required for
the project. The existing and proposed service laterals shall be shown
from the main line to the property line.
ENG 31. Upon approval of any improvement plan (if required) by the City Engineer,
the improvement plan shall be provided to the City in digital format,
consisting of a DWG (AutoCAD drawing filetype) and PDF (Adobe Acrobat
document filetype) formats. Variation of the type and format of the digital
data to be submitted to the City may be authorized, upon prior approval by
the City Engineer.
ENG 32. The original improvement plans prepared for the proposed development
and approved by the City Engineer (if required) shall be documented with
record drawing “as-built” information and returned to the Engineering
Services Department prior to issuance of a final certificate of occupancy.
Any modifications or changes to approved improvement plans shall be
submitted to the City Engineer for approval prior to construction.
ENG 33. Nothing shall be constructed or planted in the corner cut-off area of any
intersection or driveway which does or will exceed the height required to
maintain an appropriate sight distance per City of Palm Springs Zoning
Code Section 93.02.00, D.
ENG 34. All proposed trees within the public right-of-way and within 10 feet of the
public sidewalk and/or curb shall have City approved deep root barriers
installed in accordance with City of Palm Springs Standard Drawing No.
904.

ENG 35. This property is subject to the Coachella Valley Multiple Species Habitat
Conservation Plan Local Development Mitigation Fee (CVMSHCP-LDMF).
The LDMF shall be paid prior to issuance of Building Permit.
TRAFFIC
ENG 36. A minimum of 48 inches of clearance for accessibility shall be provided on
public sidewalks. Minimum clearance on public sidewalks shall be
provided by either an additional dedication of a sidewalk easement if
necessary and widening of the sidewalk, or by the relocation of any
obstructions within the public sidewalk along the frontage of the subject
property.
ENG 37. A minimum of 48 inches of clearance for accessibility shall be provided on
public sidewalks or pedestrian paths of travel within the development.
ENG 38. All damaged, destroyed, or modified pavement legends, traffic control
devices, signing, striping, and street lights, associated with the proposed
development shall be replaced as required by the City Engineer prior to
issuance of a Certificate of Occupancy.
ENG 39. Construction signing, lighting and barricading shall be provided during all
phases of construction as required by City Standards or as directed by the
City Engineer. As a minimum, all construction signing, lighting and
barricading shall be in accordance with Part 6 “Temporary Traffic Control”
of the California Manual on Uniform Traffic Control Devices (CAMUTCD),
dated November 7, 2014, or subsequent editions in force at the time of
construction.

As requested, Linscott, Law & Greenspan, Engineers (LLG) is pleased to submit this
Traffic Impact Assessment for the proposed The Springs Chick-fil-A Project
(hereinafter referred to as Project). The project site is located at 5200 Ramon Road,
within The Springs Shopping Center, in the City of Palm Springs, California. Figure
1, located at the rear of this letter report, presents a Vicinity Map, which illustrates
the general location of the project site and depicts the existing surrounding street
system while Figure 2 presents an aerial depiction of the existing site.
Based on our understanding, a Traffic Impact Assessment has been required by the
City of Palm Springs to ensure that the proposed Project will not exceed the
previously entitled development square-footage for The Springs Shopping Center and
to ensure that the trips associated with the proposed Project will not exceed the
previously entitled trip budget for The Springs Shopping Center. An on-site
circulation analysis has also been required to ensure that the proposed drive-through
lanes will provide adequate storage and that adequate access and on-site circulation
for the shopping center will be maintained with construction of the proposed Project.
Our method of analysis, findings, and recommendations are detailed in the following
sections of this letter report.
PROJECT DESCRIPTION
The project site is located at 5200 Ramon Road, within The Springs Shopping
Center, in the City of Palm Springs, California. The Springs Shopping Center is a
393,000 square-foot (SF) shopping center that contains a home improvement store,
various retail uses, and various in-line food/restaurant uses. The project site is
currently occupied by a vacant retail shops building totaling 22,372 square feet (SF).

Figure 3 presents the proposed site plan for the proposed Project, prepared by CRHO
Architects. As shown, the proposed project will replace the existing vacant 22,372
SF retail shops building with a 5,707 SF Chick-fil-A restaurant with drive-through,
resulting in a reduction of 16,665 SF to the overall square-footage of the shopping
center. The Springs Shopping Center will provide 376,335 SF after completion of the
proposed Project. The proposed drive-through lane will provide stacking for up to
forty-nine (49) vehicles. Access to the shopping center is currently provided and will
continue to be provided via the two existing driveways located along Ramon Road,
via the two existing driveways located along Gene Autry Trail, via the three existing
driveways located along San Luis Rey Drive and via the one existing driveway
located along San Joaquin Drive.
PROJECT TRAFFIC GENERATION FORECAST
Traffic generation is expressed in vehicle trip ends, defined as one-way vehicular
movements, either entering or exiting the generating land use. The trip generation
equations used in this analysis are based on information found in the 9th Edition of
Trip Generation, published by the Institute of Transportation Engineers (ITE)
[Washington, D.C., 2012], consistent with the entitled development traffic analysis,
and also based on information found in the 11th Edition of Trip Generation, published
by ITE (Washington, D.C., 2021), consistent with current conditions.
Table 1 summarizes the trip generation equations used in forecasting the vehicular
trips generated by the proposed Project (i.e. The Springs Shopping Center with the
Proposed Chick-fil-A Project) and the existing entitled land use (i.e. the existing The
Springs Shopping Center) and presents a trip generation comparison. As shown in
the upper portion of Table 1, the trip generation forecast for the existing entitled land
use has been estimated using ITE Land Use 820: Shopping Center trip equations from
the 9th Edition of Trip Generation, which is consistent with the entitled development
traffic analysis and the trip generation potential of the proposed Project land use has
been estimated using ITE Land Use 820: Shopping Plaza Greater Than 150K trip
equations from the 11th Edition of Trip Generation, which is consistent with the
current required development traffic analysis. It should be noted that a fast-food land
use is a typical land use contained within a shopping center and therefore it is
appropriate to calculate the proposed The Springs Shopping Center development
based on total square footage and ITE Land Use 820: Shopping Center, consistent
with the entitled development traffic analysis.
A review of the middle portion of Table 1 indicates that The Springs Shopping Center
with the proposed Project is forecast to generate approximately 11,924 net daily trips,

with 320 net trips (199 inbound, 121 outbound) produced in the AM peak hour and
1,113 net trips (534 inbound, 579 outbound) produced in the PM peak hour on a
“typical” weekday. A review of the lower portion of Table 1 indicates that the
existing entitled land use (i.e. the existing The Springs Shopping Center) generates
approximately 12,564 net daily trips, with 323 net trips (201 inbound, 122 outbound)
produced in the AM peak hour and 1,139 net trips (547 inbound, 592 outbound)
produced in the PM peak hour on a “typical” weekday. It should be noted as shown
in Table 1, the gross daily trip generation for the existing entitled The Springs
Shopping Center is 16,531 daily trips consistent with the “trip budget’ identified in
City of Palm Springs City Council Resolution No. 21433 (page 8), which is greater
than the gross daily trip generation for The Springs Shopping Center with the
proposed Project at 15,690 daily trips.
In addition, the aforementioned trip generation includes adjustments for pass-by, to
account for trips that are already in the everyday traffic stream on the adjoining
streets (i.e. Ramon Road, Gene Autry Trail, San Luis Rey Drive, etc.) and will stop as
they pass by the Project site as a matter of convenience on their path to another
destination. Consistent with the City of Palm Springs City Council Resolution No.
21433 (page 8), the daily and PM peak hour pass-by reduction factor utilized in the
analysis is 24%. The AM peak hour pass-by reduction factor was estimated to be
10%.
Based on common traffic engineering practices, the traffic generated by the existing
entitled land use may be considered to represent a “trip credit” for the project site,
against which the impact of the proposed Project might be compared. As a result, as
shown in the last row of Table 1, comparison of the trips generated by the existing
entitled land use (i.e. the existing The Springs Shopping Center) to the trips generated by
the proposed Project (i.e. The Springs Shopping Center with the Proposed Chick-fil-A
Project) shows that the proposed Project will generate 640 fewer net daily trips, 3 fewer
net AM peak hour trips and 26 fewer net PM peak hour trips.
Based on the reduction of square footage for The Springs Shopping Center with the
proposed Project and the results of the aforementioned trip generation comparison, we
conclude that the trips associated with the proposed Project will not have an adverse
impact to the existing surrounding roadway network. In addition, the anticipated trips
with the proposed Project are fewer than what was previously analyzed in the
approved EIR for the site and therefore no further analysis is required.

ON-SITE CIRCULATION EVALUATION
Figures 4 and 5 present the potential inbound and outbound vehicular paths that
patrons of the proposed Project will utilize to access the project site, respectively,
based on the current and proposed layout of the shopping center with the Chick-fil-A.
As shown, patrons will primarily utilize the two existing driveways located along
Ramon Road and the driveways located each on Gene Autry Trail and San Luis Rey
Drive. Based on the forecast trip generation detailed above with the proposed Project,
the existing shopping center driveways will be able to adequately accommodate
proposed Project traffic without impacting traffic flow on Ramon Road, Gene Autry
Trail and San Luis Rey Drive. In addition, the overall layout of the proposed Project
does not impact the current or proposed vehicle-pedestrian conflict points, as there
are no changes to the current shopping center access design. Therefore, based on the
results of our evaluation, we conclude that the on-site circulation presented in Figure
4 and Figure 5 is adequate.
DRIVE-THROUGH QUEUING ANALYSIS
To confirm the adequacy of storage provided for the proposed drive-through lane,
existing queuing observations were conducted at the following four (4) existing
Chick-fil-A restaurants. A description of each existing restaurant is also provided
(i.e. dining options and drive-through lane configuration).
Chick-fil-A Irvine, located at 4127 Campus Drive
The restaurant provides indoor and outdoor dining. The drive-through
lane entrance starts as one lane that opens up to two lanes at the menu
boards and tapers back to one lane towards the pick-up window.
Chick-fil-A San Juan Capistrano, located at 31872 Del Obispo Street
The restaurant provides outdoor dining only (no indoor seating). The
drive-through lane entrance starts as two lanes and tapers back to one lane
towards the menu boards and remains as one lane to the pick-up window.
Chick-fil-A Yucaipa, located at 31479 Avenue E
The restaurant provides indoor dining and outdoor dining. The drive-
through provides two lanes throughout the entirety of the drive-through
(i.e. entrance to pick-up window).
Chick-fil-A Santa Clarita, located at 24180 Magic Mountain Parkway
The restaurant provides indoor dining and outdoor dining. The drive-
through provides one lane from the entrance of the drive-through to the
pick-up window.

Drive-through queuing observations were conducted at the four (4) locations on two
weekdays (Thursday and Friday) and on a Saturday during the morning, mid-day and
evening service periods, generally between the hours of 7:00 AM and 9:00 AM,
11:00 AM and 2:00 PM, and 4:00 PM and 8:00 PM. It should be noted that the drive-
through queuing observations conducted at the Santa Clarita Chick-fil-A were
conducted between 11:00 AM and 8:00 PM. The queuing observations for the Irvine
Chick-fil-A and San Juan Capistrano Chick-fil-A were conducted by Transportation
Studies Inc. (TSI) on Thursday December 9, 2021, Friday December 10, 2021 and
Saturday December 11, 2021. The queuing observations for the Yucaipa Chick-fil-A
were conducted by TSI on Thursday December 16, 2021, Friday December 17, 2021
and Saturday December 18, 2021. The queuing observations for the Santa Clarita
Chick-fil-A were conducted by TSI on Thursday May 19, 2022, Friday May 20, 2022
and Saturday May 21, 2022. The vehicular queues observed at the four (4) sites were
recorded at 5-minute intervals.
Tables 2, 3 and 4 summarize the Queue Frequency that was observed at the four (4)
sites for the weekday (Thursday), weekday (Friday) and weekend (Saturday) peak
periods, respectively. Our evaluation of this data indicates that on average during the
weekday (Thursday) peak periods, an average queue of 13 vehicles in the drive-
through lane can be expected, with an 85th percentile queue of approximately 19
vehicles, a 95th percentile queue of approximately 23 vehicles and a max queue of
approximately 27 vehicles. Similarly, our evaluation of this data indicates that on
average during the weekday (Friday) peak periods, an average queue of 14 vehicles in
the drive-through lane can be expected, with an 85th percentile queue of
approximately 19 vehicles, a 95th percentile queue of approximately 23 vehicles and a
max queue of approximately 31 vehicles. In addition, our evaluation of this data also
indicates that on average during the weekend (Saturday) peak periods, an average
queue of 10 vehicles in the drive-through lane can be expected, with an 85th percentile
queue of approximately 16 vehicles, a 95th percentile queue of approximately 19
vehicles and a max queue of approximately 27 vehicles. It should be noted that the
85th percentile queue is generally utilized when designing/sizing the length of the
proposed drive-through lane.
In conclusion, the four (4) study sites experienced an 85th percentile queue range
between 16 vehicles and 19 vehicles. Based on this empirical data, the expected
queue of the proposed Project will likely be 19 vehicles or less 85% of the time. As
stated previously, the proposed Project will provide storage for up to 49 vehicles
within the proposed drive-through lane without encroaching into the drive aisle.
Therefore, the 85th percentile expected queues can be accommodated without
interfering with internal circulation or causing congestion to the drive aisles. It
should be noted that the proposed 49 vehicle storage drive-through lane can also

accommodate the observed 95th percentile queues (i.e. queue range between 19
vehicles and 23 vehicles). Based on this empirical data, the expected queue of the
proposed Project will likely be 23 vehicles or less 95% of the time. Lastly, it should
be noted that the proposed 49 vehicle storage drive-through lane can also
accommodate the observed maximum queue of 31 vehicles, which only occurred one
time and only at one site throughout the survey days.
Appendix A presents the drive-through queuing study data for the four (4) existing
sites.
Even though the drive-through queuing analysis demonstrates that the proposed
drive-through lanes will accommodate all potential queues on site, Chick-fil-A staff
will implement the following program, on an as-needed basis during their peak
operating times, to further ensure that vehicles will not queue back into the drive-
aisles of the shopping center or onto the public streets (i.e. Ramon Road). The
program consists of the following as provided by Chick-fil-A management staff:
“Our restaurants are staffed so that if the drive-thru queuing begins to
extend beyond the drive-through lanes, team members go out and assist
with ordering via Chick-fil-A’s iPad ordering system. Our operators use
the iPad ordering during our peak hours of 11:30 am to 1:30 pm and any
additional time when needed. The iPad ordering system allows team
members to take orders, receive payment, and assist with traffic movement
within the parking lot.
Based on data from our other comparable stores, the iPad ordering system
increases the Chick-fil-A drive thru speed of service by 30% than the
typical speaker box. Putting people forward in the drive-through is one of
our biggest competitive advantages in the market because it personally
connects our team members with our valued guest. We want to continue
this momentum by building a platform to supporting current and future
innovations that increase capacity and put our people forward to care for
our guest in every interaction. Our customers enjoy the face to face
ordering over the standard drive-thru experience.”
Along with face-to-face ordering, Chick-fil-A implemented a multiple
lane drive-through concept from the entrance of the drive-through to the
pick-up window. The second and third drive-through lanes can be used
for full order take and meal delivery, mobile pick up lane, or for a pickup
point for smaller orders. The Operator has the flexibility to use the second
and third lanes as they see fit (during peak demand). Chick-fil-A team

members will take orders and deliver orders in all lanes, hence the
importance of the canopies to provide shade for the team members.
Appropriate safety signage and protocols are placed throughout the drive-
thru.
It should be noted that Chick-fil-A team members will control the drive-
through area after the pick-up window ensuring that only one vehicle will
exit the drive-through lane at a time after they receive their order.
CONCLUSION
Based on the reduction of square footage for The Springs Shopping Center with the
proposed Project and the results of the aforementioned trip generation comparison, we
conclude that the trips associated with the proposed Project will not have an adverse
impact on the existing surrounding roadway network. In addition, the anticipated
trips with the proposed Project are fewer than what was previously analyzed in the
approved EIR for the site and therefore no further analysis is required. We also
conclude that the on-site circulation presented in Figure 4 and Figure 5 is adequate
and that the proposed 49 vehicle storage for the proposed Chick-fil-A drive-through
lane is adequate to accommodate the observed queues of four (4) existing Chick-fil-A
study sites.
