HomeMy WebLinkAboutItem 5 - Gilbert - Denial PacketADMINISTRATIVE APPEALS BOARD STAFF REPORT DATE: February 26, 2025 SUBJECT: APPEAL OF THE ADMINISTRATIVE DECISION TO DENY A VACATION RENTAL CERTIFICATE TO OPERATE A VACATION RENTAL FOR A PROPERTY LOCATED AT 1172 DEEPAK RD., PALM SPRINGS, CALIFORNIA PURSUANT TO PALM SPRINGS MUNICIPAL CODE 5.25.045 BY: DEPARTMENT OF SPECIAL PROGRAM COMPLIANCE SUMMARY Adam Gilbert has requested an appeal of the administrative decision to deny a Vacation Rental Registration Certificate for the property located at 1172 Deepak Rd, pursuant to Palm Springs Municipal Code (PSMC) 5.25.45 related to the Vacation Rental Neighborhood Percentage Cap. RECOMMENDATION: 1) Open the Appeal Hearing and accept public testimony. 2) Adopt Resolution No. ______, A RESOLUTION OF THE ADMINISTRATIVE APPEALS BOARD OF THE CITY OF PALM SPRINGS, CALIFORNIA, ON THE APPEAL OF ADAM GILBERT FOR THE PROPERTY LOCATED AT 1172 DEEPAK RD, PALM SPRINGS, CALIFORNIA REGARDING THE DENIAL OF A VACATION RENTAL REGISTRATION CERTIFICATE. THIS PORTION OF PAGE BLANK Item 5 - Page 1 Administrative Appeals Board Staff Report February 26, 2025 Vacation Rental Appeal – 1172 Deepak Rd., Palm Springs Ordinance Background On October 17, 2022, the City of Palm Springs City Council adopted Interim Urgency Ordinance No. 2071 which established a 45-day moratorium of the issuance of new Vacation Rental Certificates due to potentially additional regulations on Vacation Rentals in the City. One significant issue decided was the scope of the temporary moratorium, in terms of which pending applications it would apply to. Properties for which a permit had not been issued, but for which a completed application had been received, options were presented to Council to include pausing the issuance of vacation permits that were applied for after the following dates:  September 22, 2022 (the date that the September 29, 2022, Council agenda was posted)  September 29, 2022 (the date of the City Council discussion of possible additional vacation rental regulations)  October 10, 2022 (the date the agenda for the October 17, 2022, agenda item was posted)  October 17, 2022 (the date of moratorium adoption) At this time, the City Council directed staff to use the October 17, 2022, as the effective date of the Moratorium and that no Certificate could be approved or issued. On November 28, 2022, the City of Palm Springs City Council adopted Ordinance 2075 terminating the moratorium adopted on October 17, 2022, and amending and restating Palm Springs Municipal Code 5.25 – Vacation Rentals. Ordinance 2075 defined “New permittee” as a property for which a complete application for a vacation rental registration certificate was filed with the city after October 17, 2022.” Ordinance 2075 defined “Existing Permittee” as a property for which a vacation rental registration certificate has been issued, or for which a complete application has been filed with the city, on or before October 17, 2022. Ordinance 2075 established a cap on the number of Vacation Rental Registration Certificates that can be issued, based on the percentage of those certificates that are issued in a particular Neighborhood in relation to the number of total dwelling units within that Neighborhood. Additionally, the Neighborhood-based cap would not affect any existing certificates that have already been issued by the City, even in Neighborhoods that exceed the percentage cap. Vacation Rental Application Background On October 3, 2022, the Department of Special Program Compliance received an application for a Vacation Rental Registration Certificate, for the property located at 1172 Deepak Rd., on behalf of Adam Gilbert from Kevin Francis, a local property manager. Item 5 - Page 2 Administrative Appeals Board Staff Report February 26, 2025 Vacation Rental Appeal – 1172 Deepak Rd., Palm Springs On October 3, 2022, Special Program Compliance staff sent an email to the property manager asking for missing documents before processing could occur. These documents were: proof of insurance, file stamped grant deed and the pool inspection invoice. On October 14, 2022, Special Program Compliance staff received an email from the property manager resolving the missing insurance document that was requested on October 3, 2022. During the period between October 3, 2022, and October 27, 2022 Special Program Compliance staff conducted title searches to verify if the official county file stamped grant deed was accessible. It wasn’t until October 27,2022 that staff was able to print the missing file stamped grant deed on behalf of the applicant. The date of the recording was October 12, 2022. On October 27, 2022, it was confirmed that the missing insurance and pool certification invoice documents had been received by the applicant and staff added the file stamped grant deed to the application material, date stamping the application as received. On January 23, 2023, the application was rejected and returned to the owner/applicant via certified mail and email. The rejection letter also included a waitlist application. (ATTACHMENT 4) On June 6,2023, the Special Program Compliance staff received a completed wait list application for the owner of record for the property located at 1172 Deepak Rd. On August 28, 2023, the Department of Special Program Compliance staff mailed and emailed a letter regarding the appeal process available to owners whose applications were not accepted or was impacted by the moratorium and the newly adopted regulations. (ATTACHMENT 5). As mentioned in the letter dated August 28, 2023, there was discussion to bring exemption requests to City Council for review and approval. Exemption requests included, but not limited to, properties that were under construction during Ordinance proceedings and properties that were in Escrow. However, the City chose to not take exemption requests to the City Council, but rather, accept appeal request pursuant to Palm Springs Municipal Code Chapter 2.50 – Administrative Appeals Board. An appeal was received July 2, 2024 for the property located at 1172 Deepak Rd. Staff Analysis The Vacation Rental Application was received complete on October 27, 2022, 10-days after the date selected by City Council on which applicants would be considered “new” and be affected by the moratorium and which applicants would be considered “existing” Item 5 - Page 3 Administrative Appeals Board Staff Report February 26, 2025 Vacation Rental Appeal – 1172 Deepak Rd., Palm Springs which staff could continue processing under the then Ordinance in effect, Ordinance 1918. Ordinance 2075 adopted November 28, 2022, established a cap on the number of Vacation Rental Registration Certificates that could be issued, based on the percentage of those certificates that are issued in a particular Neighborhood in relation to the number of total dwelling units within that Neighborhood. The property located at 1172 Deepak Rd., is in the Movie Colony East neighborhood. At the time of application rejection, the Vacation Rental Percentage for Movie Colony East was 23.45% with 6 on the waiting list. (ATTACHMENT 6) As of February 6, 2025, Movie Colony East is at 19.78% with 24 applicants on the waiting list. The neighborhood has 147 Vacation Rentals and 743 residential units. With 743 residential units, the maximum number of Vacation Rental Certificates that can be active is 148. In the event the VR Neighborhood Percentage Cap has been exceeded for a particular neighborhood, and additional complete applications are on file with the city for Vacation Rental Registration Certificates within that neighborhood, if and when the VR Neighborhood Percentage falls below the applicable VR Neighborhood Percentage Cap for that neighborhood, any additional certificates for that neighborhood shall be issued in order of the date on which complete applications were filed with the city. The current owner of 1172 Deepak Rd. is number 8 on the waiting list. Staff recognizes that during the ordinance proceedings with City Council, there were conversations regarding how to administer applicants who had submitted completed applications in the Vacation Rental work que, and regarding prospecting applicants that were currently in remodel or construction phase of their property, or in Escrow, thus not able to apply before the October 17, 2022, no formalized path was decided, rather, only that completed applications received on or before October 17, 2022 would be considered “existing permittees” whom would not be affected by the newly adopted rules with respect to neighborhood cap limitations. In conclusion, staff is recommending upholding the staff decision to deny the application for a Vacation Rental Certificate for the property located at 1172 Deepak Rd. due to the restrictions set forth in Palm Springs Municipal Code 5.25.045 – Caps on Certificates based on Neighborhood. Additionally, staff recommends denial of the appeal pursuant to Palm Springs Municipal Code Chapter 2.50.080(b) as the appeal was received outside the required 10 day and 15 day filing requirement. The following Palm Springs Municipal Codes sections are applicable to this matter. The Palm Springs Municipal Code §5.25.030 Definitions, reads as follows: Item 5 - Page 4 Administrative Appeals Board Staff Report February 26, 2025 Vacation Rental Appeal – 1172 Deepak Rd., Palm Springs "Vacation Rental" means a single-family dwelling, or any portion thereof, utilized for occupancy for dwelling, lodging, or sleeping purposes without the Owner being present for a period of twenty-eight (28) consecutive days or less,…” "New permittee" means a property for which a complete application for a vacation rental registration certificate was filed with the city after October 17, 2022. "Existing permittee" means a property for which a vacation rental registration certificate has been issued, or for which a complete application has been filed with the city, on or before October 17, 2022. "VR neighborhood percentage" means a percentage derived by dividing the total number of residential dwelling units within a neighborhood that have been issued a vacation rental registration certificate (not counting any junior vacation rental registration certificates) by the total number of residential dwelling units within that neighborhood, and multiplying that quotient by 100. "VR neighborhood percentage cap" means the maximum VR Neighborhood percentage allowed by the city council in each neighborhood. The VR Neighborhood Percentage Cap is set at 20%. This VR Neighborhood Percentage Cap may be adjusted by the city council by ordinance or resolution. The Palm Springs Municipal Code § 5.25.045 Caps on Certificates based on Neighborhood, reads as follows: The city shall not issue any new vacation rental registration certificate, other than junior vacation rental registration certificates, in any neighborhood in which the VR Neighborhood Percentage Cap has been exceeded or would, with the issuance of any such certificate, be exceeded. In the event the VR Neighborhood Percentage Cap has been exceeded for a particular neighborhood, and additional complete applications are on file with the city for vacation rental registration certificates within that neighborhood, if and when the VR Neighborhood Percentage falls below the applicable VR Neighborhood Percentage Cap for that neighborhood, any additional certificates for that neighborhood shall be issued in order of the date on which complete applications were filed with the city (i.e., on a "first in time, first in right" basis). Jurisdiction: This administrative hearing is conducted in accordance with Palm Springs Municipal Code 2.50 which confers jurisdiction upon the Administrative Appeals Board. WHEREAS On October 17, 2022, The City of Palm Springs City Council adopted Interim Urgency Ordinance No. 2071 which established a 45-day moratorium of the issuance of new Vacation Rental Certificates due to potentially additional regulations on Vacation Rentals in the City; and WHEREAS, Interim Urgency Ordinance No. 2071 identified the scope of the temporary moratorium, in terms of the effective date of October 17, 2022, that any applications received after October 17, 2022, could not be approved or certificates issued; and WHEREAS, a completed Vacation Rental Application was received on October 27, 2022, for the property located at 1172 Deepak Rd; and WHEREAS, On November 28, 2022, the City of Palm Springs City Council adopted Ordinance 2075 terminating the moratorium adopted on October 17, 2022, and amending and restating Palm Springs Municipal Code 5.25 – Vacation Rentals; and WHEREAS, Palm Springs Municipal Code Section 5.25.045 reads “The city shall not issue any new vacation rental registration certificate, other than junior vacation rental registration certificates, in any neighborhood in which the VR Neighborhood Percentage Cap has been exceeded or would, with the issuance of any such certificate, be exceeded”; and WHEREAS, On January 23, 2023, the Department of Special Program Compliance staff rejected and returned the application received on October 27, 2022, pursuant to Palm Springs Municipal Code 5.25.045; and WHEREAS, on August 28, 2023, the Department of Special Program Compliance staff administered a letter to the owner of 1172 Deepak Rd., with respect to the appropriate path of appeal for the rejection of the application received on October 17, 2022; and Item 5 - Page 8 Resolution No. Page 2 WHEREAS, Adam Gilbert, owner for the property located at 1172 Deepak Rd., filed an administrative appeal of the denial of Vacation Rental Registration Certificate for the property located at 1172 Deepak Rd., Palm Springs with the City Clerk; and WHEREAS, the Administrative Appeals Board opened and conducted a duly noticed Administrative Appeal Hearing on February 26, 2025; and WHEREAS, the Administrative Appeals Board was presented evidence of the denial of the Vacation Rental Certificate pursuant to Section 5.25.045 of the Palm Springs Municipal Code due to the property located at 1172 Deepak rd., located in the Organized Neighborhood Movie Colony East was at or above the 20 percent Vacation Rental Neighborhood Cap; and WHEREAS, the Administrative Appeals Board has carefully reviewed and considered all the evidence presented in connection with said appeal on February 26, 2025; and THE ADMINISTRATIVE APPEALS BOARD HEREBY FINDS, after due consideration given to the relevancy, weight and credibility of testimony and evidence, and based upon a preponderance of the evidence in accordance with the Board’s procedures, as follows: SECTION 1. Where to file your Appeal Mail your completed Written Notice of Appeal Form and your appeal fee to: City of Palm Springs Office of the City Clerk 3200 E. Tahquitz Canyon Way Palm Springs, CA 92262 Scheduling the Appeal Hearing The Office of the City Clerk will schedule your Appeal within forty-five (45) days of receiving the Written Notice of Appeal Form and appeal fee. You will be mailed written notice to the address specified on your form; this will indicate the time and place for your Appeal Hearing with the Administrative Appeals Board. This notice will be mailed to you at least ten (10) calendar days prior to your Hearing date. Appearing at the Appeal Hearing Failure to appear at your scheduled Hearing shall constitute a forfeiture of the fine and a failure to exhaust the Appellant’s administrative remedies. At the Appeal Hearing, you will be required to take an oath, and you may present your testimony or evidence (either written or verbal) concerning the violation. All hearings are open to the public. After the Appeal Hearing The Administrative Appeals Board will render its decision within fifteen (15) days following the conclusion of the hearing of the appeal, unless extended for good cause. No later than five (5) days following the Appeals Board decision the City Clerk will mail a copy of the decision to the Appellant. The Appeals Board decision constitute final administrative action on the matter. If the Hearing Officer dismisses the Administrative Citation, the penalty and the appeal fee will be returned to the appellant. If the Hearing Officer upholds the administrative citation the penalty and the appeal fee are retained by the City and the property owner or individual receiving the citation must correct the violation or face criminal prosecution and/or the imposition of additional administrative penalties.
