Please forward the ADDENDUM comment to the appropriate Planning Director,
Assistant Planning Director and Architectural Board for tonight's ARC hearing on PS
Fulfillment Center. This is an Addendum to the Comment Letter received from Oswit
Land Trust this morning. I am an independent consultant to Oswit Land Trust.
I am concerned at the absence of criteria in the City's municipal ordinance for awarehouse development permit and/or a major architectural permit (includingtheir findings requirements) addressing building massing, scale, and height. The city's ordinances seem deficient in thresholds or methods to assess the impact of
multiple warehousing buildings built within the M-2 zone at maximum capacity. How
does the ARC or the Planning Commission assess these impacts and address them?
Are standards or criteria for review required in the ordinances or general plan as it
was in a California legal case where the Noise Element of the General Plan wasdeficient in noise standards, which led to invalidating a permit to allow trucks throughresidential neighborhoods?
As it stands now, the City appears to assume that as long as these mega-buildingsmeet the maximum zoning 'development standards' set for the area, the developerhas an 'entitlement' to build, and there is no environmental impact. This would also
assume that at the time the zoning standards for height, bulk, and mass were set
(was this 2022?), there was a full environmental assessment of the impact of
changing the standards. From reviewing the record in 2022, a Notice ofExemption was filed by the City when the height and massing was created.
It is the request of Oswit Land Trust that the City of Palm Springs review this legalquestion and determine whether its ordinances due an adequate job of settingstandards for review of building mass, height, and scale, particularly after allowingwarehousing buildings at the scale of 95 feet and 60% lot coverage.
