A.CALL TO ORDER:
A regular meeting of the Palm Springs Public Arts Commission was called to order by
Chair Gary Armstrong on Thursday, April 4, 2024, at 5:30 p.m.
B.ROLL CALL:
Present: Commissioners Carlos Silveira, Tom Burns, Shawnda Thomas Faveau, Vice
Chair Newkirk and Chair Armstrong. Not present: Commissioners Melissa Shelton and
Christopher Ramirez.
City Staff: Director, Jay Virata
C.PRESENTATIONS:
D.ACCEPTANCE OF AGENDA:
MOTION BY VICE CHAIR NEWKIRK, SECONDED BY COMMISSIONER BURNS,
CARRIED 5-0 TO ACCEPT THE AGENDA.
E.PUBLIC COMMENTS:
Jodie Diaz passed around a photo of the entrance to north Palm Springs at Indian Canyon
to indicate what she believes is an eyesore and an important area that is not being kept
up. She would like the public arts commission to consider doing something to beautify
this entrance to Palm Springs. She also expressed interest in seeing the George Floyd
mural relocated and preserved and in finding a fundable solution for the James O. Jessie
mural.
D.REMARKS FROM THE CHAIR:
The Chair shared that several initiatives were progressing well, including the Eco-Walk
project which was recently given the green light to add art in the area. He also shared that
because we have to work within the system, with multiple departments and with the rules
of the Brown Act governing our actions, the commission should expect things to move
slowly.

G.APPROVAL OF MINUTES: Minutes from the meeting of March 7, 2024.
MOTION TO APPROVE THE MINUTES WAS MADE BY COMMISSIONER SILVEIRA
AND SECONDED BY COMMISSIONER BURNS. THE MOTION CARRIED 5-0 TO
APPROVE THE MINUTES.
H.PUBLIC HEARING: Consider Resolution No. MUR-2024-0001 “A RESOLUTION OF
THE PUBLIC ARTS COMMISSION OF THE CITY OF PALM SPRINGS,
CALIFORNIA, APPROVING AN ART MURAL APPLICATION FOR “DESERT SUN
AND PALM TREE” BY MURALIST SEAN SPELLMAN LOCATED ON THE NORTH
AND SOUTH ELEVATION OF THE BUILDING AT 284 SOUTH INDIAN CANYON
DRIVE (CASE MUR-2024-0005).
The owner of the Drift Hotel, Philip Bates was on hand to answer questions. He confirmed
that the artwork would not be used in any advertising, marketing, or literature.
MOTION TO APPROVE RESOLUTION No. MUR-2024-0001 WAS MADE BY
COMMISSIONER BURNS AND SECONDED BY COMMISSONER SILVEIRA. THE
MOTION CARRIED 5-0.
I.ITEMS FOR DISCUSSION/APPROVAL:
1.Discuss next steps for the James O. Jessie Mural by Richard Wyatt, Jr., entitled
“Desert Highland Mural Project. -- It was pointed out that the mural is jointly owned
by the city and Mr. Wyatt who would like to have a say on what happens to the art.
If it’s to be restored, he would like to choose the restorer. Commissioner Faveau
shared that the community was open to considering not only restoration, but also
the tile option. Director Virata added that a new agreement with Mr. Wyatt would
be needed. It was decided that Director Virata would work with Commissioner
Faveau to get a new agreement to Mr. Wyatt. Chair Armstrong said the agreement
should lay out a range of fees so as to cap costs and it outline a succession plan
for Mr. Wyatt’s share of the mural’s ownership, should anything happen to him.
2.Approve removal of George Floyd Mural from storefront located at 317 North
Indian Canyon and discuss repair and potential new locations for the mural. -- On
behalf of the community, Commissioner Faveau went on the record to share that
the mural should not be destroyed or put in storage, and that an effort should be
made to relocate and preserve the art. Chair Armstrong shared that it was never
intended to be a permanent part of the City’s collection. A decision was made to
table the discussion and explore potential new locations to move the mural to after
removing the graffiti.

3.Approve Scope of Work for the public art inventory. -- Director Virata shared that
the next steps would be to request proposals, score, review and select a vendor
from among them.
4.Reschedule July 4, 2024 meeting due to Fourth of July holiday. It was decided to
cancel the July meeting and if matters such as proposal for the art scape came in
where a decision was needed before the August meeting, the Commission might
have a special meeting to review the designs.
MOTION TO CANCEL THE JULY 4TH MEETING WAS MADE BY VICE CHAIR
NEWKIRK AND SECONDED BY COMMISSONER BURNS. THE MOTION CARRIED
5-0.
J.PROJECT UPDATES:
1.Pillars of Palm Springs – The Chair shared that installations were scheduled,
Public Works was being cooperative, and a dedication ceremony was planned for
Monday, April 15th.
2.The team learned that they are able to place the horses 10 feet from the curb
without requiring an encroachment or approval from Riverside County. Once key
decisions are made, the project is to go to Council for approval.
K.REPORT FROM DIRECTOR/STAFF:

ADJOURNMENT: The Public Arts Commission adjourned to a meeting on May 2, 2024,
at 5:30 p.m. in the Large Conference Room of Palm Springs City Hall located at 3200 E.
Tahquitz Canyon Way.

BURNS CARRIED 5-0 TO ADJOURN at 6:43 PM TO A REGULAR MEETING ON
APRIL 4, 2024, AT 5:30 PM IN THE LARGE CONFERENCE ROOM OF CITY HALL
LOCATED AT 3200 E. TAHQUITZ CANYON WAY.
