CONSTRUCTION PERMIT RULES®ULATIONS
1. Applicant shall indemnify and save harmless the City of Palm Springs, its officers and agents from allsuitsoractionsofeverynameanddescriptionbroughtfor,or on account of any injuries or damagesreceivedorsustainedbyanypersonorpersons,by or from the applicant, his servants or agents intheconstructionofwork,or by or in consequence of any negligence in guarding the same or forimpropermaterialsorworkmanshipusedinitsconstruction.2. Liability insurance and/or Performance Bond may be required of the permittee whenever in thejudgmentoftheCityEngineer, it becomes necessary or advisable.3. City Inspector must be contacted a MINIMUM of 48 hours prior to requested inspection of project forschedulingpurposes.Inspections not expressly mentioned in the foregoing schedule or unnecessaryre-inspections may be subject to additional permit fees.4. All concrete pouring for subsurface structures must be done in the presence of a City Inspector.5. Final approval of curbs with depressions will not be issued until a driveway approach has beenconstructedandapproved.
6. Barricades must be kept on all trenches,excavations and obstructions. Lights must be maintained atnight.All signs,flags, lights and other warning and safety devices shall conform to the requirementssetforthinthecurrentMUTCD,California supplemental,issued by the California Department ofTransportation.
7. Failure to install barricades which are subsequently placed by the City of Palm Springs to protect thepublicshallbebilledtotheapplicantperthecurrentfeeschedule.8. Access to fire hydrants shall be maintained at all times.9. Access to adjacent driveways shall be maintained during construction. No streets may closedwithoutpriorauthorizationfromtheCityEngineerorhisauthorizedrepresentative,10. Construction debris or unused materials shall be removed from the property immediately followingcompletionofthework. No materials of any kind are to be stored or stock piled within the public rightofwaywithoutpriorapprovalfromtheEngineerorhisauthorizedrepresentative.11. This permit is not valid unless signed by the City Engineer or his authorized representative.12. This permit expires twelve months from the date of issuance.13. This permit must be kept at the project site during the execution of the work.14. It shall be the responsibility of the applicant to identify and notify all applicable utility providers andeffectedgovernmentagenciespriortoanyconstructionwhichmayinvolveundergroundoroverheadfacilitiesorenchroachmentintoexistingeasements.15. It is the permitee's responsibility to contact Underground Service Alert of Southern California,a.k.a.,DigAlert(dial 811)for utility location prior to any excavation.16. The work done shall be guaranteed for a period of one year. Failure of the City inspector to detectflawsintheworkshallnotrelievetheapplicantofthisresponsibility.17, Forms and subgrades must be inspected and approved before ordering Portland cement concrete orasphalticconcrete. Sewers and other pipelines must be inspected and approved priorto backfilling.Failure to arrange for inspection prior to proceeding with work may result in the removal of the work.18. Laboratory and/or field compliance testing of construction materials and compaction efforts may berequiredwhendeemednecessarybytheCityEngineerorhisauthorizedrepresentative,19. When required by the Engineer or his authorized representative a construction schedule shall besubmittedandapprovedpriortobeginningwork.20. When required by the Engineer or his authorized representative a traffic control plan shall besubmittedandapprovedpriortobeginningwork.
CITY OF PALM SPRINGS INDEMNIFICATION AGREEMENT
In application for and issuance of a permit to commence work as identified on the permit associated
therefore, the Applicant as noted on the permit hereby agrees as follows:
To the fullest extent permitted by law, Applicant shall defend (at Applicant's sole cost and expense),
indemnify, protect, and hold harmless City, its elected officials, officers, employees, agents, andvolunteers (collectively the "Indemnified Parties"), from and against any and all liabilities, actions,
suits, claims, demands, losses, costs, judgments, arbitration awards, settlements, damages,demands, orders, penalties, and expenses including legal costs and attorney fees (collectivelyClaims"), including but not limited to Claims arising from injuries to or death of persons (Applicant'semployeesincluded), for damage to property, including property owned by City, from any violation of
any federal, state, or local law or ordinance, and from errors and omissions committed by Applicant,its officers, employees, representatives, and agents, that arise out of or relate to Applicant'sperformanceunderthisPermit. This indemnification clause excludes Claims arising from the sole
negligence or willful misconduct of the City, its elected officials, officers, employees, agents, andvolunteers. Under no circumstances shall the insurance requirements and limits set forth in this
Permit be construed to limit Applicant's indemnification obligation or other liability under this Permit.
Applicant's indemnification obligation shall survive the expiration or earlier termination of this Permit
until all actions against the Indemnified Parties for such matters indemnified are fully and finallybarredbytheapplicablestatuteoflimitationsor, if an action is timely filed, until such action is final.
This provision is intended for the benefit of third party Indemnified Parties not otherwise a party to thisPermit.
