SUBJECT: APPEAL OF THE ADMINISTATIVE CITATION AB0747 AND
ADMINISTRATIVE DECISION OF A SIX-MONTH SUSPENSION OF THE
VACATION RENTAL REGISTRATION CERTIFICATE FOR THE
PROPERTY LOCATED AT 2040 E. JOYCE DRIVE., PALM SPRINGS,
CALIFORNIA.

SUMMARY
David Trapani has requested an appeal of a litany of items as stated on his Written Notice
of Appeal Form; however, only administrative citation AB0747 issued in the amount of
$2,500 and the six (6) month suspension of the Vacation Rental Registration Certificate
#2306 for the property located at 2040 E. Joyce Drive, Palm Springs (“Subject Property”),
California is subject to appeal. Mr. Trapani has since sold the Subject Property, therefore,
the issue of the six (6) month suspension is moot, leaving only the fine amount of $2,500
being contested.
RECOMMENDATION:
1) Adopt Resolution No. ______, A RESOLUTION OF THE ADMINISTRATIVE
APPEALS BOARD OF THE CITY OF PALM SPRINGS, CALIFORNIA, ON THE
APPEAL OF DAVID TRAPANI FOR THE PROPERTY LOCATED AT 2040 E.
JOYCE DRIVE, PALM SPRINGS, CALIFORNIA REGARDING ADMINISTRATIVE
CITATION AB0747 ISSUED IN THE AMOUNT OF $2,500 AND THE SIX-MONTH
SUSPENSION OF VACATION RENTAL REGISTRATION CERTIFCATE #2306.
Background
The property located at 2040 E. Joyce Drive, Palm Springs, California was registered as
a Vacation Rental with Vacation Rental Registration Certificate #2306. The start date was
August 2, 2018. On August 3, 2024, Code Compliance responded to a call for music
beyond the property line, the investigation resulted in Citation A8851 being issued to the
responsible renter for music audible at property line, Palm Springs Municipal Code
5.25.070(g). The citation was not contested by the renter and the fine was paid in full on
August 5, 2024. As part of their investigation, Code Compliance verifies if the owner
complied with PSMC 5.25.070(h):

“Prior to occupancy pursuant to each separate occasion of rental of a
vacation rental, the owner or the owner's agent or representative shall enter
into a written contract with a responsible person where: (1) the responsible
person will provide the responsible person's name, age, address, and a
copy of a government issued identification; (2) establishes and sets out the
terms and conditions of the contract, including without limitation, occupancy
limits, noise prohibitions, and vehicle parking requirements; (3) requires the
responsible person to acknowledge and agree that he or she is legally
responsible for compliance of all occupants of the vacation rental or their
guests with all provisions of this chapter and/or the municipal code; (4) the
owner or the owner's agent provides a copy of the "Good Neighbor
Brochure" to the responsible person; (5) the responsible person provides a
list of all guests by name; and (6) the responsible person provides a list of
all guests' vehicles, including license plate numbers. Each contract shall be
maintained by the owner or the owner's agent for a minimum of four years
and shall be readily available for inspection upon request of the
enforcement official. A summary or abstract of the written contract, in a form
approved by the enforcement official, shall be filed with the enforcement
official prior to each applicable occupancy, in a manner approved by the
enforcement official, and shall be posted in a conspicuous location on the
vacation rental property and shall be made available on site at the
request of an enforcement official.”
Further investigation by Code Compliance revealed that Mr. Trapani has a history of
failing to submit contract summaries prior to occupancy with the City throughout the seven
years of operating a vacation rental. On August 3, 2024, Code Officer Jason Whittaker
contacted Mr. Trapani and left a voicemail explaining the situation and that an operational
audit would be conducted, this is standard protocol when an offense of failure to submit
contract summaries is determined. In addition to the phone call, an email was sent
requesting the required documents, , including the "City of Palm Springs Vacation Rental
Statement of Rules and Regulations" forms and the "Completed Reservations" report
from Airbnb.com, covering all guest stays from January 2023 through August 2024. A
deadline of August 8, 2024, was set for submission. To date, the property owner has not
submitted the requested documents. Further examination of the guest reviews on the
Airbnb listing revealed that at least 38 short-term guest stays had occurred between
January 2023 and December 2023, and around 11 more stays between January 2024
and August 2024, with no contract summaries submitted for any of these stays.

David Trapani requested an extension to the deadline. On August 5, 2024, Code
Compliance Supervisor Mitch Nabhan granted an extension until August 15, 2024. On
August 8, 2024, another extension was granted by Veronica Goedhart until September 9,
2024, with the documents still not being submitted by the property owner.
Unbeknownst to Special Program Compliance staff, David Trapani was subject to a
Transient Occupancy Tax (TOT) audit conducted by the City’s Finance Department. TOT

audits are conducted randomly, and the Department of Special Program Compliance is
not notified of the commencement of said audit.
STAFF ANALYSIS
The owner for the property located at 2040 E. Joyce Drive was issued administrative
citation AB0747 for failure to file contract summaries to the Enforcement Official as
required by The Vacation Rental Ordinance 2075 for guests stays of 28 days or less at a
Vacation Rental.
The Vacation Rental Ordinance No. 2075 (Palm Springs Municipal Code 5.25) requires
the submittal of a Contract Summary prior to each separate guest stay of 28 days or less
at a Vacation Rental. This Contract Summary allows the Office of Special Program
Compliance Department to verify the contract limitations outlined in Palm Springs
Municipal Code Section 5.25.070(b).
Palm Springs Municipal Code (PSMC) 5.25.070(b) states “A Contract includes any
occupancy of a property subject to a Vacation Rental registration certificate by persons
other than the Owner when the Owner is not present during such occupancy, regardless
of whether compensation is paid for such occupancy or whether occupancy is evidenced
in an agreement or document”.
Contract Summary acknowledgement and notification
Each application that was completed between 2018 and 2023 included Section E –
Vacation Rental Regulations. This section requires owners to initial that they understand
and comply with Palm Springs Municipal Code Chapter 5.25. Specifically, in this matter,
a section that is required to be initialed for understanding and compliance informs the
owner of the requirement to submit a summary of the contract prior to occupancy.
Attachment 5 shows Section E initialed and signed for each registration period. The
dates of the initials and signatures are below:

On August 2, 2018, staff sent an email confirming that the application was fully processed.
Among the information communicated included a link and instruction to complete Contract
Summaries.
Administrative staff conducted Contract Summary audits in calendar years 2020/2021.
2040 E Joyce was found to have operated as a short-term rental, but did not submit the
required Contract Summaries for such stays. This was identified by comparing who
submitted Transient Occupancy Tax and submitted Contract Summaries. Letters were

sent to David M Trapani Trust, the owner on file at the time. These letters are included as
Attachment 6 and summarized below:
March 30, 2020 – Failure to submit Contract Summaries in the month of December
2019
August 29, 2020 - Failure to submit Contract Summaries in the month of January
2020
December 29, 2020 - Failure to submit Contract Summaries in the month of
September 2020 (sent certified)
August 4, 2021 – Failure to submit Contract Summaries in the month of April 2021.
It is important to note that in general, Contract Summaries are not permitted to be
submitted retro-actively in the Contract Summary tool. However, during this time, the
Department of Special Program Compliance goal was identification and education and
owners who received the letters were permitted to retro-actively submit Contract
Summaries so that records would be on file.
The department did receive response to the letters. The department received the records
shown in Attachment 7 which show print outs of the Contract Summary submission tool,
printed on May 4, 2020, for two stays that occurred in December 2019. This would be in
response to the March 30, 2020, letter.
Additionally, records show that Contract Summaries were submitted retroactively on
August 22, 2021, for stays in April 2021 as shown below:

2021, letter.
Staff finds that based on the information reviewed, that short-term vacation rental use at
the property 2040 E. Joyce Drive occurred and Contract Summaries were not submitted
as required prior to a guest stay of 28-days or less and proceeded to issue administrative
citation number Ab0747 in the amount of $2,500.00 to David Trapani, the owner on title,
for failure to file a contract summary to the Enforcement Official prior to occupancy of the
Vacation Rental. The Administrative Citation was mailed by staff to the mailing address
located on the title report.
Pursuant to Palm Springs Municipal Code 5.25.090(d) the Vacation Rental Certificate
was suspended for a period of six-months; however, it should be noted that the owner of

the property sold the property on September 27, 2024, and a suspension of the vacation
rental certificate is no longer relevant.
The following Palm Springs Municipal Code Sections are applicable to this matter:
The Palm Springs Municipal Code §5.25.030 Definitions, reads as follows:
"Vacation Rental" means a single-family dwelling, or any portion thereof,
utilized for occupancy for dwelling, lodging, or sleeping purposes without
the Owner being present for a period of twenty-eight (28) consecutive days
or less,”
Palm Springs Municipal Code §5.25.070(b) reads as follows:
No more than thirty-two (32) Contracts for Vacation Rental use of a
property shall be allowed or provided in any calendar year; however, up to
four (4) additional Contracts shall be allowed or provided for the Third
Quarter of a calendar year so long as the entire term of each such
Contract occurs during such Third Quarter A Contract includes any
occupancy of a property subject to a Vacation Rental registration
certificate by persons other than the Owner when the Owner is not present
during such occupancy, regardless of whether compensation is paid for
such occupancy or whether occupancy is evidenced in an agreement or
document.
Palm Springs Municipal Code §5.25.070(h) reads as follows:

Responsible Person provides a list of all guests’ vehicles, including license
plate numbers. Each Contract shall be maintained by the Owner or the

shall be posted in a conspicuous location on the Vacation Rental
property and shall be made available on site at the request of an
Enforcement Official”.
Palm Springs Municipal Code §5.25.090(d) reads as follows regarding the administrative
fines:
“Any person who advertises a Vacation Rental without including the
Vacation Registration Certificate in any advertising for such Vacation
Rental, or operates a Vacation Rental without a contract, or without
providing the City with a summary or abstract of such contract, or
without timely tendering full monthly payments of transient occupancy tax,
shall pay a fine in the amount of Two Thousand, Five Hundred Dollars
($2,500.00) and the Owner’s Vacation Registration Certificate shall be
suspended for six (6) months for a first offense and shall pay a fine in the
amount of Five Thousand Dollars ($5,000.00) and the Owner’s Vacation
Registration Certificate shall be revoked for a second offense. Any
subsequent violations will be subject to the provisions of Subsection (c) of
this Section”.
Despite Mr. Trapani’s Exhibit “A”, the simple fact is that Mr. Trapani upon registering his
property as a vacation rental property agreed to abide by the regulations set forth in
PSMC 5.25. The ability to rent your home as a secondary and ancillary use is not a right,
in exchange for the ability to do so, the owner attests that they will abide by the
regulations. Mr. Trapani owned and operated a vacation rental without complaint for
seven years up and until he was asked to comply with audits which he failed to provide
the required documents per the municipal to show compliance. The City’s Special
Program Compliance staff provided Mr. Trapani numerous extensions to gain compliance
only to be responded with threats of litigation.
On September 15, 2024, Mr. Trapani, via email submitted a Request for Documents,
requesting 116 documents. In California, you can file a Request for Documents at any
point after initiating a lawsuit. This request is a legal tool used in civil litigation; it is not
used to request documents for personal investigation. To comply with Mr. Trapani’s
request, the document was treated as a Public Records Request. A Public Records
Request allows any member of the public to access government records, with exceptions.
The California Public Records Act has many exemptions and several of Mr. Trapani’s
request were for documents protected by State law. All documents subject to disclosure
were provided. Mr. Trapani’s statement that he is unable to respond to an audit consisting
of contract summaries for his guest stays being contingent on the City providing
documents is simply untrue.
The appeals board should find that Mr. Trapani is in violation of PSMC 5.25.070(h), failure
to submit contract summaries.
Therefore, the fine amount for $2,500 is valid and should be upheld.

Jurisdiction: This administrative hearing is conducted in accordance with Palm
Springs Municipal Code 2.50 which confers jurisdiction upon the Administrative Appeals
Board.
WHEREAS, David Trapani did not file a Contract Summary for an occupancy 28
days or less;
WHEREAS, any person who operates a Vacation Rental and fails to submit a
contract summary to the Enforcement Official, shall be liable to the City an
administrative fine in the amount of Two Thousand and Five Hundred Dollars
($2,500.00), and shall have the Vacation Rental Registration Certificate suspended for a
period of six-months, Palm Springs Municipal Code 5.25.090 (d); and
WHEREAS, “Vacation Rental” means a single-family dwelling, or any portion
thereof, utilized for occupancy for dwelling, lodging, or sleeping purposes without the
Owner being present for a period of twenty-eight (28) consecutive days or less; and
WHEREAS, On August 2, 2024, the City investigated and determined that the
Vacation Rental Property 2040 E. Joyce Drive, hosted guests for a period of twenty-
eight (28) consecutive days or less; and
WHEREAS, Administrative Citation No. AB0747 failure to file a Contract
Summary was issued on September 17, 2024 to David Trapani for the property located
at 2040 E. Joyce Drive, Palm Springs; and
WHEREAS, David Trapani, filed an administrative appeal of the Administrative
Citation No. AB0747 for failure to file a Contract Summary prior to an occupancy for the
property 2040 E. Joyce Drive, Palm Springs to the Enforcement Official with the City
Clerk and paid the appeal fee; and
WHEREAS, the Administrative Appeals Board opened and conducted a duly
noticed Administrative Appeal Hearing on January 22, 2025; and

WHEREAS, the Administrative Appeals Board was presented prima facie
evidence that David Trapani., violated Section 5.25.070 (h) of the Palm Springs
Municipal Code; and
WHEREAS, the Administrative Appeals Board has carefully reviewed and
considered all the evidence presented in connection with said appeal on January 22,
2025; and
THE ADMINISTRATIVE APPEALS BOARD HEREBY FINDS, after due
consideration given to the relevancy, weight and credibility of testimony and evidence,
and based upon a preponderance of the evidence in accordance with the Board’s
procedures, as follows:
SECTION 1.
The Appellant is in violation of Palm Springs Municipal Code 5.25.070(h).
The Administrative Appeals Board upholds the administrative decision of a six-
month suspension of the Vacation Rental Registration Certificate and the
Administrative Fine of $2500.00 to David Trapani., for the property located at
2040 E. Joyce Drive, Palm Springs
The Appellant is not in violation of Palm Springs Municipal Code 5.25.070(h).
The Administrative Appeals Board overturns the administrative decision of a six-
month suspension of the Vacation Rental Registration Certificate and the
Administrative Fine of $2500.00 to David Trapani., for the property located at
2040 E. Joyce Drive, Palm Springs

Dear David M Trapini Trust,
Palm Springs Municipal Code (“PSMC”) section 5.25.070(h) requires that a summary or abstract of a written
Vacation Rental contract be filed with the Department of Special Program Compliance (“Department”) prior to
each separate guest stay of 28 days or less. This abstract or summary assist the Department with verifying that
the contract limitations outlined in PSMC 5.25.070(b) are followed.
A review of your file indicates that you have not submitted any contract summaries for the month of
December, 2019. It is imperative that all contract summaries for this time period be submitted to our office no
later than April 7, 2020. The summaries may be delivered in person, or by mail to 425 N Civic Dr, Palm Springs,
CA, 92262 or via email to Shantel.Sterling@palmspringsca.gov.
Failure to comply with this requirement constitutes a violation of the PSMC and maybe subject to an
Administrative Citation Penalty of $2,500 and a six‐month suspension of the Vacation Rental Certificate, in
accordance with PSMC section 5.25.090(d). If you have any questions, please contact our Department at

This letter serves as a warning and any future violation found by the Department during a review or audit of
these files, pursuant to PSMC 5.25.080, will be subject to the full extent of PSMC 5.25.090(d).

This letter serves to inform you are currently not in compliance with Palm Springs Municipal Code

contract be filed with the Department of Special Program Compliance (“Department”) prior to each
separate guest stay of 28 days or less. This is the second violation of your permit.
A review of your file indicates that you have not submitted any contract summaries for the month of
January, 2020. This noncompliance must be resolved no later than August 27, 2020, by you providing all
required summaries by such date. The summaries can be uploaded to our Contract Summary tool by
visiting our website www.psvacationrentalcompliance.com and selecting “Submit Contract Summary”
on the left menu column.
Failure to comply with this requirement constitutes a violation of the PSMC and will result in an
Administrative Citation Penalty of $2,500 and a six-month suspension of the Vacation Rental Certificate,
in accordance with PSMC section 5.25.090(d). This letter serves as a final warning, and any future
violation found by the Department will be subject to the full extent of penalties provided under PSMC
5.25.090(d).
