PLANNING COMMISSION MEETING AND STUDY SESSION MINUTES
December 11, 2024

CALL TO ORDER:
Chair Weremiuk called the meeting to order at 5:30 p.m.
ROLL CALL:
Present: Chair Weremiuk, Baker, Miller, Murphy, Morrill, Rotman
Excused: None.
Staff Present: Planning Director Christopher Hadwin, Principal Planner Ken Lyons, Associate
Planner Glenn Mlaker, Principal Planner Edward Robertson, Attorney Jim Priest,
Engineering Assistant Jonathan Samaniego, Administrative Specialist Anita
Fields.
REPORT OF POSTING OF AGENDA: Agenda available for public access at the City Hall
exterior bulletin board (west side of Council Chamber) and the Planning Services counter by 9:00
pm on Thursday, December 5, 2024.
ACCEPTANCE OF THE AGENDA:
Commissioner Baker moved, seconded by Commissioner Miller, to accept the Agenda.

EXCUSED: None.
PUBLIC COMMENT: Comments regarding Item 2B spoke to a review of greenhouse gases, the
2005 EIR, and the banal design.
1. CONSENT CALENDAR: None.
2. PUBLIC HEARINGS:
A. A REQUEST BY STACEY NELSON, OWNER, FOR APPROVAL OF A
CONDITIONAL USE PERMIT TO ESTABLISH AN EXISTING SINGLE-FAMILY
DWELLING AS AN ACCESSORY DWELLING UNIT TO ALLOW A NEW PRIMARY
DWELLING UNIT TO BE CONSTRUCTED ON A ROUGHLY 23,533-SQUARE FOOT
PARCEL LOCATED AT 2772 ANZA TRAIL, APN 513-130-016, ZONE R-1-B,
GENERAL PLAN: “VLDR” (VERY LOW DENSITY RESIDENTIAL); Case #CUP-

RECOMMENDATION:
1. Open the public hearing and receive testimony.
2. Close the public hearing and adopt a resolution determining the application eligible
for a Class 3 Categorical Exemption pursuant to the guidelines of the California
Environmental Quality Act (“CEQA”) and approve the application based on findings
subject to conditions in Exhibit “A”.
Ken Lyon, Principal Planner, presented the Staff Report and answered questions of the commission.
Stacey Nelson, owner and applicant, spoke and answered questions of the commission.
Commissioner Rotman moved, seconded by Commissioner Morrill, to continue to a date-certain of
January 8, 2025, so they can obtain clarification regarding:
1.The access to the casita and how it is oriented on the site
2. The relationship between the three buildings
2. If the kitchen remains in the existing ADU structure.

EXCUSED: None.
B. A REQUEST BY LILAC 19, LLC, FOR A CONDITIONAL USE PERMIT FOR THE
REDEVELOPMENT OF BUILDING “I” AT THE SPRINGS SHOPPING CENTER TO
INCLUDE THE DEMOLITION OF AN EXISTING BUILDING FOR THE
CONSTRUCTION OF A QUICK SERVICE RESTAURANT NAMED CHICK-FIL-A
WITH A DRIVE-THROUGH LOCATED AT 5200 EAST RAMON ROAD, ZONE M-1-P
(PDD 291) (CASE NO CUP 2024-0001) (GM).
RECOMMENDATION:
1. Open the public hearing and receive testimony.
2. Close the public hearing and adopt the approval resolution.
Glenn Mlaker, Associate Planner, presented the Staff Report and answered questions of the
commission.
Jonathan Samaniego, City Engineering Assistant, spoke and answered questions of the commission.
Jim Priest, City Attorney, spoke and answered questions of the commission.
Jerimiah Cover, 4G Development and Consulting, for Chick-fil-A and the property owner, applicants,
spoke and answered questions of the commission.
Eric Baker, Chick-fil-A, and David Pack, Operator of Chick-fil-A Palm Desert, for the applicant, spoke
and answered questions of the commission.
Sarah Withers, Manager, Kerry Kramer, Leasing Department, Springs Shopping Center, for the
applicant, spoke and answered questions of the commission.
Chair Weremiuk moved, seconded by Commissioner Rotman, to continue to a date uncertain so
traffic, environmental concerns and landscaping can be further reviewed along with the following:

1. The shopping center’s landscaping is brought into compliance.
2. The landscaping plans consider additional shade trees and surrounding landscaping.
3. Staff and the city attorney consider whether additional environmental analysis is required to
supplement the 2005 EIR, specifically to examine the proposed three lanes of drive through
and interior traffic.
4. The applicant provide traffic analysis to support the proposed site plan and internal circulation.
5. Provide data that supports 3 drive-through lanes and considers an alternate plan with 2 lanes.
6. The Architectural Review Committee should look at the architectural elements for cohesion.

4. NEW BUSINESS:
A. A REQUEST BY MSA CONSULTING, INC. ON BEHALF OF EMP 2, LLC, FOR A
STUDY SESSION TO REVIEW A PROPOSED SUBDIVISION OF APPROXIMATELY
22 ACRES OF UNDEVELOPED LAND INTO SIX LOTS FOR A FUTURE
DEVELOPMENT WITHIN PLANNING AREA 1 (PA 1) OF THE ESCENA
DEVELOPMENT LOCATED AT 1000 NORTH GENE AUTRY TRAIL, ZONED PDD
231, CASE NO. STM-2024-0005- (ER).
RECOMMENDATION: Provide preliminary comments to staff and the applicant.
Fernando Dutra, Sun Cal Development, for the applicant, made a presentation and answered
questions.
Edward Robertson, Principal Planner, presented the Staff Report and answered questions.
Public comments spoke to density, amenities, traffic, maintenance as a gated community,
annexation of the properties into Escena, and egress.
The Commission discussed applicable General Plan and Housing Element policies, as well as State
law, which impose a minimum density on the site.
Discussion item only; no action taken.
PLANNING COMMISSION REPORTS, REQUESTS AND COMMENTS:
Chair Weremiuk will provide details regarding the Holiday Staff Party at the next meeting.

PLANNING DIRECTOR’S REPORT:
Director Hadwin noted that an appeal regarding the Fulfillment Center that was approved on
December 4, 2024, is anticipated to be heard at the January 23, 2025 City Council meeting.
The update to the General Plan will be heard at the January 9, 2025 City Council meeting.
ADJOURNMENT: The Planning Commission Study Session adjourned at 8:52 p.m. to the next
regular meeting at 5:30 pm, Wednesday, January 8, 2025.
