Our names are Misti Rausch and Sean Reynolds, and we are proud lifelong residents of the
Coachella Valley. We are also small business owners in the city of Palm Springs. We have
each worked at our restaurant for over 12+ years and purchased it (Native Foods) in 2023.
We are writing to you today to urge the city to deny In and Out’s application to build on the
recently demolished Bank of America location in the Smoketree Village shopping center.
Our reasons are as followed:
1.The residents of Palm Springs do not want another fast food restaurant that will attract
homeless people and illegal activity. Our property management at Smoketree Village
already has a severely understaffed security and maintenance crew. That team struggles
to handle the constant barrage of trespassing and crime that is committed within the
shopping center.
2.In and Out is going to adversely affect the sales of the locally owned, small businesses
that are already located in our shopping center - not only our restaurant but Low Desert,
Teriyaki Yogi, Giuseppe’s, Smokin Burgers and Pho 533 will lose sales we desperately
need.
3. The city of Palm Springs is should be dedicated to sustainability and fighting climate
change - approving any new drive throughs (especially three lanes) is a direct
contradiction of these goals. The stretch of East Palm Canyon between Sunrise and
Farrell is already badly congested with traffic and idling cars will create more air
pollution. Idling cars also omit greenhouse gases that directly contribute to climate
change.
Thank you for taking the time to listen to our concerns. We hope that the best decision is made
for the small business owners & residents of Palm Springs.

Item 3D I urge you to enact a moratorium on drive-through developments. A recent planning commission hearing
for CHICK-FIL-A relied on an ERS that was prepared in 2005 when this area was mostly vacant and undeveloped. The
ERS needs to be updated as the air quality in Palm Springs is often deemed unhealthy by the AQMD. This is another
fast food drive through among many others in the location and I urge you to consider the guidelines and
recommendations consistent with the Blue Zone Project adopted by Palm Springs and reject this request.
Conclusion: I agree with Mayor Ron deHarte’s statement: ‘with the city’s numerous ongoing projects and initiatives,
emphasizing priorities of quality of life, economic development, and becoming a “we can” city…maintaining the
unique character and appeal of Palm Springs. I urge you to enact a moratorium on drive-through developments.

I appreciate your consideration of a moratorium on new drive-thrus in the city. Please DO enact such a moratorium
until an analysis can be completed as to where they should best be located and how they should be designed.
Citing one possibility as an example, locating an In-n-Out Burger at Smoketree Village with a drive-thru is simply
not appropriate, nor is a drive-through appropriate in many other locations in the city that are located so far from the
freeway. Drive-throughs cause congestion, are inherently unfriendly to pedestrians, and require a large amount of
paved surfaces.
The recent closure of several bank buildings along E Palm Canyon at Smoketree, along with the very long standing
vacant restaurant building in that location, represent a great opportunity to re-think a large parcel in the city at a key
location. I would strongly recommend that you direct your staff to develop a more detailed plan for this location. A
string of free-standing fast food restaurants is a long-obsolete concept that is no longer appropriate in a city like
Palm Springs. Higher quality and denser development here that could result from such a plan would benefit the
businesses in Smoketree as well as create a more friendly frontage along E Palm Canyon, and could create better
pedestrian flow between the street and the mall.
Please take advantage of a unique opportunity and declare a moratorium on drive-throughs and a new plan for this
important area.

cameras throughout Palm Springs City boundaries.
Please consider the Public good over the willingness of city officials to continue to negatively
impact city residents and guests with it's desires to install a complete surveillance system that
impedes the everyday person with the uncertainty of Government intrusion into their private

The establishment of Animal's to detect desired "Scents" could and has been flawed in prior
incidents throughout the world.
Please reconsider any forced animal training/service within the City of Palm Springs,

Pleaae accept this letter in opposition of this organization continued desire to install a
complete surveillance system that impedes the everyday person in the City of Palm Springs,
California.
It's reasonable to consider that the newly approved "radar" system designed for this type of
drone deployment was conspired in advance of this matter of increasing the City's drone
supply with supporting equipment.
It's not reasonable to have drones navigate City sky's without the safety aspect of having the
drone operator(s) having a continuous unimpeded visual view of the drone activities.
Furthermore, aerial reconnaissance (surveillance) over City Residents (private properties) is
extremely alarming to be considered by progressive elements (Palm Springs enforcement
agency) and potentially undesirable government and private sector agencies. It's been
repeatedly demonstrated that "Trust" in the Palm Springs City Government have been
degrading for a number of years.
Simply, the City of Palm Springs and It's internal administration(s) can't be trusted to monitor
and or operate the massive surveillance system (Police State radical enforcement methods)
that they desire to install and operate.
4) Agenda Item: 3.D (Proposed Ordinance to deny Drive-Throughs)

I am writing today to express my opposition to imposing a moratorium on applications for drive-thru service for new
businesses. While I believe that land use applications should be vetted against a set of criteria that balances impact
and benefit these reviews should be conducted as the opportunities arise as is the case of both Chick-Fil-A and the
most recent announced intent of In-N-Out Burger. The timing of the drive-thru moratorium feels more like a ruse to
thwart a business because people don't agree with its politics more so than concerns that it would create a public
nuisance or danger. The city has mechanisms to assure that later does not occur. Members of the LGBT+ community
know full well the impact of these types of indirect methods to limit or constrain expression. Personally, I don't
patronize Chick-Fil-A as I find their values at some variance with my own but at the same time I respect their right to
exercise their beliefs in line with the law.

Please note and for the record:
I am totally opposed to the opening of more Drive Thrus in the City of Palm Springs, ever.
They bring traffic, congestion, and air pollution to the city streets and neighborhoods they are in.
Cars idle and spew toxic fumes as they wait to be served. People will sit in their cars as they wait for
their super-caloric fat meals. Whatever happened to the “Blue Zone” that PS wants to be? People
living long here and all that? You can’t be both a freeway exit AND a Blue Zone!
Also how is allowing more national fast-food chains in the center of town helping the home-grown
and local businesses in Palm Springs that the city says it cherishes and supports so much? The profits
and benefits of those businesses will flow out of the community and into far-flung corporate
headquarters.
Drive-Thrus belong on the sides of Freeways and not in the center of towns, and especially not in a
city like Palm Springs, that purports itself to be an architectural draw for the world..

I support a moratorium banning new drive throughs in PS. Drive throughs don't add any character to a city. Rather,
they make one city indistinguishable from another. Cookie Cutter cities is what I call them. You don't know which
city you're in, and you really don't care. That's sad. Add to this the issue of increased traffic and pollution and drive
throughs become a net negative on PS.

I like many others have been encouraged to message you to offer my views on the proposed
moratorium.
I fully support a halt on new drive thru businesses. I find myself hard pressed to think of any
location in Palm Springs where a new drive thru would not create further traffic snarls. The
intersection of Ramon and Gene Autry is a great example. Traffic is already backed up in
multiple direction for much of the day. Allowing any business, especially one known to have
lines into streets elsewhere, to open in that location is just dumb.
I would also point you towards the Starbucks on Sunrise, in front of Ralph's. The exit from
this business creates a snarl, though limited to the parking lot at most times. A business bigger
than that even on a corner with such passable roads, would complicate exiting the plaza onto
Sunrise and Ramon both. This holds true for almost every intersection in the City, we're just
too busy.
Palm Springs has grown beyond village status. The existing restrictions are no longer enough,
and PS needs to move into a new chapter as a city. Our trend towards more full time residents
requires that our city streets remain passable and safe year round. Adding businesses with
convoluted entrances and exits only adds to "rage driving" and accidents on our streets.
I thank you for taking the time to consider all our remarks, and look forward to a decision to
create a safer city by simply pausing new drive thru locations.

Permitting a drive-thrus will:

place. Our built environment should reinforce our

There are many news and scholarly articles on the
dangers of drive-thrus below are just a couple.
In June 2023 CNN published an article on why drive-
thrus are creating problems for cities and towns.

Even the US Department of Labor discusses the hazards
of drive-thrus on young workers (let alone older
workers) including:
1. Car exhaust
2. Noise
3. Prolonged standing
4. Strains and sprains
5. Workplace violence
My opinion has nothing to do with the recent application
for Chic fil a but the fact that the proposal contains a
drive-thru. I believe in and want to reinforce the magic
that Palm Springs offers the world over and to do that we
need to continue to make decisions that will keep us a
world class tourist destination as well as a livable place
for our residents. Drive thrus do not do that.

Good morning Jeffrey,
I saw the article in the Desert Sun about a possible drive-thru moratorium. I am retired from the City
of Phoenix Planning and Development Department where I reviewed building plans for fire code
compliance. The traffic issues/accidents and resulting necessity for response from fire personnel
caused city management to require closure of the Dutch Brothers location closest to the light-rail
station (Camelback Rd and Central Ave). The Chick-fil-A location being near the airport entrance
from Ramon/Gene Autry might be similarly unwise given the expected increase in air traffic. The
attached PDF contains comments made on Facebook regarding the problem. Hopefully, this
information will at least be fuel for the fire to continue the discussion of a possible moratorium.

Dear Mayor and Councilmembers.
I understand that you will be considering drive-
thrus in Palm Springs. I have been asked to
write to you. For a variety of reasons, allowing
drive-thrus is not a good choice for the City and
its image as a City "Like No Place Else".
Palm Springs Mission Statement is:
"Palm Springs is an inclusive world class city
dedicated to providing excellent and responsive
public services to enhance the quality of life for
current and future generations."
Permitting a drive-thrus will:
- Not enhance our quality of life for current or
future residents
- Is discriminatory and not inclusive
- Diminishes our "Like No Place Else" image
- Endangers pedestrians, bicyclists, and the
disabled
- Is not in keeping with our mission statement

- Is not healthy for workers
- is dependent upon disposable packaging
- Has negative environmental consequences not
satisfying the principals of our:
1. Sustainability Master Plan
2. Climate Action Roadmap
3. Climate Action Plan
4. Non-motorized Transportation Plan
The City’s built environment should look and
evoke in people a feeling that they are entering a
place like nowhere else. Allowing drive-thrus
visually diminishes the principles by which the
City is built upon and sends a strong message
that we are Not unique or care about our
environment or the health of our people.
Becoming more car dependent is contrary to the
plans we have in place. Our built environment
should reinforce our mission statement, plans,
and our hopes for our future.
There are many news and scholarly articles on
the dangers of drive-thrus below are just a
couple.
In June 2023 CNN published an article on why
drive-thrus are creating problems for cities and
towns.

I think part of the problem is one of the reasons DB is popular. Their employees
are TOO friendly, and the line crawls as a result. I've seen someone get their
drink, and the employee will still stand there and talk to them for two minutes

Maybe cities need to stop the exceptions of fewer parking spots and smaller drive
thru lines. I can’t stand driving in downtown Gilbert because the right lane is
always blocked!

All of their locations are insanely busy. They need to rethink their model to
accommodate for the increased traffic, both in person and vehicle. What are
other shops doing that Dutch bros is not, is the question. There's a lack efficiency
here.

Never really understood the Dutch brother drive through line that end up on the
main road. They are dangerous im not to sure why they dont get into trouble over
it yet. Main roads are for driving not for drive throughs.
