HomeMy WebLinkAboutItem 2B - Chick-fil-A Planning Commission Staff Report DATE: DECEMBER 11, 2024 PUBLIC HEARING SUBJECT: A REQUEST BY LILAC 19, LLC, FOR A CONDITIONAL USE PERMIT FOR THE REDEVELOPMENT OF BUILDING “I” AT THE SPRINGS SHOPPING CENTER TO INCLUDE THE DEMOLITION OF AN EXISTING BUILDING FOR THE CONSTRUCTION OF A QUICK SERVICE RESTAURANT NAMED CHICK-FIL-A WITH A DRIVE- THROUGH LOCATED AT 5200 EAST RAMON ROAD, ZONE M-1-P (PDD 291) (CASE NO CUP 2024-0001)(GM). FROM: DEPARTMENT OF PLANNING SERVICES SUMMARY This is a request for the Planning Commission to review an application by Lilac 19, LP, the owners of The Springs Shopping Center, for the redevelopment of Building “I” by demolishing an existing “in-line” retail building for the construction of one (1) quick service restaurant named Chick-Fil-A at 5,707-square feet in size with seventy-eight (78) indoor and twenty-four (24) outdoor seats with three (3) drive-through lanes. The project requires the approval of a Conditional Use Permit (CUP) for the drive-through. ISSUES: • The Palm Springs Zoning Code (PSZC) Section 92.16.01(D)(7) requires a Conditional Use Permit for a business with “drive-through facilities”. The proposal before the Planning Commission includes three (3) queuing lanes described and analyzed in the Staff Report. • The Springs Shopping Center is considered a big box retail center with multiple national retailers located at the intersection of two major throughfares. All intersections are fully signalized with the appropriate number of through and turning lanes and no additional traffic mitigation measures are required. Approve the Conditional Use Permit subject to attached conditions of approval. 2. Determine that the project is consistent with the previously certified final EIR by the City Council on 10/19/2005 and no further analysis is required. 3. Major Architectural Application to be reviewed by the Architectural Review Committee (ARC) for final architectural approval. SCOPE OF REVIEW: 1. The Planning Commission shall review a Conditional Use Permit to allow a quick service restaurant with drive-through in the M-1-P Zone (PDD 291) per Section 92.16.01(D)(7) 2. The Architectural Review Committee (ARC) will review the Major Architectural Application following approval of the CUP. BUSINESS PRINCIPAL DISCLOSURE: 1. The Springs Shopping Center (applicant), Lilac 19, LP is solely owned by Mark Gabay as listed in the submitted Public Integrity Disclosure Form. 2. Chick-Fil-A, Inc (lease holder) is a corporation with Dan T. Cathy listed as the Chief Executive Officer as recorded in the attached certified company resolution of corporate officers. PRIOR ACTIONS: Related Relevant City Actions by Planning, Fire, Building, etc… 9/28/2005 The Planning Commission approved Resolution #5025 approving a Planned Development District for a 393,000-square foot commercial development on 37-acres named The Springs Shopping Center. 10/19/2005 The City Council adopted a resolution certifying the final EIR and adopting a statement of facts and findings, statement of overriding considerations, and mitigation measures for the approval of Planned Development District #291. PROJECT DESCRIPTION: The project consists of the demolition of the existing “in-line” retail structure known as Building “I” within The Springs Shopping Center; and the construction of one (1) quick service restaurant with drive-through facilities. The detail of the proposal is as follows: • Chick-Fil-A will be a standalone 5,707-square foot single-story structure placed in the same location as the razed Building “I” on a leased parcel from the overall shopping center ownership. The quick service restaurant will have seventy-eight (78) indoor and twenty-four (24) outdoor seats with a triple drive-through allowing for forty-nine (49) vehicles to queue. One (1) drive-through lane can be used for on-line order pick-up. The hours of operation to be from 5:30 AM to 11:00 PM Monday to Saturday and closed on Sunday. Planning Commission Staff Report December 11, 2024 -- Page 3 of 11 Case CUP 2023-0001 – Lilac 19 LP The new restaurant will be located in the south center of The Springs Shopping Center which is a big box retail center containing a Home Depot as the anchor store, with multiple in-line retail buildings, several existing drive-through businesses such as Jack In The Box and Wells Fargo Bank, and a cluster of quick service restaurants including Panda Express, Five Guys, Panera Bread, and Rubio’s Mexican. According to the property ownership, the majority of Building “I” has had long-term vacancies other than a relocated T-Mobile cell phone shop which has moved to the building containing Burlington. The justification letter states that the redevelopment of the site will create a draw to the center and will benefit the city from the new revenue, new amenities, and create 15-35 new jobs once operating. BACKGROUND AND SETTING: Most Recent Ownership 04/26/2019 Lilac 19, LP Notification 09/24/2024 Property posted with “Project Under Consideration” sign listing the case number and contact information to review the proposal. 12/4/2024 Notice of public hearing mailed to addresses within 500-feet of the site, notifying that the subject application would be considered by the Planning Commission at a public hearing on December 11, 2024. The public hearing notice was also emailed to Neighborhood Organizations within one mile of the project site. Field Check November 2024 Staff visited site to observe existing conditions. Vehicle traffic counts at this intersection are among the most traveled within the Coachella Valley per the City’s Engineering Department. The project location is at the southern end of the Palm Springs International Airport and surrounded by other large retail centers such as the Home Depot, Lowes Home Improvement, Destination Ramon – Walmart, and other quick service restaurants with drive-through facilities such as the Raising Canes with a double drive through. The General Plan Land Use designation for this area of the city is Regional Business Center (RBC) which is intended to accommodate a wide variety of business activities in a multi-use environment. Commercial, office, and industrial uses that can be supported by their proximity to the freeway are encouraged in this area. Uses are intended to provide large-scale development opportunities that serve a region larger than the city proper. The vehicle traffic count lends itself to the type of use Planning Commission Staff Report December 11, 2024 -- Page 5 of 11 Case CUP 2023-0001 – Lilac 19 LP proposed as a quick service restaurant with drive-through facilities. All intersections within the area are fully signalized with appropriate through and turning lanes. No additional road improvements are anticipated or required. The Springs Shopping Center – red box is Building “I” site location Site Plan: The proposal will demolish the existing Building “I” to be replaced with the new 5,707- square foot restaurant building in a similar location at the center of the leased parcel. The quick service restaurant with seventy-eight (78) indoor seats and twenty-four (24) outdoor seats contains a drive-through component. The proposal includes three (3) drive aisles for ordering which merge into two (2) lanes for food pick-up. This concept seeks to provide quick order and delivery of products by increasing the capacity of the ordering and queuing area. The applicant has stated in the justification letter that the third lane can be used for on-line orders and pick-ups. The queuing lanes can accommodate up to forty-nine (49) vehicles at one time and will begin on the south side of the building where they will be greeted by a staff member to take the food order. A 2,106-square foot freestanding canopy is proposed on the east side to provide shelter as patrons order and pay. Autos will advance from the triple lane to a double lane to pick up food orders on the north side of the building underneath a 1,440-square foot canopy and then exit into the parking lot. Planning Commission Staff Report December 11, 2024 -- Page 6 of 11 Case CUP 2023-0001 – Lilac 19 LP The building orientation is north to south with access to the site from existing driveways within the shopping center. A circulation plan has been provided that shows the types of vehicular movements anticipated and shows that internal parking lot circulation will not be affected. The Chick-Fil-A is a high-volume business which relies on vehicles quickly moving through the drive-through lanes. The triple lanes will allow autos to stack outside of the designated parking lot area. In analyzing the proposed site plan and layout, a comparison can be made regarding impervious surfaces for the drive-throughs versus the size of the building being razed. The proposed new structure is smaller in size and the addition of a landscaped area containing the outdoor patio proposed on the Ramon Road side of the building will increase the landscaped areas. Other site features include a fully enclosed trash structure with internal long-term bike parking for staff members. Additional bike racks are proposed adjacent to the outdoor patio for patrons’ use. The drive-through lanes will be screened from the street with a four (4) foot tall block wall with berms and landscaping. Pedestrian connections to the site will be via a sidewalk leading from East Ramon Road and via other sidewalks connecting from the interior of the shopping center. Building Elevation: The proposed Chick-Fil-A structure will have an average height of twenty-one (21) feet with a center parapet of twenty-three (23) feet. The building is a mix of box elements consisting of EIFS stucco with the top portion in “White Cloud” cream color, and lower element in “Hardware” which is a contrasting darker brown color. A stone veneer will be added as accents at the building base and entry points which is like other buildings in the center. In addition, an aluminum storefront glazing system in dark bronze with canopy elements to be dark colored steel structures to match other buildings. Staff and the Urban Design Planner worked with the applicant on adding appropriately dimensioned overhangs above all windows for solar control. Site lighting on the building will be sconce fixtures that wash the walls with illumination. The large canopies over the drive-throughs will have recessed lighting that will be focused downward and not spill off the site. Parking: The Springs Shopping Center has a total of 1,817 off-street parking spaces for the entire retail center. The parking field between the new restaurant and the building to the west contains 114 parking spaces. An additional thirteen (13) spaces located along the north internal drive aisle can be converted to EV charging in the future. Landscape Plan: The proposed landscape plan shows the use of desert plantings along East Ramon Road and the access driveway to include Acacia, Multi-trunk Palo Verde, Rosewood, Mexican Ebony and Mesquite trees in 36” boxes. Large trees will be planted in the parking lot to provide the required shading. The new landscaping will require the removal of eighteen (18) existing tall palm trees throughout the disturbed site. Landscaping between Ramon Road and the outer screen wall will include multiple Agave, Bougainvillea, Bird of Paradise, Desert Spoon, Ocotillo, Red Yucca, and other ground covers. The area on the south side of the building will contain the outdoor seating area for twenty-four (24) seats under a covered canopy which will be surrounded by a large planter area containing two (2) larger trees and ground cover. Signage: Signage for the site is not part of the review at this time, however the building elevations show possible areas for signs. The Springs Shopping Center currently has a sign program and any proposed signs would need to adhere to those guidelines or an amendment could be sought. REQUIRED FINDINGS: This project’s conformance to the Conditional Use Permit findings of the Zoning Ordinance is analyzed below. CONDITIONAL USE PERMIT: Section 94.02.00 of the Palm Springs Zoning Code (PSZC) requires that the following conditions be met in order to approve a Conditional Use Permit: 1. That the use applied for at the location set forth in the application is properly one for which a conditional use permit is authorized by this Zoning Code. PSZC Section 92.16.01(D)(7) allows for a drive-through restaurant subject to the development standards as listed. The proposed construction of one (1) quick service restaurant with three (3) drive-through lanes within the M-1-P zone is a permitted use with the approval of a Conditional Use Permit. The PSZC is silent as to the appropriate number of drive-through lanes and the proposed use is a high-volume restaurant that seeks to provide quick order and delivery of products Planning Commission Staff Report December 11, 2024 -- Page 8 of 11 Case CUP 2023-0001 – Lilac 19 LP by increasing the capacity of the ordering and queuing area by reducing vehicle idling. The request for a triple lane drive-through with a large stacking capacity will result in the maximum development potential of the site, however the auto- oriented nature of the big box retail center at this specific location would not further contribute to impervious surfaces from existing conditions. An analysis by the Engineering Department determined that the existing road network and ingress/egress into the shopping center is adequate to accommodate the anticipated vehicular traffic volumes and the findings have been met. 2. That the use is necessary or desirable for the development of the community, is in harmony with the various elements or objectives of the general plan and is not detrimental to existing uses or to future uses specifically permitted in the zone in which the proposed use is to be located. The General Plan designation of the subject property is Regional Business Center (RBC) with an underlying zoning of M-1-P (Light Industrial) within a Planned Development District. According to the General Plan, the RBC land use designation is intended to accommodate a wide variety of business activities in a multi-use environment and the RBC will provide job opportunities for the residents of Palm Springs, and the whole Coachella Valley. Commercial, office, and industrial uses that can be supported by their proximity to the freeway are encouraged in this area. Uses are intended to provide large-scale development opportunities that serve a region larger than the city proper. The proposed quick service restaurant will be consistent with the retail services present within The Springs Shopping Center. The redevelopment of the site will meet the following General Plan Goals and Actions: Goal LU1.4 – “encourage the introduction of new uses that are considered to be of significant importance and contribute benefits to the City” the new restaurant will provide economic benefits to the City and provide a source of income for residents. Goal LU4.4 - “encourage the reuse of obsolete commercial properties” by razing an underutilized in-line retail building and permitting the redevelopment of the site will respond to changes in the business market. Goal LU8.3 – “encourage the development of specialty uses such as restaurants that cater to the residents in close proximity to mixed/multi-use areas” the location of the proposed project at the intersection of two major throughfares within The Springs Shopping Center provides vehicular and pedestrian access to the site for local residents and regional visitors. Action LU8.3 – “continually monitor the preferred mix of uses withing mixed/multi-use areas and encourage new uses that will provide new services that complement existing uses” the elimination of an underutilized in-line retail building with a new restaurant use is a response to changing economic conditions and strengthens the mixed-use center. That the site for the intended use is adequate in size and shape to accommodate such use, including yards, setbacks, walls or fences, landscaping and other features required in order to adjust such use to those existing or permitted future uses of land in the neighborhood. The project site is located within The Springs Shopping Center which is a big box retail development consisting of a Home Depot as the major anchor store and several other large buildings containing national retailers. The south entrance to the Palm Springs International Airport is to the west and to the south and east are several large commercial shopping centers including Gene Autry Plaza, Lowes Home Improvement, and Destination Ramon – Walmart. The redevelopment of Building “I” for the construction of Chick-Fil-A is appropriate for a site at the intersection of Gene Autry Trail (State Highway 111) and East Ramon Road which are Major Thoroughfares with vehicle traffic counts at this intersection among the most traveled within the Coachella Valley. The Springs Shopping Center is a big box retail center consisting of 37-acres and over a 1,000 dedicated off-street parking spaces. The subject site for the new quick service restaurant is 86,957-square feet which is larger enough to accommodate the building, outdoor patio, trash enclosure, landscaped areas, parking and the proposed three lane drive through. One lane of the drive through will be an express lane dedicated to pick-up for orders made on-line thus reducing vehicle queueing and idling. The auto-oriented nature of the mixed-use shopping center with the proposed restaurant and drive-through lanes will provide convenience and accessibility to patrons of the large retail center. 4. That the site for the proposed use relates to the streets and highways properly designed and improved to carry the type and quantity of traffic to be generated by the proposed use. The site is part of The Springs Shopping Center in an area comprised of multiple large national retail stores near the corner of two main streets of South Gene Autry Trail and East Ramon Road. Access to the restaurant will be from traffic- controlled intersections with the interior road network of the shopping center providing adequate ingress/egress. The proposed building will meet all development standards for the zone per setbacks, heights, lighting, and landscaping and the finding has been met. The location of the quick service restaurant with three (3) drive-throughs within the shopping center is an appropriate location for an auto-reliant business. Access onto the site will be from existing driveways from an internal street system which direct vehicles to signalized intersections. All surrounding intersections are fully signalized with the appropriate number of through and turning lanes. The introduction of a quick service restaurant would not require additional traffic mitigation measures as the road network is fully built-out and does not require modification to accommodate Planning Commission Staff Report December 11, 2024 -- Page 10 of 11 Case CUP 2023-0001 – Lilac 19 LP the anticipated traffic volumes. Pedestrian access will be provided via existing sidewalks from East Ramon Road and based upon this determination the finding has been met. 5. That the conditions to be imposed and shown on the approved site plan are deemed necessary to protect the public health, safety and general welfare and may include minor modification of the zone’s property development standards. The conditions imposed as part of this Conditional Use Permit are intended to minimize impacts on the surrounding community. The CUP approval will work in conjunction with the Major Architectural approval by the City. The site plan as proposed will allow for the orderly development of the site as a quick service restaurant with drive-through facilities. ENVIRONMENTAL DETERMINATION: The proposed development is a project as defined by the California Environmental Quality Act (CEQA). The project was analyzed when the development was first approved. As the proposal is less square footage than the razed building and there is no increase in height resulting, it is determined that the project is consistent with the previously certified final EIR by the City Council on 10/19/2005 and no further environmental analysis is required. CONCLUSION: The proposal to demolish an under performing in-line retail building for the construction of a new quick service restaurant with drive-throughs within The Springs Shopping Center at the intersection of a two Major Thoroughfares near other auto oriented businesses is an appropriate location. The proposal meets all the development standards of the PSZC and is in conformance with the General Plan Land Use designation. In addition, findings for a Conditional Use Permit can be made based upon these facts. The request for a triple lane drive-through with a large stacking capacity will result in the maximum development potential of the site, however the auto-oriented nature of the big box retail center at this specific location would not further contribute to impervious surfaces from existing conditions. The three (3) drive-throughs for an anticipated high-volume restaurant are intended to quickly move vehicles through the ordering and food pick-up process reducing vehicle idling. Based upon the above analysis, Staff recommends that the Planning Commission make the required findings and approve the proposed project with conditions. Lilac 19, LLC, (“Applicant”) has filed a Conditional Use Permit (Case CUP 2024- 0001) with the City pursuant to Sections 94.02.00 (Conditional Use Permit); of the Palm Springs Zoning Code for the construction of a one (1) quick service restaurant named Chick-Fil-A at 5,707-square feet in size with seventy-eight (78) indoor seats and twenty- four (24) outdoor seats with three drive-through lanes located at The Springs Shopping Center, 5200 East Ramon Road. (This application, Case CUP 2024-0001 is referred to herein as the “Project”.) B. The property was posted with a “Project Under Consideration” sign on September 24, 2024 and a notice of a public hearing of the Planning Commission of the City of Palm Springs to consider the Project was given in accordance with applicable law. C. On December 11, 2024, the Planning Commission held a public hearing to consider the Project in accordance with applicable law. D. The proposed development is a project as defined by the California Environmental Quality Act (CEQA). The project has been determined to be consistent with the certified final EIR as approved by the City Council on October 19, 2005 as the proposal is less square footage than the razed building and there is no increase in height resulting in no further analysis required. E. The Planning Commission has carefully reviewed and considered all of the evidence presented in connection with the hearing on the Project, including, but not limited to, the staff report, and all written and oral testimony presented. Action LU8.3 – “continually monitor the preferred mix of uses withing mixed/multi-use areas and encourage new uses that will provide new services that complement existing uses” the elimination of an underutilized in-line retail building with a new restaurant use is a response to changing economic conditions and strengths the mixed-use center. Based upon the above enumerated General Plan Goals and Actions the findings have been met. 3. That the site for the intended use is adequate in size and shape to accommodate such use, including yards, setbacks, walls or fences, landscaping and other features required in order to adjust such use to those existing or permitted future uses of land in the neighborhood. The project site is located within The Springs Shopping Center which is a big box retail development consisting of a Home Depot as the major anchor store and several other large buildings containing national retailers. The south entrance to the Palm Springs International Airport is to the west and to the south and east are several large commercial shopping centers including Gene Autry Plaza, Lowes Home Improvement, and Destination Ramon – Walmart. The redevelopment of Building “I” for the construction of Chick-Fil-A is appropriate for a site at the intersection of Gene Autry Trail (State Highway 111) and East Ramon Road which are Major Thoroughfares with vehicle traffic counts at this intersection among the most traveled within the Coachella Valley. The Springs Shopping Center is a big box retail center consisting of 37-acres and over a 1,000 dedicated off-street parking spaces. The subject site for the new quick service restaurant is 86,957- square feet which is larger enough to accommodate the building, outdoor patio, trash enclosure, landscaped areas, parking and the proposed three lane drive through. One lane of the drive through will be an express lane dedicated to pick- up for orders made on-line thus reducing vehicle queueing and idling. The auto- oriented nature of the mixed-use shopping center with the proposed restaurant and drive-through lanes will provide convenience and accessibility to patrons of the large retail center. 4. That the site for the proposed use relates to the streets and highways properly designed and improved to carry the type and quantity of traffic to be generated by the proposed use. The site is part of The Springs Shopping Center in an area comprised of multiple large national retail stores near the corner of two main streets of South Gene Autry Trail and East Ramon Road. The location of the quick service restaurant with three (3) drive-throughs within the shopping center is an appropriate location for an auto- reliant business. Access onto the site will be from existing driveways from an Planning Commission Resolution No. December 11, 2024 Case CUP 2024-0001 – Lilac 19 LP Page 4 of 4 internal street system which direct vehicles to signalized intersections. All surrounding intersections are fully signalized with the appropriate number of through and turning lanes. The introduction of a quick service restaurant would not require additional traffic mitigation measures as the road network is fully built- out and does not require modification to accommodate the anticipated traffic volumes. Pedestrian access will be provided via existing sidewalks from East Ramon Road and based upon this determination the finding has been met. 5. That the conditions to be imposed and shown on the approved site plan are deemed necessary to protect the public health, safety and general welfare and may include minor modification of the zone’s property development standards. The conditions imposed as part of this Conditional Use Permit are intended to minimize impacts on the surrounding community. The CUP approval will work in conjunction with the Major Architectural approval by the City. The site plan as proposed will allow for the orderly development of the site as a quick service restaurant with drive-through facilities. THE PLANNING COMMISSION RESOLVES: That the findings and determinations reflected above are true and correct and are incorporated by this reference herein as the cause and foundation for the action taken by and through this Resolution. Based upon the foregoing, the Planning Commission hereby approves Case CUP 2024-0001 for the construction of one (1) quick service drive-through restaurant in The Springs Shopping Center located at 5200 East Ramon Road, subject to the conditions of approval attached herein as Exhibit A. EXHIBIT A Case CUP 2024-0001 The Springs Shopping Center Lilac 19 LP 5200 East Ramon Road December 11, 2024 CONDITIONS OF APPROVAL Before final acceptance of the project, all conditions listed below shall be completed to the satisfaction of the City Engineer, the Director of Planning Services, the Director of Building and Safety, the Chief of Police, the Fire Chief or their designee, depending on which department recommended the condition. Any agreements, easements or covenants required to be entered into shall be in a form approved by the City Attorney. ADMINISTRATIVE CONDITIONS ADM 1. Project Description. This approval is for the project described per Case CUP 2024-0001 except as modified by the conditions below. ADM 2. Reference Documents. The site shall be developed and maintained in accordance with the approved plans, date stamped August 5, 2024, including site plans, architectural elevations and colors on file in the Planning Division except as modified by the approved by conditions below. ADM 3. Conform to all Codes and Regulations. The project shall conform to the conditions contained herein, all applicable regulations of the Palm Springs Zoning Ordinance, Municipal Code, and any other City, County, State and Federal Codes, ordinances, resolutions and laws that may apply. ADM 4. Minor Deviations. The Director of Planning or designee may approve minor deviations to the project description and approved plans in accordance with the provisions of the Palm Springs Zoning Code. ADM 5. Indemnification. The owner shall defend, indemnify, and hold harmless the City of Palm Springs, its agents, officers, and employees from any claim, action, or proceeding against the City of Palm Springs or its agents, officers or employees to attach, set aside, void or annul, an approval of the City of Palm Springs, its legislative body, advisory agencies, or administrative officers concerning Case CUP 2024-0001. The City of Palm Springs will Resolution No. Draft Conditions of Approval Page 2 of 13 Cases CUP 2024-0001 – Lilac 19 LP December 11, 2024 promptly notify the applicant of any such claim, action, or proceeding against the City of Palm Springs and the applicant will either undertake defense of the matter and pay the City's associated legal costs or will advance funds to pay for defense of the matter by the City Attorney. If the City of Palm Springs fails to promptly notify the applicant of any such claim, action or proceeding or fails to cooperate fully in the defense, the applicant shall not, thereafter, be responsible to defend, indemnify, or hold harmless the City of Palm Springs. Notwithstanding the foregoing, the City retains the right to settle or abandon the matter without the applicant's consent but should it do so, the City shall waive the indemnification herein, except, the City's decision to settle or abandon a matter following an adverse judgment or failure to appeal, shall not cause a waiver of the indemnification rights herein. ADM 6. Maintenance and Repair. The property owner(s) and successors and assignees in interest shall maintain and repair the improvements including and without limitation all structures, sidewalks, bikeways, parking areas, landscape, irrigation, lighting, signs, walls, and fences between the curb and property line, including sidewalk or bikeway easement areas that extend onto private property, in a first class condition, free from waste and debris, and in accordance with all applicable law, rules, ordinances and regulations of all federal, state, and local bodies and agencies having jurisdiction at the property owner’s sole expense. This condition shall be included in the recorded covenant agreement for the property if required by the City. ADM 7. Time Limit on Approval. Approval of this Conditional Use Permit shall be valid for a period of two (2) years from the effective date of the approval. Extensions of time may be granted by the Planning Commission upon demonstration of good cause. Once constructed, the Conditional Use Permit, provided the project has remained in compliance with all conditions of approval, does not have a time limit. ADM 8. Right to Appeal. Decisions of an administrative officer or agency of the City of Palm Springs may be appealed in accordance with Municipal Code Chapter 2.05.00. Permits will not be issued until the appeal period has concluded. ADM 9. Comply with City Noise Ordinance. This use shall comply with the provisions of Section 11.74 Noise Ordinance of the Palm Springs Municipal Code. Violations may result in revocation of this Conditional Use Permit. ADM 10. Conditional Use Permit Availability. The applicant shall provide a copy of this Conditional Use Permit to all buyers and potential buyers. Coachella Valley Multiple-Species Habitat Conservation Plan (CVMSHCP) Local Development Mitigation Fee (LDMF) required. All projects within the City of Palm Springs, not within the Agua Caliente Band of Cahuilla Indians reservation are subject to payment of the CVMSHCP LDMF prior to the issuance of certificate of occupancy. ENV 2. California Fish & Game Fees Required. The project is required to pay a fish and game impact fee as defined in Section 711.4 of the California Fish and Game Code. This CFG impact fee plus an administrative fee for filing the action with the County Recorder shall be submitted by the applicant to the City in the form of a money order or a cashier's check payable to the Riverside County Clerk prior to the final City action on the project (either Planning Commission or City Council determination). This fee shall be submitted by the City to the County Clerk with the Notice of Determination. Action on this application shall not be final until such fee is paid. The project may be eligible for exemption or refund of this fee by the California Department of Fish & Game. Applicants may apply for a refund by the CFG at www.dfg.ca.gov for more information. PLANNING DEPARTMENT CONDITIONS PLN 1. Hours of Operation. The operating hours shall be as follows: Monday – Saturday 5:30 AM until 11:00 PM Sunday – Closed PLN 2. Sign Permits Required. No signs are approved by this action. All signs, including temporary signs, shall be consistent with approved sign program for The Springs Shopping Center. Amendment to the sign program will be reviewed and approved in accordance with Section 93.20.00 (Signs) of the Palm Springs Zoning Code (PSZC). No signs shall be installed without sign permits. PLN 3. Off-Street Parking. Parking for new building shall be accommodated by the existing and newly constructed fifty-two (52) spaces on the leased area with additional spaces as part of the overall Springs Shopping Center. PLN 4. Water Efficient Landscaping Conformance. The project is subject to the Water Efficient Landscape Ordinance (Chapter 8.60.00) of the Palm Springs Municipal Code and all other water efficient landscape ordinances. The applicant shall submit a landscape and irrigation plan to the Director of Planning for review and approval prior to the issuance of a building permit. Landscape plans shall be wet stamped and approved by the Riverside Resolution No. Draft Conditions of Approval Page 4 of 13 Cases CUP 2024-0001 – Lilac 19 LP December 11, 2024 County Agricultural Commissioner's Office prior to submittal. Prior to submittal to the City, landscape plans shall also be certified by the local water agency that they are in conformance with the water agency’s and the State’s Water Efficient Landscape Ordinances. PLN 5. Outdoor Lighting Conformance. Exterior lighting shall conform to Section 93.21.00, Outdoor Lighting Standards, of the Palm Springs Zoning Code. Manufacturer's cut sheets of all exterior lighting shall be submitted to the Planning Department for approval prior to the issuance of building permits. No lighting of hillsides is permitted. PLN 6. Outside Storage Prohibited. No outside storage of any kind shall be permitted except as approved as a part of the proposed plan. PLN 7. Property Use and CUP. If the use of the subject property is ever changed, the City reserves the right to modify or revoke this Conditional Use Permit application pursuant to Section 94.02.00(I) of the Zoning Code. Conditions imposed by the Planning Commission: PLN 8. Add conditions POLICE DEPARTMENT CONDITIONS POL 1. Developer shall comply with Section II of Chapter 8.04 “Building Security Codes” of the Palm Springs Municipal Code. FIRE DEPARTMENT CONDITIONS FD 1 These Fire Department conditions may not provide all requirements. Owner/developer is responsible for all applicable state and locally adopted fire codes. Detailed plans are still required for review. Conditions are subject to final plan check and review. FD 2 Fire Department Conditions were based on the 2022 California Fire Code as adopted by City of Palm Springs, Palm Springs Municipal Code, PSFD Appendix “T” Development Requirements and latest adopted NFPA Standards. FD 3 Conditions of Approval – “Conditions of Approval” received from the Palm Springs Planning Department must be submitted with each plan set. Failure to submit will result in a delay of plan approval. FD 4 Plans and Permits (CFC 105.1): Resolution No. Draft Conditions of Approval Page 5 of 13 Cases CUP 2024-0001 – Lilac 19 LP December 11, 2024 Permits and scaled drawings are required for this project. Plan reviews can take up to 20 working days. Submit a minimum of three (3) sets of drawings for review. Upon approval, the Fire Prevention Bureau will retain one set. A deposit for Plan Check and Inspection Fees is required at the time of Plan Submittal. These fees are established by Resolution of the Palm Springs City Council. Complete listings and manufacturer’s technical data sheets for all system materials shall be included with plan submittals. All system materials shall be UL listed or FM approved for fire protection service and approved by the Fire Prevention Bureau prior to installation. Plans shall include all necessary engineering features, including all hydraulic reference nodes, pipe lengths and pipe diameters as required by the appropriate codes and standards. Plans and supporting data, (calculations and manufacturers technical data sheets) including fire flow data, shall be submitted with each plan submittal. Complete and accurate legends for all symbols and abbreviations shall be provided on the plans. FD 5 Access During Construction (CFC 503): Access for firefighting equipment shall be provided to the immediate job site at the start of construction and maintained until all construction is complete. Fire apparatus access roads shall have an unobstructed width of not less than 24 feet and an unobstructed vertical clearance of not less than 13'-6". Fire Department access roads shall have an all-weather driving surface and support a minimum weight of 73,000 lbs. FD 6 Required access (CFC 504.1): Exterior doors and openings required by this code or the California Building Code shall be maintained readily accessible for emergency access by the fire department. An approved access walkway leading from fire apparatus access roads to exterior openings shall be provided when required by the fire code official. FD 7 Key Box Required to be Installed (CFC 506.1): Where access to or within a structure or an area is restricted because of secured openings or where immediate access is necessary for life-saving or fire-fighting purposes, the fire code official is authorized to require a key box to be installed in an approved location. The key box shall be flush mount type and shall contain keys to gain necessary access as required by the fire code official. • Key Box Contents (CFC 506.1): The Knox key box shall contain keys to all areas of ingress/egress, alarm rooms, fire sprinkler riser/equipment rooms, mechanical rooms, elevator rooms, elevator controls, plus a card containing the emergency contact people and phone numbers for the building/complex. Resolution No. Draft Conditions of Approval Page 6 of 13 Cases CUP 2024-0001 – Lilac 19 LP December 11, 2024 FD 8 Turning Radius: Fire access road turns and corners shall be designed with a minimum inner radius of 25 feet and an outer radius of 43 feet. FD 9 NFPA 13 Fire Sprinklers Required: An automatic fire sprinkler system is required. Only a C-16 licensed fire sprinkler contractor shall perform system design and installation. System to be designed and installed in accordance with NFPA standard 13, 2016 Editions, as modified by local ordinance. Fire pumps may also be required due to the size of the building. FD 10 Fire Alarm System Required: An automatic or manual fire alarm system is required. Only a C-10 licensed fire alarm contractor shall perform system design and installation. System to be designed and installed in accordance with NFPA standard 72, 2016 editions, as modified by local ordinance. FD 11 Dead Ends: Dead-end fire apparatus roads in excess of 150 feet in length shall be provided with an approved area for turning around a fire apparatus. FD 12 Designated Fire Lanes: In private developments fire lanes shall not be less than 24 feet in width (curb to curb) with no parking on either side and shall be identified as fire lanes with red surb, stating in white lettering “NO PARKING FIRE LANE”, or by approved signage, or by red curb with lettering and signage. FD 13 Private Fire Hydrants: This development may require private fire hydrants and double check detector assemblies. FD 14 Fire Department Access Roads/Driveways: Shall be provided so that no portion of the exterior wall of the first floor of any building shall be more than 150 feet from such roads. ENGINEERING DEPARTMENT CONDITIONS STREETS ENG 1. Any improvements within the public right-of-way require a City of Palm Springs Encroachment Permit. All improvements are subject to inspection and a 48-hour inspection notification is required. RAMON ROAD ENG 2. Remove and replace existing asphalt concrete pavement where required, in accordance with applicable City standards. All broken or off grade street improvements along the project frontage shall be repaired or replaced. ON-SITE ENG 4. The minimum pavement section for all on-site pavement to the drive aisles and parking spaces shall be 3 inches asphalt concrete pavement over 4 inches crushed miscellaneous base with a minimum subgrade of 24 inches at 95% relative compaction, or equal. If an alternative pavement section is proposed, the proposed pavement section shall be designed by a California registered Geotechnical Engineer using "R" values from the project site and submitted to the City Engineer for approval. ENG 5. All on-site drive aisles shall be two-way with a minimum 24 feet wide travelway (as measured from face of curb) where no parking is proposed. ENG 6. On-site drive aisles and parking lot shall be constructed with curbs, gutters, and cross-gutters, as necessary to accept and convey street surface drainage of the on-site streets to the on-site drainage system, in accordance with applicable City standards. ENG 7. A clearly designated pedestrian walkway of adequate width shall be provided to centralize a location for pedestrians entering or leaving the retail areas and accessing the retail parking. Traffic signage, lighting, pavement markings, and/or other visual cues shall be incorporated in the design of the ground floor parking level to support the use of the walkway by pedestrians and alert vehicles of the potential for crossing pedestrians. SANITARY SEWER ENG 8. All sanitary facilities shall be connected to the public sewer system via the existing on-site private sewer system. The existing sewer service to the property shall be used for new sanitary facilities. New laterals shall not be connected at manholes. GRADING ENG 9. Submit a Precise Grading Plan prepared by a California licensed civil engineer to the Engineering Services Department for review and approval. The plan shall be approved by the City Engineer prior to grading permit issuance. a. A Fugitive Dust Control Plan shall be prepared by the applicant and/or its grading contractor and submitted to the Engineering Services Department Resolution No. Draft Conditions of Approval Page 8 of 13 Cases CUP 2024-0001 – Lilac 19 LP December 11, 2024 for review and approval. The applicant and/or its grading contractor shall be required to comply with Chapter 8.50 of the City of Palm Springs Municipal Code, and shall be required to utilize one or more “Coachella Valley Best Available Control Measures” as identified in the Coachella Valley Fugitive Dust Control Handbook for each fugitive dust source such that the applicable performance standards are met. The applicant’s or its contractor’s Fugitive Dust Control Plan shall be prepared by staff that has completed the South Coast Air Quality Management District (AQMD) Coachella Valley Fugitive Dust Control Class. The applicant and/or its grading contractor shall provide the Engineering Services Department with current and valid Certificate(s) of Completion from AQMD for staff that have completed the required training. For information on attending a Fugitive Dust Control Class and information on the Coachella Valley Fugitive Dust Control Handbook and related “PM10” Dust Control issues, please contact AQMD at (866) 861-3878, or at http://www.AQMD.gov. A Fugitive Dust Control Plan, in conformance with the Coachella Valley Fugitive Dust Control Handbook, shall be submitted to and approved by the Engineering Services Department prior to approval of the Grading plan. b. The first submittal of the Grading Plan shall include the following information: a copy of final approved conformed copy of Conditions of Approval; a copy of a final approved conformed copy of the Site Plan; a copy of current Title Report; a copy of Soils Report; and a copy of the project-specific Final Water Quality Management Plan. ENG 10. Prior to approval of a Grading Plan (or issuance of a Grading Permit), the applicant shall obtain written approval to proceed with construction from the Agua Caliente Band of Cahuilla Indians, Tribal Historic Preservation Officer or Tribal Archaeologist ( a copy of the written approval must be provided to the City) . The applicant shall contact the Tribal Historic Preservation Officer or the Tribal Archaeologist at ACBCI- THPO@aguacaliente.net to determine their requirements, if any, associated with grading or other construction. The applicant is advised to contact the Tribal Historic Preservation Officer or Tribal Archaeologist as early as possible. If required, it is the responsibility of the applicant to coordinate scheduling of Tribal monitors during grading or other construction, and to arrange payment of any required fees associated with Tribal monitoring. ENG 11. In accordance with an approved PM-10 Dust Control Plan, temporary dust control perimeter fencing shall be installed. Fencing shall have screening that is tan in color; green screening will not be allowed. Temporary dust control perimeter fencing shall be installed after issuance of Grading Permit, and immediately prior to commencement of grading operations. Resolution No. Draft Conditions of Approval Page 9 of 13 Cases CUP 2024-0001 – Lilac 19 LP December 11, 2024 ENG 12. Temporary dust control perimeter fence screening shall be appropriately maintained, as required by the City Engineer. Cuts (vents) made into the perimeter fence screening shall not be allowed. Perimeter fencing shall be adequately anchored into the ground to resist wind loading. ENG 13. Within 10 days of ceasing all construction activity and when construction activities are not scheduled to occur for at least 30 days, the disturbed areas on-site shall be permanently stabilized, in accordance with Palm Springs Municipal Code Section 8.50.022. Following stabilization of all disturbed areas, perimeter fencing shall be removed, as required by the City Engineer. ENG 14. The applicant shall obtain approvals to perform any off-site grading from the record owner(s) of those adjacent properties to be impacted. Approvals shall include, but not be limited to, a right-of-entry and permanent slope easement, a maintenance and joint use agreement, or other legally recognized approvals, subject to the review and approval by the City Engineer and/or the City Attorney. Off-site approvals by the adjacent property owner shall be required prior to approval of a grading plan. ENG 15. A Notice of Intent (NOI) to comply with the California General Construction Stormwater Permit (Water Quality Order 2009-0009-DWQ as modified September 2, 2009) is required for the proposed development via the California Regional Water Quality Control Board online SMARTS system. A copy of the executed letter issuing a Waste Discharge Identification (WDID) number shall be provided to the City Engineer prior to issuance of a grading or building permit. ENG 16. This project requires preparation and implementation of a stormwater pollution prevention plan (SWPPP). As of September 4, 2012, all SWPPPs shall include a post-construction management plan (including Best Management Practices) in accordance with the current Construction General Permit. Where applicable, the approved final project-specific Water Quality Management Plan shall be incorporated by reference or attached to the SWPPP as the Post-Construction Management Plan. A copy of the up-to-date SWPPP shall be kept at the project site and be available for review upon request. ENG 17. In accordance with City of Palm Springs Municipal Code, Section 8.50.022 (h), the applicant shall post with the City a cash bond of two thousand dollars ($2,000.00) per disturbed acre at the time of issuance of grading permit for mitigation measures for erosion/blowsand relating to this property and development. A Geotechnical/Soils Report prepared by a California registered Geotechnical Engineer shall be required for and incorporated as an integral part of the grading plan for the proposed development. A copy of the Geotechnical/Soils Report shall be submitted to the Engineering Services Department with the first submittal of a grading plan. ENG 19. The applicant shall provide all necessary geotechnical/soils inspections and testing in accordance with the Geotechnical/Soils Report prepared for the project. All backfill, compaction, and other earthwork shown on the approved grading plan shall be certified by a California registered geotechnical or civil engineer, certifying that all grading was performed in accordance with the Geotechnical/Soils Report prepared for the project. Documentation of all compaction and other soils testing are to be provided even though there may not be a grading plan for the project. Prior to issuance of Building Permits. ENG 20. The applicant shall provide Grading Certification for all building (or structure) pads in conformance with the approved grading plan to the Engineering Services Department for review and approval prior to issuance of Building Permits. ENG 21. In cooperation with the California Agricultural Commissioner and the California Department of Food and Agriculture Red Imported Fire Ant Project, applicants for grading permits involving a grading plan and involving the export of soil will be required to present a clearance document from a Department of Food and Agriculture representative in the form of an approved “Notification of Intent To Move Soil From or Within Quarantined Areas of Orange, Riverside, and Los Angeles Counties” (Revised - RIFA Form CA-1) prior to approval of the Grading Plan (if required). WATER QUALITY MANAGEMENT PLAN ENG 22. This project shall be required to install measures in accordance with applicable National Pollution Discharge Elimination System (NPDES) Best Management Practices (BMP’s) included as part of the NPDES Permit issued for the Whitewater River Region from the Colorado River Basin Regional Water Quality Control Board (RWQCB). The applicant is advised that installation of BMP’s, including mechanical or other means for pre-treating contaminated stormwater and non-stormwater runoff, shall be required. A Final Project-Specific Water Quality Management Plan (WQMP) shall be submitted to and approved by the City Engineer prior to issuance of a grading or building permit. The WQMP shall address the implementation of operational Best Management Practices (BMP’s) necessary to accommodate nuisance water and storm water runoff from the site. Direct release of nuisance water to the adjacent property (or public streets) is prohibited. Construction of operational BMP’s shall be incorporated into the Precise Grading and Paving Plan. ENG 24. Prior to issuance of any grading or building permits, the property owner shall record a “Covenant and Agreement” with the County-Clerk Recorder or other instrument on a standardized form to inform future property owners of the requirement to implement and maintain the approved Final Project-Specific Water Quality Management Plan (WQMP). Other alternative instruments for requiring implementation of the approved Final Project-Specific WQMP include: requiring the implementation of the Final Project-Specific WQMP in Home Owners Association or Property Owner Association Covenants, Conditions, and Restrictions (CC&Rs); formation of Landscape, Lighting and Maintenance Districts, Assessment Districts or Community Service Areas responsible for implementing the Final Project- Specific WQMP; or equivalent. Alternative instruments must be approved by the City Engineer prior to issuance of any grading or building permits. DRAINAGE ENG 25. The applicant shall accept and convey all stormwater runoff across the property and conduct the runoff to an approved drainage structure. On-site retention may be allowed on that portion of the property where historically, stormwater runoff is conveyed. All on-site grade slopes shall not be less than 0.5%. If onsite retention is utilized, retention basin calculations shall be provided to the City Engineer. This information required prior to site plan approval. ENG 26. This project shall be required to install measures in accordance with applicable National Pollution Discharge Elimination System (NPDES) Best Management Practices (BMP’s) included as part of the NPDES Permit issued for the Whitewater River Region from the Colorado River Basin Regional Water Quality Control Board (RWQCB). The applicant is advised that installation of BMP’s, including mechanical or other means for pre-treating contaminated stormwater and non-stormwater runoff, shall be required by regulations imposed by the RWQCB. It shall be the applicant’s responsibility to design and install appropriate BMP’s, in accordance with the NPDES Permit, that effectively intercept and pre-treat contaminated stormwater and non-stormwater runoff from the project site, prior to release to the City’s municipal separate storm sewer system Resolution No. Draft Conditions of Approval Page 12 of 13 Cases CUP 2024-0001 – Lilac 19 LP December 11, 2024 (“MS4”), to the satisfaction of the City Engineer and the RWQCB. Such measures shall be designed and installed on-site; and provisions for perpetual maintenance of the measures shall be provided to the satisfaction of the City Engineer, including provisions in Covenants, Conditions, and Restrictions (CC&R’s) required for the development. ENG 27. The project is subject to flood control and drainage implementation fees. The acreage drainage fee at the present time is $4,898.47 per acre in accordance with Resolution No. 15189. Fees shall be paid prior to issuance of a building permit. GENERAL ENG 28. Any utility trenches or other excavations within existing asphalt concrete pavement of off-site streets required by the proposed development shall be backfilled and repaired in accordance with City of Palm Springs Standard Drawing No. 115. ENG 29. All proposed utility lines shall be installed underground. ENG 30. All existing utilities shall be shown on the improvement plans if required for the project. The existing and proposed service laterals shall be shown from the main line to the property line. ENG 31. Upon approval of any improvement plan (if required) by the City Engineer, the improvement plan shall be provided to the City in digital format, consisting of a DWG (AutoCAD drawing filetype) and PDF (Adobe Acrobat document filetype) formats. Variation of the type and format of the digital data to be submitted to the City may be authorized, upon prior approval by the City Engineer. ENG 32. The original improvement plans prepared for the proposed development and approved by the City Engineer (if required) shall be documented with record drawing “as-built” information and returned to the Engineering Services Department prior to issuance of a final certificate of occupancy. Any modifications or changes to approved improvement plans shall be submitted to the City Engineer for approval prior to construction. ENG 33. Nothing shall be constructed or planted in the corner cut-off area of any intersection or driveway which does or will exceed the height required to maintain an appropriate sight distance per City of Palm Springs Zoning Code Section 93.02.00, D. ENG 34.
