I know I missed the meeting tonight. However, if you ever do after-
the-fact postings, I would like this to be placed in the record. There
are legal precedents, I believe. If it can't be done, I understand.

Many arguments are avoided when people check theirhistorical facts! Perceptions aren’t FACTS.
Example: Those evicted from their landlord’s propertyover 60 years ago now claim they are victims and must berecompensed for emotional damage. Living survivors ofthat event might be repaired if they receive tax dollars.But measuring the “damage” to second or thirdgeneration relatives, often non-residents, is problematic.
Will payments be prorated according to the estimatedvalue of each residence? Some were nice houses(several of which were re-located). Some were less-than-perfect houses. And some were, literally, tarpapershacks.
The eviction process stretched over several years. It wasnot overnight!
Most importantly, the land wasn’t owned by these“victims”. Nor was it owned by the City. It was owned bymembers of the Agua Caliente Band of Cahuilla Indians. As owners, it was theirs to develop. They said vacationwas necessary.
Therefore, public monies as reparation for actions ofprivately-owned enterprise??? No.
If it was handled badly, apologies and measurable actionsare required. They’ve been offered.
A cash-strapped City should not be blackmailed intogiving away tax dollars for something which was beyond

Since the local Indian Tribe council has yet to contribute any significant support to this long overdue reparation
program which involved land they actually owned:
Has anyone considered / investigated getting the Agua Caliente Indian tribe to construct a professionally designed
and permanent “racial healing” component in their new cultural center museum?
It could be something that not only serves the local community and affected Section 14 descendants, but also tells
the story to our tourist population. To possibly inspire and serve as an example for similar discrimination reparation
projects elsewhere in our country.
It seems like that could perhaps provide a wonderful bridge between the very communities who have experienced
such devastating discrimination and cultural-environmental destruction here in the area.

This comment is in response to Item 3 A of the November 14, 2024 agenda. It is obvious that the settlement
agreement between the City of Palm Springs and the Survivors of Section 14 group is a done deal. The City Council
brought this lawsuit upon itself by issuing a public apology and removing the statue of Frank Bogart before the City
was able to conduct a throught and complete analysis of the City's role and responsibility for the removal of Section
14 inhabitants. The historical study commissioned by the City Council to delve into the City's role and reponsibility
after issuing a public apology and the statue removal was simply putting the "cart before the horse." These actions
were then followed by a 2 billion dollar lawsuit filed by the Section 14 Survivors group. The City Council was reckless
and fiscally irresponsible issuing this public apology and statue removal prior to studying the matter. Palm Springs
taxpayers will now be on the hook for paying for this major blunder

Public comment re: Proposed settlement of Section 14 Claim (Agenda Item 3A):
Good evening, Mayor Bernstein, Mayor pro tem deHarte, and Councilmembers Garner, Holstege, and Middleton.
I would like to commend you and the former residents of Section 14 for agreeing to the proposed settlement offer. I
believe this settlement can help to heal our city and to better prepare for what will likely be incredibly challenging
times ahead. I want to impress upon the Council the importance of establishing a rigorous process to ensure only
verified former Section 14 residents and their descendants receive financial compensation.
I also encourage you to direct the City Manager and staff to ensure that as the City implements the terms of this
proposed settlement, it clearly discloses how the updated financial processes and procedures discussed at your
September 12 meeting will be employed. Specifically,
• What will be the payment process?
• Will there be regular reporting to the Council as funds are released?
• Which city staff members will be assigned to oversee this settlement?
Although the pain, hurt and financial losses related to Section 14 can never be fully reversed, I hope we all can
appreciate that this episode in our city history only reinforces the importance for all of us to speak out and elevate
each other. We must ensure that whenever one group is disenfranchised or dehumanized, for whatever reason, we
collectively remain committed through our government, including its volunteer boards, committees, and
commissions, to those principles embodied in the very first article of the United Nations’ Universal Declaration of
Human Rights: All human beings are born free and equal in dignity and rights. They are endowed with reason and
conscience and should act towards one another in a spirit of brotherhood. Thank you.

Areva Martin only represents a specific group of plaintiffs, and not all potential plaintiffs who may surface. What
protections are there in the settlement to preclude new plaintiffs coming forth with additional requests and suits for
compensation? These future liabilities could be devastating after having settled and given future plaintiffs grounds
for additional settlements. The city may not be in a financial position to handle such future settlements. Is the city
prepared to recognize, accrue, and book these potential liabilities on its balance sheet, including additional reserves
to ensure for such contingencies as required by GAAP? The city’s citizens need to understand all of the implications
before a vote is taken by City Council. Otherwise, the City Council could be derelict in its fiduciary responsibilities to
protect the city in its role to properly identify future liabilities on the city's required financial reporting. This
settlement is a mistake.

Hi--I am adamantly against any reparations for section 14. The amounts are a total shake down. The City Council
should not vote on this potential 20+ million dollar payout. Especially the current city council who approved the
$700,000 failed minimum income scam. 2 of the current city council who are termed out this year and should not
get to have anything to do with this decision. In fact the $20+ millions decision needs to be made by the tax payers
of this city. Put it on the ballot. This is too important a decision for just the City Council. Why should the current tax-
payers have to pay for something that happened over 60+ years ago? If anyone is liable here--it's the Aqua Caliente
Band of Cahuilla Indians. They asked the City for assistance. Let the Indians deal with this. Bottom line--put this to
the will of the Palm Springs voters.

Hello,
I received and read all of the materials on the Section 14 reporting. I am quite concerned
about it, including a critical component that has yet to be discussed (at least I haven't seen
anything on this point specifically), and I want to go on record as having surfaced this issue to
the Mayor, Mayor Pro-Tem, City Attorney, and City Manager.
As I understand, this is a potential settlement with the specific group of plaintiffs represented
by Areva Martin. It is not a settlement of a class action suit, and it does not represent
additional plaintiffs who may surface. As such, what protections have been built into any
settlement that precludes new plaintiffs not currently part of the Areva Martin settlement
coming forth with additional requests and suits for compensation? Have these risks been
addressed? Otherwise, the citizens of Palm Springs could be at risk for future and significant
liabilities not currently disclosed. These future liabilities could be devastating after having
settled and given future plaintiffs grounds for additional settlements. The city may not be in a

this liability according to GAAP as required?
Rather than a knee-jerk reaction, the citizens of the city need to understand all of the
implications before a vote is taken by City Council, and the citizens need full disclosure on the
mechanisms that protect the city against any future liabilities. Otherwise, the City Council
could be derelict in its fiduciary responsibilities to protect the city in its role to properly
identify future liabilities on the city's required GAAP financial reporting.
I think that the city may be foolish in its attempt to quickly settle, given many issues like this
one that have not been addressed, detailed, and explained to the public.
In addition, the report's conclusions were inconclusive, with many players having roles over
decades of activities. The City Council needs to tread carefully as this settlement may come
back to bite the city long after the current City Council and staff are gone. It's unclear to the
public why the city feels the need to rush to settlement before addressing all issues, including
the critical issue of future liabilities from additional plaintiffs. After all, the report came out
only two weeks ago and was made available to the public only a week ago.

Good Morning Palm Springs City Council Members:
I am emailing you today to request you except the Section 14 members proposal for reparations.
I was born and raised in Palm Springs, Ca. with my Mom, Dad and 10 siblings. All my relatives on both my Mother and Fathers side lived in Palm Springs or Banning, Ca. We were a part of the community called the reservation or Section 14 at that time. After the families were
displaced my Mom; Dad and two brothers moved to the Crossley Tack community. This is where my Mom (91 years) and myself still live today.
Palm Springs has always been a racist town where the minorities were only allowed to work cleaning homes; doing laundry; tend to the yards; cooking in restaurants or working at the barber shop. We were not afforded the opportunity to advance as a race. Our forefathers-
built buildings; worked on the roadways and created beautiful landscaping throughout the city but never allowed to benefit from the growth and wealth of the City.
Our neighborhoods were destroyed and divided into three major sections… The North End; the Dream Homes; and the Crossley Tracks which created a rivalry amongst them. The city was run by the Mafia and Ku Klux Klan… and it was never their agenda to include minorities
in anything. Especially anything that would improve on their wealth or wellbeing. Separate and Not Equal… Now we have gangs and drugs consuming these communities.
We know you did not do these things personally… but the people who ware in you positions did these things and hoped they put enough fear in us to keep us quite and it worked for a long time. We will not stay silent any longer… We will speak up… We will stand for what is
right and all we ask is that you the Palm Springs City Council do what is right today. Help us to own business and homes to call our own… You destroyed the people trust and confidence to live in this community this is why so many left after their High School graduation. We
had no further there. We lost our confidence and hope… How can you repay that? You can’t but what you can do is help the survivors survive… and give the descendants a hand up not a handout. Do what is best… to bring these communities back together.
Just do the right thing… this is all I ask.

I am totally outraged that the city council has decided to pay off nearly $6,000,000 to people
who claim they or their families were harmed more than six decades ago by an incident that
was not even on city land. Plus another $20,000,000 in benefits!!!
I read the entire report and to think that the city would make the current residents pay for
something that the city was not even responsible for is beyond belief. You all should be
ashamed, but then this action is apparently indicative of the mindset of the current city
council who also wasted our money in the Queer Works scandal.
Several years ago, while leaving Toucans, myself and several others were pelted with beer
cans and yelled at by occupants of a passing car "F*&k you faggots, you're all going to
die." I guess I should have gone to the city council and demanded money since the city
failed to protect me, a tax paying citizen, from a traumatic assault. Ridiculous? Yes, just
like this jackpot the city is paying out to "victims" who all seem to be fine now, 60 years
later, but are lining up to become newfound millionaires at the expense of the rest of us.

I am a survivor of Palm Springs Section 14. I remember very clearly how my
family was forced to move at a moment's notice on that dreadful day. We came
home that day to find all our belongings destroyed. It was heartbreaking for my
parents as we had moved from East Texas at the convincing of my father's Aunt,
to escape the discrimination and racist environment there. A family of 7 was
forced to move into the kitchen of a church, who took sheets and hung them to
