A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
SPRINGS, CALIFORNIA, DENYING THE APPEALS BY THE NEW
MESQUITE HOMEOWNERS ASSOCIATION AND DESERT
CHAPEL AND UPHOLDING THE DECISION OF THE PLANNING
COMMISSION TO APPROVE A PROPOSED MINOR AMENDMENT
TO PLANNED DEVELOPMENT DISTRICT 153 (PDD-153) BY THE
OSWIT LAND TRUST TO ALLOW THE RESTORATION OF
APPROXIMATELY 90 ACRES OF THE 120-ACRE FORMER GOLF
COURSE AND COUNTRY CLUB SITE INTO A NATIVE DESERT
HABITAT AND NATURE PRESERVE FOR THE SITE LOCATED
BETWEEN SUNRISE WAY AND EL CIELO ROAD, NORTH OF
MESQUITE AVENUE, ZONE PDD 153, SECTION 24 (CASE 5.0303-
PDD-153).
THE CITY COUNCIL FINDS AND DETRMINES AS FOLLOWS:
A. The Oswit Land Trust, (the "Applicant') has filed an application with the City to
amend the previously approved Planned Development District 153 pursuant to the
provisions of Section 94.02.00 (B) of the Palm Springs Zoning Code for the restoration of
approximately 90 acres of the 120-acre former Mesquite Golf Course and Country Club
referenced herein as the 'Project'.
B. The City Council of the City of Palm Springs last approved Planned Development
District 153 (PDD 153), on December 21, 1983, for a for residential uses and golf course
and Country Club.
C. On July 15, 2024, a notice of the public meeting of the Planning Commission was
sent to all the Neighborhood Organizations within one mile of the site.
D. On July 24, 2024, a public meeting on the Amended Project was held by the
Planning Commission; carefully reviewed and considered all of the evidence in
connection with the meeting on the Project, including but not limited to the staff report,
materials provided by the Applicant and all written and oral testimony presented, and
voted 5-0-2, to conditionally approve the Project.
E. The Planning Commission has carefully reviewed and considered all of the
evidence presented in connection with the meeting on the Amended Project, including
but not limited to the staff report, and all written and oral testimony presented.
F. The Planning Commission has carefully reviewed and considered all of the
evidence presented in connection with the Amended Project, including but not limited to
the staff report and all written and oral testimony presented.
G. On August 1, 2024, the appellants filed a timely appeal of the Planning
Resolution No. 25250

Commission decision to approve the Minor Amendment request of PDD 153. '
H. On September 12, 2024, a public meeting of the City Council of the City of Palm
Springs, California, was held and the appeal hearing was continued to a date certain of
October 10, 2024.
I. On October 10, 2024, a public meeting of the City Council of the City of Palm
Springs, California, was held in accordance with applicable law.
J. The City Council has carefully reviewed and considered all of the evidence
presented in connection with the public meeting on the Minor Modification to PDD 153,
but not limited to the staff report, and all written and oral testimony presented.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. That the foregoing Recitals are true and correct and are incorporated
herein by this reference.
SECTION 2. That the City Council hereby rejects the appeals filed by the New
Mesquite Homeowners Association and Desert Chapel and upholds the Planning
Commission's decision to approve the Minor Modification of PDD 153 associated with the ,
Case Nos. 5.0303-PDD 153.
SECTION 3. That this action is not subject to CEQA pursuant to Section 15270 of
the CEQA Guidelines.
ADOPTED THIS 10TH DAY OF OCTOBER 2024.
