Nick Pepper and Wander Asset Management I Inc are respectfully appealing the determination of
suspension; as well as the two preceding violations as issued on 4/19 and 5/13/2024.
The property owner mailing address on file with the City (on both the Permit renewal and the Agency
transfer forms filed on or about 3/8/24)is 98 San Jacinto Blvd, Suite 400, Austin Tx 78701. This is the
same address as filed for the Agency Wander Asset Management, Inc. (‘Wander”). Unfortunately, the
notices of violation and suspension were not sent to the property owner mailing address/Wander’s
Agency mailing address, or the Local Agent mailing address in Desert Hot Springs. As a result, we had
no notice of the violations. The Owner’s registered mailing and physical addresses are purposefully
different as he works in the entertainment industry and travels much of the time on business.
Upon further investigation, we found that the owner's physical address,1450 N Hayworth West
Hollywood CA 90045, as provided by the owner’s prior management agency during their completion of
the required Agency to Agency Transfer form, was returned as a ‘bad address’. Unfortunately we were
again not notified of this attempt to make contact with the owner; and we were unable to address the
violations.
Wander became aware of the violations during an attempt to upload the required Contract Summaries,
as we are accustomed to do prior to our bookings. We investigated our blocked access and were
advised that the property had been suspended. We immediately corrected all listings to include the
City Register number, and paid the associated fines; while seeking to understand the events which led
to the suspension, and further remedy the situation. In doing so, we filed a Public Records Request,
which indicated that there was no confirmation of delivery as it pertains to the violation notices, as no
delivery signatures were obtained.
It is very important to Wander and the property owner to be valued members of the City of Palm
Springs community. We work hard to ensure that we are good neighbors as holders of a vacation
rental license. In that regard we employ all local vendors in the operation of the home, and have put
together several high end videos and blog posts highlighting Palm Springs that can be found on our
website; and we have a “good neighbor policy” that all guests must follow.
We deeply regret the administrative snafu, remedied the problem as soon as we received feedback
upon our request; and are ready to follow any further instruction. The relief we seek, given that this
suspension is the result of a lack of information, and not a blatant disregard of city laws, is that the

violations and decision to suspend be reversed, so that we may honor future bookings and continue to
be compliant business partners of the city. Thank you for your time, consideration and understanding.

Incident
During a routine upload of the required contract summaries, we found that our access to the city
portal had been blocked. We then inquired regarding this, and were informed that the property had
been cited with 3 violations, dated 4/19/24, 5/13/24 and 6/8/28, for failure to post the issued CITY ID
to a listing.
Given that the first two citations unknowingly had not been addressed, this resulted in the third
citation, which carries a 2 year ban. The fines associated with the first 2 violations have been paid;
and we’ve been allowed an opportunity to appeal the 3rd violation on 10/23/2024.
Context
Neither Wander, the registered property manager, nor the owner received notice regarding any of the
violations, via mail or email; hence, the violations were not addressed prior. The accompanying copies
of the violations notices and letter of suspension were provided via email, upon our request only.
Upon further investigation, we found that the ‘bad address’ - 1450 N. Hayworth West Hollywood Los
Angeles CA 90045, listed as the owner address, had been provided by the owner’s previous
management company during the Agency to Agency Transfer Process, required when a vacation rental
changes management.

Upon review of the recent activity at your Vacation Rental property at 1011 W. Cielo Dr., Palm Springs, the City
of Palm Springs is suspending your Vacation Rental Registration Certificate for a period of two (2) years. In order
to minimize the negative impact to the near-term guests visiting our city who may be currently booked at your
property, the suspension period will begin on July 22, 2024, and will end on July 22. 2026. All advertising of
your property for short-term renting must cease immediately.
During the suspension period, your property may not be rented for short-term stays (28 days or less) but you
I may rent your property as a long term rental.
This suspension is being made in accordance with the City of Palm Springs Municipal Code Section 5.25.090(b) as
follows:
"Upon the third violation in any twelve month period, the City Manager shall suspend the Vacation
Registration Certificate for two (2) years."
During the last 12 months, the following citations have been issued to the property.

IJ>uring your suspension, Transient Occupancy Tax returns and annual renewal fees will still be due unless you
choose to complete and submit the enclosed Owner's Request to Close TOT Permit and Vacation Rental
Certificate form.
You have the right to appeal this suspension pursuant to Palm Springs Municipal Code, Section 5.25.090(f),
and pursuant to Administrative Regulation dated 8/2017 (copy attached), your appeal will be heard by the

Administrative Appeals Board in accordance with Palm Springs Municipal Code, Chapter 2.50. Any appeal of
the third and fourth Administrative Citations A8275 must be addressed at this Administrative Appeals Board
hearing pursuant to the Administrative Regulation. Please also see the attached Written Notice of Appeal Form
and Filing Process information; or feel free to contact the Department of Special Program Compliance at #760-
322-8382 with questions.
Should you choose to appeal this suspension, your suspension does go into effect on July 22, 2024, in accordance
with this letter, and it remains in effect pending the outcome of the Administrative Appeals Board hearing.
Advertising or operating as a vacation rental prior to the determination of the Administrative Appeals Board is a
violation of PSMC Section 5.25.090(c).
To exercise your option to appeal, your completed Written Notice of Appeal Form with the non-refundable
appeal fee of $911.00 must be received by the City Clerk's office no later than July 18, 2024, and should be

VACATION RENTAL ADMINISTRATIVE REGULATIONS
Subject: Displaying of Vacation Rental City ID Number on Advertising
I. Purpose
To clarify and facilitate compliance with, and enforcement of Ordinance Number 1918, Palm
Springs Municipal Code 5.25.040, Section (f), displaying of Registration Certificate on all web
based advertising, hosting platform, print media, and television.
II. Application
Palm Springs Municipal Code Section 5.25.070(t) authorizes the City Manager to establish
requirements for the display of Registration Certificate on all web based advertising, hosting
platform, print media, and television. As such, the City Manager finds and requires that posting
of the City ID Number satisfies the requirements of Section 5.25.040 (f) specific to advertising of
each Vacation Rental or Homeshare Interest.
Ill. Procedure
A. Registrants will ensure that the City ID Number for each Vacation Rental shall be
reflected on all web based advertising, hosting platform, print media and television.
1. The City ID Number will be prominently and legibly included in the Property
Description section of the Vacation Rental or Homeshare Interest web based
advertising, hosting platform, print media and television. City ID Number will be
listed on all such advertising in the following format: "The City of Palm Springs ID
#!' followed by the unique City ID Number listed on the Registration Certificate. See
Exhibit A on page 2.--------------------
2. It is the sole responsibility of the owner or owner's agent to comply with this

C. Absence of the City ID Number in advertisement is all is that is required to prove a
violation of this regulation and the ordinance. Burden of production and proof is on the
registrant as to any claims re technical problem preventing compliance.
Failure to follow this Regulation will result in fines and penalties pursuant to Palm Springs
Municipal Code Section 5.25.090(d).
IV. Effective Date
This Administrative Regulation shall be effective September 11 2017.

Administrative Appeals Board Filling Process -Vacation Rentals
When to file your Appeal
If you have received a Vacation Rental Certificate Suspension Notice or a Vacation Rental Certificate Revocation
Notic~ or a Denial of a Vacation Rental Registration Certificate and wish to appeal, you have FIFTEEN (15)
calendar days from the date of the citation to submit your Appeals Form and pay the appeal fee.

Scheduling the Appeal Hearing

The Office of the City Clerk will schedule your Appeal within forty-five (45) days of receiving the Written Notice
of Appeal Form and appeal fee. You will be mailed written notice to the address specified on your form; this will
indicate the time and place for your Appeal Hearing with the Administrative Appeals Board. This notice will be
mailed to you at least ten (10) calendar days prior to your Hearing date.
Appe;:1ring at the Appeal Hearing
Failu~e to appear at your scheduled Hearing shall constitute a forfeiture of the fine and a failure to exhaust the

Appellant's administrative remedies. At the Appeal Hearing, you will be required to take an oath, and you may
I
pres~nt your testimony or evidence (either written or verbal) concerning the violation. All hearings are open to
the piJblic.
After!the Appeal Hearing
The Administrative Appeals Board will render its decision within fifteen (15) days following the conclusion of the
hearihg of the appeal, unless extended for good cause. No later than five (5) days following the Appeals Board
decision the City Clerk will mail a copy of the decision to the Appellant. The Appeals Board decision constitute

final ~dministrative action on the matter.
If the: Hearing Officer dismisses the Administrative Citation, the penalty and the appeal fee will be returned to
the appellant. If the Hearing Officer upholds the administrative citation the penalty and the appeal fee are
retained by the City and the property owner or individual receiving the citation must correct the violation or face
criminal prosecution and/or the imposition of additional administrative penalties.
