PROPERTY LOCATED AT 1011 W. CIELO DR., PALM SPRINGS,
CALIFORNIA.

SUMMARY
Wander Asset Management has requested an appeal of administrative citation A8275
issued in the amount of $500 and the two (2) year suspension of the Vacation Rental
Registration Certificate #4398 for the property located at 1011 W. Cielo Dr., Palm Springs,
California.
RECOMMENDATION:
1)Open the Appeal Hearing and accept public testimony.
2) Adopt Resolution No. ______, A RESOLUTION OF THE ADMINISTRATIVE
APPEALS BOARD OF THE CITY OF PALM SPRINGS, CALIFORNIA, ON THE
APPEAL OF WANDER ASSET MANAGEMENT FOR THE PROPERTY
LOCATED AT 1011 W. CIELO DR., PALM SPRINGS, CALIFORNIA REGARDING
ADMINISTRATIVE CITATION A8275 ISSUED IN THE AMOUNT OF $500 AND
THE TWO-YEAR SUSPENSION OF VACATION RENTAL REGISTRATION
CERTIFCATE #4398.
Background
The property located at 1011 W. Cielo Dr., Palm Springs, California is registered a
Vacation Rental with Vacation Rental Registration Certificate #4398. The start date was
March 25, 2020. The Vacation Rental Certificate was transferred to Wander Asset
Management on April 11, 2024, a registered Agency with the city, from Natural Retreats,
another registered Agency with the city. Vacation Rental Ordinance 1918 became in
effect April 2017 and later amended and reinstated in November 2022 with Ordinance
2075. The previous and current Vacation Rental Ordinance details rules that guests
renting a Vacation Rental for a period of 28 consecutive days or less must follow;
Regulations that owners must follow relating to each stay that is 28 consecutive days or

less and that upon the third violation in any twelve-month period, the City Manager shall
suspend the Vacation Registration Certificate for two (2) years.
Palm Springs Municipal Code (PSMC) chapter 5.25 section 040(f) requires that a copy of
the current registration certificate as issued by the city and the maximum number of
guests allowed on the premises shall be displayed in a clear and legible manner in a
conspicuous and easily accessible location in the unit and on all advertising related to
each vacation rental or homesharing interest, including without limitation, web based
advertising, hosting platform, print media, and television.
An Administrative Regulation dated September 1, 2017, clarified and facilitated
compliance by the City Manager finding that posting of the City ID number satisfies the
requirement of PSMC 5.25.040(f) specific to advertising a Vacation Rental.
The procedure as directed by the Administrative Regulation directed as follows:
A. Registrants will ensure that the City ID number for each Vacation Rental shall be
reflected on all web-based advertising, hosting platform, print media and television.
1. The City ID Number will be prominently and legibly included in the Property
Description section of the Vacation Rental or Homeshare Interest web-
based advertising, hosting platform, print media and television. City ID
Number will be listed on all such advertising in the following format: "The
City of Palm Springs ID #" followed by the unique City ID Number listed on
the Registration Certificate.
2. It is the sole responsibility of the owner or owner's agent to comply with this
Regulation regardless of advertising platform changes by a host, and
technical issues shall not excuse any violation hereof.
B. Property Description Definition
1. Property Description is defined as the location on the landing page where it
references the description of the Vacation Rental property. Such section
may be referred to by the following names and is not limited to: About the
property, About this listing, About this Vacation Rental, Overview,
Summary, or something similar.
C. Absence of the City ID Number in advertisement is all is that is required to prove
a violation of this regulation and the ordinance. Burden of production and proof is
on the registrant as to any claims regarding technical problem preventing
compliance
PSMC chapter 5.25 section 050 regulates an Agency, with respect to a Vacation Rental.
An owner may retain an agent with an exclusive listing arrangement or a representative
to assist in the compliance with the requirements of the chapter, including, without
limitation, the filing of a complete vacation rental registration, the management of the
vacation rental unit or units, and compliance with the requirements of this chapter

including the collection and payment to the city of all transient occupancy taxes due and
payable on the vacation rental unit. The owner and any such agent or representative of
owner must have the authority to evict any tenant, resident, or guest permitted to reside
at the vacation rental for violation of any provision of this chapter or regulation thereof.
Except as provided in subsection (b) of the section and notwithstanding any agency
relationships between an owner and an agent or representative, the owner of the vacation
rental unit or units shall execute all applications and documentary requirements as
provided in this chapter and shall remain responsible for compliance with the provisions
of this chapter. The failure of an agent to comply with this chapter shall not relieve
the owner of the owner's obligations under the provisions of this chapter.
STAFF ANALYSIS
First Citation – A7988
The City of Palm Springs Code Compliance Division discovered a web-based
advertisement for the property located at 1011 W. Cielo Dr. on April 19, 2024, on the
rental booking platform Airbnb.com via the weblink:
https://www.airbnb.com/rooms/1098724464290081225. Upon review of the
advertisement, it was found that a copy of the current registration certificate, via posting
the property's City ID # in a conspicuous location was not correctly included as required.
Citation A7988 was issued for violation of PSMC 5.25.040(f). The officer report is included
as ATTACHMENT 4. The citation was mailed certified to mailing address on file with
tracking number 9589071052700767798049, however the is no confirmation of receipt of
citation. A copy of the citation is also sent via first class mail to the property address on
file. Citation A7988 was not appealed and paid in full July 29, 2024.
Findings:
No City ID as required in advertisement.
Second Citation – A7907
The City of Palm Springs Code Compliance Division discovered a web-based
advertisement for the property located at 1011 W. Cielo Dr. on May 13, 2024, on the rental
booking platform Airbnb.com via https://www.airbnb.com/rooms/1098724464290081225.
Upon review of the advertisement, it was found that a copy of the current registration
certificate, via posting the property's City ID # in a conspicuous location, was not included
as required. Citation A7907 was issued for violation of PSMC 5.25.040(f). The officer
report is included as ATTACHMENT 5. The citation was mailed certified to mailing
address on file, however the is no confirmation of receipt of citation. A copy of the citation
is also sent via first class mail to the property address on file Citation A7907 was paid in
full July 29, 2024.

Third Citation – A8275
The City of Palm Springs Code Compliance Division discovered a web-based
advertisement for the property located at 1011 W. Cielo Dr. on June 8, 2024, on the
rental booking platform Airbnb.com via
https://www.airbnb.com/rooms/1098724464290081225. Upon review ꞏof the
advertisement, it was found that a copy of the current registration certificate, via posting
the property's City ID # in a conspicuous location was not correctlyꞏ included as required.
Citation A8275 was issued for violation of PSMC 5.25.040(f). The officer report is included
as ATTACHMENT 6. The citation was mailed certified to mailing address on file with
tracking number 9589071052701877218724, however the is no confirmation of receipt of
citation. A copy of the citation is also sent via first class mail to the property address on
file, Citation A8275 was paid on July 29, 2024.
Findings:
No City ID as required in advertisement
Pursuant to PSMC 5.25.090(b), “Upon the third violation in any twelve-month period, the
City Manager shall suspend the Vacation Registration Certificate for two (2) years”.
Pursuant to Administrative Regulation dated 8/2017, appeals of the third administrative
citation and the suspension of the Vacation Rental Registration Certificate will be
heard by the Administrative Appeals Board according to PSMC Chapter 2.50.
Based on the three (3) administrative citations issued in a twelve-month period, a
suspension of the Vacation Rental Registration Certificate was issued by the Department
of Special Program Compliance with an effective date of June 22, 2024, for two (2) years
through June 22, 2026. ATTACHMENT 7. The suspension letter was sent to the mailing
address on file certified with tracking 9589071052701463746914. This was delivered to
an individual on June 26, 2024. Additionally, a copy was mailed first class to the mailing
address on file for the property and the agency’s on file mailing address.

this matter.
The Palm Springs Municipal Code, Vacation Rentals §5.25.040 – Registration Certificate

(f) “A copy of the current registration certificate as issued by the city and the
maximum number of guests allowed on the premises shall be displayed in
a clear and legible manner in a conspicuous and easily accessible location
in the unit and on all advertising related to each vacation rental or
homesharing interest, including without limitation, web based advertising,
hosting platform, print media, and television”.
The Palm Springs Municipal Code §5.25.090 (b) – Violations
(b) “Upon the third violation in any twelve-month period, the City Manager shall
suspend the Vacation Registration Certificate for two (2) years”.
ADMINISTRATIVE REGULATION “Violation Count for Purposes of Suspending a
Vacation Rental Certificate”- Effective 8/2017
Procedure:
A. Section 5.25.090(b) specifies, “Upon the third violation in any twelve
(12) month period, the City Manager shall suspend the Vacation Rental
Certificate for two (2) years.” Following is a clarification how violations are
counted.
1. Administrative citations for violations of Chapter 5.25 issued to the Vacation
Rental guest, Owner, or Owner’s agent prior to April 16, 2017, will count
towards the calculation of the three (3) violations in any twelve (12) month
period for suspending the Vacation Rental Certificate for such property in
accordance with Section 5.25.090(b).
2. There will be no suspension unless at least one (1) violation occurs under
new Ordinance No. 1918.
3. Appeals of the third administrative citation and the suspension of the
Vacation Rental Registration Certificate will be heard by the
Administrative Appeals Board according to PSMC Chapter 2.50.
Administrative Regulation “Authority for the Issuance of Administrative Citations”
dated 08/2017 reads as follows:
“Vacation Rental Enforcement Officials are hereby authorized to issue, an
Administrative Citation for the violation of the provision of Chapter 5.25 of the Palm
Springs Municipal Code without first complying with the pre-citation or courtesy notice
requirements contained in PSMC Section 1.06.030.”
An Administrative Regulation “Displaying of Vacation Rental City ID Number on
Advertising” dated September 1, 2017 reads as follows:

Jurisdiction: This administrative hearing is conducted in accordance with Palm Springs
Municipal Code 2.50 which confers jurisdiction upon the Administrative Appeals Board.
WHEREAS, the City investigated an advertisement in detail and found the property
1011 W, Ceilo Dr., Palm Springs, California to be in violation pursuant to Section
5.25.040(f) on Aril 19, 2024, and issued administrative citation A7988; and
WHEREAS, the City investigated an advertisement in detail and found the property
1011 W, Ceilo Dr., Palm Springs, California to be in violation pursuant to Section
5.25.040(f) on May 13, 2024, and issued administrative citation A7907; and
WHEREAS, the City investigated an advertisement in detail and found the property
1011 W, Ceilo Dr., Palm Springs, California to be in violation pursuant to Section
5.25.040(f) on June 8, 2024, and issued administrative citation A8275; and
WHEREAS, upon the third violation in any twelve-month period, the City Manager
shall suspend the Vacation Registration Certificate for two (2) years; and
WHEREAS Nicholas Pepper, owner for the property, was issued a suspension of
the Vacation Rental Registration Certificate for a period of two-years for the property
located at 1011 W, Ceilo Dr., Palm Springs, California on June 27, 2024, with an effective
suspension date of July 22, 2024, and
WHEREAS, Wander Management Asset, LLC for the property located at 1011 W,
Ceilo Dr., Palm Springs, California filed an administrative appeal of the suspension of the
Vacation Rental Registration Certificate with the City Clerk and paid the appeal fee; and
WHEREAS, pursuant to Administrative Regulation dated 8/2017, appeals of the
third administrative citation and the suspension of the Vacation Rental Registration
Certificate will be heard by the Administrative Appeals Board according to PSMC Chapter
2.50
WHEREAS, the Administrative Appeals Board opened and conducted a duly
noticed Administrative Appeal Hearing on October 23, 2024; and

WHEREAS, the Administrative Appeals Board was presented evidence that
Nicholas Pepper, owner for the property located at 1011 W, Ceilo Dr., Palm Springs, is in
violation pursuant to Section 5.25.090 (b) of the Palm Springs Municipal Code; and
WHEREAS, the Administrative Appeals Board has carefully reviewed and
considered all the evidence presented in connection with said appeal on October 23,
2024;
THE ADMINISTRATIVE APPEALS BOARD HEREBY FINDS, after due
consideration given to the relevancy, weight and credibility of testimony and evidence,
and based upon a preponderance of the evidence in accordance with the Board’s
procedures, as follows:

Upon review of the recent activity at your Vacation Rental property at 1011 W. Cielo Dr., Palm Springs, the City
of Palm Springs is suspending your Vacation Rental Registration Certificate for a period of two (2) years. In order
to minimize the negative impact to the near-term guests visiting our city who may be currently booked at your
property, the suspension period will begin on July 22, 2024, and will end on July 22. 2026. All advertising of
your property for short-term renting must cease immediately.
During the suspension period, your property may not be rented for short-term stays (28 days or less) but you
I may rent your property as a long term rental.
This suspension is being made in accordance with the City of Palm Springs Municipal Code Section 5.25.090(b) as
follows:
"Upon the third violation in any twelve month period, the City Manager shall suspend the Vacation
Registration Certificate for two (2) years."
During the last 12 months, the following citations have been issued to the property.

IJ>uring your suspension, Transient Occupancy Tax returns and annual renewal fees will still be due unless you
choose to complete and submit the enclosed Owner's Request to Close TOT Permit and Vacation Rental
Certificate form.
You have the right to appeal this suspension pursuant to Palm Springs Municipal Code, Section 5.25.090(f),
and pursuant to Administrative Regulation dated 8/2017 (copy attached), your appeal will be heard by the

Administrative Appeals Board in accordance with Palm Springs Municipal Code, Chapter 2.50. Any appeal of
the third and fourth Administrative Citations A8275 must be addressed at this Administrative Appeals Board
hearing pursuant to the Administrative Regulation. Please also see the attached Written Notice of Appeal Form
and Filing Process information; or feel free to contact the Department of Special Program Compliance at #760-
322-8382 with questions.
Should you choose to appeal this suspension, your suspension does go into effect on July 22, 2024, in accordance
with this letter, and it remains in effect pending the outcome of the Administrative Appeals Board hearing.
Advertising or operating as a vacation rental prior to the determination of the Administrative Appeals Board is a
violation of PSMC Section 5.25.090(c).
To exercise your option to appeal, your completed Written Notice of Appeal Form with the non-refundable
appeal fee of $911.00 must be received by the City Clerk's office no later than July 18, 2024, and should be
