HomeMy WebLinkAbout2101' ORDINANCE NO. 2101 AN ORDINANCE OF THE CITY OF PALM SPRINGS, CALIFORNIA, DELETING SECTION 10.20.060 "OWNER'S RIGHT TO REDEEM ANIMAL FROM PURCHASER" AND SECTION 10.20.070 "OWNER'S LIABILITY TO CITY WHEN REDEEMING ANIMAL FROM PURCHASER", AND AMENDING SECTION 10.20.030 REGARDING "DISPOSITION OF UNCLAIMED ANIMALS" City Attorney's Summary This Ordinance will allow impounded animals to be claimed within seven days, rather than five, after being impounded and will remove the ability of prior pet owners to reclaim their animals after they have been impounded, not retrieved within seven days, and then adopted out. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES ORDAIN AS FOLLOWS: SECTION 1. Section 10.20.060 entitled "Owner's right to redeem animal from ' purchaser' is hereby deleted in its entirety and is reserved, as follows. "Section 10.20.060 . Reserved. • - - - -- -• - -- •• - . Section 10.20.070 entitled "Owner's liability to city when redeeming animal from purchaser' is hereby deleted in its entirety and is reserved, as follows: "10.20.070 GWReF'S liability t9 Gity Wh8R redeeming animal frem PUFGhaseF. Ordinance No. 2101 Page 2 SECTION 3. Section 10.20.030 of the Palm Springs Municipal Code entitled "Disposition of unclaimed animals" is amended to read as follows: "10.20.030 Disposition of unclaimed animals. All animals impounded at the city animal shelter shall be provided with proper and sufficient food and water. Unless aalisensed animals have been claimed within fwe seven days after being impounded, 'G^^ eddogs seven ays and after the notification provided for in Section 10.20.020, they may be sold by the animal control officer to the person offering to pay a cash amount set by the animal control officer unless, in the sole discretion of the animal control officer any such animal shall be deemed unsuitable for adoption; provided that the purchaser adopter shall not be given possession of any dog until he the ado[iter shall have paid to the animal control officer the license fee for such dog and until he the adopter shall have made appropriate arrangements for any necessary rabies vaccination. If any dog or other animal impounded by the animal control officer shall not have been claimed within said period and cannot be sold within a reasonable time thereafter, it may be destroyed by the animal control officer in a humane manner. In lieu of destruction, animals, except those deemed unsuitable , for adoption, may be released without charge to any humane organization that provides for an animal adoption service. The animal control officer shall maintain a file describing each animal impounded in the city animal shelter, beginning on the day any such animal is taken or delivered into the possession of the animal shelter." SECTION 4. If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision will not affect the validity of the remaining portions of this ordinance. The City Council declares that it would have passed this ordinance and each and every section, subsection, sentence, clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of the ordinance would be subsequently declared invalid or unconstitutional. SECTION 5. The Mayor shall sign and the City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same, or the summary thereof, to be published and posted pursuant to the provisions of law and this Ordinance shall take effect thirty (30) days after passage.
